Poll of the week
A new survey has found that most Americans trust special counsel Robert Mueller’s investigation into Russian involvement in the 2016 election — although opinion is sharply split along partisan lines. Yet Mueller still receives higher marks than 1990s independent counsel Ken Starr, who faced a similar partisan divide. If party loyalty hasn’t changed in the past 20 years, what has? The views of independent voters.
According to a Washington Post-Schar School poll released this week, 51 percent of adults approve of the way Mueller is handling the investigation, while 34 percent disapprove. Similarly, 57 percent think Mueller is mostly interested in uncovering the truth, while 36 percent think he’s out to hurt President Trump politically. By contrast, a majority of Americans thought Starr was mainly interested in hurting then-President Bill Clinton politically in the Whitewater investigation.
During both the Starr and Mueller probes, members of the president’s party were convinced that the investigators had the knives out for their president, and members of the opposition party believed the investigators had noble intentions. Since the partisan divides are similar in both cases, independent voters are the main drivers behind the difference in overall public opinion. In 1998, as the Whitewater investigation was wrapping up, 59 percent of independents told the Post that they thought Starr’s investigation was politically motivated. This year, 57 percent said they have faith in Mueller.
The poll also suggests that independents may be the deciding factor in whether the public supports Trump’s impeachment, if it comes to that. Per the Post poll, if Mueller’s report finds that Trump obstructed justice by trying to undermine the Russia investigation, Americans believe — 65 percent to 29 percent — that Congress should impeach Trump and try to remove him from office.1 And if the report concludes that Trump authorized his campaign staff to collude with Russia, Americans support impeachment and attempted removal by a similar margin: 61 percent to 33 percent.
Those numbers may seem surprisingly high. But impeachment is a political process and, quite frankly, a partisan one. According to this poll and many others, most Democrats already support beginning impeachment proceedings against Trump — so right off that bat, that’s a sizable chunk of the country in favor. And this poll added a conditional to its question: “If Mueller’s report concludes….” Since independents mostly see Mueller as a fair judge, it makes sense that most of them would support impeachment if Mueller finds grounds for it. And indeed they do, at least in this poll: 61 percent support impeachment if Trump approved coordination with the Russian government, and 68 percent support impeachment if he obstructed justice.
By contrast, independents were not on board with attempts to remove Clinton from office, even after Starr’s report recommended impeachment. A Post/ABC News poll from December 1998 found that three out of four independents said that Clinton should not be removed from office. Most Republicans wanted Clinton removed, while most Democrats wanted him to stay put. Overall, support for removal sat at just 33 percent.
A key difference may have been that Americans, especially independents, were not convinced that Starr had proved his case. The public widely believed that the inclusion of explicit sexual details in the Starr report was inappropriate, and, as previously mentioned, independents did not believe Starr was conducting an impartial investigation. It’s possible that, if the Mueller report is publicly released, people will find his conclusions similarly lacking. But the questions from this week’s poll suggest that the public would believe Mueller if he concludes Trump committed a crime. Of course, that’s a big if; should Mueller stop short of such a declaration, it’s a safe bet that support for impeachment would not be in the 60s.

According to another Washington Post-Schar School poll, 47 percent of Virginians think their governor, Democrat Ralph Northam, should resign in the wake of the revelation that there is a racist photo on his page in his 1984 medical school yearbook. Another 47 percent said Northam should remain in office. Northam originally apologized and said he was one of the people in the photo (which features one person in blackface and another in a Ku Klux Klan robe). But Northam reversed himself the next day. He currently maintains he was not in the photo but has admitted to wearing blackface on a different occasion.
A poll conducted for The New York Times Upshot by Morning Consult found that 5 percent of U.S. adults admitted to wearing blackface at some point in their lives. Twenty percent said they’d seen someone wearing blackface.
According to a different Morning Consult survey, for Politico, Republicans are more willing than Democrats to vote for a politician from their own party who has been accused of either wearing blackface or committing sexual misconduct. However, committing tax fraud and misusing taxpayer dollars, among some other scandals, were about equally likely to be deal-breakers for members of both parties.
According to a survey by HuffPost/YouGov, 42 percent of Americans think the Democratic Party is too extreme. Forty percent think the Republican Party is too extreme. But in both cases, those people tend to be members of the opposite party; only 12 percent of members of each party find their own party too extreme. And only 11 percent of Americans think both parties are too extreme.
ScottRasmussen.com and HarrisX found that Ruth Bader Ginsburg is the most popular Supreme Court justice, based on the share of registered voters who say they have a “very” or “somewhat” favorable view of her (43 percent). Brett Kavanaugh is the best-known justice — only 9 percent of respondents have never heard of him — but that fame comes at a cost: He also has the highest unfavorable rating of any justice, with 34 percent viewing him in a negative light. Stephen Breyer has the lowest name recognition of any justice; 32 percent said they’ve never heard of him.
Amazon has canceled its plan to build a headquarters in New York City in the face of opposition from residents and some politicians. However, a Siena College poll of registered voters in New York state that was released before Thursday’s announcement found that 56 percent approved of the package of tax incentives that New York used to lure the company, while 36 percent disapproved. In New York City alone, 58 percent approved and 35 percent disapproved.
Trump approval
According to FiveThirtyEight’s presidential approval tracker, 41.5 percent approve of the job Trump is doing as president, while 54.1 percent disapprove (a net approval rating of -12.6 points). At this time last week, 40.1 percent approved and 55.3 percent disapproved (for a net approval rating of -15.2 points). One month ago, Trump had an approval rating of 40.7 percent and a disapproval rating of 54.4 percent, for a net approval rating of -13.7 points.

"This happened in April this year that Rica, who knew the existence of 'in art', told Supect 1 that he wanted to participate. She called out to acquaintances' screenwriters, musicians, and illustrators, and a total of 6 members, including Suspect 1 and the another manager named Suspect 2 will apply. Before sending a project, I had to register the applicant in the city and gets a valid ID. Registration will start by mid-May 2020 but, he/she is needed to fill in the person in-charge to get a valid ID. He applied under the name of 'Video Shooting/Editing'. Rika is a responsible representative. After that, the work was decided to be a recitation drama between Rica and the scriptwriter. By June 2, I made a proposal to the capital and submitted it. I have never come up with any ideas for this project".
TMG reporter told OneNETnews, Rica isn't participating a project which is possibly inflated and a scandalous CoViD19 grant was recieved during the anime hiatus of Pokémon Journeys. Split SCOTUS ruling concludes IRCA does not preempt state prosecution for identify theft for SSN fraud
The Supreme Court handed down a criminal law ruling this morning in Kansas v. Garcia, No. 17-834 (S. Ct. March 3, 2020) (available here), that may ultimately interest federalism fans more than sentencing fans. The majority opinion is authored by Justice Alito, and it starts this way:
Kansas law makes it a crime to commit “identity theft” or engage in fraud to obtain a benefit. Respondents — three aliens who are not authorized to work in this country — were convicted under these provisions for fraudulently using another person’s Social Security number on state and federal tax-withholding forms that they submitted when they obtained employment. The Supreme Court of Kansas held that a provision of the Immigration Reform and Control Act of 1986 (IRCA), 100 Stat. 3359, expressly preempts the Kansas statutes at issue insofar as they provide a basis for these prosecutions. We reject this reading of the provision in question, as well as respondents’ alternative arguments based on implied preemption. We therefore reverse.
Justice Thomas, joined by Justice Gorscuh, concurs in an opinion that starts this way:
I agree that Kansas’ prosecutions and convictions of respondents for identity theft and making false information are not pre-empted by §101(a)(1) of the Immigration Reform and Control Act of 1986, 8 U. S. C. §1324a. I write separately to reiterate my view that we should explicitly abandon our “purposes and objectives” pre-emption jurisprudence.
Justice Breyer filed an opinion concurring in part and dissenting in part joined by Justices Ginsburg, Sotomayor and Kagan:

So here's the question in case you don't want to read my wall of text below (but it would be appreciated if you did to further understand my question). I was covered under my moms health insurance while in college and I was told I needed to be enrolled in school to stay covered, I dropped out a while ago and was wondering if I am still covered by law under the Affordable Care Act since I am only 19. I was covered under my mothers health insurance, she works for a private company and she said that I needed to be enrolled in school in order to stay covered by the insurance. But this was close to a year ago if I'm remembering correctly. The reason I'm worried is because I'm taking a break from college, and have had multiple doctor appointments/tests done after I left, but I never had a problem with the insurance going through. I've made myself paranoid into thinking that the company may just not know, and is assuming I'm still in school and will randomly hit me with the costs of the testings and doctor visits if they saw I was not in school, or god forbid somewhere down the road my mother or I are in a serious accident and are dropped because of this. I know this happens all the time, the insurance agencies have people hired to find abnormalities in your history in an attempt to drop you and not have to pay the bills. So would I still be covered under my mothers health insurance even though I'm not currently enrolled in school under the Affordable Care Act? Once again I am 19 also. Thank you""

I'm looking to get a new motorbike in January and am looking at quotes online. Where it says where is the bike kept overnight I have put: on a public road. Then where it says Address where bike is kept overnight I have put my home address. However I want to take it too uni and that's obviously a different address, but it won't let you have two. Last company auto renewed my policy but i wasnt aware of this as had moved address, so to cancel it I had to pay 133 as id already started going with someone else on top of the initial deposit amount i had to pay for both companies which has took a large chunk of my money for what i feel was no fault of mine, then a month later im getting letters from my current insurance asking me to pay an extra 90 plus 25 admin fee or my policy will be cancelled AGAIN meaning a cancellation fee because when i said i had held my licence for 8 years they recon its 7 ive held it for and this makes my policy go up, thing is i got my licence on 22/08/2003 and took my poliocy out on the 19/08/2011 so they're making out when i took out the policy i only had licence for 7 years for sake of 2 days who the hell wouldnt have said 8 to that? it just seems theyre trying everything now days trawling through all your stuff finding the smallest detail just so they can get money off you or cancellation fees cos that way they're not risking anything on insurance but still gettin money off you for cancellation fees its a joke and I can really see why people think there's no point having insurance anymore. The Statute of Limitations in Professional Malpractice
Accountants and stock-financial advisers are professionals for the purpose of the statute of limitations. For this reason the doctrine of “continuous representation” can apply. Reville v Melvin Ginsberg & Assoc. 2017 NY Slip Op 30821(U) April 20, 2017 Supreme Court, New York County Docket Number: 152167/2015 Judge: Joan M. Kenney gives some explanation on how to calculate the statute of limitations and apply continuous representation.
“In this action sounding in professional negligence, breach of contract, breach of fiduciary
duty, and aiding and abetting fraud, plaintiff Daly Reville (Reville) seeks damages for purported
unlawful conduct by her accounting firm, Melvin Ginsberg & Associates (the firm; or MGA).
Defendant moves for summary judgment, pursuant to CPLR 3212, to dismiss the complaint on
the basis that it is barred by the statute of limitations, lacks merit and is subject to the judicial
policy against double recovery. ”
“CPLR 214 (6) imposes a three-year time limitation period in all professional malpractice
actions, except those involving medical malpractice. In an accounting malpractice action, the
limitations period is measured from the date the client receives the accountant’s advice and/or
work product (Ackerman v Price Waterhouse, 84 NY2d 535, 541-543 [1994]). The statute may
be tolled in accounting malpractice cases pursuant to the continuous representation doctrine (Zaref v Berk & Michaels, 192 AD2d 346 [1st Dept 1993]; Hall & Co. v Steiner & Mondore, 147
AD2d 225 [3d Dept 1989]). Facts supporting the application of the continuous representation
doctrine must be proffered in connection with the “specific matter directly under dispute” and
must assert more than merely “the continuation of a general professional relationship” (Zaref,
192 AD2d at 347-348).
A negligence-based claim, absent fraud, accrues when the malpractice is committed,
even though the injured party may be ignorant of the wrong or injury (Ackerman, 84 NY2d at
541). Plaintiffs action was not commenced until March 4, 2015, well past the three year
limitations period. Consequently, plaintiffs malpractice claim is untimely unless the continuous
representation doctrine serves to toll the three-year limitations period. ”
“Plaintiffs reliance on the Alpert case is misplaced. In Alpert, plaintiffs, Joan and Paul
Alpert, commenced an action against defendant, a certified public accountant, for negligence and
breach of fiduciary duty. Plaintiffs claimed defendant played a role in plaintiffs’ decisions to
invest in eight tax shelters, and in plaintiffs’ responses to tax deficiency notices received from
the Internal Revenue Service (IRS). Defendant denied recommending any investments, denied
preparing tax returns that included the alleged tax benefits, and denied advising against settling
their dispute with the IRS. Defendant asserted that he had been purely plaintiffs’ accountant, not
their financial advisor. The Alpert court found that there was a triable issue on a material
question of fact where Paul Alpert’s deposition revealed that, although he had retained tax
counsel, he would regularly send defendant the mail from the IRS first, and only relay copies to
his tax lawyer if defendant so advised. The court concluded, “[t]here is at least some evidence
that he continued to advise the Al perts on the tax shelter problems.” (Id. at * 5).
In contrast, and directly applicable here, the Court of Appeals, stressed that a “mutual
understanding” between the parties regarding further representation and the “nature and scope of
the parties’ retainer agreement (engagement) play a key role in determining whether continuous representation was contemplated by the parties.” (Williamson v PricewaterhouseCoopers LLP, 9 NY3d 1, 10 [2007], quoting Shumsky v Eisenstein, 96 NY2d 164, 170 [2001] [internal quotation marks omitted]).
Here, plaintiffs allegations do not establish a course of representation as to the particular
problems relating to this transaction that gave rise to the malpractice claim. Furthermore, there
is no written agreement between the parties. The invoices submitted by defendant appear to
contemplate separate and discrete accounting services for each fiscal year, and once the
defendant had performed the services for a particular year, no further work was undertaken
(Vergari reply affirmation, exhibit GG). No corrective or remedial services were offered.
As a result, there was no mutual understanding between the parties that MGA would
provide Reville with any further representation in connection with this alleged unlawful
transaction (see also, Apple Bank for Sav. v PricewaterhouseCoopers, LLP, 23 Misc 3d 1126
[A], 2009 NY Slip Op 50948 [U] [Sup Ct, NY County 2009], revd 70 AD3d 438 [l51 Dept
2010]). “

As was highlighted in a recent article on your website about Michael Simmons and his crooked ways; I wish to let the public of Barbados know that known thief, Michael Simmons was working in the Procurement Department for none other that the 2016 MVP of Naked Departure, Jason Barker – Head Of Procurement.
Michael Simmons was fired from his previous government job (NHC) for….guess what… thiefing. Michael is no fly by night thief, Michael has been stealing from his employers for years. He is very experienced and his specialties include but are not limited to Invoice manipulation, coercion and collusion.
Here is the kicker, when management found out Michael was committing massive fraud in the Procurement Department it was reported to Commissioner Sivers, who then transferred him to another department within the Revenue Authority for him to find other ways of making money by committing fraud.
Jason Barker has been complicit in these fraudulent transactions along with Michael Simmons. While Michael flies under the radar with regards to his everyday living, Jason flaunts his must be laundered cash in expensive watches, clothes, jewelry and the latest and greatest shades. Michael kept his mouth shut when he got found out and they both still have a job.
In some cases the same suppliers are complicit in the frauds, where they submit inflated invoices and give the two a cut back for the work. The suppliers who submit hand written invoices make it that much easier for these two criminals to make their side cash.
Margaret Sivers needs to be fired for not firing Michael Simmons when the facts were brought to her attention about his fraudulent dealings. You simply cannot have a known habitual thief, such as Michael Simmons working in a Company, especially the Central Revenue Collecting Agency, that is the Barbados Revenue Authority.
The Barbados Revenue Authority needs to be audited from top to bottom by a third party, starting with the Procurement Department.
Do you want to know why you haven’t gotten back your income tax return? Or why you haven’t gotten back your VAT returns some in the $100,000s from BRA?
It is because of the incompetence of the managers and the thieving of some of the staff.
