Amazon argues that national labor board is unconstitutional, joining SpaceX and Trader Joe’s
Amazon is arguing in a legal filing that the 88-year-old National Labor Relations Board is unconstitutional, echoing similar arguments made this year by Elon Musk’s SpaceX and the grocery store chain Trader Joe’s in disputes about workers’ rights and organizing.
The Amazon filing, made Thursday, came in response to a case before an administrative law judge overseeing a complaint from agency prosecutors who allege the company unlawfully retaliated against workers at a New York City warehouse who voted to unionize nearly two years ago.
In its filing, Amazon denies many of the charges and asks for the complaint to be dismissed. The company’s attorneys then go further, arguing that the structure of the agency — particularly limits on the removal of administrative law judges and five board members appointed by the president — violates the separation of powers and infringes on executive powers stipulated in the Constitution.
The attorneys also argue that NLRB proceedings deny the company a trial by a jury and violate its due-process rights under the Fifth Amendment. (source)
ICYMI, this is a case of corporations going, “7th Amendment Protections for me, but not for thee.”
It is strongly worth noting that in 2018 the John Roberts Court ruled 5-4 that companies can use forced arbitration clauses to stop people from joining together to fight workplace abuses - in effect denying individuals their 7th Amendment protections.
Subsequently, binding arbitration clauses used by corporations has proliferated; sneaking into all manner of common legal documents: personal banking applications, ordinary car loan applications, furniture purchases, and more. This is, unsurprisingly, a direct violation of the 7th Amendment that guarantees HUMAN BEINGS AND PEOPLE the right to a jury trial in certain civil cases and inhibits courts from overturning a jury's findings of fact. Republicans and SCOTUS are perfectly okay with corporations having more rights than workers and using forced arbitration to block people from having access to jury trials—but God forbid if corporations don’t have their right to a jury trial.

This legislative push to bestow corporations with more rights than people, while simultaneously taking away rights from human beings, has been nothing if not thoroughly and methodically done. At this rate, no corporation will ever need to fear a class action lawsuit again.
Amazon, SpaceX and Trader Joe’s are union busting.
But this latest case against the NLRB isn’t just an attack on labor and worker’s rights, it’s a fascistic attack on the very heart of fairness and democracy itself.

Class action lawsuits against six of Ontario's largest for-profit long-term care (LTC) home providers, claiming gross negligence that led to illnesses and deaths during the COVID-19 pandemic, have been allowed to proceed.
In a ruling last week, the Ontario Superior Court of Justice certified class action suits against Sienna, Revera, Schlegel, Responsive, Extendicare and Chartwell.
The separate class actions were filed on behalf of thousands of clients, family members and visitors, who allege the companies were unprepared to provide care during the pandemic and failed to protect the health of residents and visitors.

Wanted to spread some awareness to folks who have been looking at the 9 days left and 23 days left on the Facebook class action lawsuit settlements:If u have SSI and SSDI be careful, because any money you receive from that can count against you and you *can* lose your benefits for SSI due to that. --anon who is unbelievably angry at the state of disability rights in the US + who isn't a lawyer or representative + this isnt legal advice just warning folks and asking them to look over their rights

But, what a way to be reminded that if you are disabled, you really are considered a different category of citizen from normate people

Hey Twitter employees getting laid off tomorrow! IMPORTANT INFO from a CA employment attorney (me):
CA's "WARN" law requires Twitter to give you 60 days notice of a massive layoff.
A layoff of 50+ employees within a 30 day period qualifies.
I know you didn't get that notice.
This WARN law applies to all California employers of 75+ employees, which obviously includes Twitter with its thousands of employees.
Purpose of the law is to give laid off employees time to figure out how to handle this disruption.
And Elon completely ignores it.
Employers like Twitter who violate the WARN Act face civil penalties of $500/day for each violation. With thousands of employees, this could be significant, though maybe not to Elon.
Employees laid off in violation of the WARN Act receive back pay at the employee's final rate or 3 year average of compensation, whichever is higher. Twitter would also be liable for workers' medical expenses that would have been covered under an employee benefit plan.
Twitter will be liable for all of these (civil penalties, lost compensation, lost medical and other benefits) & attorneys' fees for the 60 days it failed to give workers notice.
This flagrant violation of workers rights is outrageous.
Who's in for a class action? LET'S DO THIS
Also, CA's strong antidiscrimination laws apply to Twitter's big layoff tomorrow. Are people of color, women and/or older workers disproportionately chosen, for example?
This was done so hastily, so slapdash, so that the world's richest man can get even richer faster.
We'll see how long Twitter lets my posts stay up. If they take them down tonight, before the layoffs, that means they were on notice of the law I cite and chose to punish me rather than follow it.
That's consciousness of guilt and I'd use it as the basis for punitive damages.

The Quebec Court of Appeal has approved a class-action lawsuit launched on behalf of Facebook users who claim they were discriminated against because the social media giant allowed advertisers to target job and housing ads based on factors like age, gender or race.
The class action could include thousands of Quebec residents who have used Facebook since April 2016 and who were looking for jobs or housing during that period.
Facebook has 60 days after the court's Dec. 22 ruling to decide whether to appeal to the Supreme Court of Canada. If it does not appeal, the case returns to the Quebec Superior Court. [...]
"We are very pleased with the Quebec Court of Appeal judgment that recognizes that class actions are an appropriate vehicle for claims of widespread, surreptitious discrimination," Boctor said.
"Algorithmic discrimination that excludes people such as women and older workers from receiving employment advertisements is just a modern form of the same type of discrimination that is illegal under the Quebec Charter."
Boctor estimates the class action could involve $100 million in damages. [...]

If you are in the US and subscribed to Crunchyroll + watched their content at any point between September 8, 2020 and September 20, 2023, check your email for a message from [email protected]
That domain seemed fishy and went to spam for me, but I looked into the details in the message and they are legit. It is a notice of entitlement to a payout from a class action settlement against Crunchyroll. The lawsuit accuses Crunchyroll of unauthorized disclosure of subscribers' personally identifiable information to third parties without convent.
Because this lawsuit took place in the United States, entitlement is limited to those within the United States. This does not mean that claimants are required to be US citizens. The expected payout is about $30 USD but the amount won't be confirmed until all claims are received.
Claims cans be submitted until December 12, 2023.
Here is a CNET article about the lawsuit that also links to the official settlement website containing more documents and info. The email sent to eligible subscribers contains a member ID required to submit a claim through the settlement website the easiest way, but there's a PDF claim form you can fill out if you can't access the email used to subscribe to Crunchyroll or you lost the claim email in some way.
