A bill that would add child sex trafficking and statutory rape to the crimes eligible for the death penalty was debated Monday in a Missouri Senate committee — despite conflicting with U.S. Supreme Court precedent.

The legislation is sponsored by state Sen. Mike Moon, an Ash Grove Republican who said Monday that one of the “principal purposes of government” is to “punish evil.”

Rape of children under 14 and child trafficking of children under 12 would be crimes eligible for the death penalty under his bill.

“And what’s more evil than taking the innocence of the child during the act of a rape? Children are in large part defenseless and an act such as rape can kill the child emotionally,” he said.

“And so I believe a just consequence, after a reasonable opportunity for defense, is death.”

The Senate Judiciary and Civil and Criminal Jurisprudence Committee heard the bill Monday.

State Sen. Karla May, a Democrat from St. Louis, pointed to Moon’s stance of “believing in life” as an outspoken opponent of abortion without exception for rape or incest, yet supporting expanding the death penalty.

“A 12 year old who gets pregnant, you believe that she should bring that child in the world, am I correct?” May asked.

“What crime did that child, that developing human child, commit to deserve death?” Moon replied.

“…But you believe in killing the father to that child?” May asked, if the father is a rapist.

“Yes,” Moon said. “If an attacker commits a heinous crime such as the ones that I mentioned in this presentation, I believe that if they’re charged and convicted, absolutely.”

The Rev. Timothy Faber testified in support of Moon’s bill, pointing to the “lifelong repercussions” of child rape and trafficking.

“It’s also a well established fact that those who commit sexual crimes seldom if ever change their ways,” he said. “Once a sexual offender, always a sexual offender.”

Elyse Max, co-director of Missourians to Abolish the Death Penalty, opposed the bill during Monday’s hearing.

“If the goal is to overturn established U.S. Supreme Court precedent, it’s far from a guarantee,” Max said, “and the amount of resources the state of Missouri would have to spend as well as the trauma to child victims during the process cannot be understated.”

The U.S. Supreme Court in the 2008 case Kennedy v. Louisiana ruled giving the death penalty to those convicted of child rape violates the constitution’s ban on cruel and unusual punishment unless the crime results in the victim’s death or is intended to. Only homicide and a narrow set of “crimes against the state” can be punishable by death, the court ruled.

“Adding statutory rape and trafficking as death-eligible crimes are a slippery slope,” Max said, “of expanding the death penalty to non-murder crimes that would bring the constitutionality of Missouri’s death penalty into doubt.”

“Instead of spending millions of dollars to possibly change long-standing precedent, Missouri resources should be spent to protect children from abuse in the first place, and ensure survivors have access to mental health treatment and proper support, following the offense,” Max said.

Moon said, regarding the Supreme Court precedent, that it’s worth challenging.

“That’s something that we need to start the conversation about,” he said, “and those things need to be challenged.”

Florida passed a similar law for victims of rape under age 12 last year. It received bipartisan support. In December, prosecutors in that state announced they’d seek the death penalty in a case of a man accused of sexually abusing a child.

Florida’s Gov. Ron DeSantis has said the state’s bill could lead the U.S. Supreme Court to revisit the issue.

Mary Fox, director of Missouri State Public Defender, which provides defense for the majority of death penalty cases in the state, argued Monday that the death penalty is “no deterrent to a crime.”

Fox also noted that an 18 year old dating a 14 year old could be executed under Moon’s legislation because that would be considered statutory rape.

Mei Hall, a resident of Columbia who also said she was a victim of sexual abuse, also testified in opposition.

“I don’t wish my abuser death,” Hall said. “I wish them to be sequestered away and unable to harm more people, for sure. But I don’t think it’s the state’s place to kill people in general and I don’t think it’s the state’s place to make it more difficult for child victims to come forward.”

Lobbyists from Empower Missouri and Missouri Association of Criminal Defense Lawyers also testified against the bill. A lobbyist from ArmorVine, testified in support.

Missouri was one of only five states to carry out death sentences last year, along with Texas, Florida, Oklahoma and Alabama. There are two executions scheduled for this year.

Three House bills filed this year would eliminate the state’s death penalty, but none has made it to a committee hearing.

I’m finally writing a Spin City fic! I love this show so much, and I am just shocked that there is no content. Like literally, on AO3, there’s no fics under the Spin City (TV) tag. But, that may change, as writing this piece has given me a spark of inspiration for to expand on it in a multi-chapter fic.

Takes place in late Season 3.

As Nikki had taken to spending more and more nights at Mike’s apartment, they often made their commute to City Hall together. It was not an uncommon sight to see them hand-in-hand as they made their way up the steps into the building, and she could not see them stopping anytime soon-- no matter how much Stuart teased them.

Besides, she had valuable ammo against him, should he annoy her enough.

She and Mike were discussing the previous night’s episode of Law & Order when she caught something in the corner of her eye; a man, dressed in a grey hoodie and his face obscured by a baseball cap.

Something in her gut flared at the sight of this man. She had lived in New York City all her life, a city girl through and through, and these instincts had been drilled into her from her earliest memory.

Her hold on Mike’s arm tightened when she realized that the man was approaching the both of them.

“You Mike Flaherty?” the man asked.

As tightly as Nikki tried to squeeze Mike’s arm to warn him not to engage, he still took two steps forward.

“Yeah, what can I do for y--?”

The man’s fist came flying towards Mike, immediately knocking him down. The man began yelling things like “Liberal puppet!” and “Commie bastard!” as Nikki rushed to her boyfriend’s side, trying to help him up as two security guards restrained his assailant.

Nikki helped Mike back to his feet. “Hey, you okay?”

Mike shook his head, even as he held the heel of his palm against his left eye. “Y-- yeah.”

“Mike,” she gave him a warning tone.

“Nikki, don’t worry about me,” he asked. “Did-- did he try to hurt you? I couldn’t see--”

“No,” Nikki said. “Are you sure...?”

“Nikki... please,” Mike lowered his hand, revealing that his eye was beginning to swell shut.

“Mike...”

“Just... let’s just go inside,” he requested, taking her hand again. “Please?”

Nikki sighed. “Fine. But I’m getting ice for that eye when we get inside.”

Throughout the rest of the day, everyone reacted just as Nikki predicted they would; Carter, James, and Janelle showed genuine concern, Stuart asked if it had been a result of their “activities in the boudoir,” Stacey asked if Mike at least got a punch in, and Paul was just as clueless as ever.

“I heard the Secret Service guys talking,” Carter said as he and Stuart followed Nikki to the ice machine. “You think this might be the guy that tried to take a shot at the mayor last month?”

“I don’t know,” Nikki answered, inserting a coin into the machine and holding an open Ziploc bag out.

“Seems a little weird-- can’t take out the mayor, so you try to get the guy below him,” Stuart mused. “Like how I couldn’t score a night with a future Penthouse model in college, so I dated that flat-chested girl for six months. She even roped me into spending Thanksgiving with her family.”

Nikki let out a heavy sigh of frustration and contempt that harmonized with the ice machine as the ice fell into the bag.

No.

She would not let Stuart’s “horny bastard” ways aggravate her today.

She had too much on her plate to worry about.

Nikki sealed the bag and turned back around. “Just see if you can get a security detail for Mike-- and make it discreet. Don’t want to make him feel smothered.”

“And what better way to do that than to gaslight him about the black, windowless cars outside his apartment building?” Stuart said.

Nikki gave herself one split second to glare at Stuart before she turned to Carter. “If I broke his jaw, I’d be doing mankind a service, right?”

“Oh, you’d get the Nobel Peace Prize,” Carter remarked.

Nikki gave Stuart the fakest smile that she could muster up before she left for Mike’s office in a rush.

As she expected, Mike was sitting at his desk, working as if nothing had happened that morning. The only indicator that this was not just a normal day was the beginnings of a violet bruise that framed his left eye, and the pained expression he seemed to have on his face as he filled out some paperwork.

Mike looked up, seeing her standing in the doorway. “Hey.”

“Hey-- I got the ice,” Nikki held up the bag, walking towards his desk and taking a seat across from him.

“Thanks, but--”

Whatever he was going to say, she didn’t listen as she gently pressed the bag of ice against his injured eye.

“Thanks,” he repeated, sincere this time.

He began to reach his hand to take hold of the bag himself, before wincing in pain.

“Wh-- you okay?” Nikki asked.

“It’s-- it’s just my shoulder,” he tried to wave off. “It’s a little sore.”

“That didn’t sound like a ‘little sore’ groan,” Nikki observed, reaching over the desk to try to examine his shoulder. “Does it hurt? Let me--”

As soon as her hand made contact with his shoulder, Mike cried out in pain. Nikki sprung to her feet and practically hurdled the desk to get to him.

“I-- I think we need to take you to the hospital.”

The Facility don’t know about the experiments, and Efnisien doesn’t even know why he’s in there in the first place, since he’s an alpha…isn’t he? One thing’s for certain, he definitely doesn’t need an alpha companion, no matter what the staff at the facility seem to think.

Maureen O’Connor was the most powerful woman in Ohio politics for the better part of 24 years, first as lieutenant governor and later as the chief justice of the Ohio Supreme Court. But when I asked if her state currently has a legitimately representative government, she didn’t answer right away.

That’s because it’s an open question.

For one thing, the Ohio state House and Senate and the state’s congressional delegation were elected in 2022 using maps that a majority of the Ohio Supreme Court, including O’Connor, ruled were unconstitutionally unfair to Democrats. The maps, drafted by the Ohio Redistricting Commission — composed of Gov. Mike DeWine (R), Ohio Secretary of State Frank LaRose (R), Auditor Keith Faber (R), and two members of each party from the state legislature — disproportionately favored Republican candidates, in violation of constitutional amendments that were approved by a wide margin of voters just a few years earlier, the court found. Unlike other states such as New York, Ohio’s anti-gerrymandering language, written by the legislature, does not give the state Supreme Court authority to hire independent mapmakers on its own. The court may only reject maps it deems unconstitutional. With no legal backstop, the Republican-dominated redistricting commission had no incentive to come up with maps the court would approve, and it didn’t.

The state maps were found to be unconstitutional a total of five times between January and May last year. In response to each of the court’s rulings, Republicans on the redistricting commission repeatedly doubled down. Defying the court, they created a constitutional crisis and delayed the redistricting process so badly that a federal panel stepped in at the request of local anti-abortion activists and allowed the unconstitutional maps to be used.

Amid the monthslong battle, some Republicans indicated they might support impeaching O’Connor, who as a Republican was vilified for breaking ranks with her party. A state age limit has since forced O’Connor to retire, and the Ohio Supreme Court now has a solid Republican majority — meaning the gerrymandered maps are likely here to stay. Out of office, O’Connor hasn’t lost sight of the fight for fair districts. She says she’ll work to build support for a constitutional amendment in the state to create an independent redistricting process and “get the politicians, the elected officials, off the redistricting commission.”

But for now, the product of the GOP-drawn maps is clear: It’s a stacked deck.

Republican candidates collectively won 57% of the state Senate votes overall in 2022 and yet control 79% of the state Senate seats, according to a HuffPost analysis of election results. Republican candidates won 59% of the state House votes and control 68% of the state House seats. GOP congressional candidates collectively won 57% of the vote against Democrats, and yet control 67% of the state’s congressional seats.

So is Ohio a representative democracy in any real sense? O’Connor sighed when asked that exact question.

“That’s the whole problem with gerrymandering ... Who’s being represented? And how did they secure that representation?” she said. The real question, O’Connor added, “is not how the voters secure that representation, but how the politicians secure the voters.”

Pairing: Mike Flaherty/Nikki Faber Rating: General Summary: His heart began to speed up as he recognized the voice on the other side of the door. He undid the chain and opened the door. Sure enough, Nikki Faber was standing in front of him.

She had apparently decided to keep her hair as its natural blonde, which she had decided after the break-up as an attempt to "reinvent" herself, but she had cut it much shorter since the last time he had seen her. Her eyes were rimmed red, as she had been crying.

"Nikki, wha-- what are you doing here?" Mike asked. "I mean, I'm-- I'm glad to see you, but..."

"I quit my job," Nikki confessed, her voice beginning to quiver as if she were about to cry again.

Leader of Missouri Human Rights Commission opposes adding LGBTQ protections to law

The chairman of the Missouri Human Rights Commission, which enforces the state’s non-discrimination law, is opposing adding sexual orientation and gender identity to the law, citing biblical passages about homosexuality and warning of a loss of religious freedom.

Timothy Faber, who was appointed to the commission in 2021 by Republican Gov. Mike Parson, on Wednesday urged lawmakers to reject legislation that would expand state law to prevent discrimination on the basis of sexual orientation and gender identity in housing, loans, employment and public accommodations.

During a hearing held by the Missouri Senate General Laws Committee, Faber testified as a lobbyist for the Missouri Baptist Convention, a network of about 1,800 Southern Baptist churches. He only identified himself as the commission chairman under questioning, despite saying expanding the non-discrimination law would burden the commission.
