Hermesmann v. Seyer (1993)

Colleen Hermesmann was 16 when she statutorily raped and got impregnated by Shane Seyer (12) she was his babysitter.

Herrmann received Aid from Families with Dependent Children program (ADC) from the Kansas Department of Social and Rehabilitation Services (SRS).

She was then accused of engaging in sex with a minor. "She agreed to stipulate to the lesser offense of contributing to a child's misconduct {...} The juvenile court accepted the stipulation and adjudicated Colleen Hermesmann to be a juvenile offender. (not considered a sexual offense)

SRS with Hermesmann's name took Seyer to court in order to claim child support of 7k (~$15.5k in 2022) later on the department backtracked and says they never intended to get it back...?

They petitioned for paternity orders in order to receive compensation, Seyer appealed saying that he was statutory raped

SRS/Hermesmann argued that he did not report it, he consensually agreed...? but yet the law in Kansas stated: "a person under 15 years of age is incapable of consent as a matter of law".

Courts concluded "the issue of consent to sexual activity under the criminal statutes is irrelevant in a civil action to determine paternity and for support of the minor child of such activity." -a huge slap in the face to these victims

The case established a precedent that has subsequently been used in the Kansas courts. It is one of the earlier cases now cited in U.S. child-support guidelines which say that in every case that has addressed the issue the court has decided that an underage boy is liable for the support of his child even when the conception was the result of criminal conduct by the mother. (Hermesmann v. Seyer)

Side note: "Kansas Parentage Act provided "no exception for minor parents regarding their duty to support and educate their child." Yet, in at least one section of the Act, the state legislature gave the court great flexibility in allocating support obligations by stating that "the court may order the support and education expenses to be paid by either or both parents for the minor child." (Greenbaum 98)

The court misinterpreted its own Act both parents aren't always liable for child support but the Chief Justice interpreted it as paternal support is always required. (Greenbaum 98)

“When Shane Seyer was 12, he was sexually exploited by his 16-year-old babysitter Colleen Hermesmann. She became pregnant with Seyer’s child in 1989 and was charged with statutory rape shortly afterward. Instead of being convicted of rape, Hermesmann was declared a juvenile offender under the non-sexual offense of “contributing to child misconduct.” Seyer was subsequently court-ordered to pay child support.

In 1993, at the age of 15, Seyer appealed this decision to the Kansas Supreme Court, arguing he should not be liable for these payments. He maintained that his babysitter (Hermesmann) took advantage of him sexually when he was too young to give consent.

The Kansas Supreme Court ruled against him. The judgment stated that because Seyer initially consented to the sexual encounters and never told his parents what was happening, he was responsible for supporting the child.

This court case set a precedent for male rape victims to make child-support payments. The financial needs of the children outweigh the court’s interest in deterring sexual crimes against male minors, even if statutory rape is the cause of conception.“

Bane’s World, the moniker of Long Beach-native Shane Blanchard, is for anyone who’s infatuated with the redefined sounds of dreamy, psychedelic bedroom pop. At only 22, he spent 2018 frequenting huge music fests like Coachella and Camp Flog Gnaw, despite never having released a full-length album. His 9-track debut EP, aptly titled Drowsy, paved the way for his introduction to the indie and alt-pop world, coming in strong at over 40 million Spotify streams.

It’s quite obvious that the dude’s kind of obsessed with that trippy, retro ‘80s vibe -- everything from his haircut to the way he dresses to his video content. In Bane’s World’s one and only official music video for “You Say I’m In Love,” you can see the VHS aesthetic prominently coupled with heavy static lines to convey that vintage feel.

Having toured with Inner Wave, Michael Seyer, Sara King, and opened for Mac Demarco, you can expect that Bane’s World will be giving us the scoop on the next era of emerging bedroom pop artists. Last year, he signed onto the same management and booking group (Panache) as Demarco, King Gizzard and the Lizard Wizard and Ty Segall.

Not sure if you changed your stance since the post circulated but men and especially young boys can be fucking raped and not only by men. Just because you're a man does not mean you have experience with sexual trauma. Please educate yourself, you're part of the reason men dont come out and say they were raped or taken advantage of, or even address their trauma.

I’m confused as to what you mean by this.

Tell that to Terry Crews. Or Shane Seyer. Or Gary Funkhouser. Plus, men like Benjamin Glazer have to make very clear that they were never the victims of sexual harassment before the press can knock it off.

Hermesmann v Seyer: Myths and Facts

Myth: Hermesmann established that it is legal for a woman to rape a man.

Fact: Coleen Hermesmann was actually the prosecution in this case, which was a civil suit rather than a criminal case. For that reason, no criminal activity committed by either party was ever examined. Though I was not able to find an exact birthdate for Seyer, he was 13 when Hermesmann became pregnant, and their daughter was born in 1989. Assuming Hermesmann’s pregnancy did not stretch over two calendar years, he would have turned 18 at the latest in 1994, the year after the case was decided. Assuming he’s still alive (he'd be somewhere in mid-40s, so very likely), he’s had at least 26 years to file criminal charges against her without assistance from his parents, but never has.

Myth: Hermesmann handed a female predator money after violating a child.

Fact: The Kansas Department of Social and Rehabilitation Services, who assisted Ms. Hermesmann in this case, ultimately had no intention of collecting the child support.

Myth: Shane Seyer was tried alone in this case, in a similar capacity to an adult.

Fact: His parent were listed by name as plaintiffs in the full name of the case, which also specifically calls him a minor. (Seyer might have turned 18 before the case was ultimately decided, but the civil suit was first filed in 1991.)

Myth: Hermesmann has federal application.

Fact: Hermesmann only got to the Kansas Supreme Court, and thus only applies to one state where less than a percent of the national population lives.

Myth: Hermesmann is an example of the liberalization of America.

Fact: Kansas has not had a Democratic senator since 1939, nor has it been a blue state in presidential elections since 1964. (In that particular election, Johnson ran against Goldwater, who was so notoriously unpopular he only won his home state of Arizona and a few states in the deep south.) If anything, Hermesmann represents an ersatz shotgun wedding.

Myth: “Male empowerment/men’s rights/opposition to the matriarchy” would have prevented the decision reached at Hermesmann.

Fact: Seven justices sit on the Kansas Supreme Court. At the time Hermesmann was decided, six of those were men, who had enjoyed elevated legal, political, economic, and social influence for several decades by virtue of residing in lower courts. These men were under no pressure, economic, political, or sociocultural, to rule in a manner that would appease feminists or anyone else. Chief Justice Holmes and every other male justice on the court who agreed with him made the ruling based on their personal whims.

Myth: The justices who decided Hermesmann did not concern themselves with the welfare of children.

Fact: All justices were born in one of the poorest states in the US, immediately before, during, or immediately after the Great Depression, in a world where smallpox still existed outside labs, and came of age or had their childhoods during the deadliest conflict in human history by total number fallen (in which the chief justice actually served). They were all born into a world marked by poverty, famine, war, and disease. Their early legal careers almost certainly saw cases where poor widows or single mothers whose partners had run off were trying as hard as they could to raise children alone. They saw the issue of granting Seyer revenge or making sure Hermesmann’s child was provided for as a very difficult decision. Though I can sit here and say I don’t agree with it, I can appreciate just how complicated of a moral choice it actually was, especially for those who spent their early lives in a world for which neither I nor almost anyone currently living, in particular those who would use this case as a talking point against me, have any frame of reference.
