１月の教員養成で、はじめて「子どもの観察」を体験した。それはこれまで受けてきた授業のなかでもっとも予想外の内容だった（予想：「7年ごとの成長段階を、実際の子どもの様子に当てはめるとか？　あまりわくわくしないな……」）。学校の心臓ともいえる教員会では、時折ひとりの子どもを取り上げる時間を持つ（「心臓もまた学ぶ意志を持っている」）。何かしらの理由があってなのか・なくてもなのか、それは場合によりけりで。人と輪になって座る。それだけで立ち上がってくるものがあることは講座中しょっちゅう感じているけれど（通いはじめてから人生で最も頻繁に人と輪をつくっている）、ここではそれが意識的だ。何しろ、ここにはいないその子どもを、言葉を使って、イメージを通じて、その輪のなかにありありと存在させようとするのだから。まだ１年なのか、それとも９年か（横浜では９年間担任を受け持つ）、共に過ごし関わり続けてきた経験のある担任が中心となって、専科の先生やその他の先生も交えてみんなで子どもを描写する。その子はどんな髪の毛をしている？　表情はどう？　手のあたたかさは？　どんなふうに歩く？　声はどう？　自分の感覚器官を使ってとらえられる外的特徴からはじまり、だんだんと目には見えない領域まで分け入っていく。ふるまいや行動、態度、生まれたときの環境などを通じて、魂や霊（とだけ記すと圧倒的に誤解を生みそうな）領域にまで。それをたんたんとする。たんたんと、具体的に。それぞれが知っていることをその場であたらしく思い出す。��れはべつに魔術ではない、きわめて現実的なことだ。それで何が起きるのか？　問題は解決するのか？　関係が改善するのか？　それとも劇的なことを期待するのか？　yesでもnoでもない別の回答があるとしたら、それは時間とか眠りとか予感とか、もしくはかすかな響きといったようなものなのかもしれない。その子どもが、その人が、ここにいることを認識すること。ここにいないときでも、いることを。そうすると、いったい何が起きる（それとも起きない）？

輪のなかでわたしが見たもの：輪郭だけあるのっぺらぼうの顔、そこに表情が与えられていくさま、だんだんと動きが生まれ、体温が流れこみ、いつのまにかその子どもの全存在が立ち上がってくる（気がする）。それを頭だけでなく、全身全霊で感じる。爪のさき、目の輝き、それをいま目の前で見ているように見る。わたしはその子にあったことがない。会ったことがない人と、言葉を通じて、イメージを介して、そしてできるかぎりの共感と反感を超えたところで、会っている（気がする）。

知らない人のことを知るようになることは、見えないものを見えるようになることと同じなんだろうか？　あなたに会わずに、あなたと会うことは？

シュタイナーは超感覚的世界なんかのことをやたらむずかしく説明しながらも、そこに到達するための秘密は、たとえば人と出会い、語り合うことだよ、しかもまるでそれが相手の言葉であるかのように語り、それが自分の言葉であるかのように相手の話を聞くことだよ！　などと言ってくる。そしてあとから、その人のことをひとり思い出す。あの人とわたしは、なんてこんなにちがうんだろう、そして同時になんと似ていることだろう、なんて考えながら。あの人もわたしも、世界でたったひとりの人間なんだ、代わりはほんとにどこにもいないんだ！　という事実に何度も驚嘆しながら。人を知るということは、その人が自分のなかで生きはじめること、同時にその人のなかに自分の居場所を見出すことだよ、とシュタイナーは言う。ポイントは人を知ること、そして人が人に関心を持つ、ということだよ、なんて指を一本立てながら。まさに「人・智・学」。それともこれはわたしの超訳・跳躍？

いちど誰かのことを知ってしまったら、とても無関心ではいられないはずだからーー

マクドナルドのMを見て思い出すのは、たとえば高校時代の放課後、海の見える三浦海岸の店舗で山盛りのポテトフライをナプキンの上に広げて、友人たちと大好きだった映画「エンパイア・レコード」について語り合ったこと（ひとりはAJが好きでもうひとりはマーク、わたしはやっぱりルーカスだった）。大学生になって、目白の小ぎれいな店舗で部活仲間と大人びた顔でミーティングをした夜（そのうちのひとりが100円のバーガーを毎回３個食べていた）。もしくは暑い夏のロサンゼルスで、キャンペーン中のキャラメル風味のアイスラテをばかでかいカップで当時のボーイフレンドと１日何杯も車のなかで飲んだこと（どの店舗にいってもリフィルフリーだった気がする）。それからずいぶん時が経って、今ではほとんど紅茶しか飲まなくなったけれど、あのびかびかのMのマークの奥にわたしはたくさんの人たちの顔を見る。若くて、元気で、でもいつもどこかくたびれていた、あの頃の彼女・彼たちの目に映る今とはちがうわたしの姿も。わたしにしか見えないけれど、たしかにそこにあるもの。

Florida Uniform Heirs Property Act

          In 2020, the Florida legislature passed a new law called the Florida Uniform Partition of Property Heirs Act (“the Act”).  The purpose of this law is to allow heirs of property to buy out the shares of other heirs in a court-supervised sale.

 In the past, if one of a group of heirs wanted to keep an inherited property but the others wanted to sell, and the heirs couldn’t agree on a sales price, then the only legal remedy that the heirs had was a partition sale under Florida Statute Section 64.041.  The Act allows the heir that wants to buy another heir’s property share the ability to purchase it for its appraised value.  The intent of the new law is to facilitate preservation of real estate within a family.

When Does the Florida Uniform Heirs Property Act Apply

Heirs who inherit a property share may avail themselves of the Act when the following conditions apply:

-the heir holds his property interest as a tenant in common

-there is no prior agreement among all the heirs governing partition of the property

-one of more of the cotenants acquired title from a relative, whether living, or deceased

AND, any of the following applies:

1.       Twenty percent or more of the interests are held by co-tenants who are relatives;

 2.      . Twenty percent or more of the interests are held by an individual who acquired title from a relative, whether living or deceased; or

  3.       Twenty percent or more of the cotenants are relatives.

 Buyout Process Under the Act

 The process is initiated when an heir who wants to sell his portion of the property  files  a partition action under Florida Statute Section 64.041. In his partition complaint, he asks the court to apportion and sell the property.  The court then determines whether the property is heirs’ property under the criteria stated above.  If the property meets these criteria, the court then orders an appraisal to determine the fair market value of the property.  Once the court notices all parties of the results of the appraisal, it holds a hearing at which it decides whether to adopt the results of the appraisal as the fair market value of the property.

      The next step that the court takes under the Act is to send notice to all the other co-tenants that they have the right to buy out the cotenant who requested partition at a purchase price based on the appraised value of the property multiplied by the co-tenant’s fractional ownership share.  The cotenants then have 45 days to exercise their purchase rights under the Act.

      What happens next depends on whether one or more cotenants elect to purchase the property interest of the co-tenant who sought partition.    If no cotenant exercises his purchase rights, the court orders a physical partition or partition by sale of the property.  If one or more cotenant exercises his purchase rights, the court notices the other co-tenants of this fact and then issues a judgment of partition that reallocates the co-tenants’ respective shares in the property.

       In keeping with the purpose of the act, a court-ordered buyout is only available when a relative of the decedent owns a portion of the property (so, if decedent’s heirs are not relatives, the Act will not apply).  The Act defines a relative broadly as “ an ascendant, descendant, or collateral or an individual otherwise related to another individual by blood, marriage, adoption, or law of this state other than this part.”  However, an heir who is not a relative may exercise buyout rights under the Act as long as 20% or more of the other cotenants are relatives (or 20% of shares belong to a relative).  Thus, the act has broad applicability in situations where heirs inherit a decedent’s real property.

Gathering Ideas Through Interview Conversations

 In today's dynamic and competitive business landscape, entrepreneurship stands as a beacon of innovation, resilience, and opportunity. It is a journey marked by uncertainty, risk, and relentless pursuit of success. In chasing success, one must know and study the market to know what the customers wants and what problems they encounter. In order to come up a business idea that can benefit everyone. As Central Mindanao University students, we've faced a variety of obstacles and situations that we feel many of our fellow students may relate to. However, as a group, we realize our own limits, particularly as newbies, and accept that our comprehension of many topics may be limited. As a result, we needed to get testimony from others on their university experiences. As a group, the first things we do is we interviewed our cotenants who also studies in CMU, and then we extended our inquiries in each student we met in the university campus to have more knowledge of the university and the issues it is facing, to gather information for a better business idea.

During our interviews, we managed to collect data from various students in the university campus. The common difficulties they shared ranged from trash, delivery services, transportation, and the difficulty of searching for available part-time jobs or any student-friendly jobs that would help sustain or aid their expenses. Among this long list of difficulties faced by a variety of students, the challenge during the hunt for part-time jobs was the one we picked to solve, more so that we also sometimes experienced the inadequacy of funds. But before we made the final decision, we also considered other things, such as food delivery within CMU, but somehow, we couldn't think of any unique selling proposition. That’s why we pursue a job-hunting website since we also consider those students who were not born with a silver spoon, which makes studying more challenging for them, especially with the many expenses they face.

However, their desire to complete their studies drives them to seek for any additional sources of funding that may allow them to survive. Based on the information gathered, the group devised a plan to build a website that would allow students, faculty, and locals surrounding CMU to hunt for jobs or discover workers. This website is quite similar to the current program Linked-in, and it is aimed to help those who are having difficulty finding a job and workers without having to put in additional effort.

The team's concept was then presented to Sir Tracy Van Tangonan during our venture pitch. He complimented the group for having a great concept; nevertheless, he highlights that our product should have a clear, unique selling proposition because, according to his observations, our proposal does not include capabilities that are not available in other existing apps. Furthermore, based on this experience, the group will continue to grow our creativity and invention in order to produce even better and more valuable results, with the goal of alleviating the challenges that many CMU students encounter.
