THCa flower, the stakes are high and the chances are slim…

It’s cold outside here in Middle Tennessee, so The Old Hemp Farmer is nursing a wonderful hot cup of organic Indonesian coffee and noshing some Costa Rican Cacao fortified with Tennessee homegrown Cannabis extract. Which is just one of the many Tennessee homegrown Recreational Cannabis edibles that’ll remain legal after July 1st of this year, which is a good thing because we will probably lose three different revenue streams - D8 Vape cartridges, THCa Pre-rolls and D8/D9 Tinctures unless…

So this morning’s blurb is about how possibly the high THCa Industry can be salvaged here in Tennessee. There are two scenarios that can possible save the Cannabis “cash cow” that is known as THCa. The first scenario that could save your THCa favorite product could start January 9th when the 2024 Tennessee legislative session commences. During this upcoming legislative session the House and Senate could simple rewrite HB0304 to state that all testing would be for Delta 9 THC only and this would apply to Cannabis grown by licensed Tennessee farmers. Lee Crabtree and I have been compliantly growing Cannabis in the state for going on eight years and presently we have to watch the majority of THCa flower being sold in Tennessee being Black Market grown other states. There is only one way to battle Black Market Cannabis and that is to have a Vertical (grown, processed, packaged and inspected in state) Cannabis program that provides relatively inexpensive high THCa flower that can be accessed easily. Which is an easily understood concept but I strongly doubt the Republican Super majority that control the Tennessee House and Senate are going to be comfortable with basically sensible Cannabis laws. So The Old Hemp Farmer doesn’t see HB0403 rewritten to save high THCa Flower because the majority of folks in the Tennessee Statehouse still harbor animosity against marijuana, which is basically what high THCa Flower actually is, so that ship probably won’t sail.

The other way that could possibly salvage the high THCa flower Industry in Tennessee is the ongoing campaign of petitioning the Tennessee Department of Agriculture with letters, phone calls and texts to amend the methodology (testing for Delta 9 THC from post decarboxylation to pre decarboxylation) of testing Cannabis products. (Doesn’t seem like much but the difference is everything to wholesalers and retailers.) With the Culmination of this “Save The THCA flower” campaign being hopefully a mass of Cannabis folks attending the town hall meeting where Public comment is scheduled for Feb. 6, 2024, at 10 a.m. at the Tennessee Department of Agriculture’s Porter Building Atrium. So let us say a gang of folks actually do contact their legislators and the TDA to plead for high THCa flower and products, will this approach work? Maybe, maybe not. I’m not sure if people realize that the Tennessee Department of Agriculture was founded in 1854 and is the oldest state agency in Tennessee. This Cabinet-level agency is one of the largest and most firmly entrenched bureaucracies in Tennessee executive branch and supposedly only answers to the Governor. Which means the TDA can’t be voted out of office so they know their jobs are safe. Assured longevity has its rewards. Also know that the forthcoming lack of the public’s access to high THCa flower and the loss of revenue at Cannabis companies isn’t a crisis at the Tennessee Department of Agriculture. But be assured that the TDA will listen attentively but in the end these civil servants will do what they think is best for their agency and their pensions. Breaking Down Hemp: The Flower

Often confused with the psychoactive variant of the Cannabis plant, hemp is not the same – and as such, has different uses. Despite looking and smelling alike, hemp flower produces different cannabinoid concentrations than what many know as ‘Marijuana’.

…So, what’s the difference?

Over time, people bred cannabis for different things. Sometimes, they would breed shorter, denser varieties to produce more seed per acre. Others, taller plants for more fiber. And as people started using it recreationally, they basically started breeding it for strength. As a result, we have the high-THC variation of cannabis Sativa known as ‘Marijuana’. But even more recently, people started utilising modern breeding practises to breed THC out of the plant.

Why? So the plant produces more CBD. CBD is medicine.

So now we have two classes of ‘cannabis Sativa’: Hemp and Marijuana. ‘Hemp’ is any plant grown for seed, fibre, or CBD hemp flower. ‘Marijuana’ is basically just a hemp flower that contains over 1% THC.

So now we’re past that, let’s take a deeper look at what hemp flower can be used for.

Where on the plant it is found

Hemp flowers are found on both the male and female hemp plants. However, on the female plant, they are elongated, spike-like clusters that produce seed when pollinated. On the male plants, the flowers are responsible for producing pollen, and form more clustered branches

The main flowers (also known as colas, tops, or heads) are found at the apex of the plant.

Does it contain THC?

Hemp flowers do contain THC. However, this concentration is low and contains high-CBD. THC, Tetrahydrocannabinol is the substance that produces the mind-altering effect of psychoactive strains of the cannabis plant.

Hemp must contain less than 1% THC in Australia. The law is set this way so that it is virtually impossible for users to experience the psychoactive effects no matter how much they consume. Research demonstrates that hemp contains more than 500 chemical compounds and though one of this is THC, its quantity is negligible.

So what can it be used for?

Hemp flowers are legal in most countries including the US, and the majority of EU countries. But in Australia, if you have a licence to grow Hemp, you are unable to use the flower or leaf. Flowers are very easy to grow and harvest, and can be done by hand or machine. The less mechanical processing, the more of the naturally occurring cannabinoids, terpenes, flavonoids, and other organic compounds remain intact in the plant – and that’s what you want for medicine.

Smoking hemp is the most used method of flower consumption, however, trends are moving towards more health conscious methods of consuming CBD. It has a relaxing effect without producing any “high”. It can come as pre-rolled CBD cigarettes. Smoking in itself is not a healthy habit, but CBD cigarettes seem to be helpful for people searching for alternatives to nicotine cigarettes and psychoactive breeds of cannabis.

Healthier options include using the flower in cooking or brewing as tea, although this method requires trial and dosing.

Hemp flowers will produce hemp seed if pollinated.

Hemp seeds are actually a type of fruit botanically. They belong to a group called an achene. They are formed from the pollinated hemp flowers, just as with any other type of true fruit. This means that a hemp farmer can choose from one of two paths each crop: seed or CBD (and that’s before even using the stalks, leafs, and roots!)

Hemp seed can be eaten whole, hulled /dehulled

Hemp seeds can be eaten with or without the shell. Whole means unhulled, that the seeds still have their shells. The ‘whole’ variants of hemp seed are crunchy, contain lots of fibre, and serve as a great source of minerals. They can be sprinkled on top of salads, yoghurt or sandwiches – and you can never have too much!

Hulled (dehulled) hemp seeds are hemp seeds with their shells removed. Also called hemp hearts and hemp nuts, they’re actually the only type of hemp seed available as food to us over here in Australia. Currently, it’s required that hemp seeds have their ‘hull’ (shell) removed in case they contain leftover cannabinoids from the plant they came from, though there are no cannabinoids in the seed itself, this only occurs if the seed has not been cleaned probably. Also, you may grow a plant in your back garden!!

Hemp seed can be ground up into different forms such as…

Flour

Hemp Flour is made from raw hemp seeds which are made up of about 30% oil. After the grinding process, the hemp oil is extracted. It is also known as hemp powder or bran. It is much cheaper than protein powder.

Protein

The production of hemp protein requires an abundance of healthy and ripe hemp seeds. Hemp seed oil is first extracted from the seeds by cold pressing and hemp cake is obtained as a by-product. The hemp cake is then sieved several times. If the cake is only “roughly” sown, it produces hemp flour, which is rich in dietary fibre, most of which is retained in the seed shells.

Further high granulation sieving removes larger particles of hemp seed shells which leaves much more protein-rich particles that are found inside the seeds (hemp hearts). Thus, hemp protein powder is obtained.

Nutritional benefits of hemp

Hemp as seed, flour, or protein is rich in gluten-free fibre which helps with digestion and can assist in the prevention of a number of health issues. Similarly, the seed oil is rich in heart-healthy oils including omega 3 and 6 fatty acids (the only plant source of this essential fatty acid).

Hemp Flower can be used for CBD oil if not pollinated

How is it turned into CBD oil

CBD is one of over 100 cannabinoids in the hemp plant. It accounts for 40% of any extract from the flower. There are different ways to extract it from the flower but the most popular and most accessible method is “Carrier oil solvent”.

It’s obviously a bit more complicated than this – and probably not legal to share the whole process. So, here’s the quick version.

After flowers are obtained, they are put into a container as small as a crockpot or as large as an industrial drum, along with a carrier oil – coconut oil, for example. The mixture is subjected to low heating. A perfect balance must be created between the temperature needed for extraction and not damaging the nutrients in the flower. The oil is stirred at regular intervals and “cooked” for nothing less than 3 hours.

The mixture is then strained, the new CBD oil is bottled and stored.

What are the benefits

Cannabidiol (CBD) is a popular natural remedy for a variety of mental and physical ailments From anxiety to PTSD, and pain management to epilepsy. It is used topically, orally, and even through suppositories in order to provide relief for a number of medical issues that at times, may not have been possible through traditional medicine.

So, why is CBD so effective? Because of the body’s endocannabinoid system.

CBD is also well known for its application in cancer management. It helps to reduce nausea and vomiting associated with cancer treatment. Research is also finding that it is neuroprotective and can be used in the treatment of epilepsy and multiple sclerosis.

RAW Rolling Papers Caught in a Web of Deceit

A jury verdict found HBI International, creator of RAW Organic Hemp rolling papers, engaged in unfair business practices which violated the Illinois Uniform Deceptive Trade Practices Act. The RAW brand, known for its artisanal products and charitable contributions, apparently lied about the existence of its charity, the RAW Foundation, and the manufacturing and distribution location of its RAW Organic Hemp rolling papers.

RAW Founder Joshua Kesselman told Cannabis & Tech Today in a 2022 interview that RAW papers are crafted in Alcoy, Spain in the “last remaining authentic rolling paper factory in Alcoy.” The United States District Court for the Northern District of Illinois permanently enjoined HBI International from implying its RAW Organic Hemp products are created in or distributed from Alcoy.

Further, HBI International is forbidden from stating HBI and/or RAW contributes funds or proceeds to the RAW Foundation charitable entity. The court determined the foundation does not actually exist.

The January 31, 2023 court ruling forbids HBI International from marketing or stating any of the following:

That HBI and/or RAW® contributes its funds or proceeds to a charitable entity/foundation dubbed the “RAW Foundation”

That RAW® Organic Hemp rolling papers are “unrefined”

That RAW® Organic Hemp rolling paper adhesives are made from natural hemp gum

That RAW® Organic Hemp rolling papers are the world’s first or only organic (or organic hemp) rolling papers

That RAW® Organic Hemp rolling papers are made in Alcoy, Spain

That HBI International shall not include a packaging “stamp” using the word Alcoy or referring to Alcoy

That RAW® Organic Hemp rolling papers utilize wind power

That RAW® Organic Hemp rolling papers are made from the center of hemp stalks

That HBI or its founder Joshua Kesselmen invented rolling paper pre-rolled cones

That OCB® Organic Hemp papers are knock-offs, “RAWnabees,” copies, or fake versions of RAW® rolling papers

After May 31, 2023, HBI must cease promoting, selling, or distributing products under any of its other brands in packaging with an Alcoy stamp. These brands include Elements, Juicy Jays, and others.

RAW’s websites RAWgiving.com and RAWthentic.com, are currently down, stating “We’re updating our website and packaging to give you the most rawesome rolling experience ever.” This may be in response to the injunction requiring certain claims on RAW’s packaging be changed.

Once again its a beautiful, Sunny morning here in Middle Tennessee and we’ve had streak of weather that you wish would last all year long, but this weekend will be toasty enough to let you know the heat of Summer will soon make an appearance. And for the record, The Old Hemp Farmer has returned to the status quo and is enjoying an extremely good cup of organic Indonesian coffee and enjoying a half of a bar of Siriana Costa Rican Cacao laced with Tennessee homegrown extract. This morning’s blurb has to do with events of the previous day when Minnesota Governor Tim Walz signed the latest Recreational Marijuana bill into law. I’m not really sure how many people in general noticed or payed attention, heck I don’t know how many Cannabis professionals did. This makes Minnesota the 23rd state to end Cannabis Prohibition. And the Gopher State is bringing in their Marijuana law in at Water Ski speed, legal possession and Homegrown go into effect August 1st, 2023 with Commercial Cannabis sales beginning within a year. One thing that The Old Hemp Farmer will be watching with baited breath will be to see what the “rules of the road” will end up being and how smoothly the rollout will be. The implementation of the Minnesota Cannabis program should be fairly smooth, after all they’re not the first or second Recreational Programs, they are the 23rd! So the Minnesota Cannabis rollout should be as smooth as butter, after years of Recreational Marijuana in America, but weird things happen in Cannabis.

Speaking of Cannabis rollouts, on July 1st 2023, Tennessee’s nascent Hemp Derived Cannabis Recreational law has it’s not so soft launch. Where as Minnesota will take a year or so to bring their state’s Commercial Cannabis sales online, Tennessee is bringing their program in burning. Tennessee will go from zero people participating in a state run Hemp Derived Cannabis program, to 2,000+ individuals and companies, in a single day. You go to bed on June 30th an independent business and wake up July 1st as a part of a grand Cannabis experiment. Since our baby Hemp Derived Cannabis Recreational law was birthed, yours truly has spoken to a plethora of Cannabis professionals and first all, most folks believe that the Cannabis industry in Tennessee needed some guard rails and in the long run, HB0403 will be a good thing, not only in our state but nationally, as well. But in the near future, the Cannabis pros I know are as nervous as a seventeen year old on a first date. We’re not sure of how to dress or what to say, we’re kind of waiting on the Tennessee Department of Agriculture and the Depart of Revenue to make the first move and then act accordingly. At this point, we (Cannabis Professionals) are waiting to see when the TDA and DOR will start making inspections and trying to collect the Excise Tax. Also when the TDA start inspecting producers and retailers, what products have to have what standards? The Old Hemp Farmer has yet to find anyone that knows how the standards for THCa and concentrates will be enforced. Are the testing results in relation to THCa flower pre-carboxylation or post “decarbed”? Also how does Tennessee’s Hemp Derived Cannabis law interpreted in regards to D8 THC Vape cartridges? Most all D8 THC vape carts are 90% plus THC and are nowhere near what HB0403 says is legal. THCa flower and D8 THC vape cartridges are a large part of the Tennessee Cannabis industry and that loss of those sales would effect the bottom line of many companies. The loss of those revenue streams, would mean some Cannabis companies’ very existence would be in question. Meanwhile HB0403 doesn’t effect Edible Cannabis companies, nearly as much, don’t get me wrong, there are some hurdles such as child proof packaging and changing some dosages but Tennessee homegrown’s D8 THC Edibles can roll with these regulations pretty easily.
