Kind of a magical day
4/10/2023
Kind of a magical day, a total “the mysteries plan” type day——Jury duty morphed into a possible 3 week trial experience!, Although—the chances of me being chosen are less than infinitesimal.
3 jurors told profound Criminal Justice System failure stories. Two said that they couldn’t be fair in a trial where police would be witnesses because of their past negative interactions with the police.. The 3rd, her eyes welling with tears,  said “The police killed my brother and my son after a high speed chase in Oakland”.
When the judge asked if she could be fair to both sides as a trial juror, she screamed out “The system’s not working!”
I have picked many juries prior to that and had never heard such dramatic  statement’s of hostility towards the police uttered by potential jurors. We potential jurors were asked to return to the jury room. We latter learned that the case settled, probably in part at least to what the 3 potential jurors had said about the police earlier.
First warm day in an ice age, really warm. After leaving jury land, I treadmilled at Valley gym for 36 minutes. On the way home, at the  Palendale and Mc Henery red light, there was a homeless man and his dog. He was flying a sign (asking for help). I gave him $5 and two bottles of sparkling water. As I waited at the light, he drank in the heat. And, as he drank, I healed.
He healed me.
It was the perfect gesture “at”.” At" the callous hardness of the  jury court experience.
The homeless man , a white maybe 35 year old, was blackend from sleeping out side. It’s been  a brutal cold wet stretch out there—But, today it was warm and he and his dog now had water.
Note:
Re: "the mystery’s plan", above, the Inuit Indians have a saying that there are two plans every day: your plan and the mystery’s plan.
I had been a trial lawyer for about 40 years before I was called to jury duty in April of 2023. I have been in many jury trials as a criminal defense attorney during those 40 years. Because I was a criminal defense attorney, it was not likely that the District Attorney would leave me on the criminal case in which I was potential juror.
When we are picking a jury, we ask potential jurors questions to attempt to determine if they could be fair given the facts of the trial. I think that jury selection is the hardest part of trial work. It involves a lot of mind reading and guess work.
I have  passed that light at Palendale and McHenery many times on my way home from Trader Joes or the gym. The homeless man and his dog were there on a little island one lane from the curb many times. If I stopped at the light by them, I’d give the homeless man money and or water. He camped in a grassy area 1/4 mile down Mcherey near rthe road. I would see him there as I drove passed at times.
He may have moved on because I haven’t seen him there for awhile
When I did a lot of work with the homeless in 2017 and 2018, I would say to myself when I handed a bag of food to a homeless person that this gesture was “At” the harshness of society that I had experienced. In other words, instead of retaliating against people who had wronged me , I passed out a bag. I had a healing encounter with the homeless person. In accepting the bag, they healed me. So, my response to hostility, which demanded a response, was a healing gesture, passing out the bags.

This book is blowing my mind and making me sick to my stomach at the same time. It’s describing what I know the practice of law to be, but I lose sight of it in my everyday work. Do I believe in the rule of law? I always thought it to be a means to an end. But is the rule of law an end that I am actually creating?
Does my work actually make the criminal justice system more legitimate and authoritative, as messed up as it is?
My innocent client is being put on trial tomorrow, if the state can even put a trial on (I have my doubts). Our case is clear but I am so nervous. So I’m reading about the big picture. The author only practices civil law though (Stereoscopic Law by Alexander Lian)

When you make a plea offer to the baby-DA... and they turn down your offer with an email citing the "violent" facts of the case and the danger your client poses to the community... and then the baby-DA ends the email with an offer better for your client then the one turned down.

Can't Make the Sick Chicken Better
Can’t Make the Sick Chicken Better
This week was a rough week for appellate outcomes for a few appeals where I wrote the briefs. I learned a long time ago – sometimes you just cannot make the sick chicken better and it sucks for the clients who had less than optimal representation at the trial level or had good appellate issues that the appellate court simply punted on (because they can). Elections have consequences – and this…

Want to sue Your Negligent Doctor?
Well, if you have been a victim of your doctor's negligent act, then, there are many legal remedies that can be availed in order to compensate your losses or to teach him a lesson.
1)Your course of action depends upon the remedies you want to seek. If you want to claim for your damages, you can move to a Consumer court or to a Civil Court and file a suit for Compensation depending upon the circumstances. If the bills are settled you may move to the consumer courts. Consumer Court's are fast track Courts. They serve a quick relief provided you should have ample ammount of evidence with you against the medical practitioners. If the bills are not settled you may approach the Civil Court.
2)If you want your Doctor to get arrested then you can file for an F.I.R against him or the hospital under section 304A ,336 337,338 of Indian PenalCode or . In this case criminal proceedings shall be initiated.
3)If the Medical Negligence of the doctor was really grave then you can also approach the National Medical Council or the State Medical Council and get his license suspended or cancelled even.
4) You can also make a complaint to National Human Rights Commission and hold him on Humanitarian grounds.
Note: Whether the Doctor was Negligent or no will be decided by team of Medical experts because the police (Executive)and Judiciary have no knowledge of Medical procedures and terminologies.Hence the Final authority remains with the MEDICAL EXPERTS.

Attorneys - is there anything as jarring as prepping for trial and constantly concluding "I don't disagree with what this witness has to say" to the point its the whole case? Can't tell you how panic-inducing it is when you think you must be missing something because why are we going to trial if we don't disagree on the facts?

A community event
January 17, 2024
Re: my 1/13/2023 Blog: I can’t save them, but I can buy them coats:   I bought the coats and took them out to Mac and friend.
___________________________________________________________
January 17, 2024. Wednesday 9:09pm
Just drove 2 coats out to MAC. One was XXX size for his friend, who I didn’t meet.
But, I did meet Mike. Mac asked if Mike could use my address to get his mail. I said ok.
Mac said Mike is one of the only guys who won’t steal from him.
End of this part of the entry
Note:
1/22/2024
Mac and Mike are staying out in a strip mall parking lot in South Modesto.
The night I drove out to deliver the coats, I could see maybe 8 other homeless people huddled up against a store wall across the parking lot. It was really cold.
The photos I included with this blog show Mac modeling the coat that I gave him. His coat came from a thrift store and cost $18.
When I arrived , he was wearing a pink girl’s coat. That’s all he had to wear.
He and Mike and I had a good conversation. I gave Mike about $10. I gave Mac enough to buy a faster phone charger plug than one that I previously gave him.
I learned that the phone I had given Mac money to buy had been stolen. He could play his games on that phone. Huge loss, but, taken in stride out there.
The coat that I bought for his friend was new and cost over $100. That’s the only way I knew of to obtain a XXX coat. I told the clerk at the store  where I bought the coat that I needed a coat for a homeless friend. He asked “Are you asking for a donation (of the coat?). I said no.
Why would he ask that? Why would he think that I would not pay for a coat for a homeless man?
I told him no, that I would pay. I told him that I was concerned that the coat would be stolen out there. I told him about Mac. He asked how long I’d known him? Me  “Since 2010” and that Mac became homeless in part because of drug addiction. We talked about drug addiction and how the gym can be the cure.
In the end , re: homelessness he said “We each take our own path”.
So, buying the coat for Mac’s homeless friend opened a pathway of discussion about homelessness in the clothing store. It became a community event.
