Ryan Russell, Alabama inmate 0000Z774, born 1973, incarceration intake in 2010 at age 37, sentenced to death

Murder

A Shelby County Circuit Judge followed a jury's earlier recommendation and sentenced Ryan Gerald Russell to death for the 2008 slaying of his 11-year-old cousin and ward Katherine Helen Gillespie.

The Judge said he considered the jury's unanimous decision and himself came to the same conclusion that there was no less deserving case for the death penalty than a man with parental control of an 11-year-old girl who he killed.

Joiner said the sentence clearly fit the death penalty test of the crime having the aggravating circumstances of being heinous, atrocious and cruel.

Russell was convicted of capital murder. Trial testimony indicated Russell killed the girl by a gunshot to the back of her head in the house they shared. After shooting her, Russell stuffed her body in a plastic trash can which he placed in the back of his SUV located in the garage.

Russell, wearing an orange jail jumpsuit, was offered the chance to speak before being sentenced but declined. One of his attorneys, Rick Vickers, told the judge the crime didn't meet the tests needed for a death penalty and instead asked the Judge to give Russell life in prison without parole.

Chief Assistant District Attorney Bill Bostick argued justice required the death penalty.

Tim Gillespie, a relative of both Russell and Katherine Gillespie, called the Judge's decision a just sentence and said he only wished it would be carried out sooner.
