Chad Chronicles is on hold while we work from home.

I'll keep updating this post if anything does happen to us.

Basically, I was telling Jacqui how J*ck told me I should join Tinder, use it during work to find out of he is there and if we would match. But Jacqui was like "what if you don't see him there but his friends see you??" So I was like "Then good na he's not on it 😂 as if he's ever talked about me to his friends 😂"

Then, nearly an hour later, I looked at my "Friends You May Know" on FB (there's a rumor that that is a list of people who's viewed your profile) then I saw that one of his friends are on it!!! I was shook, if the algorithm theory is right, then his friend was stalking me which means he has talked about me to his friends. LOL AYAN NANAMAN OVERTHINKING BES EH 😂

Then Jacqui told me how she asked her bf: if you offer a lift to a girl, does that mean he's interested? Her bf said yes but I shouldn't overthink and wait for another big sign.

Anyways, my Mandalorian plan is still going ahead. 😂

Well, we didn't really talk online, he welcomed one of the guy on our team because he just got his access sorted today but I did not get the same treatment yesterday 😭

It's G tho 😂 Seems like he really is super smart because I looked into one of his chats and he used the word "futile". I'm just....wow big word 😂

Lol anyways, we're out for the weekend, Disney+ comes out on Tuesday, will try to binge it as soon I can so I can message him by Thursday or something 😂 really hope our conversation can flow naturally. Like I will just say "oh I've finished it and I am now obsessed with Baby Yoda or I can see why you are obsessed with Baby Yoda, he is adorable!" Swear everyone is telling me to either text him or to keep my feet on the ground and let the connection grow.

I REALLY DO NOT KNOW. He keeps doing all these things to me and I am always overthinking it. My friends have told me not to but it is sooo hard. They told me to wait for other signs.

I really want to take a risk and tell him but I really do not want to ruin our new found friendship. I mean I really hope he's just waiting to make more signs because he doesn't think it's time yet or something but I just don't want to give give give and not have anything in return. This morning, I told my mom about the fact that he drove me home. At first, I couldn't tell her immediately, I was just staring at her the whole time and she asked "Anong kailangan mo sakin?" I said "nothing." "Bakit naka tingin ka sakin?" Then finally, I said, "Wala lang, may update lang ako sayo." Then she was like "ano may date ka???" I replied, "No update!!! Hinatid nya ako kila tita nung last time kaming pumasok.." and she was just like "ayie, hinahatid ka na ha." Then she told me, "yan dapat, cool ka lang. Pero tapusin mo muna.." She didn't complete her sentence but I knew she was talking about my FE1s but then she was probably thinking that I am nearly 25 and she should let me be. Hahaha. Then she asks "nag offer ba xa?" Sabi ko oo 😂

Then she asks me if he texts me and I told her no, we only talk in work. Then she replied, "ganun talaga" 😂 hay mother, if she had asked more details, I would have told her how I am getting mixed signals from him kaya di ko tlga sure kung gusto nya din ako 😂 but she didn't, so let's leave that for another time. 😂

Lord, pleaseee I trust you. If he doesn't reach out to me, ako na tlga mag rereach out. Need to binge The Mandalorian asap.

I FINISHED THE MANDALORIAN YOU GUYS.

I took a risk and messaged him. It took me a whileeeeee but I just took the plunge.

Basically, I asked him how he was and how working from home has been coming along. It took him like 6 mins to reply, which was fine, we were in work so understandable.

He told me he is relaxed but about to get boring. He asked me ‘how about you?’ So I sent him this quite long response how I’ve been relaxed working in my jammies and binged watch Mandalorian, bummed about 2 eps so illegally streamed the rest. Told him that I am now also obsessed with Baby Yoda (he laughed react to this). Then he said how it was dumb for Disney not to release everything at once. (Was upset he didnt ask me what I thought of the show)

Then I told him if Netflix can do it, so can they. But he said people would just sign up for trial, watch it then cancel. Thennnn he asked if I liked it. I said yes except for Ch.6′s characters. He said he thinks you were not meant to like them.

Then I asked him if he thinks Fennec Shand is still alive. He was like which one was HE again? So I told him correction she* (laugh emoji) then explained her character. He was like ‘Oh yeaaahhh. Then boba fett was supposedly the one who found her” I replied ‘yup that’s the theory but I feel like she was pretty much lifeless already and maybe just a teaser for boba fett then?'

Then nearly 3 hours later, I go check our workplace chat and he seenzoned me. Okur. He read the message at 20.27. He better reply tomorrow or I’ll take it a sign that he really just isn’t interested in me.

On a side note, he went on lunch at 6pm, came back at around 7ish but didn't change his Status xD it's either he forgot or na distract na sya sakin CHOS sige laaaangg.

I swear I hope we can talk more tho. Since he seenzoned me, I will not message him again cos I don't want to look eager/desperate so yeah. Byeeeeee.

Why do I keep dreaming about him? I dreamt that he messaged me on FB, really long paragraphs of him confessing his feelings.

Urgh.

Oh and I also paid for a tarot reading of how he really sees me. I mean idk if it's real but there are feelings there but there may be a third party but the reader could not 100% confirm it. It is highly probable, he's a single man who could totally date around. The reading also mention how he finds me attractive and sees a long term energy with me. It also says how he may not be ready for a serious romantic relationship but he can see it progressing down the line. But honestly, I do not see him as someone who longs for sex, yknow? I am nearly sure that he could still be a virgin but the fact that he frequented Krystle in college, makes me question it. I mean, he is a white male, it is something I am not super pressed about.

Argh why did I dream of him again?

We were back in the office daw and I sat in a different computer because I was avoiding him as in. For some reason, the coat rack was behind him so when it was home time, I grabbed my coat as fast as I could so he would not talk to me. He was slouched in his seat and looked really tired. His hair was long like mid length sufer dude hair, he was not wearing his hat. But then he saw me and called me and said "Bianca, I'll give you a ride home." I replied, gaga naman ate nyo, "If it's not raining, I can walk but if it is, I'll take the bus." He replied, "What time is your bus?" I replied, "In an hour." He replied, "Okay, if it's raining, I'll wait for you here, let me know." Then I grabbed my stuff from my locker, I went out the office and it was raining. I went back into the office and told him that it was raining. So he got up from his seat and we walked to his car. On the way, I noticed he looked really tired and his eyes were red so I asked him, "Did you not sleep?" His reply was: "Yeah I came to work with no sleep." So we just walked to his car and he opened the door for me. He even adjusted my seat.

Then for some weird reason, we ended up in Dolphins Barn, like the flats and around Tesco. Then there were billboards for Book of Mormons and he saw it he said or read "What about the Mormons?" Then I was confused at first so he pointed at the ads for the Book of Mormons. Then I told him: "Oh I really wanna see that! I heard it's meant to be one of the best Broadway shows." He then tells me he is not a big play fan but there is something he likes. I asked him but he saw another Book of Mormons billboard and pointed to it. Then we reached Reilly's Ave and idk why but my whole family and our old neighbors were all outside. Bsta ang weird talaga na he dropped me off in our old house. Dreams are weird.

So I just thanked him and watched him leave.

Had another dream about him. Just why oh why? What are these dreams trying to tell me? I haven't been thinking about him seriously so idk.

Basically in this dream, we were all back in the office. So we got a few newbies who joined our team. And management/TL thought it was a good idea to blend the newbies with the senior agents so there was a complete seat change again. Chad and the guy beside him moved to my old area, as in Chad moved to my old seat. While I was stayed in my current seat. Of course I felt sad that I won't be able to see him face to face as often anymore and that I felt like our friendship will drift apart again.

Basta ano baaa I don't understand this. Do I still have feelings for him deep down?

Oh and he read my message on the group chat again. 10:18am. I mean ok he's been active on the UKI chat today so here's me overthinking again.

So in this dream, I was in Tesco with my mom or Aldi, anyways a supermarket.

I wanted to make Tacos so I was at the spice aisle, looking for a taco spice mix. Then out of nowhere, he pops up and sees me. Says hello and asked how I was etc, while I was grabbing the taco spice mix.

Then I told him goodbye but I still kept seeing him everywhere in the store even though I purposely was avoiding him.

Hmmmm... Beginning to think he actually has 3 siblings contrary to the fact that I thought he said there are 3 of them in the family, him being the eldest, followed by his sister then his younger brother.

If it is his brother that I saw on FB then it makes sense now because remember when he gave out chocolates for Christmas? I heard him say "my brother's work had them on sale" or something along the lines. And the other brother I was aware of was only a kid. This person I saw matches the bill, from Chicago and went to the same secondary school as him. (AND LOOKS LIKE HIM!!! We may be the same age or a year younger because he graduated secondary school in 2014) [yup he is older than me by 6 months and just like his older brother, he is also very much into Star Wars and video games. But he seems more social than his bro. It's been a while. As of yesterday, he is fully back to work. We had a team meeting on Monday and he was on it. He said they gave him a laptop to work on. I had myself on mute so I was just listening to him. Yes I wanted to join in on the convo but I needed to stop myself. I need to distance myself until I fully move on from him.

Anyways, today, a case was assigned to me at around 8.30 in the morning. I didn't action it because the office was going mad with chats so I said I was gonna action it when I had a chance later on.

Then I noticed that it disappeared from my queue. I went to my closed cases and I saw that he had actioned it. I mean, I am not saying that he did it on his own free will, our TL may have asked him to go through our team's response received internal queue. Which is aight but this case was not originally mine, but one of his office broskis, na mean? So it's either he did not read the email thread at all or he just decided to close it in MY name. I mean he had to type my name and I wonder if he felt something. CHOSSSSSS 😂

But I'm telling you guys, ever since he got access again, my heart started fluttering again just like when I was still crushing on him, before I moved in front of him and he started giving me all these attention that made me fall in love with him.

I have been trying to move on. I even wrote a 7 page journal entry about my feelings. I've been super distracting myself by watching Kim Possible and staying away from sappy romantic shows 😂

I need more time to heal but it will be okay!

I got another case from the same broski, which he actioned yesterday and closed it under his broski's name but he closed the other one on mine.

So I've been hesitating about posting this but about 2 days ago? I had a dream about him again. It wasn't just him in it but the dream mostly centered about him and I.

Basically, we there was a party in the office and for some reason, I was getting ready at my desk as in curling my hair (so weird 😂😂😂).

Then Chad decided to go out of the computer area, probs was on a break or something. Then my team decided it was a good idea to hide his baby yoda plushie so I hid it in my locker and when he came back, he kept looking for it and we were just laughing at him. 😂

That was it haha.

But you guys, I've been diligently praying for my vocation and I've been getting signs about marriage etc. What if he's the one? God, please give me more signs.

Been a while since this was updated, nothing's been happening between us so there is nothing to report. But anyways, lately I've been having (r-rated) fantasies about him 😂 argh I just want to be with him 😂

So I told MF on the 14th of August about everything that has happened, like how I was getting mixed signals that made me overthink alot to me messaging him twice and being left on read, also how I plan on asking him out when we get to the office. (Also how he dropped me home.)

I told her how it's been very hard for me in the last 5 months, trying to move on from someone I don't even talk to. She was very understanding and told me that she also has not talked to Chad since WFH, as she was also left on read. She said he may not be the texty type because he's quite shy.

I was honestly shook. I thought they talk, even on our workplace chat because they are close in work. Cause I asked her if it was even a good idea for me to ask him out or if she knows if he's seeing someone because I don't want to intrude. I told her I want to take a risk with him but a part of me fears rejection.

She asked me if I ever thought about asking him out for coffee since things are opening up. I told her, yes but I don't think we are in that level where I could just ask him randomly.

So her plan is to build up a rapport with him again and find out the goss. I really hope she can build something up with him and that if ever, this time, there will be progress.

Until I know I have a chance with him, I can't move on. If he's seeing someone, then okay at least I'll know where I stand.

One of the internal tools was not working for him so he asked for help. I was the first to reply so I told him to send me the details and I'll do it.

When I did it for him, he said 'Perfect thank you!' and I just replied, "No worries 😊" landi landi with that emoji 😂 Wish we kinda had a conversation going though 😭 Wish I asked him how he was but it wasn't appropriate okay 😂

Haaayy can't wait to find out if he's dating anyone or when I'll see him again so I can ask him out. HAAAAAYYYYSSSS.

But she did talk to Chad and he applied to the SME role apparently, I think he may have already been interviewed but he didn't hear back from them yet.

MF also said that we should meet up for a coffee date "with Bianca" and he said we should hahaha cmon MF make this a reality please so I can talk to him 😭

Rod Rosenstein, formerly the deputy attorney general, is a key figure in enabling, at a minimum, the Deep State’s seditious attacks on President Trump.

More proof is in new documents uncovered by a Judicial Watch lawsuit. Specifically, we forced the release of 145 pages of Rosenstein’s communications that include a one-line email from Rosenstein to Mueller stating, “The boss and his staff do not know about our discussions.” They also include “off the record” emails with major media outlets around the date of Mueller’s appointment.

We filed a lawsuit to get these documents after the Department of Justice failed to respond to our September 21, 2018, Freedom of Information At (FOIA) request (Judicial Watch v. U.S. Department of Justice (No. 1:19-cv-00481)).

We were seeking any and all e-mails, text messages, or other records of communication addressed to or received by Deputy Attorney General Rod Rosenstein between May 8, 2017, and May 22, 2017.

The time period referred to in this suit is critical. On May 9, 2017, Rosenstein wrote a memo to President Trump recommending that FBI Director James Comey be fired. That day, President Trump fired Comey. Just three days later, on May 12, Rosenstein sent an email assuring Robert Mueller that “The boss and his staff do not know about our discussions.” (It is not clear if the “boss” is then-AG Sessions or President Trump.)

The documents also show that, again during the same time period, Rod Rosenstein was in direct communication with reporters from 60 Minutes, The New York Times, and The Washington Post. In an email exchange dated May 2017, Rosenstein communicated with New York Times reporter Rebecca Ruiz to provide background for this article about himself. Ruiz emailed Rosenstein a draft of the article, and he responded with off-the-record comments and clarifications.

In an email exchange on May 17, 2017, the day of Mueller’s appointment, Rosenstein exchanged emails with 60 Minutes producer Katherine Davis in which he answered off-the-record questions about Mueller’s scope of authority and chain of command:

Rosenstein: “Off the record: This special counsel is a DOJ employee. His status is similar to a US Attorney.”

Davis: “Good call on Mueller. Although I obviously thought you’d be great at leading the investigation too.”

Data experts on Facebook’s GDPR changes: Expect lawsuits

Make no mistake: Fresh battle lines are being drawn in the clash between data-mining tech giants and Internet users over people’s right to control their personal information and protect their privacy.

An update to European Union data protection rules next month — called the General Data Protection Regulation — is the catalyst for this next chapter in the global story of tech vs privacy.

A fairytale ending would remove that ugly ‘vs’ and replace it with an enlightened ‘+’. But there’s no doubt it will be a battle to get there — requiring legal challenges and fresh case law to be set down — as an old guard of dominant tech platforms marshal their extensive resources to try to hold onto the power and wealth gained through years of riding roughshod over data protection law.

Payback is coming though. Balance is being reset. And the implications of not regulating what tech giants can do with people’s data has arguably never been clearer.

The exciting opportunity for startups is to skate to where the puck is going — by thinking beyond exploitative legacy business models that amount to embarrassing blackboxes whose CEOs dare not publicly admit what the systems really do — and come up with new ways of operating and monetizing services that don’t rely on selling the lie that people don’t care about privacy.

  More than just small print

Right now the EU’s General Data Protection Regulation can take credit for a whole lot of spilt ink as tech industry small print is reworded en masse. Did you just receive a T&C update notification about a company’s digital service? Chances are it’s related to the incoming standard.

The regulation is generally intended to strengthen Internet users’ control over their personal information, as we’ve explained before. But its focus on transparency — making sure people know how and why data will flow if they choose to click ‘I agree’ — combined with supersized fines for major data violations represents something of an existential threat to ad tech processes that rely on pervasive background harvesting of users’ personal data to be siphoned biofuel for their vast, proprietary microtargeting engines.

This is why Facebook is not going gentle into a data processing goodnight.

Indeed, it’s seizing on GDPR as a PR opportunity — shamelessly stamping its brand on the regulatory changes it lobbied so hard against, including by taking out full page print ads in newspapers…

This is of course another high gloss plank in the company’s PR strategy to try to convince users to trust it — and thus to keep giving it their data. Because — and only because — GDPR gives consumers more opportunity to lock down access to their information and close the shutters against countless prying eyes.

But the pressing question for Facebook — and one that will also test the mettle of the new data protection standard — is whether or not the company is doing enough to comply with the new rules.

One important point re: Facebook and GDPR is that the standard applies globally, i.e. for all Facebook users whose data is processed by its international entity, Facebook Ireland (and thus within the EU); but not necessarily universally — with Facebook users in North America not legally falling under the scope of the regulation.

Users in North America will only benefit if Facebook chooses to apply the same standard everywhere. (And on that point the company has stayed exceedingly fuzzy.)

It has claimed it won’t give US and Canadian users second tier status vs the rest of the world where their privacy is concerned — saying they’re getting the same “settings and controls” — but unless or until US lawmakers spill some ink of their own there’s nothing but an embarrassing PR message to regulate what Facebook chooses to do with Americans’ data. It’s the data protection principles, stupid.

Zuckerberg was asked by US lawmakers last week what kind of regulation he would and wouldn’t like to see laid upon Internet companies — and he made a point of arguing for privacy carve outs to avoid falling behind, of all things, competitors in China.

Which is an incredibly chilling response when you consider how few rights — including human rights — Chinese citizens have. And how data-mining digital technologies are being systematically used to expand Chinese state surveillance and control.

The ugly underlying truth of Facebook’s business is that it also relies on surveillance to function. People’s lives are its product.

That’s why Zuckerberg couldn’t tell US lawmakers to hurry up and draft their own GDPR. He’s the CEO saddled with trying to sell an anti-privacy, anti-transparency position — just as policymakers are waking up to what that really means.

  Plus ça change?

Facebook has announced a series of updates to its policies and platform in recent months, which it’s said are coming to all users (albeit in ‘phases’). The problem is that most of what it’s proposing to achieve GDPR compliance is simply not adequate.

Coincidentally many of these changes have been announced amid a major data mishandling scandal for Facebook, in which it’s been revealed that data on up to 87M users was passed to a political consultancy without their knowledge or consent.

It’s this scandal that led Zuckerberg to be perched on a booster cushion in full public view for two days last week, dodging awkward questions from US lawmakers about how his advertising business functions.

He could not tell Congress there wouldn’t be other such data misuse skeletons in its closet. Indeed the company has said it expects it will uncover additional leaks as it conducts a historical audit of apps on its platform that had access to “a large amount of data”. (How large is large, one wonders… )

But whether Facebook’s business having enabled — in just one example — the clandestine psychological profiling of millions of Americans for political campaign purposes ends up being the final, final straw that catalyzes US lawmakers to agree their own version of GDPR is still tbc.

Any new law will certainly take time to formulate and pass. In the meanwhile GDPR is it.

The most substantive GDPR-related change announced by Facebook to date is the shuttering of a feature called Partner Categories — in which it allowed the linking of its own information holdings on people with data held by external brokers, including (for example) information about people’s offline activities.

Evidently finding a way to close down the legal liabilities and/or engineer consent from users to that degree of murky privacy intrusion — involving pools of aggregated personal data gathered by goodness knows who, how, where or when — was a bridge too far for the company’s army of legal and policy staffers.

Other notable changes it has so far made public include consolidating settings onto a single screen vs the confusing nightmare Facebook has historically required users to navigate just to control what’s going on with their data (remember the company got a 2011 FTC sanction for “deceptive” privacy practices); rewording its T&Cs to make it more clear what information it’s collecting for what specific purpose; and — most recently — revealing a new consent review process whereby it will be asking all users (starting with EU users) whether they consent to specific uses of their data (such as processing for facial recognition purposes).

As my TC colleague Josh Constine wrote earlier in a critical post dissecting the flaws of Facebook’s approach to consent review, the company is — at very least — not complying with the spirit of GDPR’s law.

Indeed, Facebook appears pathologically incapable of abandoning its long-standing modus operandi of socially engineering consent from users (doubtless fed via its own self-reinforced A/B testing ad expertise). “It feels obviously designed to get users to breeze through it by offering no resistance to continue, but friction if you want to make changes,” was his summary of the process.

But, as we’ve pointed out before, concealment is not consent.

To get into a few specifics, pre-ticked boxes — which is essentially what Facebook is deploying here, with a big blue “accept and continue” button designed to grab your attention as it’s juxtaposed against an anemic “manage data settings” option (which if you even manage to see it and read it sounds like a lot of tedious hard work) — aren’t going to constitute valid consent under GDPR.

Nor is this what ‘privacy by default’ looks like — another staple principle of the regulation. On the contrary, Facebook is pushing people to do the opposite: Give it more of their personal information — and fuzzing why it’s asking by bundling a range of usage intentions.

The company is risking a lot here.

In simple terms, seeking consent from users in a way that’s not fair because it’s manipulative means consent is not being freely given. Under GDPR, it won’t be consent at all. So Facebook appears to be seeing how close to the wind it can fly to test how regulators will respond.

Safe to say, EU lawmakers and NGOs are watching.

  “Yes, they will be taken to court”

“Consent should not be regarded as freely given if the data subject has no genuine or free choice or is unable to refuse or withdraw consent without detriment,” runs one key portion of GDPR.

Now compare that with: “People can choose to not be on Facebook if they want” — which was Facebook’s deputy chief privacy officer, Rob Sherman’s, paper-thin defense to reporters for the lack of an overall opt out for users to its targeted advertising.

Data protection experts who TechCrunch spoke to suggest Facebook is failing to comply with, not just the spirit, but the letter of the law here. Some were exceeding blunt on this point.

“I am less impressed,” said law professor Mireille Hildebrandt discussing how Facebook is railroading users into consenting to its targeted advertising. “It seems they have announced that they will still require consent for targeted advertising and refuse the service if one does not agree. This violates [GDPR] art. 7.4 jo recital 43. So, yes, they will be taken to court.”

“Zuckerberg appears to view the combination of signing up to T&Cs and setting privacy options as ‘consent’,” adds cyber security professor Eerke Boiten. “I doubt this is explicit or granular enough for the personal data processing that FB do. The default settings for the privacy settings certainly do not currently provide for ‘privacy by default’ (GDPR Art 25).

“I also doubt whether FB Custom Audiences work correctly with consent. FB finds out and retains a small bit of personal info through this process (that an email address they know is known to an advertiser), and they aim to shift the data protection legal justification on that to the advertisers. Do they really then not use this info for future profiling?”

That looming tweak to the legal justification of Facebook’s Custom Audiences feature — a product which lets advertisers upload contact lists in a hashed form to find any matches among its own user-base (so those people can be targeted with ads on Facebook’s platform) — also looks problematical.

Here the company seems to be intending to try to claim a change in the legal basis, pushed out via new terms in which it instructs advertisers to agree they are the data controller (and it is merely a data processor). And thereby seek to foist a greater share of the responsibility for obtaining consent to processing user data onto its customers.

However such legal determinations are simply not a matter of contract terms. They are based on the fact of who is making decisions about how data is processed. And in this case — as other experts have pointed out — Facebook would be classed as a joint controller with any advertisers that upload personal data. The company can’t use a T&Cs change to opt out of that.

Wishful thinking is not a reliable approach to legal compliance.

  Fear and manipulation of highly sensitive data

Over many years of privacy-hostile operation, Facebook has shown it has a major appetite for even very sensitive data. And GDPR does not appear to have blunted that.

Let’s not forget, facial recognition was a platform feature that got turned off in the EU, thanks to regulatory intervention. Yet here Facebook is now trying to use GDPR as a route to process this sensitive biometric data for international users after all — by pushing individual users to consent to it by dangling a few ‘feature perks’ at the moment of consent.

Veteran data protection and privacy consultant, Pat Walshe, is unimpressed.

“The sensitive data tool appears to be another data grab,” he tells us, reviewing Facebook’s latest clutch of ‘GDPR changes’. “Note the subtlety. It merges ‘control of sharing’ such data with FB’s use of the data “to personalise features and products”. From the info available that isn’t sufficient to amount to consent for such sensitive data and nor is it clear folks can understand the broader implications of agreeing.

“Does it mean ads will appear in Instagram? WhatsApp etc? The default is also set to ‘accept’ rather than ‘review and consider’. This is really sensitive data we’re talking about.”

“The face recognition suggestions are woeful,” he continues. “The second image — is using an example… to manipulate and stoke fear — “we can’t protect you”.

“Also, the choices and defaults are not compatible with [GDPR] Article 25 on data protection by design and default nor Recital 32… If I say no to facial recognition it’s unclear if other users can continue to tag me.”

Of course it goes without saying that Facebook users will keep uploading group photos, not just selfies. What’s less clear is whether Facebook will be processing the faces of other people in those shots who have not given (and/or never even had the opportunity to give) consent to its facial recognition feature.

People who might not even be users of its product.

But if it does that it will be breaking the law. Yet Facebook does indeed profile non-users — despite Zuckerberg’s claims to Congress not to know about its shadow profiles. So the risk is clear.

It can’t give non-users “settings and controls” not to have their data processed. So it’s already compromised their privacy — because it never gained consent in the first place.

New Mexico Representative Ben Lujan made this point to Zuckerberg’s face last week and ended the exchange with a call to action: “So you’re directing people that don’t even have a Facebook page to sign up for a Facebook page to access their data… We’ve got to change that.”

But nothing in the measures Facebook has revealed so far, as its ‘compliance response’ to GDPR, suggest it intends to pro-actively change that.

Walshe also critically flags how — again, at the point of consent — Facebook’s review process deploys examples of the social aspects of its platform (such as how it can use people’s information to “suggest groups or other features or products”) as a tactic for manipulating people to agree to share religious affiliation data, for example.

“The social aspect is not separate to but bound up in advertising,” he notes, adding that the language also suggests Facebook uses the data.

Again, this whiffs a whole lot more than smells like GDPR compliance.

“I don’t believe FB has done enough,” adds Walshe, giving a view on Facebook’s GDPR preparedness ahead of the May 25 deadline for the framework’s application — as Zuckerberg’s Congress briefing notes suggested the company itself believes it has. (Or maybe it just didn’t want to admit to Congress that U.S. Facebook users will get lower privacy standards vs users elsewhere.)

“In fact I know they have not done enough. Their business model is skewed against privacy — privacy gets in the way of advertising and so profit. That’s why Facebook has variously suggested people may have to pay if they want an ad free model & so ‘pay for privacy’.”

“On transparency, there is a long way to go,” adds Boiten. “Friend suggestions, profiling for advertising, use of data gathered from like buttons and web pixels (also completely missing from “all your Facebook data”), and the newsfeed algorithm itself are completely opaque.”

“What matters most is whether FB’s processing decisions will be GDPR compliant, not what exact controls are given to FB members,” he concludes.

US lawmakers also pumped Zuckerberg on how much of the information his company harvests on people who have a Facebook account is revealed to them when they ask for it — via its ‘Download your data’ tool.

His answers on this appeared to intentionally misconstrue what was being asked — presumably in a bid to mask the ugly reality of the true scope and depth of the surveillance apparatus he commands. (Sometimes with a few special ‘CEO privacy privileges’ thrown in — like being able to selectively retract just his own historical Facebook messages from conversations, ahead of bringing the feature to anyone else.)

‘Download your Data’ is clearly partial and self-serving — and thus it also looks very far from being GDPR compliant.

  Not even half the story

Facebook is not even complying with the spirit of current EU data protection law on data downloads. Subject Access Requests give individuals the right to request not just the information they have voluntarily uploaded to a service, but also personal data the company holds about them; Including giving a description of the personal data; the reasons it is being processed; and whether it will be given to any other organizations or people.

Facebook not only does not include people’s browsing history in the info it provides when you ask to download your data — which, incidentally, its own cookies policy confirms it tracks (via things like social plug-ins and tracking pixels on millions of popular websites etc etc) — it also does not include a complete list of advertisers on its platform that have your information.

Instead, after a wait, it serves up an eight-week snapshot. But even this two month view can still stretch to hundreds of advertisers per individual.

If Facebook gave users a comprehensive list of advertisers’ access to their information the number of third party companies would clearly stretch into the thousands. (In some cases thousands might even be a conservative estimate.)

There’s plenty of other information harvested from users that Facebook also intentionally fails to divulge via ‘Download your data’. And — to be clear — this isn’t a new problem either. The company has a very long history of blocking these type of requests.

In the EU it currently invokes a exception in Irish law to circumvent more fulsome compliance — which, even setting GDPR aside, raises some interesting competition law questions, as Paul-Olivier Dehaye told the UK parliament last month.

“All your Facebook data” isn’t a complete solution,” agrees Boiten. “It misses the info Facebook uses for auto-completing searches; it misses much of the information they use for suggesting friends; and I find it hard to believe that it contains the full profiling information.”

“Ads Topics” looks rather random and undigested, and doesn’t include the clear categories available to advertisers,” he further notes.

Facebook wouldn’t comment publicly about this when we asked. But it maintains its approach towards data downloads is GDPR compliant — and says it’s reviewed what it offers via with regulators to get feedback.

Earlier this week it also put out a wordy blog post attempting to diffuse this line of attack by pointing the finger of blame at the rest of the tech industry — saying, essentially, that a whole bunch of other tech giants are at it too.

Which is not much of a moral defense even if the company believes its lawyers can sway judges with it. (Ultimately I wouldn’t fancy its chances; the EU’s top court has a robust record of defending fundamental rights.)

  Think of the children…

What its blog post didn’t say — yet again — was anything about how all the non-users it nonetheless tracks around the web are able to have any kind of control over its surveillance of them.

And remember, some Facebook non-users will be children.

So yes, Facebook is inevitably tracking kids’ data without parental consent. Under GDPR that’s a majorly big no-no.

TC’s Constine had a scathing assessment of even the on-platform system that Facebook has devised in response to GDPR’s requirements on parental consent for processing the data of users who are between the ages of 13 and 15.

“Users merely select one of their Facebook friends or enter an email address, and that person is asked to give consent for their ‘child’ to share sensitive info,” he observed. “But Facebook blindly trusts that they’ve actually selected their parent or guardian… [Facebook’s] Sherman says Facebook is “not seeking to collect additional information” to verify parental consent, so it seems Facebook is happy to let teens easily bypass the checkup.”

So again, the company is being shown doing the minimum possible — in what might be construed as a cynical attempt to check another compliance box and carry on its data-sucking business as usual.

Given that intransigence it really will be up to the courts to bring the enforcement stick. Change, as ever, is a process — and hard won.

Hildebrandt is at least hopeful that a genuine reworking of Internet business models is on the way, though — albeit not overnight. And not without a fight.

“In the coming years the landscape of all this silly microtargeting will change, business models will be reinvented and this may benefit both the advertisers, consumers and citizens,” she tells us. “It will hopefully stave off the current market failure and the uprooting of democratic processes… Though nobody can predict the future, it will require hard work.”

Online Voting for Re-examination:

(1)(procedure for SSC Chairman Clerk) The SSC chairman will order clerk to: Make an online portal on SSC's website wherein students who have attempted the exam can vote whether they want to have a reexam or not.

(2)(procedure for SSC Chairman's Clerk) The SSC chairman will order clerk to: display results of this online election on SSC's Website.

(3)(procedure for SSC Chairman) If more than 50% of students say that re-examination should be conducted then the chairman MAY conduct a re-examination.

(Commentary: This is not a referendum procedure. It is not binding on the SSC Chairman to conduct a re-examination)

How to prevent this kind of cheating in future?

They were using Windows 7 computers for conducting exam. I think that they should develop there own Linux Based OS, for conducting examination, which will be specific to conducting MCQ based exams only. And hence, softwares like TeamViewer etc. can't be used.

Also for selecting questions for exams and making sure that paper leaking is made difficult government can use the following method to make examination papers:

Introduction

(1) Vande Mataram. This writeup is NOT a proposed a law. It is a proposed method to take recruitment exams. The method proposes paper based examination method, where over ONLINE exams. Here (a) question paper is printed in hall (b) students give answer on OMR or paper (c) immediately after exams, answers are scanned and uploaded on public website (d) students get xerox copy of their answers. And this writeup explains why this method is superior to online testing

(2) The activists can decide whether they support this exam method or other exam method. If they support this paper based exam method, then they can decide which activist method  wish to use to convince PM/CMs to use this examination method.

Details of this method

(3) SSC (or any testing body) will use hall of large size where at least 200 candidates can sit. Each candidate must be on a single person chair. Hall will have CCTV camera with live feed going on youtube for all halls. So if 200,000 candidates have to give exams, then SSC may need 1000 such halls, or lesser halls if halls are bigger in size.

(4) Each hall will have 2 PCs, 3-4 large printers, 3-4 heavy duty scanners and also xerox machines

(5) The hall incharge will get question paper in PDF format over secured connection over internet  just 10 minutes before exam. Say PDF file is 8 pages. Then he will need to print 8 pages * 200 copies = 1600 pages in that room and distribute the paper to the candidates

(6) The candidates will get A4 size OMR sheet, and supplementary sheets of A4 size.

(7) If the questions are MCQ, then he will need to select the application spot on OMR sheet and also write the question number, answer choice and line from answer choice on the supplementary. For non-MCQ, the candidate will need to use answer sheets as usual.

(8) For MCQ, the system will take OMR as main input. But his answers and handwriting supplementary may be seen and used to decide if there was any wrong doing

(9) In addition, students will get envelope of A4 size

(10) Moment the exam ends, each student will need to put OMR sheet and all answer papers in the envelope

(11) The hall in-charge and staff will then scan all OMR sheets and all answersheets right in the hall and immediately put all the data on PUBLIC website right away. The students will also get a xerox copy of their OMR sheets and answer sheets there and there. So say each candidate has written say 10 pages. Then hall in-charge and staff needs to scan about 11 * 200 candidates = 2200 pages.

(12) All candidates and anyone in world will be able to download answers of any or all candidates for a small charge to cover networking costs.

(13) Results can be announced after a few days, as applicable.

Why imo Online testing is useless

(14) In online testing, if SSC server administrators get bribed, then they can replace candidate’s actual answers by correct answers and increase his chance of selection, and no one will know. There are software tools which enable person physically close to machine to change data on disk without login !! One way is to booting the PC using DVD , and then change the data on disk in a way that after change no forensic audit can prove tempering !!

(15) Another method is – if owner of testing software installs a remote login software on the PC, then a well learned can login on the candidate’s PC and see all questions and answer,. The candidate can simply pretend that he is clicking answers, while the cheater on remote terminal and click all answers

(16) Another way is – cheater can remote login on the router between testing center and server. By this, he can trap the data coming from candidate’s PC and he can change data of just 1-2 candidates and keep other data as is. So those 1-2 candidates will get more marks

(17) In short, there are innumerable “touch-points“ in online testing. So online testing is good when stakes are low such as primary class maths exams. But if testing is to give Govt jobs or recruitment in apex bodies or promotions etc, then imo online testing is open invitation for corruption and ideological filtering

(18) Ideological or Political Filtering : what is worse than corruption in online testing is ideological or political filtering. If the apex in-charge of testing body belongs to Ideology-A or Party-A and he wants to ensure that only candidates of ideology-A or candidates affiliated with Party-A to get selected, then without taking any bribes, he can  do so. Thru social media , party rosters and other means,  can obtain which candidates subscribe to which ideology or party. And by tempering data on server, he can replace answers given by chosen candidates by correct answers. And thus he can increase the chances of those candidates getting selected. Ideological Filtering or Political Filtering imo is more dangerous than corruption. And so I oppose online testing

(19) What is important in recruitment is NOT just honesty, but every lay outsider should be able to see and also verify that there was no foul play. In online testing, outsider can never feel sure whether insiders hacked the candidates answers or not, and whether candidates terminals were rigged or not. But paper has not be hacked till date. So imo outsiders may feel more assured with paper instead of online testing is used.

(20) Each candidate or activist needs to decide whether  he wants SSC and other Govt bodies to use this paper methods or use online testing. If he decides to support this paper method, then I request him to take following steps
