Note from Napoleon to Fouché on 28 July 1809, regarding the wheat trade and the Chamber of Commerce:
I received this rubbish that you sent me on the wheat trade and which is completely ridiculous. This is economist chatter. Who in France is opposed to the wheat trade? Who is opposed to Export? It is not the law of the land; it is the English who prevent neutrals from coming to our ports. These reasonings are pitiful, but have a great disadvantage: they encourage commerce to govern the government, raise discussions and create agitation in people's minds. The administration is not an economist. The principles of wheat trade are invariable: there is export as soon as there are outlets, there is no export without trade with foreign countries. It is England which prevents these means of commerce. I’ve tried to make up for it with licenses, and if we use them, this could remedy the problem.
As for what concerns me, please do not send me such nonsense. I don't need the drivel or the lessons of M. Dupont de Nemours and a few merchants.
I read the letters from the Chamber of Commerce. You were wrong to receive them, and I am sorry to see the direction you are giving to the Interior. We don't need lessons from Chambers of Commerce. Conversations with a few educated traders can be useful but the Chamber deliberation are always useless and have serious disadvantages. The Chamber of Commerce must be very ignorant if it does not know: 1° that the Americans have not lifted the embargo for France; 2° that I have never opposed the Americans coming to our ports; it is the English who oppose it.
The embargo has been lifted for Holland. The King felt he had to accept it. I stopped allowing the introduction of goods from Holland into France, and I summoned him to rescind the measure he took, wanting France and Holland to follow the same principle; and certainly, if England wants to let American ships come to France, I will be the first to approve it.
The Chamber of Commerce knows nothing and only talks about precepts. Please do not expose me to the inconvenience of receiving such memoranda. I can see you have no experience of interior affairs: we don't need any new legislation on trade. France is suffering a lot, I know, not because of legislation but because of England's blockade. This comes from the fact that the Danish, Russian, Prussian etc., as enemies, cannot circulate, that the Americans put the embargo on them, then later issued an act of prevention. There is no flow channel; we sought to supplement this with patents or licenses. Let me know the effect of these measures and do not agitate the spirit of commerce with crazy and untimely discussions. They will talk a lot and say nothing of value: they do not even have the first notions of the question.

President Joe Biden on Monday asked Congress to intervene and block a railroad strike before next month’s deadline in the stalled contract talks, and House Speaker Nancy Pelosi said lawmakers would take up legislation this week to impose the deal that unions agreed to in September.
“Let me be clear: a rail shutdown would devastate our economy,” Biden said in a statement. “Without freight rail, many U.S. industries would shut down.”
In a statement, Pelosi said: “We are reluctant to bypass the standard ratification process for the Tentative Agreement — but we must act to prevent a catastrophic nationwide rail strike, which would grind our economy to a halt.”
Pelosi said the House would not change the terms of the September agreement, which would challenge the Senate to approve the House bill without changes.
The September agreement that Biden and Pelosi are calling for is a slight improvement over what the board of arbitrators recommended in the summer. The September agreement added three unpaid days off a year for engineers and conductors to tend to medical appointments as long as they scheduled them at least 30 days in advance. The railroads also promised in September not to penalize workers who are hospitalized and to negotiate further with the unions after the contract is approved about improving the regular scheduling of days off.
Hundreds of business groups had been urging Congress and the President to step into the deadlocked contract talk and prevent a strike.
Both the unions and railroads have been lobbying Congress while contract talks continue. If Congress acts, it will end talks between the railroads and four rail unions that rejected their deals Biden helped broker before the original strike deadline in September. Eight other unions have approved their five-year deals with the railroads and are in the process of getting back pay for their workers for the 24% raises that are retroactive to 2020.
If Congress does what Biden suggests and imposes terms similar to what was agreed on in September, that will end the union’s push to add paid sick time. The four unions that have rejected their deals have been pressing for the railroads to add that benefit to help address workers’ quality of life concerns, but the railroads had refused to consider that.
Biden said that as a “a proud pro-labor president” he was reluctant to override the views of people who voted against the agreement. “But in this case — where the economic impact of a shutdown would hurt millions of other working people and families — I believe Congress must use its powers to adopt this deal.”
Biden’s remarks and Pelosi’s statement came after a coalition of more than 400 business groups sent a letter to congressional leaders Monday urging them to step into the stalled talks because of fears about the devastating potential impact of a strike that could force many businesses to shut down if they can’t get the rail deliveries they need. Commuter railroads and Amtrak would also be affected in a strike because many of them use tracks owned by the freight railroads.
The business groups led by the U.S. Chamber of Commerce, National Association of Manufacturers and National Retail Federation said even a short-term strike would have a tremendous impact and the economic pain would start to be felt even before the Dec. 9 strike deadline. They said the railroads would stop hauling hazardous chemicals, fertilizers and perishable goods up to a week beforehand to keep those products from being stranded somewhere along the tracks.
“A potential rail strike only adds to the headwinds facing the U.S. economy,” the businesses wrote. “A rail stoppage would immediately lead to supply shortages and higher prices. The cessation of Amtrak and commuter rail services would disrupt up to 7 million travelers a day. Many businesses would see their sales disrupted right in the middle of the critical holiday shopping season.”
A similar group of businesses sent another letter to Biden last month urging him to play a more active role in resolving the contract dispute.
On Monday, the Association of American Railroads trade group praised Biden’s action.
“No one benefits from a rail work stoppage — not our customers, not rail employees and not the American economy,” said AAR President and CEO Ian Jefferies. “Now is the appropriate time for Congress to pass legislation to implement the agreements already ratified by eight of the twelve unions.”
Business groups that have been pushing for Congress to settle this contract dispute praised Biden’s move.
“The Biden administration’s endorsement of congressional intervention affirms what America’s food, beverage, household and personal care manufacturers have been saying: Freight rail operations cannot shut down and imperil the availability and affordability of consumers’ everyday essentials,” said Tom Madrecki, vice president of supply chain for the Consumer Brands Association. “The consequences to consumers if a strike were to occur are too serious, especially amid continued supply chain challenges and disruptions.”
Clark Ballew, a spokesman for the Brotherhood of Maintenance of Way Employes Division, which represents track maintenance workers, said before Biden’s announcement that the union was “headed to D.C. this week to meet with lawmakers on the Hill from both parties. We have instructed our members to contact their federal lawmakers in the House and Senate for several weeks now.”
The U.S. Chamber of Commerce’s Neil Bradley said Biden was correct in advocating for the deal already reached. “Congress must do what it has done 18 times before: intervene against a national rail strike,” Bradley said in a statement, and he called Congress enforcing the deal agreed to by railroads and union leaders the “only path to avoid crippling strike.”
The railroads, which include Union Pacific, BNSF, Norfolk Southern, CSX and Kansas City Southern, wanted any deal to closely follow the recommendations a special board of arbitrators that Biden appointed made this summer that called for the 24% raises and $5,000 in bonuses but didn’t resolve workers’ concerns about demanding schedules that make it hard to take a day off and other working conditions. That’s what Biden is calling on Congress to impose.

REPUBLICANS PLAN TO launch a variety of investigations into the U.S. Chamber of Commerce and many of its largest member corporations if they retake the majority in the House of Representatives this November. The probes, said a GOP member of Congress and multiple Republican operatives who requested anonymity to discuss plans that have yet to be made public, will marry Republicans’ newly formed hostility to the Chamber with the party’s mission to undermine the growth of the ESG investment sector.
The power of ESG — which stands for environmental, social, and governance — criteria to shape company valuations and behavior has become a major source of consternation among conservatives, who argue that companies that follow it are breaking with their fiduciary duty to maximize profits for investors.
The Chamber has infuriated Republicans by endorsing ESG criteria. “Today, for many companies, climate change and carbon emissions impact long-term value, thereby becoming a factor that retirement fund managers should take into consideration,” wrote a Chamber vice president in a typical statement in July 2020.

The powerful U.S. Chamber of Commerce sued the Federal Trade Commission on Wednesday in an effort to block the agency's widely celebrated new rule banning most noncompete clauses, pervasive contract agreements that restrict employees' ability to work for or start a competing business.
The Chamber filed its lawsuit alongside the Business Roundtable and other corporate lobbying groups in a federal court in Texas. The suit came shortly after Ryan LLC, a tax service firm, filed the first legal challenge to the FTC's rule in a separate Texas venue.
"The commission's categorical ban on virtually all non-competes amounts to a vast overhaul of the national economy," reads the Chamber's complaint against the rule, which the FTC finalized in a 3-2 vote on Tuesday.
The agency, led by Biden-appointed Commissioner Lina Khan, estimates that roughly 30 million U.S. workers are subject to a noncompete agreement, limiting their ability to start their own companies or switch jobs in pursuit of better wages and benefits.
"Noncompete clauses keep wages low, suppress new ideas, and rob the American economy of dynamism, including from the more than 8,500 new startups that would be created a year once noncompetes are banned," Khan said in a statement Tuesday. "The FTC's final rule to ban noncompetes will ensure Americans have the freedom to pursue a new job, start a new business, or bring a new idea to market."
The Chamber, the largest corporate lobbying organization in the United States, signaled its intent to sue the FTC immediately after the agency finalized its new rule on Tuesday.
"The Federal Trade Commission's decision to ban employer noncompete agreements across the economy is not only unlawful but also a blatant power grab that will undermine American businesses’ ability to remain competitive," Chamber president and CEO Suzanne Clark said in a statement following the FTC's vote.
While the organization claims to fight for the interests of businesses small and large, a Public Citizen report published earlier this year found that the majority of the Chamber's legal work supports big corporations.
The Chamber acknowledged in response to questioning from a pair of Democratic senators last year that its corporate members use noncompete clauses—though the group did not specify which members.
"Why does the U.S. Chamber of Commerce hate dynamism in the American economy, where workers are free to move to the best opportunities, and companies are free to recruit the best talent?" asked University of Massachusetts Amherst economics professor Arin Dube in response to the Chamber's pledge to sue over the FTC's rule.
According to the FTC, its ban would boost the average U.S. worker's earnings by $524 a year, increase new business formation by close to 3% annually, and lower national healthcare costs by nearly $200 billion over the next decade.
