Register your logo as a trademark
If you have already come up with a catchy name for your business, you should protect it and register it as a trademark. Where to register your company name? How do you register your logo as a trademark? Which registration procedure should you choose? The registration of names and logos is handled by the patent offices. You have three options, and these options are not mutually exclusive: you can apply for national protection, register an EU trade mark or register an international trade mark.
Tumblr media
How do I choose where to claim my company name and logo?
As you already know, you have ample opportunities to claim a name for your business. Register your logo as a trademark wherever you want. You can do this almost anywhere in the world. The basic criterion for your choice is, of course, the extent of your business activity. If you initially plan to operate within the territory of your own country, then registering your company name at the nearest Patent Office will be sufficient. Even if, over time, your business grows and you want to enter foreign markets, you can then apply for protection of your company name as a European Union trade mark or for protection in a selected country or group of countries through international registration.
Tumblr media
How do I register my logo as a trademark faster?
If you want to register your logo as a trademark, then use the tools for international trademark registration. With Bonamark.com, registration is quick and easy. The service's database allows you to search for specific copyrights and brand names from among the millions registered. The application process could not be simpler with state-of-the-art algorithms and infrastructure.

A Guide to Starting Your Own Skin Care Products Business
In recent years, the skincare industry has experienced exponential growth, driven by increasing awareness of skin health and beauty. If you're passionate about skincare and dream of starting your own business in this field, now is an opportune time to turn your aspirations into reality. Here's a comprehensive guide to help you kickstart your journey into the world of skincare product entrepreneurship.
Research and Planning
Market Analysis: Begin by researching the skincare market to identify trends, target demographics, and potential competitors. Analyze consumer preferences, emerging ingredients, and popular product categories to understand where your business can thrive.
Identify Your Niche: With a saturated market, finding a unique selling proposition (USP) is crucial. Consider specializing in organic, vegan, or cruelty-free products, targeting specific skin concerns like acne or aging, or catering to a particular demographic segment such as men or teenagers.
Product Development: Invest time and resources in developing high-quality skincare formulations. Partner with experienced chemists or formulators to create effective and safe products using proven ingredients. Conduct thorough testing to ensure efficacy, safety, and compliance with regulatory standards.
Legal and Regulatory Compliance
Business Registration: Register your skincare products business with the appropriate authorities in your country or region. Choose a legal structure such as sole proprietorship, partnership, or LLC (Limited Liability Company) based on your preferences and legal requirements.
Intellectual Property Protection: Consider trademarking your brand name, logo, and product formulations to safeguard your intellectual property rights. Consult with a legal expert to understand patent requirements and other legal considerations specific to the skincare industry.
Compliance with Regulations: Familiarize yourself with regulations governing the manufacturing, labeling, and marketing of skincare products. Ensure compliance with standards set by regulatory bodies such as the FDA (Food and Drug Administration) in the United States or the EU Cosmetics Regulation in Europe.
Branding and Marketing
Brand Identity: Develop a compelling brand identity that resonates with your target audience. Choose a memorable brand name, design a visually appealing logo, and craft a compelling brand story that communicates your values, mission, and commitment to skincare excellence.
Product Packaging: Invest in attractive and functional packaging that reflects your brand aesthetic and appeals to consumers. Consider eco-friendly packaging options to align with sustainability trends and attract environmentally-conscious customers.
Online Presence: Establish a strong online presence through a professional website and active presence on social media platforms like Instagram, Facebook, and Pinterest. Share engaging content, including skincare tips, product tutorials, and user-generated content to foster community engagement and brand loyalty.
Distribution and Sales
Retail Partnerships: Explore opportunities to collaborate with retail partners such as beauty salons, spas, boutiques, and specialty stores to distribute your skincare products. Attend trade shows and industry events to network with potential partners and showcase your products.
E-commerce Platforms: Leverage e-commerce platforms like Shopify, WooCommerce, or Amazon to sell your skincare products online. Optimize your product listings with high-quality images, detailed descriptions, and customer reviews to maximize visibility and sales.
Direct Sales Channels: Consider implementing a direct-to-consumer (DTC) sales model through your website or subscription-based services. Offer incentives such as discounts, loyalty programs, and free samples to attract and retain customers.
Continuous Improvement
Customer Feedback: Listen to customer feedback and reviews to identify areas for improvement and innovation. Use surveys, focus groups, and social media monitoring tools to gather valuable insights into customer preferences and expectations.
Stay Informed: Stay abreast of industry trends, scientific research, and technological advancements in skincare ingredients and formulations. Attend seminars, workshops, and conferences to expand your knowledge and network with industry experts.
Adapt and Innovate: Remain flexible and adaptable to changes in consumer preferences, market dynamics, and regulatory requirements. Continuously innovate your product offerings, marketing strategies, and business processes to stay ahead of the competition and sustain long-term growth.

Company Registration for Tech Startups: Special Considerations in Hyderabad
Tumblr media
Starting a tech startup in Hyderabad is an exciting venture that requires careful planning and consideration of various legal aspects. Registering your company is a crucial step towards establishing a solid foundation for your startup. However, tech startups often have unique requirements and considerations compared to traditional businesses. In this article, we will explore the special considerations for company registration in Hyderabad specifically tailored for tech startups. Choosing the Right Business Structure When registering a tech startup in Hyderabad, selecting the appropriate business structure is essential. The most common structures for tech startups include Private Limited Company, Limited Liability Partnership (LLP), and One Person Company (OPC). Each structure has its own advantages and considerations, such as the ability to raise funds, liability protection, and ease of doing business. It is crucial to carefully evaluate the needs and goals of your tech startup to determine the most suitable structure. Intellectual Property Protection For tech startups, intellectual property (IP) is often a valuable asset that needs protection. Prior to company registration, it is important to safeguard your IP rights. This can be done through patents, copyrights, trademarks, or trade secrets. Registering trademarks and filing patents can provide legal protection for your tech startup's branding and innovations. Consulting with an IP lawyer can help navigate the complexities and ensure your IP assets are adequately protected. Shareholding Structure and Agreements Tech startups often involve multiple founders and investors. Establishing a clear and comprehensive shareholding structure is crucial to avoid conflicts and disputes in the future. Drafting a well-defined shareholders' agreement can address key issues such as equity distribution, decision-making processes, roles and responsibilities, and exit strategies. Seeking legal advice and assistance in structuring the shareholding arrangement can help ensure fairness, transparency, and long-term stability for your tech startup. Compliance with IT and Data Protection Laws Tech startups typically handle large amounts of data and may provide online services. It is important to be aware of and comply with relevant IT and data protection laws. For example, the Indian Information Technology Act, 2000 governs electronic transactions and cybersecurity, while the General Data Protection Regulation (GDPR) compliance may be necessary for startups dealing with EU citizens' data. Taking appropriate measures to protect user data, ensuring privacy compliance, and implementing robust cybersecurity practices are vital for building trust and maintaining legal compliance. Angel and Venture Capital Funding Tech startups often rely on external funding to fuel their growth. Registering your tech startup as a private limited company can make it easier to attract angel investors and venture capital firms. VC firms and angel investors generally prefer investing in structured entities that offer limited liability protection. Registering as a private limited company not only enhances credibility but also allows for the issuance of equity shares, convertible notes, and other investment instruments favored by investors. Conclusion Registering a tech startup in Hyderabad requires special considerations compared to traditional businesses. Understanding these considerations and taking appropriate legal steps can help pave the way for a successful journey. Choosing the right business structure, protecting intellectual property, structuring shareholding agreements, complying with IT and data protection laws, and attracting funding are crucial aspects to address during the company registration process. Seek advice from legal professionals or startup consultants who specialize in tech startups to ensure that you navigate the legal landscape with confidence and maximize the potential of your tech startup in Hyderabad.

Bad Faith Games – Hasbro Rolls and Loses
For EU and UK trademarks, there is a five-year grace period following the issuance of a registration, during which the trademark owner must use the mark in connection with the goods and/or services covered by the registration before it can be challenged (and potentially ultimately revoked) for non-use with such goods and/or services. Some trademark owners have tried to take advantage of this by…

Trademark - the continuing story
Recap
Almost a year ago we discovered, or perhaps I should say uncovered, the well documented ongoings on the trademark ‘The Sassenach’. Short recap, GGC filed a petition for cancelation to a charity group which name caused initially a partial rejection of the application. They later on terminated the petition w/o naming the reason. Though documents show that they reached a Consent Agreement pursuant to a Co- Existence Agreement which both parties agreed would eliminate any potential for confusion between the respective marks. Finally they received the Notice of Allowance for the trademark ‘The Sassenach’ in February this year.
Europe and Germany
At the same time the registration of the trademark in Europe met opposition of a German company. Something that we recently saw confirmed in several news articles. GGC has received an official Refusal of Protection on March 30, they have 4 months to submit an objection to the refusal. The trademark can not be used in the EU for his whisky or other spirits.
New Applications
Since last month (April 2021) some new trademark applications have been filed and are awaiting Examination.
Tumblr media
The Sassenach Unique Spirits was filed on 19 April 2021, they added the words Unique Spirits to the already existing trademark ‘The Sassenach’. They also added the logo this time. Last year I wondered about why they had not done that. The category is straight forward Alcohol and beverages, except beer. Perhaps they will try to fight the refusal this way in Germany?
The next one is more interesting.
Tumblr media
Unique Spirits. At first I thought it’s just to trademark this line separate. But reading on, the category is entertainment services and ongoing series featuring a docu-series travel show and a multimedia program series featuring comedy, action and adventure.
Do I read here a MiK 2? Even if Starz will not buy it, they could name it Unique Spirits!
The 3rth new application got me a bit more excited though....... Drumroll 🥁
Tumblr media
Dram with Sam! 😂 Very original Sam! Oh and read the category! How clever! It’s not a very original idea, but hey in Dutch we would say ‘Beter goed gejat dan slecht bedacht’ (Better be good stolen than poorly conceived).
Categories contain books publishing and entertainment services, namely an ongoing series featuring a talk show!  Ah didn’t he say he was writing a book (again). Now we know what it is about, his favorite subject 🥃 we could have guessed it. And a talk show, I guess some guy with a podcast named Whisky Neat sparkled a new idea! A show where he can drink whisky all the time, and free commercials for his own whisky and related merch! Will he be on his couch with his tartan plaids, of course the cap 🧢 so he wont need his Daman wig.
How clever! I can see the opportunities and advantages... and of course the potential $$$$ coming in.

SHOULD I REGISTER MY E-COMMERCE BUSINESS FOR VAT?
So you’ve got your business set up for your customers. You have your email, website, company name, and logo trademarked and ready. You have your products and your Amazon account set up, and you and your supplier are raring to go. You’re excited to be marketing your products to the 450 million people in the EU and the 70 million in the UK.
There’s just one thing left: your EU VAT number. So, should you register your business for VAT in the country where you’re selling?
If you ware looking for Register for VAT in Germany, German VAT Registration and Germany VAT Registration. We are here to help you in this.
E-commerce businesses, like Amazon sellers, need to have a selling-point VAT registration (a seller’s EU VAT number) if:
the seller exceeds the threshold limit of sales;
the seller stocks his or her goods in that EU country and exceeds the annual distance selling threshold.
Non-compliance with these rules could result in the suspension of your ability to sell in the EU. It is important therefore to plan and do your research.
What is VAT?
VAT or Value-added Tax is a system of indirect taxation in the sales of goods and services in the EU. Simply put, VAT is a consumption tax.
If you’re a non-EU e-commerce seller (Amazon, eBay, Shopify, etc), you must take note of some important things about VAT in the EU.
The retail price of your products must be marked up with VAT. VAT rates are usually somewhere between 19 and 23% around Europe, depending on the country. With this added rate on your product, you (the seller) become a sort of tax collector on behalf of the government where you sell.
VAT, therefore, is not an expense of the e-commerce seller. You collect it from the end consumer and you file the return in the country where the product was sold.
VAT is payable upon entry of goods in the EU. This is relevant if you’re a non-EU seller. Import charges apply to all goods once they reach EU customs. This is also why you need an EU VAT number.
Since the departure of the UK from the EU (20 February 2020), most retailers stock their inventory in Germany as it has one of the simplest VAT rules in the union.
The Sales Limit Threshold
The threshold limit of sales varies per country. When the changes on VAT take on place on 1 July 2021, this threshold limit will become either be €35,000 or €100,000 depending on your country.
You might’ve been selling in the EU and have never breached this threshold. But when trends pick up and you find yourself expecting to go over in about a month, you should register immediately.
The Distance Selling Threshold
The current system also has different distance selling thresholds for each country. This means that if you stock your goods in an EU country, registering for VAT becomes obligatory.
When you also sell your products from your EU warehouse to another EU warehouse and you go over the distance selling threshold (DST) of the destination country, you need to register for VAT in that country. This is because your total annual sales that go above the DST of the country of arrival are payable to that country.
Click here to see all the current thresholds applicable to all e-commerce sellers until 30 June 2021.
Amazon FBA sellers are usually registered in the seven countries where products are stocked: Spain, the Czech Republic, Germany, Poland, France, Italy, and the UK. These are their Pan-EU fulfilment centres.
How Do I Register My Business for VAT?
It takes a while to get an EU VAT number and certificate, so it’s wise to start the registration once you decide to sell in Europe.
This waiting time can range from 3 to 4 weeks in the Czech Republic but can stretch up to 10 weeks or more for Germany.
Aside from the waiting time, the process of VAT registration is also quite complex for many business owners with non-accounting backgrounds. Requirements differ from country to country. It is then wise to get an experienced e-commerce VAT advisor with international accountants in many European countries to take care of the registration (and eventually filing of returns) for you.
Having a professional tax advisor to help you through this process will ensure that your numbers are calculated against your thresholds properly. You can ask for advice if you’re unsure at any stage of the process and they’ll take care of the paperwork that comes with registration and regular filing of returns.
Click here to see a step-by-step registration process with the help of VATstudio.
Once you get your EU VAT number, your products can now be shipped. This number is now your permanent VAT identity.
You will only ever have one. Not sure if you already have an EU VAT number? Search the EU VAT checker here.
What Happens After You Become VAT Registered?
Now that you have your EU VAT number, you need to file returns. This can be done monthly but most do it quarterly.
You will also have to take note of changes to VAT guidelines come 1 July 2021. These changes will make VAT more streamlined across different European countries through a One-Stop-Shop (OSS) system.
But don’t worry. With the changes to be applied this 2021 to e-commerce VAT-registered businesses, you’ll only have to file one tax return every month or quarter. As a tax advisor, it will be VATstudio’s job to take care of this for you.
What If I Get Registered and I Never Breach the Thresholds?
A seller that never goes beyond any of the thresholds in 12 months can be deregistered. However, being only VAT registered for a short amount of time can be a basis for authorities to question your motives. If you have a valid reason, ask VATstudio about your eligibility for deregistration.
Trust the VAT Experts in Spain IVA VAT Registration
The evolving world of e-commerce tax is something you need to know about but not memorize. For that, there’s VATstudio.
VATstudio is a group of professional tax advisors who stay on top of your e-commerce tax requirements so you won’t have to. All that’s left for you is to do what you do best: focus on growing your business. VAT registration in Spain

Common Challenges Related To Search & Register Trademark Europe & How To Dodge Them
Imagine this: You are ready to expand your business to Europe, or perhaps you have created a unique brand that you want to protect within the European market.
Tumblr media
The next crucial step?
EU Trademark Search and Registration. But in this thrilling journey, there are obstacles to dodge. Let us explore the common challenges and how to leap over them.
Inadequate Trademark Search:
It is a classic blunder – underestimating the importance of a thorough EU Trademark Search. Relying solely on the European Union Intellectual Property Office (EUIPO) database can be a trap, as it may miss trademarks within individual EU member states.
Overlooking Non-Registered Trademarks:
Not all trademarks in Europe are registered. Common law trademarks, which gain rights through usage, can be powerful. Neglecting them might result in objections from prior users. To avoid this pitfall, consider common law trademarks during your search.
Misjudging Classifications:
Register Trademark Europe is categorized into classes based on their goods or services. Failing to check relevant classes can lead to unexpected conflicts. Ensure your search encompasses all applicable classes to prevent unpleasant surprises.
Oppositions & Objections:
During the registration process, your trademark may face opposition from third parties or objections from the trademark office. To dodge this challenge, work with legal counsel who can address objections effectively and navigate oppositions.
Time Delays:
Register Trademark Europe can be time-consuming. It can take from 6 to 12 months or more, depending on the logo, brand name, and more. To expedite the process, consider using expedited services available in some EU member states.
Conclusion
In conclusion, the road to EU Trademark Search and registration is strewn with potential challenges. However, with meticulous research, the right legal guidance, and a well-thought-out strategy, you can successfully navigate these obstacles and secure your brand’s identity in the European market.
