Apelativo confirma decisión de entregar información sobre los alquileres a corto plazo

San Juan – Ya son cinco los jueces que ordenan la entrega al Centro de Periodismo Investigativo (CPI) de una lista de todas las propiedades registradas para operar como alquileres a corto plazo en Puerto Rico. La Compañía de Turismo de Puerto Rico tiene hasta el 8 de febrero para entregar la información para evitar que se le imponga una multa diaria e indefinida de $300, según ordenó el juez de primera instancia Alfonso Martínez Piovanetti durante una vista de desacato celebrada en enero. 

Un panel de cuatro jueces del Tribunal Apelativo confirmó de forma unánime el pasado viernes, 26 de enero, la decisión del Tribunal de Primera Instancia (TPI) validando el reclamo de información del CPI presentado en noviembre de 2023 contra Turismo. 

“Contrario a lo planteado por Turismo, concluimos que ni la ley ni la reglamentación vigente le otorga carácter de confidencial a la información solicitada por el Centro”, dice la sentencia del Apelativo, que tuvo como jueces a Ángel R. Pagán Ocasio, Ricardo G. Marrero Guerrero, la jueza Lersy Boria Vizcarrondo y el juez ponente y presidente del Panel I, Roberto Sánchez Ramos.

El pasado 18 de diciembre de 2023, el juez Martínez Piovanetti emitió una resolución ordenando la entrega inmediata de una lista con todas las propiedades registradas para operar como alquileres a corto plazo, incluyendo la dirección física de las propiedades, sus nombres comerciales, así como los nombres de sus propietarios, tal como el CPI solicitó en mayo del año pasado. 

Turismo se negó a entregar la lista inmediatamente y el CPI solicitó que se le encontrara incurso de desacato, razón por la cual se citó una vista de desacato a principios del mes en curso.

Previo a la vista, Turismo apeló la determinación del juez Martínez Piovanetti y solicitó que se paralizaran los procedimientos hasta tanto se resolviera su apelación. El foro apelativo denegó la paralización, pero decidió atender el caso en sus méritos. 

Durante la vista, Turismo hizo una entrega parcial e incompleta de la información, pues proveyó una copia del Registro de Hosteleros que mantiene. Este registro no tiene la totalidad de la información solicitada por el periodista del CPI, Luis Joel Méndez González. El foro primario ordenó a Turismo a entregar la información restante en 30 días, antes del 8 de febrero de 2024, so pena de que se le imponga una multa diaria e indefinida de $300.

A pesar de lo anterior, ante el foro intermedio, la agencia continuó reclamando la confidencialidad de la información que insistió en caracterizar como contributiva, citando la Ley del Impuesto sobre el Canon por Ocupación de Habitación, Ley 272 de 2003, y otro reglamento de la propia agencia.  

El Tribunal de Apelaciones rechazó estos planteamientos y sostuvo que la ley y el reglamento invocado no tenían el alcance que pretende Turismo y confirmó, en su totalidad, la determinación del juez Martínez Piovanetti.

En específico, el foro intermedio concluyó que “únicamente se solicitó un listado de las propiedades destinadas para alquileres a corto plazo, su ubicación, el nombre comercial y el nombre del propietario del inmueble. Nada más. El simple hecho de que esta información también pueda surgir de las “Declaraciones” [sobre el impuesto por ocupación de habitación] no le otorga carácter de confidencialidad”. En su sentencia, el Tribunal de Apelaciones hizo una analogía entre la información solicitada y los expedientes de personal de empleados públicos, y razonó que es así “por la misma razón que es pública la información sobre el nombre de los empleados de una agencia, independientemente de que esos nombres también consten en el expediente de personal que mantiene la agencia, el cual se considera confidencial”. 

Ante la victoria judicial, la Directora Ejecutiva del CPI, Carla Minet, expresó: “El Gobierno de Puerto Rico nuevamente usa recursos públicos para no entregar datos que son de alto interés público. Es una contradicción con la política pública que le ha presentado al país. Estamos en espera de que nos entreguen cuanto antes la información completa para poder hacer nuestro trabajo investigativo. No quepa duda de que iremos a los tribunales cada vez que se nos nieguen documentos que nos pertenecen, como ciudadanos y como prensa”.

La representación legal del CPI está a cargo de su abogado Carlos F. Ramos Hernández y los abogados de la Clínica de Acceso de la Información de la Facultad de Derecho de la Universidad Interamericana, Luis José Torres Asencio, Steven Lausell Recurt y Judith Berkan.

DEPORTISTAS DE LA UACJ CONQUISTAN MÁS MEDALLAS PARA MÉXICO

Ciudad Juárez, Chih., sábado 22 de octubre de 2022.-Gracias al arduo desempeño de los deportistas de la Universidad Autónoma de Ciudad Juárez (UACJ), en su segunda jornada, la delegación mexicana de atletismo continuó subiendo al pódium de los ll FISU America Games, Mérida 2022 conquistando preseas.

Alba Gabriela Amparán Macías, estudiante de la maestría en Actividad Física para la Salud en la UACJ, obtuvo la medalla de oro al realizar un lanzamiento de martillo de 56.30 metros en la rama femenil; por su parte, el segundo lugar fue para la brasileña Beatriz Moreira, quien realizó un lanzamiento de 50.93 metros, quedando en tercer lugar su compatriota Carla Novelo, con un lanzamiento de 47.38 metros.

Plata en lanzamiento de bala

Además, la medalla de plata en impulso de bala, rama varonil, fue para José Manuel López Soto, alumno de la licenciatura en Terapia Física y Rehabilitación en la Autónoma de Ciudad Juárez, tras haber hecho un lanzamiento de 17.74 metros; mientras que su compañero Jairo Morán, obtuvo la medalla de oro, con un lanzamiento de 18.14 metros y la de bronce se la llevó el carioca Thiago Alves, con los 16.7 metros.

Plata en 200 metros planos

Igualmente, la velocista y profesionista aborigen, Rosa Leticia Cook Martínez, ganó la medalla de plata en los 200 metros planos, categoría femenil, tras hacer un récord de 24.60 segundos; la mexicana Mónica Ortiz, fue la más rápida con 24.43 y en tercera posición Anny Bassi, de Brasil, con 24.91 segundos.

Estos resultados representan méritos de sus entrenadores Cosme Rodríguez Sánchez, Leonardo Juan Avelle Ugarte e Isidro Javier Guerrero Baca, que siguen consechando medallas con sus pupulios en justas destacadas.
