i heard washington was willing to give madison a bureaucratic position should he fail the house race in 1789—what do you think his politics would’ve been like if he was a member of the executive?
This is a really interesting question!! I don't think it would be very different.
So, firstly, the reason Madison wasn't considered seriously by Washington was because Washington had learned through his war experiences that giving appointments based off of seniority was very crucial to not upsetting very influential people, which is why the War and State departments went to General Henry Knox and Thomas Jefferson respectively, and Hamilton was not the first contender for Treasury Secretary. Knox would later get upset whenever Hamilton was selected for assignments before him, further demonstrating the importance of seniority.
Madison, though we know him as the fourth president and a prestigious southern landowner, did not have that kind of reputation in 1789, obviously. In the 1780s, he was still a rising star, and didn't have a whole lot of publicity in his toolbelt. He served in state committees, but only had two national positions, in the Philadelphia Convention (which was temporary) and in the Confederation Congress (but he wasn't particularly important there). While Washington respected him greatly and Jefferson was his friend, he couldn't give him a major appointment, such as being one of his ministers, without offending SOMEONE.
To get into your question, I think his politics would really depend on what department he was in charge of. We can eliminate Treasury because he didn't have any economic qualifications, and while Washington was not aware of Hamilton's financial skills when he appointed him, he intimately knew that Hamilton could manage a department, including the financial aspects. Madison was not particularly managerial, so Hamilton was more qualified in that respect, even though their experience levels were the same in Washington's perspective. And ofc, James Madison didn't know shit about war (i mean, look at how the War of 1812 went. yikes!)

So this leaves the State department and Attorney General. Personally, I think Madison would only really qualify for the latter, since the only diplomatic experience he had was within the United States with the natives. However, Madison was an accomplished lawyer and the largest legal issues at this time concerned the Constitution, which Madison was THE expert of, as the author of the Virginia Plan and the most influential Federalist papers (according to Ellis, Washington was aware of the authors of The Federalist, I don't see how this is possible, but it is to Madison's credit.

Madison's legal career began with the defense of freedom of religion, which we can see in the Constitution, and consistently throughout his life. This is definitely a hill he'd die on, and he was very well educated on it. Basically, just look at the Bill of Rights ("which i wrote/the ink hasn't dried"), and you can see, for the most part, Madison's key beliefs. ACTUALLY i recommend reading the original draft of the Bill of Rights because you can get a more clear picture of what Madison believed should be specified in the Constitution.

Jefferson was a political radical (shocker! he never stopped being absolutely insane), and he definitely pushed Madison. I talked about this in my post about their relationship, however, I want to emphasize that Jefferson did have a perceivable influence on Madison's opinions, and you can see it in their correspondence. And, yes, Jefferson was a manipulative person, but he was also a fellow Virginian who took states' rights very seriously. I think that was the most influential aspect on Madison, was that someone from his home state was in his ear telling him how much injustice was being done to people from his native region, and how he should be fighting back against that. When we see Madison in the executive, he quickly realizes why Washington and Hamilton and the other guys that were in executive positions during the Revolution were Federalists. He struggled so much in 1812, because you cannot wage a war on an united platform, and thats what he and Washington had in common.
It seems like, from this perspective, that if Madison were Attorney General, or even a Secretary, he'd have that realization sooner. I don't think so. If Hamilton, in his hypothetical, was not Secretary of the Treasury, maybe he would, and maybe he'd remain a Federalist, since it was Hamilton's financial plan that caused Madison's switch in political party, but if Hamilton was still Treasury Secretary, Madison would still switch. Hamilton's Report on Public Credit said "fuck you we need to fix this crisis, facts over feelings" to states' rights activists, and Madison and Jefferson took that as a personal attack.

To wrap things up, Madison's core values would not change, and a position in the executive would give him more of a platform to implement them, and that might have affected the judicial reforms around the turn of the century, but I really don't think we'd see a huge jump. A trans-identified male in Kentucky has reached a plea deal after being charged with sexually abusing a baby and will avoid prison so long as he meets certain conditions. Maria Childers, a former daycare worker, hired a prominent trans activist lawyer to represent him in the sickening case.
As previously reported by Reduxx, Childers was arrested in February of 2023 after the Department of Community Based Services (DCBS) received an anonymous tip detailing an alleged incident of abuse that had occurred in November of 2022 at Explore Learning Academy. The tip, reportedly written by one of Childers’ co-workers, accused him of making inappropriate comments towards an infant while changing the child’s diaper, and touching the baby inappropriately.
Reduxx has now obtained court records detailing the full complaint against Childers, which showed that he was accused of both physical and sexual abuse while employed at the daycare.
Following the receipt of the initial anonymous complaint, a DCBS case worker and a police officer from the Paducah Police Department went to the daycare on February 8, 2023, to interview witnesses. After speaking to a number of staff, they were able to corroborate the anonymous report.

According to witness testimony, a co-worker had asked Childers for assistance in changing an infant’s diaper. While Childers was cleaning the baby’s genitals, the co-worker noticed that the infant appeared to be in distress and asked Childers if he was hurting the baby. She then witnessed Childers rub the infant’s genitals in a “circular motion,” while saying “that was her clit area and she likes it. It just made her day.”
While Childers was reported to management at the Academy, he was only given a “write up.” Police later learned that Childers had also been accused by other co-workers of leaving the children in high chairs for “hours” without care.
After being taken to the police station for questioning, Childers initially claimed he had not changed the infant’s diaper at all. He later admitted to having done so after an officer presented him with evidence in the form of a text that he had sent to the daycare’s director confirming the baby’s diaper had been changed. He then tried to deny he had ever said anything inappropriate, but admitted he often said things that were “taken out of context.”
Childers was placed under arrest and charged with one count of 1st Degree Sexual Abuse of a Victim Under 12 and three counts of 1st Degree Criminal Abuse of a Child Under 12. He was then booked at the McCracken County Jail.
There has been some confusion over the spelling of his last name, with the courts, police, and his social feeds having different spellings alternating between “Childers” and “Childres.” The Kentucky Court of Justice has his name spelled “Childres,” but his own signature and defense documents read “Childers.”
While Childers was initially marked as a “male” by both police and the jail, internal documents obtained by Reduxx reveal that his recorded sex was later switched to “female” by the McCracken County Jail.

Court records show that just one month after being booked on the felony charges, Childers privately retained trans activist lawyer Madison LeachMadison Leach to represent him.
Leach, a male who began identifying as a “woman” seven years ago, was the first openly transgender candidate to seek public office in western Kentucky when he ran as a Democrat for the Calloway County attorney seat. Leach recently threatened to leave Kentucky over Senate Bill 150, which would make it optional for public school teachers to use a student’s preferred pronouns.

After some negotiation with the court, the motion was ultimately approved, and Childers’ bond was reduced from $100,000 to $5,000 surety. The bond conditions included no contact with children and to remain away from the daycare where he had been employed. Childers was released from custody in January of 2024.
On January 29, 2024, Childers struck an apparent deal with prosecutors. In exchange for a guilty plea, his charge of 1st Degree Sexual Abuse of a Victim Under 12 was amended to Class A Misdemeanor Sexual Misconduct, and the remaining abuse charges were dropped.

Judge Joseph Roark handed Childers a 12-month penalty, but withheld sentencing and imposed a conditional discharge for 6 months.
If Childers abides by the conditions set by the court during the 6-month period, he will not serve any prison time at all, and may not even receive a criminal record.

Survivors Awake and Texting During Tragic University of Idaho Home Invasion In a shocking revelation, it has come to light that two housemates in an off-campus rental home in Moscow, Idaho, were awake and texting each other during a tragic home invasion that claimed the lives of four of their friends in November 2022. The incident occurred at 4 a.m., resulting in the deaths of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin, following a night out with friends just before Thanksgiving break. The source of this information is a leaked report from grand jurors involved in the case. Although Kaylee Goncalves' father received the information and shared it in a lengthy Air Mail story, neither Goncalves nor his attorney have commented on the matter, likely due to a court-issued restrictive gag order. Steve Goncalves and his attorney have not responded to questions regarding these claims, instead labeling them as a "very poor attempt at getting attention" and "obviously fictional." Awake and Texting During Tragedy According to the report, the two survivors were not only awake during the fatal incident but also communicated via text messages as the attacker moved through the house. Court documents revealed that one of the survivors noticed something suspicious around 4 a.m. This housemate initially believed the sounds were from Kaylee Goncalves playing with her dog on the upper floor but later heard Goncalves say, "There's someone here." When she checked, she saw nothing unusual. Around the same time, Xana Kernodle was alive and using the TikTok app on her phone. The survivor then heard crying from Kernodle's room, located on the same floor. Overhearing a male voice reassuring Kernodle, the housemate "opened her door for the third time" and spotted a masked man leaving through a rear sliding door. This man was described as "not very muscular but athletically built." A Horrific Discovery and Delayed 911 Call Police believe that the victims had all been repeatedly stabbed before 4:25 a.m. However, a 911 call was not made until around noon the following day, originating from one of the survivors' phones. Yet, the identity of the caller remains undisclosed. At the crime scene, a crucial piece of evidence was found next to Madison Mogen's body: a Ka-Bar knife sheath containing Bryan Kohberger's DNA, as authorities allege. The second surviving housemate, who is briefly mentioned in court documents, eventually agreed to an interview with Kohberger's defense team in April after resisting a subpoena. Legal Proceedings and Future Court Date The prosecution's case relies heavily on evidence such as the sheath, the suspect vehicle, and phone records. The Air Mail story alluded to the existence of a secret informant who would provide undisclosed testimony. Prosecuting Attorney Bill Thompson has expressed the intention to seek the death penalty should Kohberger be convicted. Kohberger faces four charges of first-degree murder and a felony burglary count. MADISON, Wis. -- A man accused of killing six people and injuring dozens more when he allegedly drove his SUV through a Christmas parade in suburban Milwaukee last year has decided to mount an insanity defense, his attorneys said Monday.
Darrell Brooks Jr. faces more than 80 charges, including six homicide counts, in connection with the Nov. 21 incident in Waukesha. He pleaded not guilty in February. During a hearing Monday one of his attorneys, Jeremy Perri, told Judge Jennifer Dorow that Brooks is changing his plea to not guilty by reason of mental disease or defect.
Perri did not elaborate. The judge ordered a mental evaluation for him.
When a defendant enters such a plea under Wisconsin law a judge or jury must determine whether he's guilty or innocent of the alleged crime. If the defendant is found guilty, a judge or jury must determine whether the defendant was mentally responsible for his conduct at the time of the offense. Such a determination could result in the defendant being committed to a mental health facility rather than prison.
Perri announced the change after Dorow refused a defense request to move the trial out of Waukesha County or bring in jurors from outside the county. Perri has argued that the publicity around the incident has been so intense and so overwhelmingly negative that Brooks can't get a fair trial in the county.
Dorow said that she has found media coverage has been prolific but objective and jurors aren't required to be ignorant of a case. She went on to say that internet analytics show interest in articles about the parade has waned since the first few weeks immediately following the incident and she was confident the court could assembly a pool of about 150 prospective jurors who could decide the case fairly.
The criminal complaint detailing the charges against Brooks describes how he allegedly drove into crowds of onlookers during the parade. People bounced off his vehicle as police ordered him to stop. Police arrested Brooks later that night.
Brooks is being held on a $5 million cash bond. He appeared at Monday's hearing in a surgical mask and an an orange jail T-shirt. He said nothing throughout the proceeding.
His trial had been scheduled to begin Oct. 3 and last all month. It wasn't immediately clear if that date will stand given Brooks' new plea.

Here are 10 important information that was that were made public on Thursday. A roommate spotted a mask-wearing man. Investigators have previously claimed that two of the roommates who were in the home on the night of the incident and who were not attacked were asleep. The evidence shows they both awoke at around 4 a.m. after hearing sounds that a man's voice was heard and crying. This was about the time that the police believe the murders took place. The roommate, as per the documents, observed from her room when the man dressed in black wearing a mask over his face made his way to the back door of the home. She said she locked her bedroom door at this point but it's unclear in the documents what happened afterwards. The authorities were not summoned to the site in more than seven hours. Investigators located an uncut knife at the scene. In an upstairs bedroom in which two victims -two of them - Madison Mogen and Kaylee Goncalves were discovered dead, police said they discovered a brown leather knife sheath. The police reported that they could obtain the DNA of an unidirectional snap on the sheath. Later, they discovered a link between that sample and the DNA at Mr. Kohberger's parents' house in Pennsylvania. A victim could have been asleep. The coroner has suggested that the victims were likely asleep during the killings, the investigators have suggested in the court documents that at least one could be awake. Xana Kernodle was the recipient of the DoorDash delivery at around 4 a.m. Just prior to when the vehicle arrived in the form of a white car police said. An investigation of her mobile also indicated that she was on the TikTok app about 4:12 a.m. An officer from the campus found Kohberger's vehicle. With the surveillance footage in their possession, the police began searching the area in search of white Hyundai Elantras and an officer on campus at Washington State University found one in November, which was registered at the address of Kohberger. Kohberger. Investigators have said that they have reviewed photos of. Kohberger and found that his physical appearance was similar to the memory of the roommate who observed a man inside the house. This included his height, build , and eyebrows with bushy hair. Police initially stated that they were searching for an 2011-13 Elantra however, they later discovered that it could be an earlier model year, that was released in 2016. Mr. Kohberger had a 2015 Elantra. Kohberger's cell phone was disconnected in the aftermath of the murders. At the end of December investigators were able obtain records about the whereabouts that Mr. Kohberger's phone. The police records revealed that he visited the area of the crime scene on a dozen occasions prior to the night of killings, as stated in the police statement. On the night of murders, his cell phone was on in Pullman in the early hours of 2:47 a.m. The phone was then disconnected from the network. The phone connected on the Internet at approximately 4:48 a.m. The phone was located at an area of about a mile southwest from the University of Idaho. The phone later returned to Pullman. The police believe that the suspect might return to the scene of the crime. After the killings in the early hours of 9:12 a.m. the victim, Mr. Kohberger's cell phone was discovered in Moscow and connected to the cellular network in close proximity to the scene of the crime and remained there for nine minutes according to the police reports. The phone was then returned to the location of his residence in Pullman. In the morning, nobody was calling 911 and police hadn't yet arrived at the scene of the crime. An DNA test was collected from a trash bin in Pennsylvania. In the days following the acquisition of Mr. Kohberger's phone numbers Investigators were in Pennsylvania which is in the state where Kohberger was a resident. Kohberger had driven for the holidays with his dad. Agents in the area found trash at the residence belonging to the Mr. Kohberger's relatives and transported the trash to Idaho. Investigators claimed they were able to link a DNA profile that was found in the trash with the DNA sample taken from the knife sheath that was found at the scene of the murder. The results, the police claimed, proved that the father of Kohberger was the one who had left DNA on the knife. The prosecutors suspect Abigail, another student who had served time but was acquitted for the murder of her boyfriend in Spain. They discuss whether it is too early to pursue Abigail and ultimately decide to take her in.
They visit her mother, who is unaware of her whereabouts. They inspect her room and find that she has been sleeping in the cellar. Her mother explains that she has been struggling to adjust since her release from prison. They discover a piece of artwork under her bed from Todd, who seems to be an admirer.
They locate him. They follow him home, where a Spanish bounty hunter joints them. Todd denies seeing Abigail. They sneak into the house with guns drawn and take Abigail in for questioning. Nagel attempts to speak with her, but she becomes angry and violent, attacking Dawson. They restrain her.

Spain is seeking Abigail's extradition for a retrial. Peter has gone to court to prevent this from happening. The judge has given Peter 48 hours to file charges officially, or Abigail will be handed over to Spain. A celebrity website published a picture of Abigail in the escape room. Dawson and Nagel have tracked down the person who took the photo and are creating a timeline. Abigail appears to be innocent of Kennedy's murder. The detectives visit her in the hospital to gather more information about her friends, who are now the primary suspects.
Nagel and Dawson investigate the crime scene and discover a gun, which makes Abigail a material witness in the case. Upon dusting the gun, they find two sets of fingerprints, one of which belongs to Kennedy. As a result, she is now the owner of the gun.

Kennedy's father admits to buying her the gun because he was worried for her safety. Although she didn't have any enemies, she had a run-in with a political group at her college. They head to the college to talk to the Madison Club. It was discovered that Kennedy had an issue with her English teacher. The teacher frequently expressed their left-wing views, which Kennedy disagreed with. During a class, Kennedy saw something on her phone and the teacher confiscated it. Kennedy planned to file a complaint about the incident.
Nagel and Dawson visit the teacher and question him about his confrontation with her in the student union. They leave after he mentions that Kennedy had a gun in the escape room, which was public knowledge. They return and question more students. During the trial, it was discovered that Bethany, a student who was present, had left a second set of fingerprints. The defense attempted to argue that the defendant acted in self-defense.
Kennedy's father testified, explaining that his wife had been raped and murdered in their home when Kennedy was young. He bought her a gun to help protect herself.
During the trial, Peter cross-examines Kennedy's English teacher while Bethany watches with a smile. He criticises gun owners. Bethany takes the stand. She testifies that she had never met Kennedy before and admits that there was a struggle and that Kennedy had a gun. She shot her because she believed Kennedy was going to shoot her. She apologized to the jury.
During dinner, the prosecution meets with Nagel and Dawson and discovers that Bethany had a connection to Kenned, which Abigail had previously disclosed. Abigail testifies and successfully proves that Bethany is lying. However, the defense attempts to discredit her by bringing up her past troubles in Spain and current extradition issues, causing her to break down in tears on the stand.

During the trial, the prosecution discovered that both the professor and Bethany had used the same quote about shooting up an NRA office in their interviews. Bethany had included it in a story she wrote for class. The following day, Peter questioned Bethany about her relationship with the professor, which caused her to break down on the stand. Bethany viewed the professor as a father figure, and Kennedy's threats towards him were a threat to her. In an attempt to stop Kennedy from ruining her life, Bethany shot her. As a result, Bethany was convicted and sentenced.

But over 400 people sent her donations. As part of the 10-year suspended sentence handed down Friday, she was ordered to pay $39,000 in restitution and a $1,370 fine. If she stays out of trouble for three years of probation, she'll stay free.The Bettendorf woman pleaded guilty in June to first-degree theft. In court on Friday, Judge John Telleen declined a defense request that would have wiped the conviction off her record if she completes probation successfully. He said people who deal with her in the future should know that she once engaged in a “criminal scheme,” and that “serious crimes must have serious consequences.”“Through this scheme, you deceived your friends, your family, your community, other cancer victims, charities and strangers who were motivated by your supposedly tragic story to donate to help support you,” the judge said.Russo told the court she made her story up because she hoped her fake cancer battle would force her troubled family to focus on her.“A lot of people have made speculation as to why I did this and how somebody who looked like they had everything together could have such a mess,” she said. “I didn't do this for money or greed. I didn't do this for attention. I did this as an attempt to get my family back together.”Her sentence also includes 100 hours of community service. She paid the $39,000 restitution earlier, and the money was being held by the court. GoFundMe has already sent refunds to donors.Her scam unraveled when medical professionals spotted discrepancies in her story online. Police subpoenaed her medical records and found she had never been diagnosed with cancer at any medical facility in the area. She was arrested in January.Scott County prosecutor Kelly Cunningham recommended against prison time because Russo had no criminal history, had good grades in college, was employed and was unlikely to reoffend. That bothered Rhonda Miles, who runs a pancreatic cancer foundation in Nashville, Tennessee, that donated to Russo and testified at the hearing.“It was devastating to sit there and watch the Scott County prosecuting attorney act like a defending attorney, so that was tough,” Miles said. “And I think she’ll have a lot of questions to answer from the locals on that at some point. Why were you defending this girl when you were supposed to be prosecuting?”Russo apologized to the court and her victims, and said she wished she had sought out help regarding her family.“I fully acknowledge what I did was wrong. And I'm incredibly sorry," she said through sobs. "If there was anything I could do to take it back I would. The reality is I can't.”

Wisconsin Governor Evers Appoints Mark A. Huesmann to the La Crosse County Circuit Court MADISON, WI (STL.News) Wisconsin Governor Tony Evers announced Friday his appointment of Mark A. Huesmann to the La Crosse County Circuit Court – Branch 3.  The appointment will fill the vacancy created by Judge Todd W. Bjerke's retirement, effective July 31, 2023.  Huesmann will complete a term ending July 31, 2024. "As a veteran and through his work with the veteran community, as professor and resource for students in our UW System, and as a court commissioner and municipal court judge, Mark Huesmann has demonstrated a profound commitment to justice and service in our state," said Gov. Evers. "His decades of experience and dedication will make him an excellent judge for the people of La Crosse County." For the past 16 years, Husemann has served as a court commissioner for Judge Bjerke, and since 2020, he has served as the Coulee Region Joint Municipal Court judge.  For more than two decades, he has also operated his own law office as a general practice trial attorney, representing clients in the areas of employment and business law, real estate, bankruptcy, criminal defense, family law, and personal injury.  Outside of the courtroom, Huesmann teaches at the University of Wisconsin (UW)-La Crosse in the College of Business as an adjunct instructor and now as a professor.  He has also been an attorney advisor for the UW-La Crosse Student Life Office, where he provides legal advice and assistance to students. Huesmann received a bachelor's degree from UW-Milwaukee and then went on to earn his Juris Doctorate from the University of North Dakota School of Law.  While in high school, Huesmann became involved with the United States Army Reserves and retired at the rank of Lieutenant Colonel in 2014.  During his service, he was deployed to Afghanistan in 2010, and he received the Bronze Star for his service in 2011.  Due to his military background, Judge Bjerke asked Huesmann to join the initiative to develop a veterans treatment court in 2009, and the treatment court came to fruition in 2010.  This work also resulted in the creation of the La Crosse Area Veteran Mentor Program, for which Huesmann has served as both a legal advisor and a member of the board of directors.  He will take over the veterans' treatment court upon Judge Bjerke's retirement. "I am grateful and humbled by this opportunity to serve the people of La Crosse County as a circuit court judge," said Huesmann.
