If you were an academic, would you remain in a state which is willing to prosecute you if you deviate from the governor's political line?
With the start of the 2023-24 academic year only six weeks away, senior officials at New College of Florida (NCF) made a startling announcement in mid-July: 36 of the small honors college’s approximately 100 full-time teaching positions were vacant. The provost, Bradley Thiessen, described the number of faculty openings as “ridiculously high”, and the disclosure was the latest evidence of a brain drain afflicting colleges and universities throughout the Sunshine state. Governor Ron DeSantis opened 2023 with the appointment of six political allies to the college’s 13-member board of trustees who vowed to drastically alter the supposedly “woke”-friendly learning environment on its Sarasota campus. At its first meeting in late January, the revamped panel voted to fire the college president, Patricia Okker, without cause and appoint a former Republican state legislator and education commissioner in her place. Over the ensuing weeks, board members have dismissed the college’s head librarian and director of diversity programs and denied tenure to five professors who had been recommended for approval.
Essentially, the DeSantis education gestapo is killing off the institution — or at least making it very unattractive to students to the left of Mussolini. Of course it's not just NCF that's been affected.
The new laws have introduced a ban on the funding of diversity, equity and inclusion programs at Florida’s public colleges and universities, withdrawn a right to arbitration formerly guaranteed to faculty members who have been denied tenure or face dismissal, and prohibited the teaching of critical race theory, which contends that inherent racial bias pervades many laws and institutions in western society, among other changes. In the face of that and other legislation backed by DeSantis and Republican lawmakers that has rolled back the rights of Florida’s LGBTQ+ community, many scholars across the state are taking early retirement, voting with their feet by accepting job offers outside Florida or simply throwing in the towel with a letter of resignation. The prevailing political climate in Florida has complicated efforts to recruit qualified scholars from outside the state to fill some vacancies. Kenneth Nunn served on a number of appointment committees during the more than 30 years he spent on the faculty of the University of Florida’s law school. He said the task of persuading highly qualified applicants of color to move to Gainesville has never been more difficult under a governor who, earlier this year, prohibited a new advanced placement course in African American studies from being taught in high schools. DeSantis came under renewed criticism this month when the state department of education issued guidelines recommending that middle school students be taught about the skills slaves acquired “for their personal benefit” during their lifetimes in bondage.
DeSantis is so fond of slavery that every public college and university in Florida is now an anti-woke plantation run by a DeSantis overseer.
Degrees from public educational institutions in the state may henceforth be looked upon like those from Trump University.

TALLAHASSEE, Fla. — The newly-installed conservative board of trustees at New College of Florida ousted its current president in favor of former state education commissioner Richard Corcoran Tuesday, launching the initial move in reshaping the campus under the vision of Gov. Ron DeSantis.
The decision came at the first board meeting since DeSantis appointed six new trustees with the idea of overhauling the liberal arts college in Sarasota into a more conservative-leaning institution. That track was accelerated Tuesday when the board paved the way for new leadership as students and parents protested the major changes that appear bound for New College.
“Some have said these recent appointments amount to a partisan takeover of the college. This is not correct,” said trustee Matthew Spalding, a constitutional government professor and vice president at Hillsdale College’s D.C. campus who was appointed by DeSantis. “It’s not a takeover — it’s a renewal.”
A leadership switch from President Patricia Okker to Corcoran as interim leader is one of several moves made Tuesday by the board, which also signaled its intent to abolish diversity, equity and inclusion programs on campus — all policies pushed by DeSantis. The changes are major developments at the school spurred by the new appointees, including Christopher Rufo, a conservative activist who has advised DeSantis on critical race theory, and Eddie Speir, the co-founder of Inspiration Academy, a Christian charter school in Bradenton, Fla.
Tuesday’s meeting was met with apprehension from dozens of students and parents who protested what they called a “hostile takeover” at New College. They urged Okker to stay on as president and push back against the new mandates from the DeSantis administration to model the school as a “Hillsdale of the South” in reference to the private conservative religious “classical“ college in Michigan.
Okker in an emotional address told the board — and the campus — that she couldn’t continue to serve as president amid accusations that the students are being inundated with liberal indoctrination.
“The reality is, and it’s a hard reality and it’s a sad reality, but the vision that we created together is not the vision I have been given as a mandate here,” Okker said.
In remaking the board at New College, the DeSantis administration said the school was “completely captured by a political ideology that puts trendy, truth-relative concepts above learning” and in need of change following downward enrollment trends. To move on from Okker, trustees agreed to a “generous” exit package that includes at least 12 months of paid professional development leave and benefits. Corcoran is unable to begin serving until March, leaving Okker’s chief of staff Bradley Thiessen in charge until then.
“New leadership is the expectation and I think it makes sense,” Rufo said at the meeting. “I don’t think it’s a condemnation of Dr. Okker, scholarship or skills or character.”
DeSantis’ changes at New College follow other efforts to reshape higher education in Florida. Earlier Tuesday, the GOP governor proposed several changes to Florida’s university system, including pressing the GOP-led Legislature to cut all funding for diversity, equity and inclusion programs and to allow university leaders to launch tenure review of professors. Last year, DeSantis and state Republicans placed GOP allies in top university posts and pushed legislation that could limit how professors teach race.
New College is also now set to review its Office of Outreach & Inclusive Excellence at the request of Rufo as part of the state’s stance against diversity, equity and inclusion programs in schools. Rufo originally pushed to abolish the office outright, including four positions, and take other actions tied to diversity and equity, but decided to request further details on the program for a discussion in February.
Tuesday’s meeting was tense at times, with audience members frequently shouting over and at the new trustees as they spoke. Several parents and students addressed the board before they huddled, often criticizing their plans to retool the university and asking them to leave the college alone.
Some faculty said students felt “hopeless” about what could happen at the school, which is a unique college of under 700 undergraduates where students craft personalized education plans and don’t receive letter grades.
“Many students came here to feel safe and access the education that is their right as Floridians,” Diego Villada, Assistant Professor of Theater and Performance Studies, told the board. “And the impulse to make this a place where race, intersectionality and DEI are banned indicates to them that you want everyone to be the same – to be like you.”
Trustees, though, made it clear that the New College overhaul is fully underway, a message that came the same day DeSantis pledged to invest millions of dollars into recruiting faculty to the school.
“The campus needs a deep culture change. You sat up here, you called us racists, sexists, bigots, outsiders,” said trustee Mark Bauerlein, professor emeritus of English at Emory University who was appointed by DeSantis. “We are now in a position of authority in the college. And the accusations are telling us that something is wrong here.”

More than one-third of New College of Florida faculty will not be returning in the fall.
That’s according to Provost Bradley Thiessen, who called the 36 departures in a single year a “ridiculously high” number for a school with fewer than 100 full-time teachers.
Some of those were retirements or sabbaticals that were planned long before the school made national headlines in January, when Gov. Ron DeSantis appointed six trustees with a mission to transform the small liberal arts school.
But many are teachers and researchers who — frustrated and dismayed by the school’s new leadership — saw no other option but to resign or take leave to look for opportunities elsewhere.

Edmonton Arts Council and City of Edmonton supports 30 local artistic projects
Artist Project grants for individual artists and collectives support the pursuit of artistic and professional advancement. Be it creation, research, development, curation, exhibition, production or professional development opportunities – artists are welcome to apply to have these projects funded. With so many artists pursuing various ideas and disciplines, it’s inspiring to see what Edmonton’s arts community is creating.

Throughout 2018, you can expect to see numerous artist projects around Edmonton. With their Artist Project investments, Nancy Sandercock and Emmanuel Osahor are each creating art installations to be shown at The Works Art & Design Festival – discover their work as part of the festival from June 21 to July 3 at Site 1. Merging dance, music, and theatre, Thou Art Here will bring you the story of William Shakespeare’s wife, Anne Hathaway, in the historic 1886 Edmonton Cemetery this fall, assisted by a Project grant.

Seeking an outlet for her compositions, professional composer and pianist Stephanie Urquhart created the group Experience Points. Together they combine funk, jazz, and groove-based music with classic video game soundtracks. With their Artist Project grant they plan to record and release their first album.

Artist Project grants also give artists the opportunity to explore and experiment in their practice. Looking to push her own artistic voice, accomplished dancer, choreographer and instructor Jodie Vandekerkhove will be exploring how to express herself through body and camera. Her dancing-camera will allow audiences to see what a dancer sees from “their” perspective, adding a new voice to the work. Using his Project grant, Keith Walker will be working with assistants to explore the Italian glasswork technique, Murrini. He experienced this labour-intensive process at an international glass residency at Salem State University in Salem, Massachusetts and is excited to continue in this exploration into future works.

Indivisible Injury Principle Applied Where Injuries Aggravated in Limitation Barred Event
Helpful reasons for judgement were published today by the BC Supreme Court, Vancouver Registry, showing the Plaintiff friendly scope of the Indivisible Injury principle.
In today’s case (Griffioen v. Arnold) the Plaintiff was involved in two vehicle collisions.  The first in 2011.  She sued the at fault motorist who admitted liability.  She was involved in a second collision in 2014.  She was a passenger in her husband’s vehicle.  He was at fault for the second crash but she chose not to sue and the limitation period to do so expired.  The second crash aggravated the injuries from the first.
The Defendant argued that the Plaintiff’s damages must be reduced to the extent that the second crash aggravated them.  The Court disagreed noting the principle of indivisible injury allows the Plaintiff to fully recover damages from the first Defendant who is then burdened to seek indemnification from other contributing tortfeasors.  In applying the indivisible injury principle in the Plaintiff’s favour Mr. Justice Bracken provided the following reasons:
[117]     In this case, the plaintiff elected not to sue her husband, who was the person at fault in the second accident.  She admits that he was at fault and that her right to bring an action is now statute-barred by the Limitation Act, SBC 2012, c. 13.
[118]     In Bradley v. Groves, 2010 BCCA 361 at paras. 32 – 34, the court said:
[32]      There can be no question that Athey [Athey v. Leonati, [1996] 3 S.C.R. 458] requires joint and several liability for indivisible injuries.  Once a trial judge has concluded as a fact that an injury is indivisible, then the tortfeasors are jointly liable to the plaintiff.  They can still seek apportionment (contribution and indemnity) from each other, but absent contributory negligence, the plaintiff can claim the entire amount from any of them.
[33]      The approach to apportionment in Long v. Thiessen [(1968), 65 W.W.R. 577 (C.A.)] is therefore no longer applicable to indivisible injuries.  The reason is that Long v. Thiessen pre-supposes divisibility; Long requires courts to take a single injury and divide it up into constituent causes or points in time, and assess damages twice; once on the day before the second tort, and once at trial.  Each defendant is responsible only for their share of the injury and the plaintiff can recover only the appropriate portion from each tortfeasor.
[34]      That approach is logically incompatible with the concept of an indivisible injury.  If an injury cannot be divided into distinct parts, then joint liability to the plaintiff cannot be apportioned either.  It is clear that tortfeasors causing or contributing to a single, indivisible injury are jointly liable to the plaintiff.  This in no way restricts the tortfeasors’ right to apportionment as between themselves under the Negligence Act, but it is a matter of indifference to the plaintiff, who may claim the entire amount from any defendant.
[119]     In Pinch v. Hofstee, 2015 BCSC 1888, the plaintiff claimed compensation arising from a motor vehicle accident.  He was subsequently injured in a second accident and the injuries from the two accidents were found to be indivisible.  The court considered Bradley v. Groves, but found that any claim for the second accident was statute-barred by section 10(1) of the Workers Compensation Act.  Burnyeat J. held that the plaintiff could not recover full damages from the defendant in the first accident.
[120]     At para.60, Burnyeat J. stated:
[60]      I conclude that the Legislature has made it clear that the principles set out in Bradley, supra, do not apply where there is a statutory bar to recovery of what may be found to be indivisible damages.  Section 10(1) of the Act is but one example of the inability to recover indivisible damages arising out of a separate breach of duty of care.  A further example might be illustrated by a situation whereby proceedings relating to a first tortious act were not commenced within the limitation period and a second tortious act occurred. In those circumstances, I cannot conclude that damages would be available where an action was not commenced relating to the first act, a subsequent act caused injuries which were found to be indivisible from the first act, and a claim was advanced against the second tortfeasor for damages for the injuries caused both by the first and the second tortious acts.  Just as a claim for damages for a second tortious act could not “give life to” recovery of damages for a first act where a limitation period had expired so also s. 10(1) of the Act has taken away “any right and rights of action” available to Mr. Pinch and any recoverable “damages, contributions or indemnity” that might have been available to Mr. Pinch as a result of MVA #2.
[121]     In Sandhu v. Vuong, 2016 BCSC 1490, Master Baker followed Pinch v. Hofstee, and held that the defendant in one action could not commence a third party proceeding against a person liable for a second accident that happened in Manitoba because the accident there was statute-barred by a “no-fault” automobile insurance regime.
[122]     I do not agree that the situation here is the same as where an action is statute-barred as in both Pinch and Sandhu.  There was no right of action in British Columbia against the person liable for the second accident.  In Pinch, the Workers Compensation Act prevented an action and in Sandhu, the court held that as there was no right of action in Manitoba, there could not be a right in British Columbia.
[123]     In both Pinch and Sandhu, the plaintiffs were not simply beyond the time limit for commencing an action, but would be barred by statute from commencing an action even if they had done so within the statutory time limits.
[124]     It seems to me that it was open to the defendants in this case to commence a third-party action provided it was commenced within the time limit that started when the defendants became aware of their right to commence an action against the plaintiff’s husband.  That is, the time limits for the defendants may not be the same for a third party action as for an action by the plaintiff. 
[125]     The plaintiff obviously knew of her right to commence an action from the time of the accident.  The defendants were aware of their right to commence an action from the time they discovered they might be liable for some damages from the second accident.  I therefore find that Pinch and Sandhu are distinguishable from the facts of this case and in the circumstances, I am not prepared to apportion liability to the plaintiff’s husband in reliance on the principle of indivisibility and will apply the principle in Bradley.
