What are the Laws Around Flying with CBD Products?

While CBD products are legal in 41 of the 50 states as of the writing of this in 2022. The 0nly states yet to legalize CBD products are: Tennessee, South Dakota, North Dakota, Indiana, Mississippi, Kentucky, Kansas, North Carolina and South Carolina. This means that the full country of the United States has not federally legalized CBD. It’s important to pay attention to legalities and regions when it comes to traveling with your CBD products, especially if you’re flying.

CBD & TSA

In the United States, CBD products have 0.3% THC. The short answer is that you can fly with CBD products, but you have to be aware of regulations. TSA requires that all liquids such as oils and creams cannot exceed the amount of 3 ounces when brought as a carry-on item. If it is more than that, the item will either be discarded at security or needs to be checked. You can visit and even print out the TSA’s “What Can I Bring?” from with you to the airport.

According to the TSA, as long as the CBD product comes from a legal source and is FDA-approved, it is fine to travel with. This is due to the fact that CBD products that follow FDA regulations are under strict guides as to what they contain, and are generally deemed as safe. This does not guarantee that the TSA will not stop you or inspect your product. It is up to their discretion as to whether or not they feel it is necessary to inspect CBD products, so be prepared but also know your rights.

What Can You Bring?

As detailed above, it is safe to bring all forms of legal CBD products. It is best to keep your CBD products in their original packaging so you can prove they came from a legal source and are FDA-approved with their levels of efficacy. It is safe to bring the following (again, be mindful of the size of items if it is a cream or liquid):

CBD For Travel Stress

Many people get anxiety when it comes to flying. Having CBD products at the ready can help to quell a lot of these nerves, and this may be why you would want to bring your items with you. Regardless of the legality of CBD in the state you are visiting, know that you are allowed to travel with your FDA-approved CBD products. When it comes to international travel, however, the regulations and laws will vary depending on the location you’re traveling to. For example, while Canada legalized cannabis back in 2018, at present it is illegal to cross the border with cannabis products of any kind. The same goes if you’re traveling to the EU. While you can purchase cannabis freely in certain countries, you may not cross the border with it (yes, even the Netherlands).

Traveling Safe

When it comes to traveling with your CBD products domestically within the U.S., you are safe as long as your products are FDA-approved. If you’re traveling out of the country, it’s best to leave it at home. If you’re in a pinch, take your CBD products before you go to the airport so you don’t have to worry about traveling with your items and having them confiscated and discarded. If you are traveling to Canada or the EU and are worried about being without your products, simply find a local cannabis shop to purchase CBD upon your arrival.
