Poland Attempts To Remove Themselves From Istanbul Convention: A decision That Will Ultimately Worsen Domestic And Gender Violence.

While countries like France are pushing for the betterment of women’s rights, others are rescinding backwards. On July 26, 2020, Poland’s President, Andrezj Duda, decided to remove the country from an international treaty whose main purpose is to protect women against violence[1]. The Istanbul Convention was enacted in 2011, banning together a majority of European countries to reduce gender discrimination1. The response to the President’s movement towards removal has been greatly negative as citizens demonstrate their unhappiness through protesting in person and through social media.
To start, the 2001 Istanbul Convention was established to develop policies and a framework to encourage countries to reduce the prevalence of violence against women and discrepancies in gender equality[2]. Co-operation between countries to grow organizations and educate law enforcement agencies on gender violence situations, Europe is growing towards reducing the number of cases a year2. It is important to note that the Convention’s definition of violence against women includes acts that are physical, economic, psychological, and sexual2. The general obligations of the Istanbul Convention are outlined in Article 12:
1. “Parties shall take the necessary measures to promote changed in the social and cultural patterns of behavior of women and men with a view to eradicating prejudices, customs, traditions and all other practices which are based on the idea of the inferiority of women or on stereotyped roles for women and men
2. Parties shall take the necessary legislative and other measures to prevent all forms of violence covered by the scope of this Convention by a natural or legal person
3. Any measure taken pursuant to this chapter shall take into account and address the specific needs of persons made vulnerable by particular circumstances and shall place the human rights of all victims at their center
4. Parties shall take the necessary measures to encourage all members of society, especially men and boys, to contribute actively to preventing all forms of violence covered by the scope of this Convention
5. Parties shall ensure that culture, custom, religion, tradition or so called ‘honor’ shall not be considered as justification for any acts violence covered by the scope of this Convention
6. Parties shall take the necessary measures to promote programs and activities for the empowerment of women”2
Unfortunately, Poland has not strictly followed the Istanbul Convention obligations. In Poland, economic violence is not considered a form of domestic violence[3]. The reason behind creating the category of economic violence is to ensure that “the standard of living for both spouses should be on the same level, even if one has employment outside the home”3. In the Polish Criminal Code, there is no definition for economic violence3. The Criminal Code also doesn’t include a definition of domestic violence either, only rape3. The Polish definition of rape also does not follow the standards set forth in the Istanbul Convection3. The definition of rape according to the Polish government is such, “to subject another person to sexual intercourse, to submit to another sexual act or to perform such act, using force, illegal threat or deceit…victim must actively and continuously resist or demonstrate their lack of consent by means of loud protests, requests or screening…authorities to focus not on the survivor’s absence of consent, but rather on the level of opposition on resistance, how that was communicated, and how long”3.
The question remains, why did President Dudadecide to remove Poland from the Istanbul Convention? President Duda’s campaigned against LGBTQ rights and also demotes gender equality1. According to President Duda, the Istanbul Convention is “harmful” because it violates the rights of parents to decide if their child learn about gender in school[4]. Under the Convention, education providers are required to teach students about gender which President Duda states, “contains elements of an ideological nature”4. Poland’s idea of the purpose of the Istanbul Convention is faulty as it does not explicitly refer to same-sex marriage so therefore, that concern by the traditional Catholic country is unjust4. The only objective of the Istanbul Convention is to prevent gender and domestic violence throughout Europe4.
The response to President Duda’s intentions to exit from the Convention has been increasingly negative as protects continue in the country. Marta Lempart, the organizer of a women’s march in a Polish city, states “the aim is to legalize domestic violence”4.
Women’s rights marches have been erupting throughout the globe and President Duda’s current decisions have only exacerbated the prominence of the outrage.
