I've had a lot of people ask for updates or just give well wishes (and I appreciate every single one of you even if I havent been able to respond--Ive been stuck on the tumblr app and mine crashes constantly lol)
Some fun disaster facts for you: they had to get a special crane to remove both the trees due to the sheer size of them, and the second tree (pictured in the top photo but not in the bottom ones bc its fricken impossible to get them both in one shot on the ground) they had to cut at the property line bc it was through both mine and my neighbors house, and the arborists got uppity about potentially further damaging my neighbors house (which I laughed at but like, I get it.)
Our insurance would not condemn or assess the house until the trees were removed. Somehow that is normal.
My house was condemned--it has some insane damage not just from the collapse, but from the second ice storm that followed. The whole place is swollen (some of the floors are crazy to walk on.) Insurance did get a structural engineer to put in supports so we were able to get a lot of things out, but at the same time there's so much more damaged than you'd ever think (given some of the upstairs rooms were untouched, etc.) just from the weather.
It's spooky to walk in, and a lot of professionals wouldn't go near it (can't blame em.)
We're finally in a rental home, and we've picked a contractor to move forward with. Whole things getting razed to the ground and rebuilt.
What's insane is that only three homes so far have been condemned in the neighborhood. My neighbors house in the above image? Yeah they said it's fine.
Which I personally think goes to show how bad insurance is more so than like--the houses themselves being sturdy.

The Swamp Chronicles: The Appeal (Department of Engineering)
Ok, both appeals are a fucking riot. Like I am so surprised his lawyer was even remotely involved with it but her additions were also marvelous. It is riddled with lies, misunderstanding of facts and the law, irrelevant facts, and stupidity. It’s glorious and so damn obvious as to why they ended up settling because they would have lost and gotten a much worse deal. If it’s in italics it’s a direct quote, if not it’s a paraphrase or my thoughts + government rebuttals. Please enjoy everything wrong with this appeal from choice phrases to every argument they made
“Factual” Background
1.3 Pierce County claimed that the Avaroes had cleared a wetland area with a bobcat. In actuality, the Avaroes were clearing-off noxious weeds - blackberry, devil’s club, and nettles in their garden
So this starts their argument that work was only done in a very specific area that was a pre-established garden on their property. We know this is a lie because work was done much more than in a garden given the video and photographic proof but also, either way Greg needed a permit to use a bobcat to remove anything off his property and only himalayan blackberries are considered to be noxious weeds in his area so he’d need permission for the others as well even if taking them out by hand. By mentioning the other two as weeds being pulled up Greg has accidentally incriminated himself. Glad to know his lawyer gives a shit. Also their garden would have to be in their already landscaped front yard because everything behind their house is classified as a wetland. And regardless you’d need permits to use a bobcat on your yard
1.5 Such noxious weeds endangered the safety and health of Mr. and Mrs. Avaroes’ children
This contradicts Greg telling the government worker that he was giving himself a view of the water which was in the initial reports. This argument comes up over and over in different phrases. Honestly this is such a redundantly-written appeal. Also, cool, let’s say this was their true intentions and the plants they pulled, they still illegally used a bobcat on the property and pulled plants they shouldn’t have. Who assumes they can bring a bobcat on their property? Why didn’t Greg google this? Pulling weeds accidentally without permission? Yeah, understandable, and the county is lenient on this letting people off with warning about this all the time.
1.7 Pierce County has issued an Order to Correct without having the slightest idea about the area in which alleged wetlands are located - Avaroes’ front, rear, or backyard
Um, yeah they do, it’s literally their job and they included an aerial photo of their property showing their property lines and where the wetland is (most of their backyard). This is also followed by 3 more points making the claim that by ~definition~ they don’t live on a wetland and acting like the county is saying all the non-wetland plants on their property was what they planted and making arguments based on that (They have an unequivocal right to maintain such existing landscaping). Again, this is irrelevant because they still got no permits, this is not the argument they are making (this is about their clearing the property and nothing about planting and clearing isn’t maintaining), and legally most of their backyard is a wetland.
1.12 Apparently, Pierce County officials sent Washington State Department of Fish and Wildlife to search Avaroes’  property and see if their gardening activities had impaired fish and wildlife habitats. 1.13 Without Mr. or Mrs. Avaroes’ permission, two WDFW officers went to their home and conducted a search of their front and back yards. The Fish and Wildlife officers found no violation. But, they passed-on information derived from their illegal search to County officials. Mr. Avaroe had denied County officials permission to search his property
Ok, so here Greg doesn’t seem to understand that he was under investigation initially by two departments (ecology and engineering) and the engineering department reffered his case to other agencies who might find violations like the Fish and Wildlife one and that agencies talk with each other. Greg denied the Ecology department’s head to check out his yard when she visited in August, that doesn’t mean he denied everyone from other agencies. The Fish and Wildlife officers knocked on his door on a totally different date independent of her, no one answered the door so they did a quick look around back and obviously they saw his front yard as they walked up to his door. Greg released a Patreon video showing this from what I assume is a security camera. Besides that this is legal (it’s in his property agreement that government workers can visit the house without permission, they’ve just asked out of politeness), they were there for all of a few minutes to see if he was working in the pond. They saw he hadn’t so they were not involved in the legal action taken against Greg. Nothing in either Notice of Order to Correct involved what these people did or didn’t find so these points are totally moot
“Illegal” search
All this says is that the county can’t use any “illegally-seized materials or information”. Besides actually admitting earlier in the appeal that the Fish and Wildlife people found nothing (and therefore had nothing to do with this appeal), they still say the nothing that was found by these people must be thrown out. I feel like they think that following this trainwreck of thought will cause everything to get thrown out. Not sure why the lawyer didn’t take out the part where they admit nothing was found or used from that department but ok. Btw, choice quote: ”All of the evidence derived from WDFW’s illegal search of Avaroes’ property is tainted and must be suppressed”
“Vague” as Applied
This is my second favourite part of the appeal, here they say the two notices were vague while listing all the codes the notices actually included!

I’m sorry but no, the first part of both notices start with a “violation” section and even I could read the notices and understand what they meant when they specifically list their violations. I included links to both previous posts on this if you don’t believe me or need a refresher.
3.4 The Order to Correct indicates that the Avaroes must obtain wetland approval, fish and wildlife habitat approval, and “obtain permits and approvals in accord with Title 18E or other Pierce County Codes” to authorize their garden maintenance activities (3.5,3.6,3.7 are varriations of this too)
Um, yeah. Certain activities on your property require approval because you live on sensitive land and right on the wetland. And you get those approvals or permits from the appropriate department... What do you not get about that? This is simple to understand, and again, most people wouldn’t think they could just rent a massive machine to work on their yard. Also, adding in the knowledge we have that Greg has cut down trees (the proof is literally on his channel and the aerial shots I’ll add below), who here thinks you can just casually cut down a tree on your own without proffesional help or a permit? Also 18E is all about living on sensitive land, so yeah, it’s the most applicable to yard work in your yard. Take note of the law Greg, then you’ll know when and how to get the approvals and permits you need for any further destruction yard work
3.8 The Order to Correct specifies that if the Avaroes fail to comply with the Order to Correct, that penalties will be imposed in the amount of $1,000, $4,000, and $10,000. It does not specify what acts will trigger the above penalties (note, they did forget the quotation mark after $10,000, that’s not me) 3.9 In addition, noncompliance with the Order to Correct will trigger misdemeanor charges
Another point where I’m convinced the lawyer didn’t read any of the information on the case because even I understood this point. Also because the lawyer would understand that Greg got two notices not one. If Greg does not comply with the requests from the Dep of Eng and Eco then he is fined a a total of 15k for each day of non-compliance. This could be anything from continuing to work (look on his youtube and leaked patreon videos and you’ll see that he did) to every day he is late in doing any of the tasks he was asked to like hiring a specialist. Also 3.9 seems weirdly tacked on afterwards
Correction notice violates Avaroes’ right to use nonconforming property
This is just lying that all the work done on his property was not Greg but the previous owners and that they are punishing them for it (except they admit that Greg did illegally remove plants with a bobcat earlier...). They are saying that because the previous owners did some landscaping Greg can do anything he likes on the nonconforming land. They also say that their house and lot were created before the regulated area was created. Again, they’re not being targetted for things they didn’t do, and not being targetted for owning the damn house. But at least here they admit that their property is on regulated land but they’re claiming the fact that the regulations were created after the property means they should be exempt from any yard work after the fact as well. At one point it wasn’t illegal not to talk on the phone while driving, so can I continue if I used to talk on the phone before it was illegal? No, of course not
4.9 Mr. and Mrs. Avaroe should not be obligated to spend thousands of dollars on permits and studies to authorize them to weed their yard
Dumbass, if you were just pulling the legally noxious weeds that wouldn’t require any permits. If you pulled some fucking dandilions no one would give a shit. You cleared the fuck out of your property with a bobcat! And, the stuff you admitted to was illegal anyways. Also the studies you are being asked to do would not have been necessary for the permit in most cases. It’s called for now because they need to assess the exact damage you’ve done. Of course if you’re doing total landscaping of your property (like you actually did), they will likely call for a specialist to oversee the development to make sure you don’t fuck up (the previous owners had to do)
The rest cries that they should be allowed to maintain their yard and the law allows them to do this. Again, that’s not what they were doing and they already admitted to removing plants not considered noxious or weeds. They also claim that aparently the county regulations are infringing on their right to due process and fairness... in their legal appeal they were permitted to start if they felt the county got the facts wrong. Also ignoring that one of the things they have to do is hire a third party to do impartial judgement on the damage to their property. They also finish off claiming the county didn’t tell them they live on wetland (the contract they signed when they bought the house did though) and again that their nonconforming rights have been violated (when they don’t fall under that ruling)
Additional “defenses”
6.2 Mr. and Mrs. Avaroe were innocent purchasers for value; they had no idea that they were prohibited from weeding their backyard
In both the Notices of Order to Correct the definition of what qualifies as innocent purchasers is explained. It means if you innocently buy a house where the previous owners have broken the law you are not to blame. It does not mean that if you are ignorant of the law you are exempt from it. WTF? Again, did his lawyer not give a shit?
Prayer for relief
7.1 The Tribunal should exclude all evidence procured from the unauthorized search of the Avaroe property
That search found nothing as you yourself said, if nothing is found it means no evidence of wrongdoing, unless there is a blank space on the notices I didn’t notice that aparently represents the fish and wildlife’s search, IT’S NOT PART OF EITHER NOTICE
7.2 The Tribunal should declare that the Order to Correct violates Mr. and Mrs. Avaroe’s right to due process
I have yet to see any reason why, no argument was presented
7.3 The Tribunal should declare that Mr. and Mrs. Avaroe have a right to maintain their existing yard
Even if you were dumb enough to think that removing trees is a normal part of maintaining your yard, 1. why did you tell the government worker you were giving yourself a view of the water, and 2. both notices explain that what you did wasn’t normal maintenance (which they themselves include a definition for in the appeal). Normal maintenance includes mowing lawns, removal of noxious and invasive species (not two of the three plants mentioned and the only permitted removal of natural plants), harvesting and replanting of garden crops, pruning (not removal) and planting of vegetation (must be indigenous native species). Also they need to provide proof that the work was all done before they moved in and they were just upkeeping what they thought was legal work. One way they could have done that is emailing this claim to the biologist of their area who can, with permission, go through the records for aerial photos of their property before and after purchase
7.4 The Tribunal should declare that Mr. and Mrs. Avaroe are innocent purchasers for value
Again, an incompetent lie
7.5 This Tribunal should accord Mr. and Mrs. Avaroe any other relief which is just and equitable
You would have gotten it if you didn’t lie, didn’t keep working past the don’t work order, didn’t send multiple emails of bullshit to both departments, were compliant, and accepted your mistakes
My conclusion
I think you can see why Greg and his lawyer gave up trying to push this bullshit. But we have the other appeal to deal with next up, and from it, I can’t say that Greg has never made me laugh in recent years. Too bad it wasn’t a joke

Just How Complicated is it to Renovate a Listed Building?
Whether you want to replace a single broken roof tile or build an extension, the correct specification of materials is vital to any work on listed and conservation area buildings. But you’re not on your own: there are set procedures to follow and experts who can guide you through them and help you assess everything you can – and can’t – do.
Can I extend a listed building? It is possible to extend a listed building, but you need to apply for a special form of permission called Listed Building Consent. Permitted Development rights do not apply to listed buildings and buildings in conservation areas, so you will also need to apply for Householder Planning Consent.
“Because there are no Permitted Development rights, standard loft conversions with box dormers are completely out of the question,” Kevin Clarke says. Any extension must enhance the existing building and not detract from the heritage value and historic elements associated with the house.
Kevin explains that any extension should be subservient to the original house. “This usually, but not exclusively, means it should be small and to the rear of the property,” he says. “The local planning authority and Historic England [or your local equivalent] will also expect materials and fenestration [windows] to match the existing house.”
If a proposed extension affects any trees on your property, be aware that trees in conservation areas are likely to be subject to Tree Preservation Orders. If you want to carry out work on trees that are not yet the subject of a Tree Preservation Order, you must give the local authority something called Notification of Proposed Works to Trees in Conservation Areas.
Does an extension have to be in the same style as the original building? A modern extension may be considered acceptable, but there are strict caveats, Kevin says. “The design must be of an exceptionally high standard. You will need to prove to the authorities that it’s an improvement on a more traditional alternative.”
Conservation officers can vary in their opinion about how best to extend listed buildings, as Denis Hayes explains: “Some look for something in keeping with what’s already there. Others believe a modern extension that contrasts with the original building and doesn’t seek to replicate it is more sympathetic. It’s subjective and you should seek advice about what might be most successful in your local area.”
What about repairing or replacing windows? “Original windows tend to be single glazed with a distorted or unperfected look,” Lior Brosh says. “Therefore, the council will assess the impact of any replacement or repair. It’s very likely they’ll ask for the replacement to be like for like.” This means the colour, material and profiles should be identical to the original windows.
“You need to be careful,” Denis says. “You can get modern replicas that mimic single-glazed sashes, but the frames are almost always too chunky and are often refused by conservation officers.
“In that instance,” he continues, “it’s always seen as better to repair than replace. You may be able to upgrade the existing glazing to improve the performance, but keep the same frame. Whatever you choose will need to be approved by your local conservation officer.”
Are there other glazing options? “The most common method to enhance acoustics and thermal buffering [insulation] in a listed building is to add secondary glazing behind the original windows,” Kevin says. This solution increases performance without changing the exterior appearance.
“But there are many high-quality heritage-style double-glazed options that are considered acceptable,” he says. “Quite often, Heritage England [or your local equivalent] and heritage officers in local planning authorities acknowledge that the existing fabric of the building is no longer fit for purpose. In this case, they will often approve an upgraded window or fenestration grouping on the assumption the aesthetics are on a like-for-like basis.”
Why is damp a particular issue in listed buildings? “Many period properties suffer from damp simply because of their age and the constant movement of the building,” Lior says. “Newer listed buildings might have a damp-proof membrane or damp course that over time has broken in one or more places.”
Once there’s a break, he says, the brick becomes a sponge and absorbs water. “If there’s no proper ventilation, bacteria can start growing into mould and rot, which can also affect human health,” he says. It’s very common and treatable, but must be tackled as soon as possible.
A lot of Britain’s historic housing stock, however, was built before modern plastics and damp courses were introduced into the construction industry and, as a result, can suffer from moisture penetrating through and rising up from the foundations.
“All old buildings were built to be breathable, with plenty of passive ventilation,” Denis explains. “They are what’s known as ‘hygroscopic’ in nature, meaning that any moisture is absorbed by the walls and released slowly over time.”
Therefore, be wary of introducing modern materials, such as insulation and vapour barriers, into older buildings, he says. “They can prevent air flow and ventilation, altering the performance of the building and causing major damage, including damp and decay.”
Kevin adds, “Many listed buildings have basements or cellars that have not been tanked or water-proofed internally, which subsequently causes damp. Trying to resolve damp issues like this on listed buildings can be costly and time-consuming.”
The correct specification of materials is vital, Denis says. “Engage with an architect as early as possible to discuss what is the most appropriate approach when upgrading a listed building element.”
What do I need to bear in mind if I want to repair or replace roofs, chimneys, guttering or drainpipes? “If the roof is made from a particular natural slate or the guttering from cast steel, you’d need to source the exact same product,” Denis says. “This can be expensive, both in material costs and the specialist labour required.”
It’s important that no material changes are made to the exterior of a listed building that alter it from its original state, he says.
“In a conservation area, a chimney needs to remain untouched, because it forms part of the streetscape,” Denis continues. “Chimneys are also often integral to the whole structure of the building. Many older properties have shallow foundations and the whole thing settles into the ground over time. As a result, removing the chimney could impact the structural integrity of a historic building. It’s always best to consult a structural engineer prior to carrying out any works involving a chimney.”
How do I insulate a listed building for energy efficiency? “It’s often incredibly difficult to do this,” Kevin says. “While windows can be upgraded on a like-for-like basis, walls, floors and roofs are trickier.
“Older listed buildings are unlikely to have a cavity to allow insulation to be pumped into the walls,” he says. “External insulation is ruled out because it would alter the aesthetics of the building. Dry-lining the walls internally is likely to be impossible, as it would require skirting boards, architraves and cornicing to be removed to achieve full coverage of the wall.”
Alternatively, look at improving insulation elsewhere, Denis suggests. “You can, for instance, upgrade loft insulation to reduce heat loss without any impact on original features.”
What about draught-proofing? “Draught-proofing is one of the most cost-effective and least intrusive ways of improving the comfort of occupants and reducing the energy used for heating,” Denis says, “and there’s little or no change to a building’s appearance. It also has the added benefit of reducing noise and keeping out dust.
“You can draught-proof the windows throughout,” he says. “Research has shown that this can reduce air leakage by at least 33%, significantly reducing the heating requirement needed for a room.”
Can I do anything about draughty floors? “If you need to insulate a wood floor because of draughts, the local planning authority will require you to carefully number and set aside the floorboards,” Lior says. “You’ll need to install the insulation without any damage to the floor joists and then carefully put the boards back in their original location.”
“Obtain professional advice on this beforehand,” Kevin advises. “This will ensure the process won’t adversely affect the thermal balance and breathability of the house or create condensation issues.”
“Whatever you have in mind for your listed building,” Lior concludes, “make sure you have all the drawings and information describing the work you want to carry out, so the local planning authority can assess and guide you through what can and what can’t be done.”

The Risks of Buying A Home With Unpermitted Renovation Work
When you're on a search for your dream home, it’s easy enough to fall in love with any renovated features, such as a remodeled kitchen or bathroom, a finished basement, or a newly-installed deck, that are set to make your life more comfortable once you take over as the owner. However, those lovable features can easily turn into expensive nightmares when they turn out to be unpermitted work, and there’s no paper trail showing such improvements were done with proper authorizations.

To save yourself from any trouble as early as you can in the process, we've laid out the risks associated with buying a home with work done without a permit, and how you can protect yourself as a buyer. Your potential home might be your biggest financial investment, after all.

  Unpermitted work is a term that applies to any modifications or construction on a home that does not carry the necessary permits to make it legal. Building codes and permit requirements vary with every city or town, so what might require a permit in one place may not in another. 
When buying a home, you can check on the property disclosure statement provided by the seller and see the list of things the current owners have done to the property during ownership, including any work done without a permit.
You can also call or visit the local building department for more information and see if the owners pulled permits. In some municipalities, the status of permits can also be checked online. Many HOAs or homeowners associations often like to have permits on file as well, so you can try asking them to see permit records on the property you're looking at.
Getting permits for any home improvement that requires it is vital, especially if it involves any electrical, plumbing, or structural work. And yet, many homeowners forgo the permitting process for various reasons, such as:
They want to save time and money. Getting the proper permits can be tedious and complicated, depending on the city or county where you’re located. And of course, there’s the corresponding filing fee that can cost hundreds of dollars.
They thought they’d be staying in their homes forever. When you think you’re never going to sell your home, unpermitted work becomes even more appealing.
They want to keep their assessed real estate value low. This way, they can save money on property taxes.
 Here are some of the potential pitfalls of buying a home with unpermitted work:

If the city inspectors in your area discover that your home has unpermitted renovations, you become liable in obtaining a retroactive permit on the already completed projects. The cost associated with retroactive permitting will depend on the scope and value of the construction.
And since the cat will also be out of the bag, you may also be responsible for paying back taxes on the increased value of the home. You could also be on the hook for associated interest and penalties.

You've fallen in love with a home that has a finished basement, only to discover that it was unpermitted work. In some towns, it is entirely possible for them to ask you to remove the entire project. In others, they might simply require you to tear down and rebuild portions of the remodelled work based on their feedback.
When fixing the issue, it might be best to hire a contractor to examine the existing work. They can estimate the cost of bringing it up to code, and also give you an idea of how much is already built in accordance with current codes.

Worst-case scenario: the home addition done without a permit included faulty electrical work, which caused a minor fire after you've already purchased the home. Your homeowners insurance company may refuse to cover the damages from that fire when they discover it was caused by unpermitted work.
The same goes if something happens in a non-permitted part of your home. If someone falls and gets hurt in an unpermitted deck, or a tree falls on any unpermitted renovation, the insurance company may deny the claim. Trying to collect your insurance policy could also see you going through a complicated lawsuit.

  Work with a trusted real estate agent.
The last thing you want to do as a home buyer is to take the matter of pulling out permits or paying fees into your own hands, especially if you can avoid it. Make sure you work with a local and experienced buyer's agent who can guide you through the home buying process, especially on the impact of unpermitted remodelling works. They can also help you account for it when creating an offer. He or she can also help you put language on the purchase agreement before signing where the seller will be held accountable (which will be discussed further).
Get a thorough home inspection.
Make sure you don’t forgo the home inspection since it can identify unpermitted construction, work not completed to code, and other potential red flags so you know what to expect before committing to buy the property. The home inspector can also check with the local permitting department to see what permits have been pulled.
Ask the seller to fix the problem.
The good news is that if you haven’t signed the purchase agreement yet, the seller can be held accountable for obtaining and closing out permits. However, keep in mind that it could take weeks or even months to close out permits, which could delay the closing or even put off the sale.
Your best bet is to have an attorney put a clause in the contract stating that the seller, at their cost, will have to take care of obtaining any necessary permits, and even resolve any code violations prior to closing. 
However, if the seller is not interested in fixing the problem, he or she could give you a discount and sell as-is, meaning they’re selling the property in its current state and will not assume responsibility for any work done without permits.

The world around you suffered loss of texture and clarity, atrocity and grief blurred everything into a characterless smear. All sharp, repeating modular construction had been swept clean of angles and precision, replaced by a flurry of arcane brushstrokes. Where you were once sure of the General's pronounced cheekbones, carved out in his sophisticated cruelty, did he newly appear as a matted red and black gathering.
He said nothing else. Not that you had wanted him to. You couldn’t say anything either, condemned by a vacant throat and numbed tongue, pressed against your teeth. Words and phrases furloughed through about your mind, all in recognizable language but jarringly useless.
An intense anger rooted around at your core. You fought to suppress it from spitting and shaking with unmeasured voltage. Even if you had been able to produce sound, even if you could scream or argue, Nines was lost and words were an inadequate device.
The General had surely understood, without needing to personally assess the damage, that he had sufficiently broken you. Hands, not made to shield or protect, closed around you.
He allowed the evacuated administration block to further punctuate the message, judiciously. In your isolation, nothing existed but tremulous thump-thumping of your own heart as it resisted the unsympathetic stillness, the gravid indoor silence of an empty facility. No echo of footsteps from others, swirling in the adjacent hallways, or shrieking of droids, could be found.
Why are you still here? What are you waiting for?
You would be afforded no particle of assurance from the shrewd General, having been appraised and found that knowledge made you hazardous. For your nerve denying authority, after having earnestly gut you with the intent to leave you out to dry, he made sure that he had took from you what he wanted most– everything in his power to take.
You recalled the churning of the General's greatcoat in stride from your last meeting. How the heavy fabric pulled gracefully in the air and how had unintentionally revealed a blaster clipped to his uniform’s belt.
I’d sooner be blasted into smithereens than let you see me cry. If that’s what you’re waiting for...
You felt your eyes itch but would not permit it, somehow containing tears as they drew themselves up from the colossal pit in your stomach. It was too easy to be angry, to give yourself into the rage. You could hear it moving and shaking in agitation, bubbling to the surface.
Still, complete self-denial proved impossible. You could feel your expression contort.
The General’s eyes, ghostly and righteous, watched you struggle with muted, personal approval. A reflexive grimace, the cocking of his head.
The expression struck you with the stealth of a crashing TIE fighter; something about the neat, equine thin-lipped sneer that made the next moments warp and swell. You had every right to be upset. Nines had his mind scrambled. You were allowed to be furious.
And then you were.
Blinking transformed his face, then his whole being, which flickered into and out the plausible borders of reality. He twisted about, a lapse in your imagination once again, showing his bloody face warped and eerily glitching like damaged security footage. Red, glistening and crude, slowly leaked from his nostrils and down to his lips, bubbling over his mouth and pouring to fill in the spaces between an animated leer.
You think I have nothing left. I have nothing but reason.
Allowing the feelings to rush through your system brought the world back into focus. Though you were conscious of the hated that ignited and it’s toxic properties, you allowed yourself to freely indulge in the heat; it was the only feeling that would deceive your halting mind into feeling remotely satisfied.
“You would have done the same.” 
No dip or nod of his head, no signal to you that he had felt even the lamest sting of remorse. His hands folded, lacing together behind his narrow back, before the heel of his boot soundlessly turned on the floors.
I would have done the same?
In the name of settling the score, of some perverse idea of fairness and payback, your being erupted with desire to observe him sentenced to the very same treatment that he prescribed Nines. Watching the General gradually disappear down the end of the corridor with eyes that burned into his back, you imagined raking your hands through his neurotically immaculate mane, shaking free the heavy scent of pomade. You imagined the inhumane straps necessary to render him immobile and plugging him into whatever monster of an apparatus that would snarl and twist his wits.
You imagined tugging his head back on his neck and letting him gaze upon you in deserved terror in his final moments of owning his mind. You would let the General’s eyes, unable to focus through confusion and panic, become symbolic of your victory.
You’re right, General. Maybe I would.
Loosing yourself, or being broken down piece-by-terrible-piece, felt all the same. In the end, each spiteful act would erode you, a product of your cruel circumstances. Previews of violence seized you, leaving you shuttering in denial whether it was at all in your control at all to stunt them.
Each time, the hate settled a deeper, rose faster.
The General ensured, that you would for another night, sleep well. Although without meaning to, after leaving the block and returning to your quarters to rest, the dream that Nines had painted out to you in your final moments had unfolded around you.
The horizon pulled back, only to sigh and bloom, heaving out flora. You could feel the air turning through created branches, singing, bringing you the cool, clean smell of shoreline lilies and other hydrophytes. The described castle dressed, in all manner of banners, sitting just behind you next to an unblemished body of water. Mesmerized by the remarkable height of the trees, all swaying in the spot but firmly anchored by their ancient trunks, you were immediately delimited by the natural world, a sight you hadn’t seen for some time. 
Though this was Nines’ vision, he was missing. Your only company was the gentle breeze, tumbling about you as you made gradual movements.
Step by slow step, removing your standardized boots with ungraceful tugging and dragging of your heels, to allow your feet to rest against something other than sterile tile floors and steel. They bathed in the soft carpet of overgrown grass, kicking free dew from tall blades as you strayed from the path.
You had long forgotten the simple luxury of feeling earth under you, feeling a connection to the natural world and the gradual process of healing that came with it. For not having seen your home planet, in person or on a star chart, Nines had correctly assumed you would have a fondness for the place. You yearned for a name, just as you had found one for the forgotten observation deck, as if a title was something you could wrap your fingers over and claim. It offered you nothing. Nothing save for a dull buzzing sound. You moved with necessity.
Crackling with electricity as you approached a small clearing, the buzzing was connected to a curious object that had been branching and alive with currents and causing the earth around it to jump back. In full armor, next to the item, Nines was sprawled through the rubble. Rushing to where he lay, you nudged him as you looked for a sign of movement. Nothing. Hastily, you then searched for a pulse, pulling at his gauntlets bespattered by the muck you stood in. Nothing, still.
Freedom had found him at last, freedom that softened his expression and wrapped him in motionlessness. He failed to mention in his spectacular hallucinations that this dream was of his death. You wanted desperately to believe that you had misinterpreted what he had said, but no such comfort was available.
“What happened to you?”
The blue of the sky dissolved, leaving darkness to wash over everything. The shadow you cast behind your back, crept along the ground, away from your body until it became one with the encroaching blackness that swallowed the world.
Dirt, warmed by the sun under your toes, replaced by cold tile; skin doesn’t lie, it only reports.
The hallway. Fixing before you, the silhouette of Matt, just as you had seen him before. Only this time, the body on the floor was not a stranger– you saw the face of Lieutenant Colonel Zack.
Matt then turned to you. You understood the look; you understood it meant you needed to run. But as hard as you tried to put one foot in front of the other, to create distance and loose the whites of his eyes, you were frozen in place.
The ground shook. One large rumble.
Another.
Another.
Then the last— and it was in that moment when you rocketed upright and let your quarters settle around you. Focus darting about the perimeter of your room, you solidified your location as you felt a vicious cold sweat plastered at your brow. No endless forests in sight, only the synthetic confines and winter beyond abiding walls.
Burdened with further cerebral symptoms, you were unable to set aside what you assumed to be the saddle of foresight. It was understood that you would have to watch and wait if you were to understand if it was a prophecy or a fluke. Letting your head to flop forward on your neck, you prayed to the makers that it was just a poorly executed patchwork of all your stressors and nothing more.
What could any of it mean?
Socialization was nominal, adding hours onto your day. Morale in your sector had suffered a tremendous blow with FN-2199’s absence; no one was interested in laughing and joking. It felt disrespectful. The room was occupied by stooped postures. Day two of collective mourning proved more severe than the first, it had sunk in that Nines wasn’t coming back and no one wanted to talk about it.
You had been waiting for the Lieutenant Colonel to come by as he always had, impatient to continue your last conversation about the FN-corps and Dr. Thos, plans you had never been aware of and still did not believe to be truthful. After significant suspension, waiting to the very moment you were to leave did he finally shuffle into the room.
Everything about the Lieutenant Colonel’s body language was irregular, he always managed a certain confidence about his motions. It was only as you got closer could you see why. Dusting the bridge of his nose, his skin broke into maroons and purples and blues. At his eyes, cheek. A constellation of bruises and cuts, uncharacteristically solemn eyes hiding amid.
What happened to you?
Your mind moved faster than you intended. It persuaded you to believe that the radar technician had hunted after Zack just as he had done to you before.
Still offering a kind look towards you, his seriousness melted at the sight of you and the worry radiating from your stare. Without drawing attention to himself, he held his face still and high, looking down through heartsick pupils.
“They’re watching,” skill of a ventriloquist, through closed lips.

You knew it was one of two people. You were sure you had inadvertently been the cause.
He offered you a kind look, wincing as he did though a nasty black eye and split lip. You hadn’t noticed the thermajug he held nervously at his side, until he pressed it into your hand, “Maybe caf will cheer you up?”
Are you kidding me right now?
“I don’t want it, but thanks.” You had to wonder what kind of pain meds had he taken to make him assume the offer was an appropriate gesture.
His voice overlapped yours, as if you hadn’t just refused or said anything at all. Proudly, he tapped the top of the canister, “Try it!”
His enthusiasm over the trivial offering frustrated you, “I’d rather not, Zack.”
“I insist. It’ll perk you right up.”
The look on his face alone was one you couldn’t deny twice. As he held the canister out for you with a now trembling arm, it was less complicated to just except the offer.
“Let me know what you think of it.”
Gesturing without making much more physical movement, his eyes moved past you to the doorway, saying it was time for you to leave without really saying anything at all.
What have I done? What did he do to you? Oh, stars, I’m sorry.
You had no motivation to do the job, or pretend to. Instead, you sat in the chair, staring blankly at the monitor, moving memories about the basement of your brain. The interface of your data programs waited patiently for you but you were so stuck inside your own head that you might as well had powered the console down.
Twisting the cap of the thermajug off, in a moment of curiosity, you laid it open on your desk. A crumpled piece of flimsi was stuffed inside the lid. You wondered if it had been stashed inside by accident. Unfolding the message then pressing it to the desk to tame the creases, it read in shiny red ink, in what you assumed had been the Lieutenant Colonel’s hand:

You nearly fell out of your chair.
Avel has a brother. The psytech.
Your eyes, unable to focus or stare any longer at the scrap before you searched beyond. There were files spread across your desk that you hadn't bothered sorting. More plast. Upon closer inspection, you found a copy of Lieutenant Colonel Zack’s profile. Someone had gone to the trouble of underlining that his record stated "N/A" for next of kin.
The First Order doesn't know.
Foolishly, you looked over your shoulder. You had a sneaking suspicion that you were being watched. Checking proved you were still alone. You returned to the paper, insisting the need to double-check.
They don't know you have another son. They don't know he works for them.
Shuffling the files around, you found that whoever had left the document for you had also included a request for an interrogation chamber. Pushing your chair back as you stood, you moved to the refresher, stuffing the documents in the sink before turning the tap on.
Plast dissolved. The fastest, safest way to dispose of it. You didn’t want to have to explain the documents, should anyone crop up for a gratuitous check-up.
Who keeps doing this?
You hadn’t noticed, through your impulsive and fevered movements, that you had started tearing up. Mad tears, bitter tears. Your bad luck brought a plague, moving through everything you valued, silently dismantling it. Between the General and the Commander, you would soon have nothing left.
From outside the refresher, there was soft beeping. A holocomm pulled you back to the desk. Setting yourself back in your seat, you answered before common sense could advise you otherwise.
Met by a projection of Kylo Ren, mask and all, you studied the soulless porthole which he surveyed you through. At least you weren’t subjected to his eyes and the stare that came with it. It could have been worse, it invariably had been.
Though whatever he was going to stay, he didn’t. Your tears fully confused him. There was a long bout of silence before he had a voice.
“Stop.”
“Stop what?” You asked, even as you understood what he meant. From his command, it was clear to you that he was largely unsure how to handle emotional outbursts; others or his own. He made a point to ignore you, as if you had stopped.
The computerized beryl recreation of his profile was easier to speak to; easier being relative. You amended his discomfort, asking a question you would never dare to had he appeared in the room in the flesh, “How’s Matt?”
No reply. No nod of his head, no movement as if he was contemplating to scold you for asking such a senseless question. You guessed behind the mask, his eyes narrowed.
“Thanks for everything, by the way.”
He was stoic.
You spoke again to clarify, dragging your sleeve under both eyes, feeling the itch of a tear streaking down to the top of your lip, “I saw what you did to the Lieutenant Colonel.”
He turned from you, still in view. Pulling up information on monitors, you saw the screen mirrored in the reflective portion of his helmet. Once he had turned back to you, his voice changed, “I had nothing to do with that.”
He had been thickly distorted, not only by the vocabulator, but by his own anger as it mutated. He was livid, spitting under his helmet.
The General. The General interrogated Zack.
Resentful, with chopped syllables, but low and cold, “My quarters. Now.”
The hologram collapsed into itself.
Upon leaving your office after much indecision— I’ll just stay in this room for the rest of my life— a pair of stormtroopers had been waiting outside for you. One positioned at either side of the door, symmetrically cradling blasters across their chests. You said nothing to either and moved.
After some time and with the door to the Commander’s private quarters in sight, one of the stormtroopers used the stock of his blaster as they knocked for entry. The sound it made as it struck the surface grated on you; it was getting harder and harder to liberally recall anything on the base that evoked a good feeling, let alone neutrality.
The door, with hiss, opened. Through your peripherals, the trooper motioned again with the blaster, remaining outside as the hatch shut behind you. For the second time, you stood in enemy territory, as the noxious atmosphere compressed your chest.
Chrome and coal with melancholic luster, the space itself was awkwardly barren with a quiet luxury embedded in the details around you. You had missed so much with the lights off. You had missed appreciating the tessellated reflective onyx that ran over the ground, likely rare stone from some inaccessible planet. The surface you had slept on, blankets twisted and unmade, creating ribbons and grooves in the sheets.
Aside from the state of the bed, the room maintained impeccable cleanliness, like that of a museum. No hint of personal items and all surfaces left uncluttered. Nothing on the polished desk, nothing along the bookshelves. Everything he owned was either hidden away in small compartments lining the walls, or, simply still, he had nothing. No attachment to material goods or people, for the matter.
Of the doors that sliced up the room, one had likely lead to a closet, some locker that held his ridiculous disguise. It was strange to imagine that Matt existed at all when you observed his ceremonial dress, the heavy fabrics dripping off his body as they had now. It was stranger still to imagine he may have owned clothes you had never seen him wear, naturally assuming the Commander would look equally ludicrous in normal attire. You had always known him to be more than human, with flesh as durable and resilient as metal.
Draped in vaporous robes, the usual, light from the falling sun stabbed his supernatural costume. The Commander showed you the broad of his back. Dark hair, falling in limp ringlets and waves told you that he had removed his helmet in anticipation for your meeting, though you did not feel wholly prepared for his face and all of it’s deadened expressions and low, sweet voice. Metallic thrashing, the inelegant scraping of his modulator, made it vastly easier to disassociate the Commander from a human than his expected voice.
Sharp, alive. Not quite a command, but his voice pulled at you as if it had been, “Lieutenant Colonel Zack was interrogated by General Hux without my knowledge. You’re going to tell me why.”
I bet you already know why...
“I do, yes.” He challenged you, still, not deeming you worthy of his full attention as he spoke without turning to face you. Fortunately, with the helmet gone, there was depth in his words and you found advantage in gauging his reaction by the slight color of his tone. “I want you to tell me.”
I don’t know.
“Liar,” he seethed, voice hardening and body crumbling. He moved, his hands collected at his sides into fists. His full attention was now yours. You fell inside his sight lines with a turn of his head. With his pronounced jaw quivering, he began speaking as if he was trying to convince himself first, before you, “You can’t protect him. Or yourself.”
Just as the intrusive whispering in his brain had assured him, or had conditioned him, to think. The voice he had listened to and obeyed all his life– “See, young master, they are weakened by their connections... Sever one and you slowly kill them all... Don’t let them hold you back from your destiny, sever yourself from others and become free.”
Searching for the words in the space between you, you felt safer at the distance but not as brave as you preferred. He hadn’t killed you yet; you were banking that he still needed you for some reason. Your voice trembled as thought transposed into sound, “I have to.”
He took in a breath, facing away from you once again as he did so to collect himself. You were treading in dangerous territory by the way his spine curved him forward, and hands collected into fists. “I understand freedom,” his voice low, dogmatic, “How it creates rebels... traitors..." The inflection of the word made it even more ugly. Spoken and repeated to nausea.
“I understand the First Order creates murderers,” you respond with less quivering in your voice, to the very best of your ability. It would have ran through your mind regardless, speech or not, he would have felt your bias. “They created you, didn’t they?”
Movement. He stirred. A single, dreadful step towards you, monitoring your response and seemingly delighted by your fear. Taking no efforts to hide his emotions, he conveyed it all.
You shook your head, defiantly, speaking again in a voice you hadn't been aware that you owned, “But they failed. They couldn’t make FN-2187 a murderer." Your own eyes widened at the words, surprised they had come from you. A bad taste to him.
FN-2187 is strong. You’re weak.
“You will either help me,” a gloved hand rose, to stifle you, “or you will die.” Advancing, until he could lean in, words soft again. You felt the warmth of his exhale as he murmured, “What will you choose?”
The disgusting claustrophobic intimacy again. The absence of tenderness, the soft blood-filled cavity. You both noticed the insult of closeness too late. There was strain, disgrace, breaking over him like a tide. Something, so startling about his face; how it was rounded and curved, continuously hinting at the child he had once been. You wished him older, scars and broken bones. Had his face, under the mask, looked sharper or worn, it would have fit him.
Your mind unwilling recounted the moment when he proved there was someone else behind the veil, the deception of his rage. You had seen him. Not a monster, but as a human.
Like now, once again. Almost like you. Something familiar in his face, and even worse, something caged inside his chest, reaching for his heart. A familiar light, purpose.
His face turned with rage as you made the association, striking like sheet-lightning. Your consciousness nimble, from your skull to the bottom of your spine.
That’s why you care so deeply, isn’t it? You envy him, me. Us. You know you’ll never be free.
He tore away from you, cape swallowing him and further billowing in all his sharp movements. Blackness. He yelled in certain, unhinged frustration. Your body understood his feral energy, to which it recoiled physically, as if to pull yourself into a safer distance.
His dominant hand reached for his lightsaber, pulling it free from his side. A phoenix bursting forward with fire and light. You heard it, the blade breathing and shuddering. The ethereal glow of a flame simultaneously growing and dying. It stayed at his side, his arm locked. Panting, breathless.
“Go.”
You couldn’t stop the words, “I’m right, aren’t I?” You hoped for his motionlessness, to freeze where he stood as the touch had done to him. You planted hope in each sound, the opiate of belief, waiting for him to be tranquilized once again.
The person underneath. You would force him back.
His lips pulled tightly, swallowing back words. More heaving. Tapping the blade against the ground, dispelling your wishes as he walked forward through a wave of sparks, “I am master of the Knights of Ren... I am the Commander of the First Order...”
But you weren’t always.
More taps. Then it crashed into the floor, releasing a wave of fury. Intimidation. You were bathed in spark and ash. He created smoke, twisting up around you and him. “There is no one else.”
Pulling the saber out of the floor, the blade ushered you back. He held opposite hand hand up.
You felt it all over you. Your arm, your neck, your shoulder, your back. Pulling you, conducting your blood, turning it vicious.
“There is only this.” He clenched his hand, your mind overflowed. You felt hot and cold and numbed with grief and anger.
Nines voice, from the deep archive of your memory, was the only thing that could reach you, “Whatever happens, don’t forget who you are. Before all this...”
You had to disarm him, you had to pacify the beast. With no weapon to match his and only a blind, visceral reaction, you knew that if you touched...
Through cataclysmic fear, as he snarled down at you, the soft of your palm met the side of his cheek.
The devil’s face was in your hands.

This weekend, my car was hit while parked in a parking lot. Nobody left a note or anything, which makes it a hit and run. The damage is extensive so I had to make a claim with my insurance co (it's unfair enough that I have to pay the deductible for something that's not my fault, I shouldn't have to pay even more). For some time now, I had been looking at subaru imprezas, of which I love. Let me paint you a scenario:
Homeowner: Hi, [municipality]! I would like to have this tree removed. Do you mind? Municipality: Yes, we mind, you can not remove that tree. H: But I really want to build a patio out front! M: Too bad. H: Well, I paid a lot for this house, I work hard for my money and I feel like I should be able to build a patio on my property. M: Well, you can’t. Bye!
Homeowner goes ahead and builds a patio right up to the base of the 60ft tall spruce. Building a patio is hard work, it involves some sort of digging, compacting soil, laying foundation (I’m not sure, I don’t build patios) and the tree’s roots were definitely in the way. So what can you do? I guess you could either cut those roots off (it has lots of roots!) or just compact the soil around them, because trees don’t need oxygen or anything, right?
So either the roots die and rot away or are removed completely. Do you know where this is going? And after a certain amount of time, years maybe, and a certain number of wind storms, the tree, missing half of its anchoring roots, finally succumbs to the force and falls over, smashing a neighbouring birch tree and missing the neighbour’s house by eight inches. Not just any old part of the house, but the kids’ bedroom. There it hangs, blocking the garage, hanging over the driveway until an arborist can come to safely remove it.
What really incenses me about this is (aside from the homeowner’s ignorance resulting in a near tragedy) that now we arborists are getting flooded with calls from people who are frantic and afraid that tall trees everywhere are going to fall down and destroy the people and things that they love, when it is often human error that is causing these trees to come down and not the nature of trees themselves. I can understand this fear of tall trees, but we can’t go around cutting down every tree. We need trees in our cities to produce oxygen, moderate the heat island effect, filter pollutants, protect and improve soil, create habitat, the list goes on, and these benefits increase with mature, large-canopied trees.
I think that the municipality could have been a little more proactive in providing information along with their decision to deny the homeowner’s permit application. It’s not really their fault, but if they’d had the common sense to assume the homeowner might go ahead and try something under the table, a thing that many people do after having their request declined, they could have instead offered some kind of advice; for example: “if you are going to go ahead and build that patio, make sure it’s [X distance] away from the base of the tree or else you are going to seriously damage the tree’s structural support and jeopardize the safety of yourself and your neighbours.” Or they could have done what they often do, and say “yes, you can remove this tree as long as you replace it with another tree of appropriate quality, size and species.”
For the record, I think that the permitting process should be a lot quicker for hazardous trees. Too many hazardous trees get hung up for too long in the permitting process. When canopy goals meet public safety, things get tricky.
My main point is, you don’t have much to fear from a well-placed, well-planted, properly maintained tree. They don’t like to fall over, and they try their best to make their roots strong enough to hold themselves up. And when they become old, or ill, and hazardous, it should be a fairly simple process to get them removed. But if you cut half of those roots off to install a patio or to dig for any other reason, or raise the grade over a root system, or plant a tree with girdling roots or a tree inappropriate for the soil type you end up with trees failing at the base, destroying property and infrastructure, and possibly causing injury or death. And then who cleans up those failed trees? Arborists. Storm damage is one of the more dangerous types of tree work, and unfortunately, it does claim lives, as we saw last week. The arborists were out doing emergency storm work while the storm was still going and a second tree fell on top of them.
So, think underground, friends! The roots are important and they spread far and wide! It should really be common knowledge, but it’s not.
If you’re worried about how hazardous the trees on your property are, every tree care company I’ve ever heard of gives free quotes - read: free information about your tree and what it might need, with no obligation. You could also hire a TRAQ (Tree Risk Assessment Qualification) Certified Arborist to write you a risk assessment report. A lot of non-certified arborists also have this knowledge, but the certification helps you choose if you’re just cold calling.

Primary and Secondary Health Insurance?
This has been a big complication for a few months, but back in October of 2008, I had a physical exam and my provider billed, what I assumed at the time, my primary insurance company (Horizon NJ Health). However, two years later, Horizon took back that money and my provider has been billing me for that physical back in 2008. I called Horizon and apparently they took back the money because I had another health insurance, and Horizon was no longer my primary. I had not known about my other health insurance company, Aetna student health care, since they never gave me any information or membership details, and I was automatically enrolled for it when I entered my university. When I contacted Aetna, they told me that they weren't the primary insurance company because they were just student health care. After several phone calls back and forth between Aetna and Horizon... I STILL haven't figured out who my primary insurance company is since they both claim to be the secondary insurance (and they seem to have endless reasons why the other is primary). I contacted my provider and asked them who they have listed as my primary, and they seem to be clueless about it too (when I spoke to the receptionist and asked, they kinda changed the topic). Is it possible to have two secondary insurance? If not, who should be my primary insurance? If Horizon is my primary, doesn't that mean they shouldn't have taken the money back for the physical exam?""

The Supreme Court recently held that prolonging a traffic stop by making investigatory inquiries unrelated to the traffic infraction in question violates the Fourth Amendment. Second Circuit: So detaining a red-light runner for five minutes to inquire after his suspected drug dealings was unconstitutional. No need to suppress the evidence though, as the traffic stop here happened before the Supreme Court issued its ruling.
College students agree to work at media corporation for no pay. Are they employees, and thus entitled to minimum wage, or are they interns? Second Circuit: Interns, by light of a seven-factor test we created last year to deduce which party is the “primary beneficiary” of the work experience.
Can auditor, who is seeking out property Delaware can escheat, audit two companies’ Ohio-based subsidiaries? Sure thing, says the Third Circuit. If, as the companies allege, the audit process is an abusive one designed to force a settlement, they can stop complying and see if Delaware comes after them. Allegation: Manassas City, Va., officer investigating illicit images sent to 15-year-old girl orders her 17-year-old boyfriend to masturbate — in front of armed officers — to compare his erect penis with the illicit images. District court: Qualified immunity. Fourth Circuit: Reversed. There may be no prior cases on point, but some things are so obviously unconstitutional that officers shouldn’t need to be told. Dissent: The officer had a warrant. (Related: The officer killed himself as police tried to arrest him for molesting other boys.)
Conroe, Tex., officers board Greyhound bus at rest stop. One passenger seems suspicious, and indeed his luggage contains contraband. District court: Suppress the evidence. Hassling a bus full of people without any individualized suspicion offends the Constitution. Fifth Circuit: Reversed. The Supreme Court is fine with such stops; defendant could have just declined to speak with the officers.
Knox County, Tenn., inmate falls from bunk, breaks neck, does not receive proper medical attention for 70 days. Jury: The county must pay him $140K. Sixth Circuit: Indeed, it must.
In year when tax assessments fell for over 99 percent of Roscoe Township, Ill., properties, couple who started petition against town assessors entering property without notice or permission are hit with sizable tax increase. Seventh Circuit: Can’t sue over that in federal court.
Indiana’s new teacher-tenure rules allowed a school district to retain an untenured teacher while laying off an otherwise-satisfactory tenured teacher who had “received critiques about his interpersonal skills” — and that, says the Seventh Circuit, violates the Contracts Clause.
Allegation: Cook County, Ill., jail officers hold inmate several months past his release date (more than doubling his ordered time behind bars), hinder his efforts to reach court, which eventually orders him freed posthaste. He sues two years and two weeks after his release. Seventh Circuit: That’s two weeks too late.
Montana’s ban on judicial candidates seeking, accepting, or using endorsement from political parties does not violate the First Amendment, says a Ninth Circuit panel; the public might perceive that a judge so endorsed is insufficiently impartial or independent (when interpreting legislation favored or opposed by the endorsing party, for instance).
Man seeks to host weddings on his rural Ventura County, Calif., property, but the neighbors object, and county officials deny him a permit. Ninth Circuit: The permitting scheme gives officials way too much power to withhold permits for any reason or no reason. The man’s First Amendment claim should not have been dismissed.
Mayes County, Okla., officer shoots into home 10 times, kills man. Officer: The man was on the porch; he fired a gun at me. Family: He was inside; he didn’t fire the gun; the officer never identified himself. Tenth Circuit: No qualified immunity. The house had 10 bullet holes, and two bullets were found in the man. Which indicates he was inside the house (with several children and his wife) when the officer fired.
Auto dealers do not have standing to challenge Missouri officials’ decision to allow Tesla to sell its cars directly to the public, says a Missouri appeals court, which suspects the dealers are more interested in squelching competition than defending the public’s interests.
And in en banc news, the Eleventh Circuit will not reconsider its decision that a company that requires employees to remove dreadlocks can’t be sued for racial discrimination. Dissent: The complaint adequately alleged dreadlocks are a natural state of black hair; this should have gotten past a motion to dismiss.
Last year, Washington, D.C. officials imposed new regulations requiring daycare workers to obtain college credentials in early childhood education. But according to the very report that officials cite as the impetus for the change, there is no empirical support for the city’s position that the rules will benefit kids. Instead, the requirements will reduce parents’ options and drive up child care costs, which are already the highest in the nation for kids below preschool age. There is no reason why someone working with two-year-olds needs to take math, English literature, and public speaking classes, all of which are required by local colleges’ programs. We Don’t Talk Any More: Conversation in Prince of Persia (2008)

Threaded through the rhythmic combat, wall-running and puzzle-solving of 2008's Prince of Persia is an ongoing dialogue between its protagonists, the wise-cracking vagabond known colloquially as 'the Prince' and the Princess Elika, heir to a decaying realm and a temple which for a thousand years has sealed away the dark god Ahriman. Yet the Tree of Life which sustained Ahriman's bonds is broken, shattered by Elika's grieving father.
Together the Prince and Elika delve into the ruins of her city in an attempt to heal the land, seeking to repair Ahriman's prison before he can escape. As they face the obstacles in their path they bicker, they joke, they tell stories of their vastly-different lives. The Prince hides behind a mask of bravado, of seducing pretty girls in the marketplace, of wandering wherever the wind takes him and seeking his fortune in forgotten tombs in the heart of the desert, while Elika's life - despite her memories of how glorious the rubble they now scamper through once was - has been one of duty. Even as her people lost faith and drifted away, she's held on to one central tenet of belief: for the sake of the world, Ahriman must never go free.
While optional, these conversations are a core gameplay mechanic. Just as there is a button on the controller assigned to Attack, and another to Jump, there's another specifically reserved to Talk. It's through dialogue that the Prince encounters Elika's determination to do the right thing at any cost, to be the hero of her story despite his exhortations to just walk away. Surely someone else can save the world without Elika risking her life? Through dialogue Elika mourns her shattered kingdom, weaving stories - as one would at a wake - of a childhood spent amongst its verdant gardens, gleaming towers and proud people. Through dialogue, the Prince's carefree facade begins to slip as he struggles to support Elika, their quest becoming ever more perilous, and learns of her untimely death and resurrection. 
Her father betrayed everything she held dear to return her to life, in exchange for Ahriman's freedom, and Elika makes no secret of the apocalypse her father's grief threatens to unleash. Ahriman "will take everything else that remains. He will swallow cities, devour the land. There is nothing that can stop him." Unless she can heal the damage her father has done there will be no hope of survival, no deus ex machina to rescue them from certain doom. There is no putting this djinn back in the bottle: once he escapes, Ahriman will consume the world.
One by one Elika and the Prince conquer Ahriman's lieutenants, face down corruption and death, and through the healing of the land they draw close. Despite their differences they grow to understand each other, respecting each other's talents and viewpoints even when they disagree. Beneath his arrogance the Prince is no cardboard cut-out: his perspective noticeably shifts over the course of their journey as he grows more conscious of his role in Elika's destiny, and despite the opportunity to walk away and resume his life, he chooses to stay, to help Elika finish her quest and save the world. Yet in their moment of triumph he realises the truth, that the Tree of Life was shattered to bring Elika back from the dead. To seal Ahriman away once more, Elika must give up her life, as she's known all along.
Too slow to prevent her sacrifice, the Prince can do nothing more than gather her lifeless body into his arms and lay her atop her mother's tomb. The conversation is over. Yet Ahriman whispers temptation in the Prince's ears, to undo all that has been done. To make the same pact Elika's father did. One life, in exchange for the world.
He has a choice to make.

There is another conversation, one which Elika and the Prince remain unaware of even as their words lead them into love. All the tales spun through the ruins of Elika's home, all the memories shared, the philosophies and mythologies and subtle moralities laid bare are parts of a wider dialogue, between Prince of Persia and you, the player. You're the one pushing Talk, the one who wants to hear more, and the narrative repays your curiosity by enrapturing you in a tale of ethical ambiguity, of dark gods and a noble family estranged by death and duty.
And once it has you under its spell, the narrative makes you complicit to their debate. The characters' conversations are founded on big questions: what is the value of a single human life? What does it mean to love someone enough to respect their desire to do what's right, even if the path they walk will surely end in death? The narrative lays out its arguments through dialogue, asks you to hear both sides of the story and allow your preconceptions to be challenged. It offers no answers, no absolute authority, demanding that you think for yourself. Is free will intrinsically superior to adherence to duty? What about when the world is at stake?
At the last, when the Prince lays Elika's body upon cold stone, these are the questions which must inform his choice. 
No, not his. Your choice.

Except there is no choice.
The fading echoes of Ahriman's power whisper in the Prince's ears, and the Prince decides that the only possible outcome is to repeat the actions of Elika's father. There is no conversation, no debate. Elika is dead, and the narrative is no longer listening. There is no option to respect Elika's wishes and return to the desert, leaving her destiny fulfilled and Ahriman once more imprisoned for a thousand years.
Despite everything that came before, the narrative decrees that the Prince values Elika's life above the continued existence of the world, and you - as the Prince's puppetmaster - are forced into carrying out its will, or else switch off the power, leaving the Prince eternally standing guard over Elika's tomb. With each sacred tree you shatter, you undo hours of progress, until at last your sword lashes out at the Tree of Life itself.
Even with Elika returned to life, the conversation is dead. The Prince has betrayed her just as utterly as her father did, and she cannot bear to look at him. He carries her into the desert as the credits roll, and Ahriman rises from his thousand-year confinement to destroy the world. And hers is not the only betrayal. The narrative entranced you with discussion and argument and open-minded consideration of conflicting viewpoints, but at the crucial moment it denies you the choice it promised, and instead railroads you into the worst possible outcome.
There are no happy endings here. Ahriman is free to devour the world. Elika lives, yet has nothing to live for, her mother dead, her father corrupted into a sick caricature of mourning, and her destiny denied by the Prince's deliberate sabotage. She can never forgive him - there is no forgiveness for such a profound betrayal, especially when committed in the name of love - and the affection which blossomed between them can do nothing but shrivel into a broken-hearted memory. It's a twisted mockery of the 'love conquers all' trope, one where 'love' involves rejecting every principle your beloved held dear, dooming both your nascent relationship and the world.
You could perhaps argue that the Prince we were introduced to at the beginning of the story - the cocky rogue stumbling through a sandstorm in search of a donkey laden with gold - might have considered that choice, yet through his interactions with Elika, he becomes someone else. He may disagree with her dedication to duty, but he learns to respect it. More crucially, he's no idiot, and the repercussions of his actions have been discussed in considerable detail. When a dark god offers you your dreams in exchange for the world, unthinking obedience is the wrong call.
Player choice is certainly not a prerequisite for a satisfying story, but here its absence is palpable, as if removed at some late stage in development. Not only do the protagonists discuss choice and destiny in considerable depth, but the Prince's decision is distinctly unsatisfying for all parties except Ahriman himself. In a 2009 interview with 1up.com Prince of Persia's producer, Ben Mattes, said: "I think story driven games that have multiple endings are a mistake, because then you don't know what the real story is." Yet the 'real story' that remains feels unfinished, the narrative heavily foreshadowing a moral choice which never comes and a denouement in which Elika's sacrifice is permitted to save the world.
We can only surmise whether it was a decision made in anticipation of a sequel which never came, the result of top-down intervention from Ubisoft management, or a creative compromise to make the most of a finite development budget. It may well be pertinent that the Epilogue DLC released shortly afterward is a direct continuation of the story, requiring Elika to be alive for you to overcome its increasingly elaborate skate-parks. Yet in living up to its name, the DLC does little to advance the story. Our protagonists' easy conversation never rallies, reduced to the Prince's increasingly-shrill demands that Elika must be some form of mystical saviour who can still fix everything, and Elika reprimanding him in turn for undoing everything they achieved together.
Whatever the reason, the conversation is over. While controversial in many ways, Prince of Persia succeeded where so many narratives fail, in crafting an evocative world, portraying a convincing relationship, and daring to ask meaningful questions. 
Until you dare to answer. Then Prince of Persia doesn't want to know.
