This has broken through my writer's ennui for a minute. Inspired (obviously) by this beautiful artwork and Stephen King's "Maturin" poem.

From the ship and through the gate

You stroll into the town of eight.

Up rosy path and violet hill,

Past mansion grand, beyond the mill,

You'll feel a thrum beneath your feet

Where sleepy kraken's heart doth beat.

The creature stirs and glides its arm

Through starry ether's perfect calm;

Its course is set to take you home

Within a dream of town that roams.

Flirting is illegal in NYC !!!

Landon's bill passed in 1902, "aimed at the flirters, gigglers, mashers, and makers of goo-goo eyes in public."

I'm sorry this is so funny. I can totally see Foggy suing Matt—

Okay. OKAY.

I spent way too much time on my lunch break trying to figure out what was actually going on here, legally.

Here is the language of the proposed bill, which was supposedly passed in 1902:

Any person who is intoxicated in a public place, or who shall by any offensive or disorderly act or language, annoy or interfere with any person or persons in any place or with the passengers of any public stage, railroad car or ferryboat, or who shall disturb or offend the occupants of such conveyance by any disorderly act or language or display, although such conduct may not amount to an assault or battery, shall be guilty of a misdemeanor.

Notably, violations would result in a fine of $500.

As you may notice, this law says nothing about flirting specifically.

However, according to sources, the intent behind this law, proposed by State Assemblyman Francis G. Landon, was as you noted, "aimed at the flirters, gigglers, mashers, and makers of goo-goo eyes in public. We have all been disgusted with them . . . so they must be brought to their senses."

(Another assemblyman, poor William Bennett, apparently received flack for the proposed bill as well, and denied any association: "I want to assure the bachelors in my district that I do not entertain the objections to this innocent amusement which have been attributed to me. There is no occasion for their excitement, at least so far as my position is concerned.")

However, I have not been able to actually find the code for that law, so I'm scratching my head over this.

Multiple articles also talk about a law with a $25 fine against men “looking at a woman in that way.” (A second offense would require the male to wear a pair of "hose-blinders" when out for a stroll.) But I haven't been able to discern whether that is connected to the previous proposed bill, other than the fact that it appears that this "looking at a woman" law was also passed in 1902. And I haven't been able to find the code for that law, either.

So...are either of these laws real? If so, why can't I find their code? Can anyone else find their code? HELP.

Anyway, assuming these laws are real....

Foggy might threaten to sign a citation against Matt, but Matt would reply that: a) he is not intoxicated; b) nothing he is doing is offensive or disorderly; and c) he is not annoying or interfering with anyone (he would want to argue that Foggy actually likes whatever he's doing), and d) he is not on a public stage, railroad car, or ferryboat. Matt would argue that even if the intent is to prohibit making "goo-goo eyes," etc., this intent was not codified, and interpreting the code as prohibiting goo-goo eyes, etc., would render the entire code void for vagueness per the Fifth and Fourteenth Amendments.

He might also argue, under the other law, that Foggy is not "a woman" (although, to my knowledge after some very cursory research, there's no statutory definition of what a "woman" is in New York). He might also argue that this other code is also void for vagueness, because "that way" (as in, the way a man is not allowed to look at a woman) is undefined.

He might also argue that, as someone with NLP, he can't make "goo-goo eyes" at any particular person (which is the only specific action mentioned in the legislative intent behind the code). He might argue that if the law intends to criminalize other forms of flirting in addition to making "goo-goo eyes," that would also render the law void for vagueness, because what are those actions and how is he supposed to know what they are to avoid them? Similarly, as for the other code, he might argue that even if Foggy were a woman, he can't "look" at him.

🥺 Birthday art request for.. Murderdock napping in sunbeam like kitty

This one was really fun to do... look at him, he's all tuckered out.

(Also, this gave me the HC that Otomo and Foggy met while he and Matt were in law school. Now Otomo will snap photos of Matt in these moments and sends them to Foggy. Other than that he communicates only in emojis because they are "silent but effective: the true tool of a ninja".)
