"Taylor-made deals: how artists are following Swift’s rights example"

Prince and George Michael are bleak warnings from history, but the moves by Swift, Rodrigo and others can stand as roadmaps for the future. It also means the music industry has had to adapt away from contracts based on ownership. There are two kinds of rights at stake here: the rights to the master recordings of an artist’s work, and songwriting rights, known as publishing. One senior music publishing executive says their part of the business was ahead of the curve, explaining that publishing deals tend to work on exclusive licensing terms or retention periods. “Publishers pivoted from a rights-ownership business to the servicing of rights,” they say. Those retention periods are getting shorter, they add, down from about 25 years three decades ago to between 12 and 15 years today.

David Martin, CEO of the Featured Artists Coalition, says there is “a propensity towards owning rights” for artists, but some acts are still prepared to sign away ownership for what they think might be their only shot at the big time. “We have members who are still signing major label deals,” he says. “Some of the terms in some of those deals are terms that we’d expect artists to be thinking very carefully about.”

Message [,Brian - a partner at Courtyard Management] says he steers acts away from ownership-based contracts. “We have a default position that we won’t advise our artists to do life-of-copyright deals,” he says. “It’s not that we wouldn’t do them, but our strong advice would always be to come up with a licence arrangement of some description.”

This is the ideological underpinning of BMG and AWAL (Artists Without a Label), which is now under the ownership of Sony Music Entertainment. “The philosophy is flipping the relationship,” says Alistair Norbury, president of repertoire and marketing at BMG UK. “There had to be a fairer and more transparent way to work with the creative community.”

Acts on BMG’s roster – notably Kylie Minogue, Suede, Sigur Rós and Louis Tomlinson – are on licensing or assignment deals, so ownership of the recordings eventually reverts to them. “They want to be with a record label where they have creative control and ownership coming back to them at some point,” says Norbury.

The One Direction star was recently quoted as saying that Up All Night - his Number 2-peaking debut album released with bandmates Niall Horan, Harry Styles, Zayn Malik and Liam Payne - was 'shit'.

It's a standpoint we demanded more insight into because, sorry, that record plays home to some stone cold 1D bangers.

As we begged Louis to rethink his stance, he told OfficialCharts.com: "Do you know what? It's funny. It was an off the cuff comment, man.

"It was amazing for the time. But look, I couldn't imagine myself singing those songs now, at this age."

We jumped to its defence, reiterating that Up All Night is very much not shit. "Tell Me A Lie! More Than This! MOMENTS!", we protest.

"Moments - I used to love that tune, to be fair," Louis explains. "It's the one that Ed Sheeran wrote. Listen, there were loads of good songs on there, but it felt very much for the time.

"I couldn't imagine jumping up and down, singing Up All Night these days. But never say never!"

So, which 1D records would Louis himself describe as 'not shit'?

“Midnight Memories onwards," he says. "Maybe this is a slightly selfish angle, because Midnight Memories was the first album where me and Liam really had influence on the writing throughout.

"I think the bottom line is, it's not about Up All Night being shit. That was just me having a laugh. From the third album, I could take true ownership in the songs that I was a part of writing.

"That made me feel immensely proud and sparked my interest in song writing. I would say my favourite One Direction album is the last one we did, Made In The A.M. I really like that album, man.

"Those three [including Four], I'm immensely proud of. The others, I'm proud of; and the only reason I think any differently is because I didn't have as much to do with the writing of them."

When we claim there was a marked growth in quality with each record, Louis agrees.

"I think so, too. When I look back at those records, there are songs across those later three albums that you wouldn't expect a band that started out with an album like Up All Night.

“Especially where we got to, with songs like Story of My Life. Looking back, I'm immensely proud of how the credibility grew musically."

Louis also explained his upcoming second solo record is his most 'sonically ambitious' work to date; seeing him collaborate with the likes of DMA's, Courteeners' Joe Cross and Hurts' Theo Hutchcraft.

He told OfficialCharts.com: "Me, Theo, Joe Cross and David Sneddon did a writing camp together, and what was great about that was that – from the off – we were all on the same page. Theo is vastly intelligent and an incredible writer. Even just being around these people, getting into their brains and taking on their different ideas; I’ve learnt so much more making on this record than I did the first. That’s purely from being around the right kind of people.

"I'm a massive fan of both Hurts and The Courteeners. Even the fact they were willing to work with me, I was buzzing about that. We’ve got some really great songs out of it.

Re: that Kid Harpoon quote and the discussion about it 

“I just remember thinking, ‘Man, when he does his album, I want to be there because this guy is special.”

In the capitalist music industry the talents are the raw material that the profit is extracted from. So it’s not a surprise that people in the industry were literally preying on especially Harry (and Zayn) and waiting for them to go solo and wanting a piece of that cake. It absolutely sucks and it’s disgusting (capitalism is disgusting), but also you don’t normally get to the level of “Harry Styles TM” in the industry as it is, unless you go along with some questionable things and work with some questionable people. 

I hate capitalism and the way it works, but under the circumstances I think Harry is managing to navigate the industry and his role in it well enough. (Not saying his situation is great, perfect etc. but that he seems to be managing.) I honestly don’t think he’s sincere when he calls the right industry people his “friends” - they are his industry “friends” of course (people who work with him towards industry goals), but not his personal/private friends. He keeps his private life very private - he’s even blatantly said that in interviews a couple of times lately. 

Another side is that while the biggest personal profit is made by the people highest up in the industry, being a huge star means you also provide for so many people working in the industry (people we rarely, if ever, see or hear about, who may be replaceable to some degree, but whose work is also crucial in the industry). (I’m in a different creative industry and I’m one of those invisible people.)

It’s interesting to see how each of the boys have navigated their careers after going solo. Harry is right now the one that the industry is extracting the most “value” from, but he seems to be managing to maintain a fair amount of his integrity in his music and performances, and to keep his actual private life private.  Liam a while ago was involved in some pretty questionable stuff where questionable people exploited his “value” for NFTs and other weird shit. Louis may have been exploited quite a lot and in questionable ways right after 1D (in his new contract with Syco), but later he became perhaps the one most in control of his “value” out of them all. He recently mentioned that he seriously considered going independent, but then gave a major label another try with BMG (which self-describes as a label that’s quite "fair” to its artists). And it’s also interesting in this context that he chose to write his new album with musicians rather than songwriters, to focus on creating music as a craft and an art form rather than a process of developing value that can be sold.  Zayn has somehow managed to stay with a Sony label but very much on his own terms (no touring or live shows, barely any promo). He might be even more in control of his “value” than Louis, but I don't know much about his situation (obvs he doesn’t talk about it much). Niall seems to have a pretty cool and relaxed path, no drama or stunts afaik, regular album and single releases, cute promo ^^

LOUIS NEWS-- label and tour!! First, Louis has announced (or, well, Simon Jones PR has anyway, no word from Louis direct and yes, SJPR is still in the picture) that Louis is “partnering with BMG to release his second album globally”, an interestingly specific/ limited reveal. Fans are eyeing the wording and questioning whether he actually signed with them as a label (which they are) or just for publishing rights or distribution (which they also do, unlike most other labels)- the mention only of a ‘partnership’ supports the possibility that it’s something other than his new label, but it isn’t definitive and the simplest explanation of the press release is that BMG will be his label for LT2, as well as distributor and publishing company. The fact that they are small (relatively speaking; not one of the “Big Four” record labels but they’re hardly tiny) and somewhat new as a label does not to me seem like a reason why Louis wouldn’t have chosen them, as some are suggesting; there’s something to be said for being the big focus of a label rather than just another act, and Louis already chose that route once before when he signed with Arista (who are umbrella-ed by Sony but themselves not one of the big four) just after their relaunch, making him their biggest act by far. Also vague: “global” in this context doesn’t necessarily mean BMG has replaced Arista (his U.S. only label), it just for sure means UK plus the ‘international’ market, ie most of the rest of the world. It could mean U.S. too! Or not. We have reason to believe Louis was still with Arista as recently as a few months ago, and no evidence to suggest otherwise. The official press release says “recording is already underway” on LT2, and quotes Louis as saying: “I’m very excited to start the next part of my journey with BMG”. BMG- a new company founded after splitting from older label SonyBMG in 2008- claim to be “a new kind of music company” who are “not just a music publisher or a label” (they instead combine both of those things) in which “service to artists and writers is key,” and as part of that combine label services with holding publishing rights for their clients, often handled by separate companies and an area where songwriters tend to get screwed. BMG’s press also mentions their involvement with new technology a lot, and they represent Kings of Leon who have been at the forefront of the music industry use of NFTs (including releasing their next album as an NFT on a special NFT label despite being BMG artists). BMG’s twitter following more than doubled [edit: tripled now] in the hours after the announcement, and they followed Louis and tweeted to welcome him aboard from three different twitter accounts, including the U.S. one.

Slightly more commentary from Louis about the updated tour dates though mostly still press release style-- “Let's try this one last time!” he said, “All shows on my world tour will be moving back to 2022 and I’m excited to announce the first wave of new dates. I can't wait to see you all soon, it's going to be special!” and what should be the final dates for tour dropped, all in Spring ‘22- including a London show at Wembley, holy shit! Not every rescheduled date has been announced but those that are mostly have one thing in common-- much bigger venues than they were originally booked into. At at least one show so far fans will have to buy tickets again which sucks, but they are offering a pre-sale for previous ticket holders so at least those buyers only have to fight each other and not all the fans that joined the scrum in the time since the tour sold out. “After all this time and years of waiting this tour is going to be incredible, I can't wait!” said Louis and he’s not wrong!

And that’s all for serious news, over in Harry land things are...a lot sillier. A “bardcore” version of Watermelon Sugar was added to Harry’s official Spotify, LOL, and it is even more ridiculous to listen to than it is to imagine! I don’t picture it topping the charts anytime soon but it’s certainly an entertaining twist I was NOT expecting over the quiet weekend. The idea of Harry and friends deciding that needed to be legitimized on the official 36 million follower page is PRICELESS, and I would love to see Harry in a Gucci doublet and hose (or a nice laced bodice), but sadly it seems that the addition of the 2020 cover song to Harry’s account is a fuck up on Spotify’s end, as acknowledged by the Bard himself (no not Harry or Shakespeare, the person who did the weird cover- they do lots of covers in this style, it’s like a whole Thing. Medieval style covers of hits.) Meantime OUR bard was seen on the My Policeman set in a t-shirt reading “don’t ruin my fantasy”. New merch? I’ve never seen something more perfect for harries, they should consider it! This shirt though is from a designer with a focus on gender neutrality who donates to queer youth charities. And Kid Harpoon said, about WS (modern version) “at first, and I get this quite a lot with his lyrics, I thought, that’s kind of weird. Then you’re like, man, it’s brilliant. I remember thinking that with this. Harry’s so good at lyrics, he’s really growing into his own thing.”

Meanwhile Niall reposted (to insta AND facebook) the same outfit of the day video post he posted and deleted yesterday but left it up this time. It is clearly NOT today’s outift- damn Niall is my whole life a lie?! What can we trust in this treacherous world?? NOT YOU I GUESS. He also popped up on twitter to claim “no idea what you’re talking about” wrt him and Anne Marie teasing their collab without offering any actual clues about WHEN-- mhmm, like I said...

Louis saw us all coming up with wacky theories about what the BMG announcement might mean and came to tell us what’s going on… wait no he just retweeted the same article from yesterday with the partnership wording! Haha, but in seriousness while I know not everyone agrees I think it’s pretty clear at this point that BMG is his new record label. The tweet he posted was captioned with another easily misconstrued statement, THANKS FOR THAT LOUIS, but I will repeat what I said yesterday, which is that by far the likeliest explanation of his announcing to a fandom that’s rabid for label news that he’s joined a label is that- it’s his new label! And all the evidence I see supports that. The post he retweeted said (in the words of Music Week) “After five One Direction albums and one solo LP with Sony Music and Syco, now Louis Tomlinson is officially an independent artist with BMG”. Some believe this means he’s NOT signed to BMG but is putting out his own album and simply using them as a distro; I personally would say it seems pretty clear at this point that that simply refers to the fact that BMG are, as a label that isn’t one of the Big Four, considered an independent label, making Louis, as someone on their roster, an indie artist- like the tweet said. If he’d gone rogue and started his own label there would be articles everywhere about it and that article would have talked about it (instead headlines read “Louis Tomlinson Signs Record Deal With BMG”), plus we have plenty of quotes that would be frankly odd if he weren’t signed to BMG, such as the vice president of A&R at BMG UK, saying "We are delighted to welcome Louis to BMG. He is already busy working on new music, and we are excited to join him on the next phase of his extraordinary career,” a BMG sales manager saying “BMG will have the new album” and referring to the fact that they’ll do promo for it (in a DM conversation that actually appears to be real, unlike SOME going around today), and Charlie Lightening posting “Congrats @louist91 on the new deal with BMG UK excited for LT2, gonna smash it lad”.

More to the point-- why do people want so badly to think he ISN’T signed with BMG? This is GREAT NEWS!! They’re an indie (what everyone has wanted for Louis forever), and they were founded specifically to give artists more control than the majors (after splitting off from Sony; they were more or less founded as a direct push back against Sony’s business model), but they’re big enough to give him the support an artist of his size needs, which would be very hard for him to pull off running his own label-- I’d much rather see him putting his energy into writing songs, touring, making documentaries, and running his management company, rather than doing his own promo and wrangling with distro deals and shit. He should be signed to a label to do that work for him! And BMG seems like an awesome choice! But the weird ideas out there just continue right on-- not just people saying he’s not on a label, but also others, who don’t think him being on a label completely unconnected to Sony will be able to prevent Sony from dropping a piano on Louis’ head like the moustache twirling masterminds they are er sabotaging BMG somehow (the whole point of them being an indie is that this shouldn’t be an issue?), and such amazing takes as “louis has signed to a queer label” (evidence? “we just know that they are queer”; an actual dialogue from tiktok), are unlikely to be affected by any number of facts, as are the twitter folks getting excited about him ‘unfollowing’ accounts he never followed to begin with (Syco etc).

Anyway Louis, on a roll of giving us what we want today, also gave us a VIDEO with his HAT OFF! I don’t even care that it’s a silly ad (for samsung), or that he trimmed his luscious locks a little, it’s Louis! Talking and stuff!! Showing off his still wonderfully long hair all pushed up and back! Gorgeous, amazing, perfect… and yes I am ignoring the slides and socks thank you very much, though I will mention that they are literally exactly the same as Harry’s slides and socks. He also followed BMG, one of his (no doubt many) NFT trading profiles was found (@LT282828, LMAO), and new shows are being added as the tour dates finalize (though ticketmaster showing a Harry date for the same day/place as one of them was a glitch, we don’t have Harry’s updated dates yet)

And speaking of Harry! MP filming was indoors today, so Harry was only seen walking to his car, but he showed up at the Brits!!! In an amazing geometric patterned (or, uh, “macro framed sequence print” I GUESS) brown and tan suit (that clashed just HORRIFICALLY with the neon pastel Brits décor and his award, I fucking love that) and a cute lil handbag and sneakers to accept his AWARD for Best British Single!! (For Watermelon Sugar oddly, but hey a wins a win). CONGRATULATIONS baby and WOW great to see him! He popped in with pal Tomo Campbell, last seen by us when they drove to Italy together last summer. He thanked “my fans, for being so generous to me, always, and everyone in my life who has my back, thank you so much I love you.” Question, did he make the choice to swap out the pink and yellow award he was handed onstage for the blue and green version he had later? Either way, lol. Lots more people will have nice things to say about him now with this high profile win, but even before that people were gushing about him-- Joshua Bassett came out as queer by calling Harry hot (”I guess this is me coming out”), we got Billy Porter on the Brits pre show carpet saying, “I am seeing change! You know Harry Styles on the cover of Vogue Magazine that is change.
