Chief Justice Robert's Perspective of Artificial Intelligence (AI)  in the Courts

With a new year on the horizon, Chief Justice of the United States Supreme Court, John Roberts, has centered his focus on Artificial Intelligence and its presence within federal courts. This particular circumstance has been designated within an annual report. The report specifically ‘made no mention of Supreme Court ethics or legal controversies involving Donald Trump’[1]. In late October of 2023, Michael Cohen, Trump's ex-personal lawyer, had willingly created AI-generated legal citations. This action was described as ‘unwittingly’ and brought a great deal of attention to the subject of artificial intelligence as well as ChatGPT, overall.
  The subject of artificial intelligence and ChatGPT is still fairly new knowledge to society, therefore a brief history is necessary. In December 2015, ‘OpenAI was founded by Sam Altman, Greg Brockman, Elon Musk, Ilya Sutskever, Wojciech Zaremba, and John Schulman’[2]. OpenAI is ‘an AI research and deployment company’ with a mission ‘to ensure that artificial intelligence benefits all of humanity’[3]. After a little over five years of research and finetuning, OpenAI released an early demo of ChatGPT in November 2022. Within an instant, ChatGPT had gone viral throughout all of society, especially across social media platforms. Numerous amounts of generations were produced from stories, outlines, travel guides, samples, etc. The efficacy and speed of production from ChatGPT ‘had attracted over 1 million users within 5 days’[1]. At first, there was much speculation about the presence of ChatGPT within classrooms and how it could disrupt the flow of learning among students. Educators felt that the ‘underlying concerns are primarily about the loss of human element in the education process’[5]. These concerns permeated throughout school districts across the nation. Luckily, for the most part, guidelines and protocols have been established to a certain extent.[7]
Above is the California Privacy Rights Act explained. This act was one of the first legislative repercussions as a result of the creation of Artificial Intelligence and only worked to apply itself to different perspectives as ChatGpt was created in 2022. These guidelines and protocols are enacted to examine and distinguish the limitations of ChatGPT in classrooms. This same degree of concern has now shifted towards the legal environment of the courts, specifically the Supreme Court.
  As a result of AI usage within the case involving Trump's ex-lawyer, Michael Cohen, much attention has been brought about to artificial intelligence in its entirety. This attention has caused ‘the ethical practices of the justices to be questioned’[2].
Chief Justice Roberts noted that using AI-generated content as the application for any matter is ‘always a bad idea’, especially within the legal profession. In hindsight, the Supreme Court adopted its first code of conduct to respond to critics who questioned the justices’ ethics. Furthermore, the subject of artificial intelligence and ChatGPT are a considered notion as the nation heads into a new presidential election year. The courts are continuously working with the intention of ‘keeping Republican former president off the 2024 ballot’[1]. With this major goal, the efforts in maneuvering around AI and ChatGPT throughout society have become the main focus. Also, another concern that has found itself on the rise is the possibility of technology becoming a replacement for many important jobs, especially judges. However, according to Chief Justice Roberts: ‘I predict that Human Judges will be around for a while, but with equal confidence, I predict that judicial work – particularly at trial level – will be significantly affected by AI’ [1]. Minor sanity can be relinquished from Chief Justice Roberts' statement. It also forewarns society and future generations of what is to come. With this, the encouragement to apply oneself is diminished to a particular extent.

  As the nation continues to grow and prosper throughout time, it is very important to understand the entity of AI. Artificial Intelligence. The first word of the phrase alone reveals the nonhuman aspect of the subject. The emphasized purpose of the subject is to the benefit of humanity in many alternative ways. Although AI may be refined and advanced over time, maybe even mimicking a humanistic nature, it is impossible that a technological and artificial intelligence creation could replace a human in any form or fashion. Especially in the working world: public service environment, legal environment, etc. The quality of being a human is essential to certain occupations and tasks that they entail. The society of the nation must persist throughout time despite technological advancements that pose regard to the replacement of human beings in the working world.
