Before High Court of Himachal Pradesh at Shimla
Hon’ble Mr. Justice Rajesh Kainthla J on 11.01.2024 partially set aside the order of Trial Court to the extent of allowing the complaint for the Offence of Defamation as calling the complainant ‘corrupt’ in press conference is tarnishing his image in the eyes of public. But will not cause breach of peace or incite a class or a community to cause breach of peace.
Facts
The Petitioner filed a complaint before the Trial Court for the offences punishable under Sections 500, 504, 505(C) of IPC asserting that the accused made a statement in the Press Conference that the petitioner had not toured Kinnaur District but more than 50 times during two years had withdrawn Travelling Allowance amounting to Rs.12,54,145/-.
He toured every district in his capacity as Vice President of Forest Corporation and had drawn the Travelling Allowance of ₹2,00,000/-. The petitioner indulged in corruption.
These words amount to defamation to him in the eye of the public.
The Trial Court recorded the statements of the petitioner and his witnesses and thereafter held that the right of speech and expression is a fundamental right. The public has a right to know.
There was no mensrea. Hence, the complaint was dismissed.
Aggrieved by the order of the Trial Court, present criminal revision is filed before High Court of Himachal Pradesh at Shimla.
Submission of the Petitioner
The petitioner is known for his honesty and integrity.
Right of freedom of speech is not absolute.
The Video recording of the statement was not considered by the Trial Court.
Trial Court misdirected itself while passing the order.
The right to criticism doesn’t include hurling abuses or criticism.
Observation of the High Court
The High Court Cited the Case of State of Haryana v. Bhajan Lal 1992 Supp (1) SCC 335 where in it was held by the Apex Court that if any imputation of corruption is made against person holding high Office, the person can approach the Court u/s 500 IPC for suing for damages.
Allegation that the petitioner had withdrawn the excess amount can amount to criticism of the public official but calling an official ‘Corrupt’ is defamation ‘per se’ & is lowering the image in the eyes of the public.
Article 19 is not absolute but subject to exceptions which includes defamation.
A person can’t tarnish the reputation of a person in the garb of Freedom of expression and speech.
Trial Court fell in error by justifying the accused calling him as ‘Corrupt’.
Nothing was stated in the complaint to infer that words used will cause breach of peace.
Offence of Section 504IPC is not made out.
The statement does not contain any word which intend to invoke or incite a class or community to cause breach of peace.
Calling complainant corrupt will not incite any community or class for breach of peace.

ok so watched rwrb and yes i know adaptions aren’t going to be perfectly book compliant whatever shut the fuck up i don’t care. anyway. my main issue with the film was the inventing of a random journalist to leak the emails (that weren’t even that significant in the first place). maybe it’s the queer poli sci major in me but turning the leak from an ugly attempted political power play into an act of personal vindictiveness takes away the potency of it. thank you and goodnight.

The second of Villa’s Lovecraft-inspired strips, this one is titled from the opening of “The Festival”, which together with “The Shadow Over Innsmouth” informs the plot. As noted at the bottom of the strip, it continues from Furman’s Revelation miniseries (though with the asterisk that this is Dreamwave-amalgamated Seeds of Deception continuity), expanding on the Gorlam Prime subplot begun with Spotlight: Nightbeat. I can't find it now, because google is the absolute worse, so keep in mind this is going entirely off memory and I could be wrong. But yeah, in an article I read, I recall it mentioning Ian Mortimer arguing that the reason why Scrope got the most 'humiliating' punishment was because Scrope used he and Henry sleeping together in his defense and Henry was furious at the affront to his masculinity.
Which, if true, is ahistorical to truly impressive proportions.

speaking. of crime. look, any mass movement is by default going to have and going to need people with a wide range of views, even technically bad ones. to remake society we need a broad coalition, and to change people’s minds, you often first have to engage them (within reason; don’t be annoying). and also, ideological diversity is a boon to our movements; constructive or even general skepticism serves to strengthen our stances and our ability to communicate them. but
it is legitimately a betrayal and a disappointment how many people - liberal, centrist, whatever - jumped on the defund the police and abolition hate train merely because it was under attack from conservatives. to me that indicates not only a lack of a spine, but no sort of solidarity or empathy toward people literally trying to address significant atrocities that take place on a daily basis in our society. its reactionary and anti-intellectual and anti-democratic to argue that a viewpoint should be broadly silenced because it is opposed by people with horrible views or even because it is opposed by some people in general. if you disagree and have an actual criticism, that’s fine. it’s good even. but this whole shit of, well nobody even supports defunding the police! it alienates people! activists are handing elections to republicans by having their own opinions! like what is wrong with you lol. in 1965, only 19% of americans in a gallup poll wanted to see vigorous enforcement of the civil rights act. 42% of those polled said the government was moving too fast in guaranteeing voting rights for black people and the rights of black people to equitable public accommodations. now i for one do not take the results of opinion polls at face value because i always wonder just who in particular they are talking to and all polls are not made equally, obviously. but think about the argument you are making when you ask people to discard issues that matter to them and denigrate activists who in many cases are making significant sacrifices to build a better world. and for what? the abstract concept of electability?

getting really distressed about what feels like people actively trying to drive a wedge between me and the people who make me happy. broadly speaking it's not gonna work, but every so often i'm confronted with, 'well here we have a screenshot of your bestie liking a post that you find personally disturbing'. and i have to be all, 'cool, that's not enough for them to stop being my bestie, i just feel worse now'. and then also i feel like some of the people i care about are ramping up and exaggerating the disturbing stuff as a reaction to all this. it's just creating suffering from every direction, and i'm loathe to talk about it publicly because i fear how people would react if they perceived what i'm saying to be Not On Their Side.
like, i get it, there are people in my life who do or say things i wouldn't do, that i would rather they didn't do, that i might on occasion find upsetting or perhaps unethical. i completely understand people who don't know them (and/or the relevant context) seeing these things and being concerned, offput, alarmed. sometimes i feel that way too. i just wish people would trust me, a person whom anyone who knows my backstory will tell you has Suffered Enough, to make my own judgements about what those things reflect or don't reflect about them as actual people, and to decide for myself who the people are that make me feel safe, happy, and loved. it's not as if i just blindly condone everything my friends ever do. i'm not afraid to talk to them privately about things they've done that i've had issues about, and they do the same with me. a lot of people seem to forget that the interactions that take place in public are just the tip of the social iceberg. shit's complicated, i don't know what to tell you.
