Trump and allies plot revenge, Justice Department control in a second term | The Washington Post

Donald Trump and his allies have begun mapping out specific plans for using the federal government to punish critics and opponents should he win a second term, with the former president naming individuals he wants to investigate or prosecute and his associates drafting plans to potentially invoke the Insurrection Act on his first day in office to allow him to deploy the military against civil demonstrations.

In private, Trump has told advisers and friends in recent months that he wants the Justice Department to investigate onetime officials and allies who have become critical of his time in office, including his former chief of staff, John F. Kelly, and former Attorney General William P. Barr, as well as his ex-attorney Ty Cobb and former Joint Chiefs of Staff chairman Gen. Mark A. Milley, according to people who have talked to him, who, like others, spoke on the condition of anonymity to describe private conversations. Trump has also talked of prosecuting officials at the FBI and Justice Department, a person familiar with the matter said.

In public, Trump has vowed to appoint a special prosecutor to “go after” President Biden and his family. The former president has frequently made corruption accusations against them that are not supported by available evidence.

To facilitate Trump’s ability to direct Justice Department actions, his associates have been drafting plans to dispense with 50 years of policy and practice intended to shield criminal prosecutions from political considerations. Critics have called such ideas dangerous and unconstitutional.

“It would resemble a banana republic if people came into office and started going after their opponents willy-nilly,” said Saikrishna Prakash, a constitutional law professor at the University of Virginia who studies executive power. “It’s hardly something we should aspire to.”

Much of the planning for a second term has been unofficially outsourced to a partnership of right-wing think tanks in Washington. Dubbed “Project 2025,” the group is developing a plan, to include draft executive orders, that would deploy the military domestically under the Insurrection Act, according to a person involved in those conversations and internal communications reviewed by The Washington Post. The law, last updated in 1871, authorizes the president to deploy the military for domestic law enforcement.

The proposal was identified in internal discussions as an immediate priority, the communications showed. In the final year of his presidency, some of Trump’s supporters urged him to invoke the Insurrection Act to put down unrest after the murder of George Floyd in the summer of 2020, but he never did it. Trump has publicly expressed regret about not deploying more federal force and said he would not hesitate to do so in the future.

Trump campaign spokesman Steven Cheung did not answer questions about specific actions under discussion. “President Trump is focused on crushing his opponents in the primary election and then going on to beat Crooked Joe Biden,” Cheung said. “President Trump has always stood for law and order, and protecting the Constitution.”

The discussions underway reflect Trump’s determination to harness the power of the presidency to exact revenge on those who have challenged or criticized him if he returns to the White House. The former president has frequently threatened to take punitive steps against his perceived enemies, arguing that doing so would be justified by the current prosecutions against him. Trump has claimed without evidence that the criminal charges he is facing — a total of 91 across four state and federal indictments — were made up to damage him politically.

“This is third-world-country stuff, ‘arrest your opponent,’” Trump said at a campaign stop in New Hampshire in October. “And that means I can do that, too.”

Special counsel Jack Smith, Attorney General Merrick Garland and Biden have all said that Smith’s prosecution decisions were made independently of the White House, in accordance with department rules on special counsels.

Trump, the clear polling leader in the GOP race, has made “retribution” a central theme of his campaign, seeking to intertwine his own legal defense with a call for payback against perceived slights and offenses to right-wing Americans. He repeatedly tells his supporters that he is being persecuted on their behalf and holds out a 2024 victory as a shared redemption at their enemies’ expense.

It is unclear what alleged crimes or evidence Trump would claim to justify investigating his named targets.

Kelly said he would expect Trump to investigate him because since his term as chief of staff ended, he has publicly criticized Trump, including by alleging that he called dead service members “suckers.” Kelly added, “There is no question in my mind he is going to go after people that have turned on him.”

Barr, another Trump appointee turned critic, has contradicted the former president’s false claims about the 2020 election and called him “a very petty individual who will always put his interests ahead of the country’s.” Asked about Trump’s interest in prosecuting him, Barr deadpanned, “I’m quivering in my boots.”

“Trump himself is more likely to rot in jail than anyone on his alleged list,” said Cobb, who accused Trump of “stifling truth, making threats and bullying weaklings into doing his bidding.”

Milley did not comment.

Other modern presidents since the Watergate scandal — when Richard M. Nixon tried to suppress the FBI’s investigation into his campaign’s spying and sabotage against Democrats — have sought to separate politics from law enforcement. Presidents of both parties have imposed a White House policy restricting communications with prosecutors. An effort under the George W. Bush administration to remove U.S. attorneys for political reasons led to high-level resignations and a criminal investigation.

Rod J. Rosenstein, the Trump-appointed deputy attorney general who oversaw the investigation by special counsel Robert S. Mueller III into Russian interference in the 2016 election, said a politically ordered prosecution would violate the 14th Amendment’s guarantee of equal protection under law and could cause judges to dismiss the charges. That constitutional defense has rarely been raised in U.S. history, Rosenstein said.

“Making prosecutorial decisions in a nonpartisan manner is essential to democracy,” Rosenstein said. “The White House should not be meddling in individual cases for political reasons.”

But Trump allies such as Russ Vought, his former budget director who now leads the Center for Renewing America, are actively repudiating the modern tradition of a measure of independence for the Department of Justice, arguing that such independence is not in law or the Constitution. Vought is in regular contact with Trump and would be expected to hold a major position in a second term.

“You don’t need a statutory change at all, you need a mind-set change,” Vought said in an interview. “You need an attorney general and a White House Counsel’s Office that don’t view themselves as trying to protect the department from the president.”

A FIXATION ON PROSECUTING ENEMIES

As President, Kelly said, Trump would often suggest prosecuting his political enemies, or at least having the FBI investigate them. Kelly said he would not pass along the requests to the Justice Department but would alert the White House Counsel’s Office. Usually, they would ignore the orders, he said, and wait for Trump to move on. In a second term, Trump’s aides could respond to such requests differently, he said.

“The lesson the former president learned from his first term is don’t put guys like me … in those jobs,” Kelly said. “The lesson he learned was to find sycophants.”

Although aides have worked on plans for some other agencies, Trump has taken a particular interest in the Justice Department. In conversations about a potential second term, Trump has made picking an attorney general his number one priority, according a Trump adviser.

“Given his recent trials and tribulations, one would think he’s going to pick up the plan for the Department of Justice before doing some light reading of a 500-page white paper on reforming the EPA,” said Matt Mowers, a former Trump White House adviser.

Jeffrey Clark, a fellow at Vought’s think tank, is leading the work on the Insurrection Act under Project 2025. The Post has reported that Clark is one of six unnamed co-conspirators whose actions are described in Trump’s indictment in the federal election interference case.

Clark was also charged in Fulton County, Georgia, with violating the state anti-racketeering law and attempting to create a false statement, as part of the district attorney’s case accusing Trump and co-conspirators of interfering in the 2020 election. Clark has pleaded not guilty. As a Justice Department official after the 2020 election, Clark pressured superiors to investigate nonexistent election crimes and to encourage state officials to submit phony certificates to the electoral college, according to the indictment.

In one conversation described in the federal indictment, a deputy White House counsel warned Clark that Trump’s refusing to leave office would lead to “riots in every major city.” Clark responded, according to the indictment, “That’s why there’s an Insurrection Act.”

Clark had dinner with Trump during a visit to his Bedminster, N.J., golf club this summer. He also went to Mar-a-Lago on Wednesday for a screening of a new Dinesh D’Souza movie that uses falsehoods, misleading interviews and dramatizations to allege federal persecution of Jan. 6 rioters and Christians. Also attending were fringe allies such as Stephen K. Bannon, Roger Stone, Laura Loomer and Michael Flynn.

“I think that the supposedly independent DOJ is an illusion,” Clark said in an interview. Through a spokeswoman he did not respond to follow-up questions about his work on the Insurrection Act.

Clark’s involvement with Project 2025 has alarmed some other conservative lawyers who view him as an unqualified choice to take a senior leadership role at the department, according to a conservative lawyer who spoke on the condition of anonymity to describe private talks. Project 2025 comprises 75 groups in a collaboration organized by the Heritage Foundation.

Project 2025 director Paul Dans stood by Clark in a statement. “We are grateful for Jeff Clark’s willingness to share his insights from having worked at high levels in government during trying times,” he said.

After online publication of this story, Rob Bluey, a Heritage spokesman, said: “There are no plans within Project 2025 related to the Insurrection Act or targeting political enemies.”

HOW A SECOND TRUMP TERM WOULD DIFFER FROM THE FIRST

There is a heated debate in conservative legal circles about how to interact with Trump as the likely nominee. Many in Trump’s circle have disparaged what they view as institutionalist Republican lawyers, particularly those associated with the Federalist Society. Some Trump advisers consider these individuals too soft and accommodating to make the kind of changes within agencies that they want to see happen in a second Trump administration.

Trump has told advisers that he is looking for lawyers who are loyal to him to serve in a second term — complaining about his White House Counsel’s Office unwillingness to go along with some of his ideas in his first term or help him in his bid to overturn his 2020 election defeat.

In repeated comments to advisers and lawyers around him, Trump has said his biggest regrets were naming Jeff Sessions and Barr as his attorneys general and listening to others — he often cites the “Federalist Society” — who wanted him to name lawyers with impressive pedigrees and Ivy League credentials to senior Justice Department positions. He has mentioned to several lawyers who have defended him on TV or attacked Biden that they would be a good candidate for attorney general, according to people familiar with his comments.

The overall vision that Trump, his campaign and outside allies are now discussing for a second term would differ from his first in terms of how quickly and forcefully officials would move to execute his orders. Alumni involved in the current planning generally fault a slow start, bureaucratic resistance and litigation for hindering the president’s agenda in his first term, and they are determined to avoid those hurdles, if given a second chance, by concentrating more power in the West Wing and selecting appointees who will carry out Trump’s demands.

Those groups are in discussions with Trump’s campaign advisers and occasionally the candidate himself, sometimes circulating policy papers or draft executive orders, according to people familiar with the situation.

“No one is opposed to them putting together ideas, but it’s not us,” a campaign adviser said. “These groups say they’ll have the whole transition planned. Some of those people I’m sure are good and Trump will appoint, but it’s not what is on his mind right now. I’m sure he’d be fine with some of their orders.”

Trump’s core group of West Wing advisers for a second term is widely expected to include Stephen Miller, the architect of Trump’s hard-line immigration policies including family separation, who has gone on to challenge Biden administration policies in court through a conservative organization called America First Legal. Miller did not respond to requests for comment.

Alumni have also saved lists of previous appointees who would not be welcome in a second Trump administration, as well as career officers they viewed as uncooperative and would seek to fire on an executive order to weaken civil service protections.

For other appointments, Trump would be able to draw on lineups of personnel prepared by Project 2025. Dans, a former Office of Personnel Management chief of staff, likened the database to a “conservative LinkedIn,” allowing applicants to present their resumes on public profiles, while also providing a shared workspace for Heritage and partner organizations to vet the candidates and make recommendations.

“We don’t want careerists, we don’t want people here who are opportunists,” he said. “We want conservative warriors.”

Lavrentiy Beria, the most ruthless and longest-serving secret police chief in Joseph Stalin’s reign of terror in Russia and Eastern Europe, bragged that he could prove criminal conduct on anyone, even the innocent.

“Show me the man and I’ll show you the crime” was Beria’s infamous boast. He served as deputy premier from 1941 until Stalin’s death in 1953, supervising the expansion of the gulags and other secret detention facilities for political prisoners. He became part of a post-Stalin, short-lived ruling troika until he was executed for treason after Nikita Khrushchev’s coup d’etat in 1953.

Beria targeted “the man” first, then proceeded to find or fabricate a crime. Beria’s modus operandi was to presume the man guilty, and fill in the blanks later. By contrast, under the United States Constitution, there’s a presumption of innocence that emanates from the 5th, 6th, and 14th Amendments, as set forth in Coffin vs. U.S. (1895).

Unlike Beria’s paradigm, U.S. prosecutions start with the discovery of a crime. Then there’s an investigation to find or confirm the identity of the perpetrator and collect evidence to prove his or her guilt.

However, Special Counsel Robert Mueller’s appointment and subsequent investigation into alleged collusion between Russia and the Trump campaign appear to follow the Beria model, not the U.S. Constitution model.

To call the Mueller probe a “witch hunt” is an insult to witches.

Lifelong Democrat Alan Dershowitz, Felix Frankfurter Professor Emeritus at Harvard Law School, voted for Hillary Clinton in 2016. He says Mueller, like other Special Counsel before him, is engaging in the “criminalization of politics.” Dershowitz states unequivocally that there was no probable cause to believe any crime was committed by Trump or his campaign. In fact, “collusion” in a political campaign is not a crime.

Moreover, constitutional law scholar Dershowitz says it is impossible for a sitting President to obstruct justice in the carrying out of his Article II powers, including the absolute right to fire former FBI Chief James Comey. But don’t take Professor Dershowitz’s word for it. Take a look at the articles written in the past year by former Assistant U.S. Attorney for the Southern District of New York Andrew McCarthy, and historian and Hoover Institute scholar Victor Davis Hanson.

There are many facets of the Mueller investigation that should trouble every citizen: the Comey memo describing how James Clapper wanted Comey to mention the Russia Ritz-Carlton episode in Comey’s meeting with Trump to give CNN the “hook” it needed to publish the nasty details; the fact that Assistant Attorney General Rod Rosenstein is in the middle of everything—Sessions’ recusal, Comey’s firing, Mueller’s appointment, the apparent enlargement of Mueller’s charge in the “scope” memo, which Rosenstein has refused to produce to Congress; the bias against Trump reflected in the tweets and actions of the bureaucrats and special agents at the top of the DOJ and FBI; DOJ’s consistent refusal to turn over documents to Congress; the Gestapo-like tactics used by Mueller, including the pre-dawn, no-knock raid on Paul Manafort’s home; the seizure of documents covered by attorney-client privilege in the search of Trump Attorney Michael Cohen’s office; and the shameful destruction of General Mike Flynn’s career for a “lie” the investigating FBI agents said did not occur.

And most telling, the discovery this week that most of the redactions by DOJ in the few documents they have produced are there to protect the reputation of those at the top of DOJ and FBI, and not to keep intelligence “sources and methods” secret.

Rosenstein’s vague charge to Mueller to investigate “links and/or coordination between the Russian government” and the Trump campaign is vague and open-ended, and an invitation for runaway Special Counsel Mueller to pursue Trump with the zeal of Police Inspector Javert hot on the trail of Jean Valjean.

LaVey lost ownership of the house in 1991 as the result of a court settlement resulting from his separation from Diane Hegarty, but LaVey was allowed to reside at the Black House until his death from poor health, increasing paranoia, and a pulmonary edema on October 29, 1997 at St. Mary’s Medical Center in San Francisco, CA. Following LaVey's death, members of the Church of Satan unsuccessfully attempted to raise funds to repurchase the house, and it was demolished on October 17, 2001. A duplex now stands in its place. On February 2, 1998, Anton LaVey's estranged daughter Zeena Schreck and her then husband Nikolas Schreck published a nine-page "fact sheet", in which they endorsed Wright's earlier allegations and claimed that many more of LaVey's stories about his life had been false.

LEGEND: Anton LaVey purchased the house at 6114 California Street (which would later become the headquarters of the Church of Satan - the infamous "Black House") because he discovered on first inspection that it was the former brothel of Barbary Coast madam Mammy Pleasant. The house was honeycombed with trapdoors and secret passageways, built by Pleasant to elude police raids.

REALITY: 6114 was Anton LaVey's parents' home. It was never a brothel, nor did Mammy Pleasant ever live or work there. Anton LaVey's parents first allowed Anton LaVey and his first wife Carole to live in the house, then transferred ownership of it to Anton LaVey and his second wife Diane in 1971. Such secret passages and hidden rooms that exist were constructed by Anton LaVey.

LEGEND: On the night of April 30, 1966 (the German Satanic festival of Walpurgisnacht), Anton LaVey in a "blinding flash" declared himself the High Priest of Satan, proclaimed that the Age of Satan had begun, and founded the Church of Satan as a religious institution.

REALITY: In 1966 Anton LaVey supplemented his income by presenting weekend lectures on exotic and occult topics, and by conducting "Witches' Workshops". He charged $2 a head, filling his living room with the curious and establishing a local reputation as an eccentric. Professional publicist Edward Webber suggested to Anton LaVey that he "would never make any money by lecturing on Friday nights for donations … it would be better to form some sort of church and get a charter from the State of California … I told Anton at the time that the press was going to flip out over all this and that we would get a lot of notoriety". In the summer of 1966, long after the fictional founding-date invented later, a newspaper article about Anton LaVey's lectures offhandedly referred to him as "priest of the Devil's church". This mixture of Webber's idea and the newspaper's characterization resulted in the creation of the Church of Satan as a business and publicity vehicle. Jack Webb, a San Francisco Police investigator who knew Anton LaVey from the "Lost Weekend" nightclub, also suggested that he should form a church of some kind to exploit his recondite knowledge.

LEGEND: Anton LaVey's trademark shaved head was the result of a ceremonial head-shaving on April 30, 1966, to formalize his role as High Priest of Satan. This ritual was performed in the tradition of the Yezidi devil-worshipping tribes of Iraq, who were said to have carried out a similar ceremony.

REALITY: Anton LaVey shaved his head in the summer of 1966 due to a light-hearted dare from his wife. The "LaVey look" had nothing to do with the Church of Satan founding nor any mystical meaning attached to it later. Nor do Yezidi qawwals (religious teachers) shave their heads.

LEGEND: In 1966 Anton LaVey personally designed the Baphomet emblem of the Church of Satan. He owns the right to this design, claiming it cannot be reproduced without obtaining licensing rights from the Church of Satan.

REALITY: The Baphomet emblem used by the Church of Satan was neither original to it nor created by Anton LaVey, hence cannot be trademarked. The original Baphomet dates at least as far back as the medieval Knights Templar. The artwork for the current emblem's goat/pentagram first appears in a 1931 book by Oswald Wirth. The complete emblem with the added circles and "LVYThN" Hebrew letters appears on the cover of a book by Maurice Bessy two years before the creation of the Church of Satan. Early photos of Church activities often show Anton LaVey or his disciples using the Bessy book as a photo-prop because of its prominent cover-Baphomet, and he included that book in his Compleat Witch bibliography. The Baphomet, including this rendition of it, is clearly in the public domain.

Pressed for material to meet Avon's deadline, Anton LaVey resorted to plagiarism, assembling extracts from an obscure 1896 tract - Might is Right by Ragnar Redbeard into a "Book of Satan" for the SB, and claiming its authorship by himself. [Ironically these MiR passages are the ones most frequently quoted by Anton LaVey disciples.] Another third of the SB consists of John Dee's "Enochian Keys", taken directly but again without attribution from Aleister Crowley's Equinox. The SB's "Nine Satanic Statements", one of the Church of Satan's central doctrines, is a paraphrase, again unacknowledged, of passages from Ayn Rand's Atlas Shrugged. The last words in the SB - "Yankee Rose" - have been puzzled over for years by readers. "YR" is actually the name of an old popular tune in Anton LaVey's nightclub repertoire.

LEGEND: Anton LaVey claimed to be a multimillionaire, owning three homes in northern California, a convent in Italy, a chateau in France, a fleet of luxury automobiles, a 185-foot yacht, three salvage ships, and other property.

REALITY: During Diane [LaVey] Hegarty's 1988-91 lawsuit against Anton LaVey, and Anton LaVey's subsequent 1991 filing for bankruptcy, Anton LaVey stipulated under oath that he owned nothing more than 50% of the house his parents had given jointly to him and Diane, along with the personal items he kept therein. Anton LaVey's final years were subsidized by California state aid. Assessors declared the house to be in such poor repair as to be nearly worthless on the real estate market. Family members have attested to the fact that by the mid-1970s the LaVeys lived in near-poverty, frequently having to rely upon Anton LaVey's father's generosity. According to other LaVey relatives, Anton LaVey continued to rely on handouts from friends and relatives until the end of his life.

LEGEND: Anton LaVey presented himself as a loving family man.

REALITY: Anton LaVey violently beat his wife Diane throughout their marriage. In 1984 a police report was made describing Diane being strangled into unconsciousness by Anton LaVey, who was in such a murderous rage that his daughter Karla had to pull him off Diane and drag her outside the house to save her life. Anton LaVey routinely physically beat and abused those of his female disciples with whom he had sex, forcing them into prostitution as part of his "Satanic counseling" and collecting their earnings. In 1986 Anton LaVey was a passive witness to the sexual molestation of his own grandson by a longtime friend who was later convicted of sex crimes with minors. In 1990 Anton LaVey informed a mentally-ill stalker of his daughter Zeena of her whereabouts and the time & location of a public appearance she was scheduled to make, deliberately endangering her life.

LEGEND: Anton LaVey had a deeply affectionate relationship with Togare, his pet lion.

REALITY: While Anton LaVey was always careful to portray himself to the public as an animal lover, in private he was cruel to and neglectful of his pets. When he was given Togare as a cub in 1964, he was ill-equipped to deal with such an exotic, wild animal despite his pretensions as a circus lion-tamer. As Togare became larger and more unruly, Anton LaVey frequently used an electric cattle prod to hurt and frighten him into submission. Many animal-rights proponents, including Togare's final owner Tippi Hedren, agree that it is detrimental to a wild animal's development to be raised in a domestic environment. Anton LaVey was arrested due to Togare's unruly behavior, and Anton LaVey was ordered to donate him to the San Francisco Zoo. After complying, Anton LaVey made only two visits to Togare. Due to the trauma of his early life, Togare needed special care at the Zoo and at every animal-care facility in which he subsequently lived.

LEGEND: Anton LaVey had a deeply affectionate relationship with his other pets.

REALITY: In the late 1960s Anton LaVey acquired a Doberman Pinscher (Loki) as an accent to his "sinister" image. Anton LaVey never took the time to housebreak or train Loki, and relegated him to the overgrown and unkempt backyard of the house, regardless of weather. If Loki ever tried to slip into the house for shelter, Anton LaVey routinely used Togare's cattle-prod on him to terrify him back outside. In his old age Loki developed such severe arthritis that he could not climb the stairs to the back door to eat, and began wasting away from malnutrition. Anton LaVey then gave him to one of his prostitute "students", who at least saw that Loki had a warm, inside home until he died a few months later. During her young childhood Anton LaVey's daughter Zeena once awoke late at night to hear slamming sounds and the shrieking of her German Shepherd puppy. Running downstairs, she saw Anton LaVey savagely beating the cowering, cornered dog with a wooden plank. When Zeena begged Anton LaVey to stop and asked him what the dog had done to deserve such treatment, Anton LaVey screamed, "She won't listen to me! I'm going to force her to obey me!" Anton LaVey continued beating the dog until her face was covered with her blood, then dropped the plank and left the dog quivering in the hallway, so injured and frightened that she wouldn't let even Zeena come near her. This incident left the dog traumatized for a long time afterwards.

Republican Subpoenas Justice For Clinton Documents

Content of the article WASHINGTON - The Republican chairman of the House Judiciary Committee is subpoenaing documents from the Justice Department as part of the committee's investigation into Democrat Hillary Clinton.

Article content Virginia's Robert Goodlatte has asked for more than 1 million documents as the department investigates its 2016 investigation into Clinton's private email server. He is also demanding documents related to the firing of former deputy FBI Director Andrew McCabe, who was dismissed by Attorney General Jeff Sessions last week.

Sessions stated that McCabe was dismissed on the advice of FBI officials who claimed McCabe had not been forthcoming with a watchdog investigation. The report due to be released by the inspector general will conclude that McCabe allowed the release of information to the media. However, McCabe was not forthcoming with the watchdog when it examined the bureau's handling of the investigation into Clinton’s emails.

Goodlatte wrote to Rod Rosenstein, stating that "Given the department's continual delays in producing these documents", he had no choice but to issue the subpoena.

Separately, Goodlatte is asking for documents related to the Foreign Intelligence Surveillance Act. Republicans have been vocal about the department's use of the secret surveillance court that was authorized in that act and a warrant to monitor the former campaign adviser of the president Donald Trump. Goodlatte said he requested those documents in February but had not received them.

Article content In a statement in response to the subpoena, Justice Department spokesman Ian Prior said that the department takes the request seriously and is "committed to accommodating" the request. Prior said that more than two dozen FBI personnel have been working on producing the documents, and are currently reviewing them for information that is sensitive.

"The initial set of documents requested was huge however, there are around 30000 documents believed to be responsive to the committee's inquiry," said Prior. tsa club "We have so far delivered 3,000 documents to this committee," Prior stated.

The request for more details about Clinton is made as House intelligence committee Republicans closed down their investigation into Russian meddling during the 2016 election. They concluded that Donald Trump's campaign was not in collusion with Russia.
