So, yeah, the last post to this Tumblr was ages ago, when I excitedly bought tickets to Worlds 2020, which was originally going to happen in Toronto (and, I gather, might happen again in 2021, if the world is calmed down enough by then). I didn’t play a single face-to-face game of Netrunner in 2020, and only a handful of online games. But recently, I’ve found myself coming back to it.

The screenshot above is from my first game in the Green Level Clearance Discord’s latest Retrunner tournament. We’re starting with 3x original core sets (with 3x Astros allowed) and I’m playing HB: Engineering the Future and Gabe. Check out my sweet mulligan — I started off with, I think, two ABTs, some money, a Biotic, and a piece of ice and thought I could do better. Mulliganing into three Priority Requisitions with no ice was pretty hilarious. I’m proud that I managed to score one of those out before losing the game. (I won the flip side; Runner is definitely overpowered in original core).

It’s fun to reengage with this game, and I think it’s fun because I’m mostly ignoring NISEI Standard for the moment. I enjoyed watching the recent Throwback tournament for Canadian hemophilia research, and love the idea of the recent Salvaged Memories revival of a bunch of old, rotated cards (Parasite! Scorched Earth! E3 Feedback Implants! SanSan City Grid! Indexing! Subliminal Messaging!) but there’s still so much 419, Hoshiko, Earth Station, RP, yawn in the game. I’ll stick to revisiting the glorious past of the game for now.

Anyway, perhaps I’ll try to post to this little blog again, if just to go down memory lane and show off some of the cool stuff I used to collect and make with regards to this game. I’m also down for a game of any format — Retrunner, Eternal, Standard, whatever — so hit me up on the GLC Discord if you’re reading this and interested. - ̗̀  alright, hey everyone !  nine years later and ya girl is finally posting an intro. before we actually get to talking about my baby jaide though, here’s a tiny bit about lil ol’ me !  for starters, my name is stormi. i just turned twenty-two (  team virgo haaaa ), i use she/her pronouns and i’m pretty much always stressed (  more lately than usual hence the need to join a group ). with that said though, i haven’t been in a tumblr rp in a minute so please excuse any trash i may leave behind. anyway, moving on !  let’s get on with the actual intro now.

GLC is always referring to HER as the TALISMAN. the last story they did on HER was about THE SEXTAPE THAT LEAKED OF HER AND HER EX, but they’d have a field day if they knew that SHE HAD NO IDEA SHE WAS BEING FILMED.  i hope no one finds out because crowned just might drop any artist with too much drama.

her name is jaide henderson, otherwise known as ‘jaide’ or jaide hendrix to the public, and she was born in august of 1996. she was raised by her dad in a two bedroom house and despite being the sole care taker of four girls, he managed to make it work. they didn’t have everything but they weren’t unhappy either and as soon as they were allowed, all four girls started working to help out.

her relationship with her mom has always been rocky at the very best. they’ve had conversations throughout the years and there were times that jaide thought they might actually be able to form a proper relationship but she was let down each time. she still tries every once in a while to reach out but she’s finally coming to the conclusion that her mom doesn’t care about her.

jaide has always held an interest in music so it wasn’t uncommon to hear her singing around the house or at family parties and what not (she even sang at her high school graduation). she knew from a very young age that she wanted to sing for a living and while the process wasn’t easy, she ended up getting signed when she was seventeen. she has always said she was lucky in terms of creativity and what not because she has always been allowed to say what she wants on her records, even when she was still a teenager.

throughout the years, she’s learned how to produce her own music and has her own studio at home but she still spends a lot of time in an actual studio. she’s pretty musically inclined and takes super seriously because it’s all she’s ever wanted to do.

around the time she was signed, she got into a relationship with someone she later found out had been using her. jaide is normally a very intuitive person and she’s good at reading people but she blames her naivety on the fact that she had never had a relationship beforehand. anyway even after they broke up, her ex kept using her name like she should be thankful for him (which she shouldn’t be at all cause he didn’t help her career in the slightest). 

he tried to blackmail her into getting back with him multiple times but she was always like ‘you have nothing on me.’ that statement should’ve been true but without even realizing it, he had been recording them the last time they slept together and after getting tired of her saying no to him, he posted the recording online.

she’s been real quiet since what with little to no music coming out, no appearances or performances and no meet and greets but she’s slowly getting back to normal. her team was able to get the video pulled off the internet (although it was entirely too late considering tons of people had already watched it) and there has even been an investigation to prove who posted it so she feels like she’s able to get back to her regular life.

personality wise, jaide is a generally good person. she’s not the nicest in the world but she’s also never unnecessarily rude to anyone and will only say something negative if you say something first. she’s very strong minded (stubborn just say stubborn) and she’s a perfectionist x10 so everything she does has to be very well planned out. while she isn’t a people person, jaide finds it easy to communicate with others. she’s very playful and loves to do things like skydiving or even just random road trips. jaide takes pride in the fact that she knows a lot about her history and what’s going on now and considers herself an educated person. she likes to educate others in a way that doesn’t seem condescending cause she knows how annoying it can be.

Insolvency process can continue despite assets of corporate debtor being attached by ED

NCLT delivers first impression in India 

The National Company Law Tribunal (NCLT), Hyderabad Bench, has delivered an important ruling impacting several ongoing tussles between the PMLA and the IBC and clarified that the Corporate Insolvency Resolution Process (CIRP) under the IBC can continue despite the attachment of the Corporate Debtor assets by the Enforcement Directorate. This is a case of first impression in India. 

In the high-profile insolvency of Leo Meridian Resorts, Hyderabad, the Applicant moved the NCLT (IA No. 323 of 2020 in CP(IB) No. 43/7/HDB/2018) and sought clarity on this very issue. The Applicant contended that despite the attachment by the ED, if the NCLT felt it necessary to allow some other applications that sought extension of time in the CIRP, then by inference, the CIRP can continue despite the attachment.

Further, the PMLA and the IBC were dealing with different aspects of infractions committed by the Management and the Corporate Debtor respectively, and that the proceedings under the IBC should be allowed to be run in parallel with the attachment, and the eventual resolution may be subject to such attachment. 

The ED opposed this application quoting that any relief related to the attachment issue must be agitated before the correct forum (PMLA) and not by seeking clarity from the NCLT itself.

The NCLT held that “The attachment does not prohibit in any way, the CIRP to continue”, “We make it clear that the CIRP to be continued as per the provisions of the Code and attachment over the assets of Corporate Debtor effected by the Enforcement Directorate is not at all an impediment to continue the CIRP against the Corporate Debtor.” 

With the ED attaching the assets of many Corporate Debtors under insolvency, the most recent high-profile case being that of Bhushan Power & Steel Ltd, there was a lingering question all across India on whether the CIRP must be stopped/be suspended in light of the ED attachments. With this order, there is now clarity that as long as the prospective Resolution Applicants are notified of an ED attachment, the CIRP of the Corporate Debtor may continue despite the attachment. 

The case for the Applicant Resolution Professional was argued by Counsel Krishna Grandhi of GLC & Partners, and the ED was represented by the Central Government Counsel Anjali Agarwal.

Counsel for the Applicant Resolution Professional Krishna Grandhi commented “Essentially, the Hon’ble Tribunal held that as long as the prospective Resolution Applicants are made aware of the attachment, and they still choose to submit their resolution plans despite the attachment, then the IBC proceedings can be continued. The attachment under the PMLA is not an impediment to continue the CIRP of the Corporate Debtor.”

Background of the judgment 

Under the Insolvency & Bankruptcy Code, 2016 (IBC), creditors or companies move insolvency petitions with NCLT. The NCLT, if it accepts the insolvency petition, initiates the Corporate Insolvency Resolution Process (“CIRP”) and appoints an Resolution Professional (RP) to run the affairs of the company for the duration of the CIRP proceedings under the guidance of the Committee of Creditors (CoC).

The RP thereafter, through some procedural formalities, invites prospective Resolution Applicants (RAs) to submit their bids for the resolution of the company. Typically, the RAs submit the bids to take over the Corporate Debtor as a going-concern. If an RAs bid is successful, their bid amount will be distributed amongst the various stakeholders of the corporate debtor under a pre-determined formula, post the payment of which, all liabilities of the corporate debtor stand extinguished. 

The dichotomy between the IBC and other laws has been tested since the beginning of the IBC’s implementation. There have been several Supreme Court and NCLAT (the appellate body over NCLTs) decisions that went into great detail on whether or not IBCs provisions take supremacy over other laws of the land, some general laws and some specialized ones. One such issue that has constantly reared its head is the interplay between the Prevention of Money Laundering Act, 2002 (PMLA) and the IBC.

While IBC proceedings are underway for the Corporate Debtor, there are parallel criminal investigations into the management personnel of the Corporate Debtor run by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED).

When ED proceedings are conducted, as one of the first steps, there is an attachment of the Corporate Debtor assets under the PMLA. This has led to a quandary under IBC. On one hand, the assets of the Corporate Debtor are “attached” by the ED under the PMLA, and on the other hand, the same assets are being put up for “resolution” by the RP and the CoC. The question, naturally, that has arisen in many minds is whether the RP and the CoC are even permitted to continue with the process of resolution under the IBC once the ED attaches the assets of the Corporate Debtor.

At last, in this ongoing tussle between the PMLA and the IBC, there appears to be some clarity on the progress of IBC proceedings in light of attachments under PMLA.
