Big Tech steals from news, but what it steals isn’t content. Talking about the news isn’t theft, and neither is linking to it, or excerpting it. But stealing money? That’s definitely theft.
Big Tech steals money from the news media. 51% of every ad-dollar is claimed by a tech intermediary, a middleman that squats on a chokepoint between advertisers and publishers. Two companies — Google and Meta — dominate this sector, and both of these companies are “full-stack” — which is cutesy techspeak for “vertical monopoly.”
Here’s what that means: when an advertiser wants to place an ad, it contracts with the “demand-side platform” (DSP) to seek out a chance to put an ad in front of a user based on nonconsensually gathered surveillance data about a potential customer.
The DSP contacts an ad-exchange — a marketplace where advertisers bid against each other to cram their ads into the eyeballs of a user based on surveillance data matches.
The ad-exchange receives a constant stream of chances to place ads. This stream is generated by the “supply-side platform” (SSP), a service that represents publishers who want to sell ads.
Meta/Facebook and Google both the “full stack” of ads: they represent buyers and sellers, and they operate the marketplace. When the sale closes, Googbook collects a commission from the advertiser, another from the publisher, and a fee for running the market. And of course, Google and Facebook are both publishers and advertisers.
This is like a stock exchange where one company operates the exchange, while serving as broker and underwriter for every stock bought or sold, while owning huge amounts of stock in many of the listed companies as well as owning the largest companies on the exchange outright.
It’s like a realtor representing the buyer and the seller, while buying and selling millions of homes for its own purposes, bidding against its buyers and also undercutting its sellers, in an opaque auction that only it can see.
It’s a single lawyer representing both parties in a divorce, while serving as judge in divorce court, while trying to match one of the divorcing parties on Tinder.
It’s incredibly dirty. These companies gobble up the majority of every ad dollar in commissions and other junk fees, and they say it’s because they’re just really danged good at buying and selling ads. Forgive me if I sound cynical, but I think it’s a lot more likely that they’re good at cheating.
We could try to make them stop cheating with a bunch of rules about how a company with this kind of gross conflict of interest should conduct itself. But enforcing those rules would be hard — merely detecting cheating would be hard. A simpler — and more effective — approach is to simply remove the conflict of interest.
Writing on EFF’s Deeplinks blog this week, I explain how the AMERICA Act — introduced by Senator Mike Lee, with bipartisan cosponsors from Elizabeth Warren to Ted Cruz (!) — can do just that:

The AMERICA Act would require the largest ad-tech companies to sell off two of their three ad-tech divisions — they could be a buyer’s agent, a seller’s agent or a marketplace — but not all three (not even two!). This is in keeping with a well-established principle in antitrust law: “structural separation,” the idea that a company can be a platform owner, or a platform user, but not both.
In the heyday of structural separation, railroad companies were banned from running freight companies that competed with the firms that shipped freight on their rails. Likewise, banks were banned from owning companies that competed with the businesses they loaned money to. Structural separation acknowledges that some conflicts of interest are so consequential and so hard to police that they shouldn’t exist at all. A judge won’t hear a case if they know one of the litigants — and certainly not if they have a financial stake in the outcome of the case.
The ad-tech duopoly controls a massive slice of the ad market, and holds in its hands the destiny of much of the news and other media we enjoy and rely on. Under the AMERICA Act’s structural separation rule, the obvious, glaring conflicts of interest that dominate big ad-tech companies would be abolished.
The AMERICA Act also regulates smaller ad-tech platforms. Companies with $5–20b in turnover would have a duty to “act in the best interests of their customers, including by making the best execution for bids on ads,” and maintain transparent systems that are designed to facilitate third-party auditing. If a single company operated brokerages serving both buyers and sellers, it would need to create firewalls between both sides of the business, and would face stiff penalties for failures to uphold their customers’ interests.

But their bills are astronomical. Just the upkeeping on the house alone, housekeepers, nannies, gardeners, cooks, repairs is costing them a few hundred thousand a month. Then there's the mortgage which costs another few hundred thousand. She's spending millions on PR even after getting dropped for being $2million in debt to Sunshine Sachs. The awards she's bought haven't come cheap either. The Gracie award is picking up clout on podcast land. But she has no projects at play that are actually generating money. She may be scrambling around trying to make an Archetypes 2, but she's not gonna get enough big names to interview and her name on its own sends people running for the hills. Spotify has yet to pick up another season though she's buying those awards to pitch hard. She has no source of future income (other than child support) and she's hustling. This is to say nothing of her legal fees, her personal assistants, her publicists, her agents, and (underpaying) the assholes she's got mailing out Starbucks cards at Archewell. I'm sure Doria's services don't come cheap either.  I mean, a bunch of nothing isn't going to do itself. I personally think Doria blackmails her daughter by threatening to tell the truth about who she is and how she didn't grow up like a black girl from Compton, but instead had a more privileged upbring that 80% of US citizens, regardless of their color. Doria also probably knows Meghan's shadiest and most sordid maneuvers to get where she is.  Doria stays silent in the background, but she's got stories to tell. And one wrong move from Meg, and they WON'T be the stories singing Meg's praises.  That's my theory anyway.
I also believe that I was right in December when I said Netflix is done with Meghan. The last thing left on their roster is The Heart of Invictus set to come out this summer, but I've heard it's being edited to focus on the athletes and occasionally Harry.  I've even heard that they may trash a lot of last year's footage, wait until this year's Düsseldorf games, and film those, Harry's-Wife-Free.  NF was reportedly unhappy with how the games suddenly focused on the ILBW, how she commandeered things, taking attention from the athletes and Harry, who's cause this is.
Remember that ridiculous kiss between her and Not-the-Heiry, and all her prancing around in couture (which she supposedly at least tried to bill to them) instead of wearing the standard issue festive polo and khakis/jeans, Well Netflix supposedly does and they supposedly don't like it. I always think of her sashaying around in Valentino while everyone else wore the Invictus clothing. It's such a stark comparison to how the other Royals function.
One of my favorite pictures of Wills and Kate is at the London Olympics. They're both wearing the clothing made for Olympics viewers, and in a rare show of affection, they are grabbing each other and smiling from ear to ear while staring downfield  cheering Team Great Britain.  They aren't eye fucking the cameras. They aren't wearing rictus grins and inserting themselves into ceremonies and celebrations where they don't belong. They're embracing, but their focus isn't on trying to make everyone believe how in love they are; their focus is on the games even as they embrace each other! They're dressed in their team colors focusing on THEIR TEAM.  The result is one of the best pictures of them I've ever seen. The soon-to-be-ex Mrs.Mountbatten Windsor looks like a fool at everything she does because she refuses to accept it's not about her. She can scream at, abuse, and gaslight Harry all she wants to, blaming their status as the laughingstock of the world on him, but she's the one who looks ridiculous and unlike Harry, she's the one running around looking ridiculous wearing a million dollar wardrobe.  I wish she'd get a clue but she's a narcissist, and she never will.

Lockwood & Co: the Impact of Society
I've been really wanting to write character analyses about the L&Co characters, but I think that first I have to recognize the impact of the world they live in. Because we can't really judge their actions & choices by what our own would have been at that age or in that situation; it's truly a different world. Here's what we know, and what I think it means.
-The Problem started around 50 years before the start of the series (roughly 1960s for the books and 1970s for the show).
-The Problem started in Kent and spread outward. Kent (I looked it up on a map) is in southeast England. So it can be assumed it spread through London much earlier than it reached northern England, where Lucy is from. Still, for the children in our story, it is widespread & has always been a part of their reality.

-The Problem resulted in many unexplained deaths, which caused fear, panic, and rioting. There was a pivot in R&D away from consumer tech and into ways to guard against deadly ghosts. There was an economic crash; even if tech is being developed in other countries, England doesn't have the buying power to trade for it. A curfew was placed on adults to keep them in after dark, further cutting into the economy.
-Burial practices had to change. It was no longer safe for people to visit the graves of their loved ones, to show respect for them in the way we accept doing so now. Graveyards were closed off, ringed in iron fencing, etc. This one is huge, to me. We learn so much about cultures by their funeral rights. What does it mean when the dead have to be swept away and ignored, forgotten, feared, avoided? With the loss of that memento mori, what impact does that have on one's respect for their own life or its impact & importance?
-Children, as virtually the last defense against ghosts, see a huge shift in their treatment. In the books, kids can start training as agents at the age of eight. This means that around what would be in the US grade 2, kids quit formal schooling. Now I admit I don't know much about how schooling works in England, but in the US, 2nd grade is when kids learn to comprehend text at the paragraph level independently, and longer texts with support from adults. They learn time and money, how to add and subtract multi-digit numbers and solve word problems, etc. Kids at this age are still mostly only able to comprehend literally; they won't learn how to make inferences until later. Imagine stopping your formal education at this point. I doubt the agencies take the time to teach them literature, social studies, and the natural sciences, except how those things interact with ghost hunting and psychical investigation. This will create entire generations of what are essentially child soldiers without critical thinking skills, who at some point will lose their Talents and also have no education to fall back upon, assuming they LIVE to adulthood. The depth and breadth of their knowledge will be whatever they learn researching a specific case, creating snippets of knowledge that aren't ever integrated into a whole except by kids who are independently able to do so.

-Adults both respect and resent child agents and night watch. They appreciate the service these children provide, but hate what it represents. As they tuck themselves into their protected houses, the child laborers are sent out into the night, rarely seeing sunlight. The more Talented ones get rapiers and flare. The less Talented get an iron tipped wooden staff. They are all cannon fodder and the last hope of survival. And at the point that our story starts, they are losing the war.

May 12 - Dracula 2023
Let me start with facts – the things I know can be verified through other sources and physical evidence. I can’t confuse them with subjective experiences, or my feelings about them. Eyewitnesses are well known for being the worst form of evidence, and I can’t assume that’s not true for me, as well.
Last evening’s meeting with the Count began with his asking of all sorts of legal and business questions. I had spent the time I’d been awake thus far going over books, just trying to keep my mind occupied, reviewing some of the information tested during my SQE. I tried to put everything he asked down in order, since there seemed to be a method to it all.
First, he asked if a man in England may have two solicitors or more. I told him that he could have a dozen or more if he really wanted. Someone having a whole team and a half of lawyers is far from unheard of these days, after all. I did warn him, that it’s a good idea to only have one solicitor engaged in one transaction at the same time, though, and changing from one to another in the middle of one is a whole production, and probably not to his interests unless gross incompetence is involved.
He understood well, and asked if there would be any difficulty with having one involved in banking, and another in shipping, in case something happened far from the banking solicitor. I encouraged him to give me an example so I wouldn’t give him the wrong information.
He said, “I shall illustrate. Your friend and mine, Mr. Peter Hawkins, from under the shadow of your beautiful cathedral at Exeter, which is far from London, buys for me through your good self my place at London. Good! Now here let me say frankly, lest you should think it strange that I have sought the services of one so far off from London instead of some one resident there, that my motive was that no local interest might be served save my wish only; and as one of London residence might, perhaps, have some purpose of himself or friend to serve, I went thus afield to seek my agent, whose labours should be only to my interest. Now, suppose I, who have much of affairs, wish to ship goods, say, to Newcastle, or Durham, or Harwich, or Dover, might it not be that it could with more ease be done by consigning to one in these ports?”
I answered that he could, but we have a system of agency for one another, so local work can be done at the behest of any solicitor. The system was meant to make it both easier and more efficient for the client.
“But I could be at liberty to direct myself. Is it not so?” he asked.
“Ah. Yes, it’s common for self-reliant businessmen who don’t wish any one group of people know their business.”
“Good!” he said. He went on to question me about consignments, the forms he’d need to fill out, and the whole spectrum of potential issues and pitfalls. I did my best to explain, and it seemed like there wasn’t a single scenario he didn’t think of. Once satisfied, with all his concerns addressed, and me heading to the somewhat outdated law books to confirm it as much as I could, he suddenly stood and said, “Have you written since your first letter to our friend Mr. Peter Hawkins, or to any other?”
I told him in vague terms that I hadn’t had any chance to communicate with anyone outside. I did my best not to let the bitterness show on my face.
“Then write now, my young friend.” His hand rested heavily on my shoulder as he spoke. “Write to our friend and to any other; and say, if it will please you, that you shall stay with me until a month from now.”
My face stilled, the only way to school my expression. “Is that how long I’ll be staying?”
“Yes. I desire it much; nay, I will take no refusal. When your master, employer, what you will, engaged that someone should come on his behalf, it was understood that my needs only were to be consulted. I have not stinted. Is it not so?”
“Ah yes. Of course.” My head bowed. What could I say, but yes? I am a prisoner, as I’ve said. My refusal would not unlock the castle’s doors. The way his presence bore down on me was a striking reminder of that. He knew my acquiescence was his victory and that he was fully the master of the situation, and used it as soon as he saw it.
“I pray you, my good young friend, that you will not discourse of things other than business in your letters. It will doubtless please your friends to know that you are well, and that you look forward to getting home to them. Is it not so?” As he spoke, he slid across the table three sheets of notepaper and three envelopes. The envelopes were of thin, plain paper with no print on the inside. Glancing to the side, he had a calm smile that just happened to make the points of those canines very noticeable. I got the message – careful what you right, because I can and will read all of it. I will right formal notes for now… I may try to get more detailed information out in secret.
Once I was done, I read a book while the Count wrote several letters of his own, referring to a few books on his desk as he went. He took my letters then and placed all of them together. He got up to put away his writing materials, and the instant the door closed, I went over and looked at his letters. This isn’t something I would do to anyone, normally, but information meant all the difference under the circumstances. They were addressed to Samuel F. Billington, No. 7, The Crescent, Whitby, another to Herr Leutner, Varna; the third was to Coutts & Co., London, and the fourth to Herren Klopstock & Billreuth, bankers, Budapest. The third and fourth weren’t sealed, but I heard the door handle move, and had to hurry back to my seat and resume my book.
He brought in yet another letter, and carefully sealed and stamped everything. Then he turned to me and said, ““I trust you will forgive me, but I have much work to do in private this evening. You will, I hope, find all things as you wish.” He paused at the door and added, “Let me advise you, my dear young friend—nay, let me warn you with all seriousness, that should you leave these rooms you will not by any chance go to sleep in any other part of the castle. It is old, and has many memories, and there are bad dreams for those who sleep unwisely. Be warned! Should sleep now or ever overcome you, or be like to do, then haste to your own chamber or to these rooms, for your rest will then be safe. But if you be not careful in this respect, then…” He made a motion of washing his hands. Ah. If I do, it won’t be his problem. I don’t doubt what he says. I don’t know what possible nightmare I could compare to my waking life and not have it seem pleasant.
Later – I stand by what I wrote, but there is absolutely no doubt now. I will be happy to sleep anywhere he isn’t, at this point. I placed the crucifix over the head of my bed. Any protection from my dreams after this would be a blessing.
When he left my room, I went out to the stair, to where I found that window looking out south. There was a sense of freedom in the vista, a reminder that there is the rest of the world out there, compared to the courtyard view, where the remains of my phone had disappeared at some point. I needed the fresh air, too – it’s like a prison in becoming slowly claustrophobic, as well. Or maybe it was the late night that did that? I’m not a night owl, and these long night hours are wearing at my nerves. I’m jumpy, and I keep imagining horrible things. God know it’s a well deserved thought pattern. I didn’t know how right I was about this place being a nightmares. I was looking out over the valley – it was a gorgeous night, with the moon so big and bright it almost felt like daylight. It bathed the hills in soft yellow light, and the shadowed areas almost seemed like voids in their blackness. The fresh air and the vista helped calm me. I leaned forward to get a deep breath and glanced down and too the left, where I had to imagine the Count’s rooms were, and caught something moving.
I hid a little back and looked down as hidden as could be done under the circumstances. I saw the Count leaning his head out much like I had. I couldn’t see his face from above, but I could tell by his head and hands. I had also not seen anyone else here, so it seemed like the reasonable conclusion. It seemed kind of interesting at first because as it turns out, besides the stressful games of verbal cat and mouse, being a prisoner is very boring. But then he kept moving out… and out, his whole body, and start to scale the walls face down, like a lizard or a spider. His cloak spread out around him like great wings. I wondered if it was some kind of bizarre tree shadow I had mistaken out of tiredness, but another look told me it was no mistake. His fingers and toes grasped the corners of the stones, and he moved with some speed down the wall.
What on earth am I dealing with in this place? I can feel terror taking hold and there’s no way of getting away from it… I’m trapped and surrounded by horrors.
(A/N: If Jonathan seems a little more snarky than in canon, it’s because I’m trying to think in terms of a post-1990s culture. We’re pretty steeped in irony and afraid of sincerity. He’s not too deep into it, because Jonathan was always remarkably emotional and still is here, and is very sincere. Stress is also getting to him. No idea what that’s like. >_> I did want to reassure that I have thought about it, so it wasn’t just my own writing voice sneaking in (tho its prob also that).
I’m also making an effort to write more in the active voice. Besides sounding a little more modern, it’s good practice for my original writing.
In the line about how not wanting any one person to know their business, Jon absolutely sounds like he’s describing white collar criminals or the mob. He is very aware of this fact, but he was trying to be factual and didn’t add it.

A Death in Peking investigates the cold case of the brutal murder of Pamela Werner in 1937 using primary source material un-examined.
Born and raised in London, Graeme Sheppard is a retired police officer with thirty years’ service with the Metropolitan Police and in the Northeast of England.
With commendations for crime detection, his policing experience includes working areas as wide-ranging as London’s West End to former coal-mining towns, from rural villages to inner-city housing estates.
His enthusiasm for history and a sharp eye for telling evidence has resulted in articles in History Today. Other interests include paleoanthropology, physical fitness, and playing the classical guitar. He now lives and writes in Hampshire, UK.

China-underground: Who was Pamela Werner?
Graeme Sheppard: Pamela was the nineteen-year-old adoptive daughter of the retired British consul, E.T.C. Werner.
She was found murdered one freezing morning in January 1937 in a ditch under Peking’s old city-wall, only a few hundred yards from her home.
The previous evening she had gone skating with friends at an ice rink in the nearby Legation Quarter. From this safe and gated area, she had set-off alone into the dark on her bicycle. She was not seen alive again.
Not only had she been raped and her body mutilated beyond recognition, but, most mysteriously, her heart had been stolen. It had been cut from her chest.
In a joint effort, the British and Chinese police spent months investigating the crime. But without a result.
The case remained unsolved.
After which her father began his own lengthy enquiry, resulting in him openly accusing several of Peking’s foreign residents of the crime.
How did you discover the story of Pamela Werner?
Like most police officers I generally don’t read about crime in my spare time (the job exposes you to more than enough of it).
But my wife’s grandfather was a consul in Peking at the time of the murder and then coroner in the case, so at her request, I reluctantly agreed to read Midnight in Peking, a 2011 account of the crime.
Prior to that, I had not heard of the case. Though the book was a good read, I wasn’t convinced by its conclusions.
I could not conceive how the elderly victim’s father had succeeded incorrectly identifying killers still living openly in Peking, while the British and Chinese police had failed.
Something, I realized, was very wrong. It roused my curiosity.
Was it difficult to find the research material? Where did you start from?
I began by looking up Midnight in Peking’s principal source: ETC Werner’s many letters to the Foreign Office, now stored in the UK National Archives in London.
It became immediately apparent that the letters were written by a man possessing a very peculiar mind.
ETC Werner was in no way objective. He also had a long history of making unfounded allegations and problems with the truth.
Instead of seeing where the evidence led, he decided first upon the guilt of an American dentist, a former US Marine, and an Italian embassy doctor – i.e. men fitting his preconceived ideas.
He then paid Chinese agents to find evidence that supported his assumptions. Unsurprisingly, he found witnesses willing to provide or alter testimony to whatever was required.
It was an elementary mistake.
Werner also made many wild allegations: that up to ten people were involved in the crime, including three doctors; that a hospital ambulance could have been used to move the body from place to place; that the senior Chinese police officer was a sexual deviant and in league with the murderers.
“Maniacally quarrelsome”, “morbidly suspicious” and “completely mad” was how Werner was described by those who knew him well.
None of this appeared in Midnight in Peking.
By this point, I was hooked on the case. What, I wondered, really happened back in 1937? Where did the police investigation take them? What could still be discovered today?
So I looked further – a great deal further.
A search of the UK National Archives alone uncovered two previously unrevealed murder theories in the Werner case.
One involved a senior diplomat at the British Embassy. The source of the other – involving the Japanese and political assassination – was no less than Sir Edmund Backhouse (the subject of Hugh Trevor-Roper’s biography Hermit of Peking), probably the most controversial and mysterious characters in China during the period.
My approach to the case was as though conducting a police investigation; searching for evidence far and wide.
Perseverance was the key; leave no stone unturned. Peking’s international community created an international trail of documents from as far as the USA to Australia, from China to Italy, from Canada to Singapore: letters about the murder between diplomats; notes and memoirs; newspaper articles; military personnel records; church missionary documents; secret reports of espionage.
I even managed to find and speak with people Pamela had lived with just prior to her death – children she had shared a home with eighty years before. There was so much more to the crime that had ever been made public.

Why was she brutally murdered?
My list of suspects grew to at least nine.
A Death in Peking examines the case against each one. Some are easily dismissed, others less so.
But only one stands out as the likely offender.
It was an odd combination of the contributions of Backhouse and British Chief Inspector Richard Dennis that pointed the way for me; Pamela’s murderer was no stranger to her, but a young Chinese friend, one who formed part of her adolescent past.
The crime was driven by a combination of frustrated sexual desire and years of resentment.
The book also describes how the removal of the victim’s heart is explained by Chinese cultural practices of longstanding. E.T.C. Werner’s murder theories were very wide of the mark.
What was the social environment in which Pamela Werner was moving? What was the cultural atmosphere of the foreigners’ community in Beijing?
Pamela’s Peking was a very different place to the Beijing of today.
Imperial China vanished in 1912. Communist rule was yet to come.
It was period now almost unimaginable: a weak Chinese state, racked by civil wars, labouring under a form of semi-colonial rule, with large sections of its major ports and cities given over to foreign control; thousands of foreign residents; patrols by foreign armies; and the humiliation of extraterritoriality (whereby foreigners were not subject to Chinese law).
Peking’s Legation Quarter was a town in itself, a square mile of western-style hotels, shops, cinemas, gardens, and clubs, where ordinary Chinese were excluded.
International trade or the missionary calling dominated the lives of most foreigners in China.
But not so in Peking, which tended to be populated by 1) diplomats and 2) wealthy western expats enjoying the old capital’s cultural delights and the many servants their money afforded.
A party atmosphere prevailed.
For generations of foreigners, it was a life of separation and privilege, one many thought would never end.
Suspects
What was the fate of family members and possible suspects?
After the murder, nearly all of the suspects remained living and working in Peking as they had done before – that was, until war and international events overtook their lives.
The fact that they did so is one of the factors that indicate their non-involvement.
Only one disappeared immediately after the crime, never to be located: Pamela’s former school friend.
The book takes place during the tumultuous years of the Sino-Japanese war. How do national events reflect on the fate of individuals?
The China of foreign enclaves disappeared in the decade following Pamela’s murder.
And with it the lives and spaces occupied by the main characters.
There were several factors: the Sino-Japanese War that began in the summer of 1937; the Pacific War starting 1941; and finally the triumph of communism.
Everyone connected with the case had their world turned upside down.
A Death in Peking describes their fate. Two were to die soon: one at sea, the other in the same elusive manner in he lived. E.T.C. Werner found himself interned by the Japanese in the same tiny camp as his two American suspects, which must have added to everyone’s misery.
With Italy, an ally of Japan, Ugo Cappuzzo got to remain at his embassy post – at least for the short term. 1945 saw a false dawn, with a few souls making a return to Peking. But it did not last long.
By the early 1950s, even the cemetery where had Pamela had been buried was swept aside. The graves were disinterred, the bones bagged, and then reburied anonymously and without ceremony somewhere outside the city.
Have there been any episodes or characters that have impressed you the most?
The bizarre Sir Edmund Backhouse, with his fabulous tales, is a star character beyond compare, but, for me, I think perhaps the most interesting of the book’s international cast is the Italian Ugo Cappuzzo.
Cappuzzo, one of Werner’s suspects, who first arrived in China in the early 1930s as a newly qualified doctor from Legnaro.
Installed as the Peking Embassy doctor (with the influence of Galeazzo Ciano), he stayed for twenty years.
Not only was he a very capable surgeon, operating on improvised tables in poor Chinese villages, but he also excelled at microbiology, volunteering to lead a dangerous project to create a typhus vaccine.
It was a brave work. He then made the mistake of remaining in China after 1949; he was arrested for being a “spy” and endured several years in a communist gaol, only being released on a prisoner exchange.
Another fascinating character was that of Pinfold, a mysterious British national arrested and released early on in the police investigation.
I took great satisfaction in finally identifying the origins and history of this most solitary and elusive of individuals.
