Trademark - the continuing story
Recap
Almost a year ago we discovered, or perhaps I should say uncovered, the well documented ongoings on the trademark ‘The Sassenach’. Short recap, GGC filed a petition for cancelation to a charity group which name caused initially a partial rejection of the application. They later on terminated the petition w/o naming the reason. Though documents show that they reached a Consent Agreement pursuant to a Co- Existence Agreement which both parties agreed would eliminate any potential for confusion between the respective marks. Finally they received the Notice of Allowance for the trademark ‘The Sassenach’ in February this year.
Europe and Germany
At the same time the registration of the trademark in Europe met opposition of a German company. Something that we recently saw confirmed in several news articles. GGC has received an official Refusal of Protection on March 30, they have 4 months to submit an objection to the refusal. The trademark can not be used in the EU for his whisky or other spirits.
New Applications
Since last month (April 2021) some new trademark applications have been filed and are awaiting Examination.
The Sassenach Unique Spirits was filed on 19 April 2021, they added the words Unique Spirits to the already existing trademark ‘The Sassenach’. They also added the logo this time. Last year I wondered about why they had not done that. The category is straight forward Alcohol and beverages, except beer. Perhaps they will try to fight the refusal this way in Germany?
The next one is more interesting.
Unique Spirits. At first I thought it’s just to trademark this line separate. But reading on, the category is entertainment services and ongoing series featuring a docu-series travel show and a multimedia program series featuring comedy, action and adventure.
Do I read here a MiK 2? Even if Starz will not buy it, they could name it Unique Spirits!
The 3rth new application got me a bit more excited though....... Drumroll 🥁
Dram with Sam! 😂 Very original Sam! Oh and read the category! How clever! It’s not a very original idea, but hey in Dutch we would say ‘Beter goed gejat dan slecht bedacht’ (Better be good stolen than poorly conceived).
Categories contain books publishing and entertainment services, namely an ongoing series featuring a talk show!
Ah didn’t he say he was writing a book (again). Now we know what it is about, his favorite subject 🥃 we could have guessed it.
And a talk show, I guess some guy with a podcast named Whisky Neat sparkled a new idea! A show where he can drink whisky all the time, and free commercials for his own whisky and related merch! Will he be on his couch with his tartan plaids, of course the cap 🧢 so he wont need his Daman wig.

SHOULD I REGISTER MY E-COMMERCE BUSINESS FOR VAT?
So you’ve got your business set up for your customers. You have your email, website, company name, and logo trademarked and ready. You have your products and your Amazon account set up, and you and your supplier are raring to go. You’re excited to be marketing your products to the 450 million people in the EU and the 70 million in the UK.
There’s just one thing left: your EU VAT number. So, should you register your business for VAT in the country where you’re selling?

E-commerce businesses, like Amazon sellers, need to have a selling-point VAT registration (a seller’s EU VAT number) if:
the seller exceeds the threshold limit of sales;
the seller stocks his or her goods in that EU country and exceeds the annual distance selling threshold.
Non-compliance with these rules could result in the suspension of your ability to sell in the EU. It is important therefore to plan and do your research.
What is VAT?
VAT or Value-added Tax is a system of indirect taxation in the sales of goods and services in the EU. Simply put, VAT is a consumption tax.
If you’re a non-EU e-commerce seller (Amazon, eBay, Shopify, etc), you must take note of some important things about VAT in the EU.
The retail price of your products must be marked up with VAT. VAT rates are usually somewhere between 19 and 23% around Europe, depending on the country. With this added rate on your product, you (the seller) become a sort of tax collector on behalf of the government where you sell.
VAT, therefore, is not an expense of the e-commerce seller. You collect it from the end consumer and you file the return in the country where the product was sold.
VAT is payable upon entry of goods in the EU. This is relevant if you’re a non-EU seller. Import charges apply to all goods once they reach EU customs. This is also why you need an EU VAT number.
Since the departure of the UK from the EU (20 February 2020), most retailers stock their inventory in Germany as it has one of the simplest VAT rules in the union.
The Sales Limit Threshold
The threshold limit of sales varies per country. When the changes on VAT take on place on 1 July 2021, this threshold limit will become either be €35,000 or €100,000 depending on your country.
