Future Of The Supreme Court

Now that Trump has announced his nomination for the Supreme Court, Amy Coney Barrett, we have more information about how the process will work. The Republicans have said they are hoping to finish the confirmation before the election. They have said they will start the hearing on October 12, and hopefully vote by the end of October, cutting it very close to the election.[1]

Amy Coney Barrett, the nominee, has been a favorite of conservatives ever since she was questioned by Senator Feinstein on the basis of her religion possibly getting in the way of her job as a justice. Conservatives, seeing this as an attack on religion and Catholicism, rallied behind her.[2]

What are the chances she will be confirmed? The Republicans can only afford to lose 3 votes, and only 2 Senators, Susan Collins and Lisa Murcowski have said they are not willing to vote to confirm her. That means the Republicans can afford to lose one more vote, and still get her confirmed, assuming the Democrats unanimously vote against her appointment.[1] Although there would be a tie if they lost 3 votes, the Republican Vice President, Mike Pence, could break the tie and would probably vote for her, meaning they could still get her through the process.[3]

What would be the effects of Judge Barrett being appointed? Although she only has three years of history on the courts, we have a good sense of her views we can pull form in order to predict her future actions. Although she sees Roe v. Wade as legal precedent, she has said that she thinks it was decided incorrectly. She also has disagreed with the Supreme Court’s decision to uphold the Affordable Care Act,a controversial healthcare act instituted by the Obama administration.[1]

The Supreme Court just started a new term, with their first case about the appointment of judges to the Supreme Court of Delaware. Delaware law states that its Supreme Court must have two judges from one major political party, and three judges from the other political party, making up five judges in total. This is intended to prevent packing the court with members of one political party. However, this excludes people from any other political party, or Independents, people who are not registered with a party, from being appointed to the state’s Supreme Court.[4]

Because of this, the state of Delaware was sued by John Adams because he was an Independent who was ineligible to be on the Supreme Court because of the rule. Delaware appealed the ruling, which is why it is at the Supreme Court.[4]

Michael McConnel, the lawyer representing Delaware, says that the reason for the exclusion of members of other political parties is to prevent a governor from appointing someone who isn’t of a major party, but is ideologically similar to him or her.[4]

We don’t have a decision yet for this case, but the subject matter is oddly relevant, at a time when there will soon be a partisan battle over the next federal Supreme Court Justice appointed, with each party hoping to appoint someone with certain political viewpoints.
