For some time, people started getting a random marking on their body.  People thought it was a genetic mutation due to quirks, but over time they discovered two people had matching marks of someone’s quirk.  No two marks were the same.  After some studies it was proven that these markings were soulmate markings.

Growing up, you hated the explosive marking you had on your upper back.  You tried to avoid tank tops, low back dresses and more.  No one really wanted to date anyone if you could see a soulmate marking.  One day you looked on television seeing the upcoming pro heroes, not being much attention until you hear ‘Ground Zero, with an amazing flashy quirk.  Explosives....’, you didn’t pay any more attention.  You started at the blonde boy on the television, feeling a connection through the television.

“Well ain't this shitty.  Regardless if he’s my soulmate, he's a pro and I’m just a civilian.  No chance of us meeting.”  You said driely to yourself.  There was not much that you could do with your fox quirk.  Not many people like you because they quickly assumed you were cunning and sly.  So the best job you could get is being a waitress at a popular underground club.

Bakugou was livid when Kirishima took him to a club.  He told him they were going out to relax and ended up in a non-relaxing place.  His friends were super excited to have a free day and to party, Bakugou on the other hand wanted to go home and sleep.  Bakugou sat on the couch next to his friends who were chatting about missions.  Until a body appeared in front of the group.

“Heya fellas, I’m y/n.  I’m here to take care of you.  Can I get you fellas anything?”  You flirt.  I mean how else will you get tips.

While the others started to ask what was good and ordering, Bakugou stared at you.  Noticing the red fluffy ears on your head that moves as you talk, as well as the bushy tail swings to the music.  Bakugou for some reason can get his eyes off of you.

“Bakugou, do you want anything?”  Kirishima snaps him back to reality.  You are standing, with a hand on your hip, smiling.

“Water.”

You smile, before walking away to get the orders.  Kirishima and Denki complained to Bakugou about just getting water.  Bakugou’s eyes follow you as you head towards the bartender to get the drinks.  You shiver as you sneak a peek at the blonde that was staring you down.  You smile, thinking this was gonna be a good night and get an amazing tip.

The whole night, you felt the blonde’s eyes everywhere you went.  You ignored it, it’s normal for working at a club.  Currently you had your eyes on a regular customer you had for a couple months.  He tipped big.

“You know I’m not a cheap one.”  You giggled, as your finger ran along his neck.  “The bigger you tip the nicer I am.”  The man’s hand laid on your waist.  At the club you were known as the promiscuous fox, playing into your quirk.  A sly and cunning fox, that flirts with anyone.  You didn’t care, the tips paid your expenses.

“Aren’t you a promiscuous foxie?  That’s why I like you.”  You internally cringe.

“I’ll be back.  I have more customers.”  You slightly push him in a flirtatious way, making him laugh.  Rolling your eyes as your back was towards him.  The bartender laughed as he saw your face.

“He’s still coming here.”  He spoke as he made your orders.

“He’s so annoying.  He always reeks of alcohol, but whatever.  He tips bigger when he’s drunk.”

“Careful, those men always think you own them when you make them feel special.”

“Trust me.  He will regret it if he tries.”  Over the night, you completely forgot how the blonde’s eyes followed you.

Bakugou stares at the fox head outline that marks his left inner wrist.  He wasn’t sure if it was you, there are others with the same quirk as you.  He would scan your body to see if there was a trace of a marking, but he was quick to come to the conclusion that it was hidden where no one could see it.  He finally gave up and minded his business.

The night was slowly coming to an end, peacefully until people heard glass shattering.  Everyone’s eyes turn to the source of sound.  Seeing a drunk man with his hands around a waitress neck.

“You bitch!  After everything don’t you think you owe me!”  The hand grips your neck tighter.  Your regular finally snapped at you for not giving anything back for all the tips.  

You groan as your nails dig into his wrist.  You can see people starting to walk over to help you.  You kick his groin, causing him to scream in pain and letting you go.  You breath in before kneeing him in the face.  Catching your breath, you look at the man lying unconscious with a bloody nose.  You grab his collar before dragging him out of the club.  Everyone stares at you and moves out of the way.  You kick the door before throwing the man out.

“This one is banned.”  You look at the doorkeeper.

Walking back in to clean up your mess, you are met with eyes.  What?  They never saw a person get kicked out of a club.

Your coworker comes over to inspect your neck.  You had slight bleeding in the back of your neck, were the drunk man dug his nails into your neck.  You pull your hair into a loose bun as your co-worker inspects the nail marks.  Everyone’s attention went to their own business after awhile.  As your coworker was scolding you from getting in dangerous situations once again and cleaning your cuts, someone else was staring wide eyed at your back.

The blonde can see your upper back exposed, that was hidden due to your hair.  Clear as day, he saw the explosive marking on your upper back.  Once your cowork placed a bandage on top of the cuts, you let your hair down and sighed.

“Aw man.  He tipped so well.”  You rest your chin on your palm, as you sipped your fruity drink.

You took the night off, sitting at the bar sipping at your drink.  You feel a presence sit next to you but you ignore it.  You hummed to the song playing as you swayed with your eyes close.  You hear someone clear their throat, causing you to turn around to face the presence.

“Ah it’s you.  Blondie.”  You giggled.  “Sorry, I’m done for the night.  That man took the wind out of me.”

“I was checking on you.”  His red eyes could still be seen in the dark room.

“Awh, are you worried about me?  That’s cute.”  You lean more into your hand and smile.  “Well don’t worry, I’m heading home.  So thank you for checking on me but this is where we part ways.”  You sighed as you placed your jacket on.

“Let me take you home.”  The blonde gets up.

You give him a weird look, causing him to backtrack and clear what he meant.  Worry that a tipsy girl was going home late at night.  You laughed and accepted, you didn’t want to deal with any drunk guys you will probably run into as you walk to your apartment.  It was silent as the blonde walked next to you.

“Bakugou was it?  Thats what the redhead said.”

“Yeah, you said your name was y/n.”

“Wow, what a good memory.  Many guys don’t care because I’m just a waitress, so I appreciate that you remembered.”

The two reach your building.  Bakugou insists that he will see you at your door.  You smile and agree.

“This is the first time a guy takes me home and doesn’t expect anything.”

“Why would I need something in return?”  He furrows his brow.

“Well most guys expect a payment for taking me home.  I usually kick them and make a run for it.”  You laughed, remembering all the times you kicked a man and booked it to your apartment.”

“Well I’m not most guys.”  He sneers.

“I can see.”  You turn to place your keys to open your door.

“I’m not most guys because I’m your soulmate.” 

You’re hand hovers above your door handle.  You stand in shock before turning around.  You see Bakugou staring down.

“Very funny.”  You gave him a dry laugh.  “It’s not nice to accuse someone to be your soulmate when you don’t even have evidence.

“Oh really.”  He shows you the outline of a fox head on his inner wrist.  

“So what?  Many people have a fox quirk.”

“Yeah but no but my soulmate would have an explosion marking.”

You feel a chill do down your back.  No one has really seen your making, so how did he know?  You hid the marking when it appeared, and never mentioned unless someone pointed it out if they got a glimpse of it.  You couldn’t believe this man standing in front of you.

“Really?  Everyone knows that Ground Zero has an explosion quirk.  Impersonating a pro hero isn’t funny.”  Your grip your door hand.

“Who said I wasn’t a pro hero?”  You felt him get closer.

“Stop Bakugou.  It’s not funny.”  You turn and glare.

“It’s not.”  You feel his hand creep, to touch your marking.  Feeling static, your face heats up.  “The marking looks just like my explosions.”

You turn around, slapping his hand away from you.  You look at him in shock as he held a smirk that was all too familiar.  Ground Zero’s signature smirk.  He got closer, faces inches apart.

“Prove it.”  You whispered.  His smirk got bigger, as he took a step back.  You hear a small crackling, looking down at his hands.  Small explosions showered his hand.  You couldn’t believe it.  You never thought you would meet him, your soulmate.

He puts his hand down, getting closer once again.  Your heart starts to race and your face flushes.  His hand lands on your hand wrist, the other near the marking.  He pulls you into a kiss.  Your heart starts pounding against your chest, as you melt into his touch. 

  Is this what your soulmate’s touch makes you feel?  

His hand starts to snake around your waist, pushing you closer to him.  You snap back to your senses.  You push his face, leaving small scratches on his face, due to your claws.  His arm wipes the beaded blood, as he stands there still smirking.

“I’ll have you know.  Even if I am your soulmate, I won’t fall for temptation.  I’m not an easy girl, I play hard to get.”

“I love a challenge.”  He chuckles.

“Well good luck.  I’m not that easy to win.  I’ll have you know, I have options.”  You open your door.  Before closing your door, Bakugou spoke.

“Who knew I got lucky with a pretty and hard to get fox?  I’m looking forward to seeing more of you.”

You glared as you slammed the door to your apartment.  You catch your breath, as you listen to the whistling and footsteps to disappear.  You fall against the door, face flushed in the crimson color.

“Holy shit.”  You muttered.

Solving the Housing Crisis in Africa

The continent of Africa has about 1.3 billion people today and many demographers believe it will nearly double to 2.5 billion by 2050. Africa also has the youngest average population with a median age in 2012 of 19.7--the worldwide median age was 30.4. This unparalleled level of growth, coupled with youth, presents many problems such as housing: The African Development Bank estimates there is a deficit of 50.5 million housing units in Sub-Saharan Africa. Every government in Africa recognizes residential housing as a key problem, yet it is hardly being addressed. The problem seems almost intractable, particularly in the so-called “social housing” segment which is often defined as a residence that costs less than $25,000 USD. So what is the problem and is there any way to solve it?

Let’s briefly discuss the various issues that are compounding the housing crisis and then we will get to an innovative approach to solve, or at least lessen this problem. The issues with housing in Africa are numerous, but there are at least four main problems that must be overcome. The first is inconsistent or poor-quality construction due to a lack of international-class training for construction trades such as concrete mixing, roof installation, and final finish. The second is limited economies of scale because house construction is often project managed by the owner or his/her representative. As a result, cost overruns are common, and construction can take years to complete. The third is a lack of trust in real estate developers which is often what leads to the aforementioned second problem. Finally, the fourth and perhaps the biggest problem is financing. Without some sort of reasonable financing, a housing industry simply cannot exist. Imagine for a moment trying to buy your current residence in the US, Europe or indeed anywhere in the world by paying cash at the time of purchase. Would you be able to buy your house under those circumstances? For most people, the answer is no, yet that is the environment that the majority of African homebuyers face today. 

These problems seem almost insurmountable; how do we even begin to address them? Rather than walk the reader through some theoretical exercise on what could be done, I will describe what two innovative companies (full disclosure: I am Managing Director of one of them) are successfully doing right now to prove these problems can be overcome. I don’t claim these companies have fully solved the problem, but they have laid out a clear blueprint in parts of West Africa that anyone else is free to emulate anywhere on the continent. In fact, the principals of both companies are willing to share their formula for success with anyone; just for the asking; no strings attached. Email [email protected] to begin a discussion. 

American Homebuilders of West Africa (AHWA) and US-Africa Housing Finance (USAHF) are both US-registered LLCs that symbiotically work together to build, sell and finance houses in West Africa. The following diagram illustrates the relationship between the two companies.

AHWA markets, builds, and sells houses in West Africa and USAHF provides the financing by purchasing loans originated by AHWA. Private investors provide the capital to USAHF (earning an annual 9%, us-dollar return over the last three years) which begins the virtuous cycle that propels this relationship forward. 

One thing you will notice is the total lack of government help or any kind of philanthropy in this model to date. Both businesses are for-profit (and currently profitable) and have thus far relied 100% on private capital raised in the United States. Having said that, there is an appropriate place for governments, foundations or other quasi-government institutions to get involved to provide much needed catalytic capital to move the respective businesses forward more quickly and efficiently. Since the business model for both companies has been proven; now is the time for large institutions to step up and provide support.

So how did these companies overcome the four problems laid out earlier where others have failed? The first problem of poor construction quality is not conceptually hard to solve given that construction techniques are well understood in the US, Europe, and other developed markets. However, to do it in an environment that is used to accepting poor quality as a "fact of life" requires investing in the local team's development and a great deal of diligence and desire to produce a quality product. Fortunately, the co-founders of AHWA all have that desire and thus construct houses that anyone can be proud to live in. Part of this diligence can be traced back to their experience as peace corps volunteers in Cote d’Ivoire in the 1990s. As an example of their dedication, one of the co-founders of AHWA, Jonathan Halloran, personally trained the local African team in how to build a safer ladder (see photo below), use power tools effectively and organize a logistics depot.

Jonathan's theory is you teach one group how to do it in an international-class way and they will eagerly pass on that knowledge to anyone who will listen. Fortunately, most Africans are eager to listen and learn as they genuinely want to see their country and indeed their continent progress. 

The second problem--limited economies of scale--, and the third--lack of trust in developers--go hand in hand. If there is trust in housing developers, then there is no need for individuals to build their own house and suffer the associated pain and heartache. Ask any member of the African diaspora and they will relate either a personal story or one of some close friends or relatives that involves getting “scammed” while trying to build a house back in Africa. AHWA has gotten over the trust problem the old-fashioned way: They provide a quality product to their customers and “word of mouth” over time has done the rest. AHWA is now a trusted brand in Guinea, West Africa and beginning to develop in neighboring countries such as Sierra Leone, Cote d’Ivoire and Senegal with many more to come.    

The final problem is financing and this is perhaps the most vexing of all. Providing a home loan to a borrower is more complicated than it might seem at first glance. There is the obvious issue of raising the capital to fund the loans (this itself is hard enough when the target market is Africa), but perhaps more difficult is the underwriting process. The lender cannot just provide a loan to anyone; the borrower must be properly vetted via some systematic and repeatable process. This requires getting to know a prospective borrower and assessing the associated risk. To ease this daunting task, initially, USAHF only plans to offer loans to the African diaspora living in OECD countries such as the US, France, Canada, UK, etc. In addition, a 30% down payment is required along with customary verification of income, debt and the like.

One unique aspect of the joint AHWA/USAHF underwriting model is that they allow borrowers to pay monthly into what is effectively an "escrow account" for up to 24 months in order to reach the 30% down payment level. This is not only helpful for the borrower but also provides invaluable data and confidence about the borrower’s ability to pay. If someone has the financial discipline to make a monthly payment for a year or more without even having a house, the likelihood of them defaulting once they actually have the house is very low. In other words, they are an excellent credit risk.

The final piece of the financing puzzle is a well-developed process to handle the inevitable loan default. No matter how good an underwriting process you have, some number of defaults are expected. In fact, many bankers will tell you that if you don’t have any defaults that means you are too strict in your underwriting and should loosen the requirements. Both AHWA and USAHF have an agreed process in place for default and have successfully navigated the process multiple times with minimal impact on either business as well as the borrower. Because of the high demand for AHWA houses, resale has been relatively smooth and as expected prices are rising and this insulates the defaulting borrower from large losses.

In conclusion, both AHWA and USAHF believe they have a profitable, sustainable and replicable model that over time can solve the housing crisis in Africa. However, governments, DFIs, foundations and other similar types of institutions will need to step up and provide catalytic capital to make this promise a reality. Saturn will go direct on September 18th, 2019 after spending the last 5 months in retrograde. Saturn is the planet of “time”, karma, lessons and hard work. In traditional astrology, Saturn represents the Father. He is stern and seeks to teach us to be responsible, hard working, and disciplined, yet he is loving. He seeks for us to learn the consequences of our actions, thoughts and behaviors (Karma), and how we must be patient and disciplined (time) while releasing control over the outcome. 

Saturn is currently in his home sign of Capricorn, along with Pluto the planet of re-birth, and the South Node of the past. While retrograde, Saturn took us back to old wounds rooted in Capricorn that needed to be transformed and come up for release. These included our father wounds, abandonment, lack of self-love, control, and limitations. He has been testing for the last 5 months to see where we have been playing our our unconscious wounds, where have failed to support ourselves and have been looking for external love rather than internal. His question to us is, “do you get it yet?”. We are everything we need, love and support must come from the internal before it will ever be experienced externally. Old patterns were re-played and re-lived so we could come face to face with them. Now he is going direct and we are going to experience a real change of pace. 

For those that have understood the lessons and been brave enough to face the pain and look at where we have continuously abandoned OURSELVES, through self-criticism, judgment and abandonment. The truth is that most of humanity have deep father wounds. The Cabal created such a toxic masculine dynamic on the planet, most either did not have a connection with their earth fathers or they exhibited the toxic masculine traits: power over, control, aggression, rage, aloofness, lack of emotion, etc. 

We then sought outside ourselves to fill these voids. The father figure, the protector and provider was not there for us when we were children, so we tried to find it externally. We filled the void with materialism, stubbornly clinging to hold onto to power, money or possessions in order to make us feel secure or safe. Or, we sought for another being to make us feel safe and comforted. Both are forms of giving our power away. Our inner masculine is there to teach us that we are independent, sovereign beings of great strength, beyond what we can even fathom in these Earth vessels. 

This is why this transit of Saturn in Capricorn has been so potent, so heartbreaking and difficult. He has been crying out to us that WE are who we have been waiting for. We are the strength, we are the love, and we are the warriors. There is nothing and no one outside of us that we need except to stop abandoning ourselves. Our authenticity and our truth is what keeps us in our hearts and there, we are always taken care of. 

As Saturn turns direct we gain clarity on why we experienced what we did and the lessons that were being instilled in us. Together, with Saturn and the South Node, these three planets are pushing us towards the greatest transformation and simultaneous crumbling of the old this planet has ever seen. This is the final collapse, the grand finale to all we have worked for. The message during the last 3 months of 2019 are DO NOT GIVE UP. It may feel like your entire reality is collapsing, every fiber of your being is exhausted and ready to lay down in surrender, but do not give in. This is the moment to gather every last bit of strength you have and push forward like you have never pushed before. Mother God, Gaia, Great Spirit is giving everything she has to push us past the finish line. Do not fail her, do not abandon her, but join her.

The ending to this story is already complete, Mom won, love won. It is only through our human perception we feel defeated and ready to give up. It is always darkest before the dawn, and on the other side of this final push is the greatest and grandest dream of loving coming true that we can ever imagine.

Should I Help?

All of us are good at some things and less good at others. In the areas where you’re highly competent, it can be tempting to attempt to “help” and guide others, basically just because you can; if you’re empathetic, and you’re aware of the pain that’s involved in someone else’s struggle, it can also seem like you have an obligation to help. The call toward alleviating suffering where you see it may be part of your spiritual outlook, or you may enjoy taking the opportunity to save others time and shorten their labors with your expertise. This desire generally comes from a kind-hearted place, and it spurs many of us to do a lot of good in the course of daily life. But is it ever inappropriate to help?

I think the answer to this comes down to respecting the concept of free will. “Help” is actually helpful only when it is offered and accepted freely, generously, and without coercion. The exception to the rule might be if someone is in a state of emergency and you either know the person well enough to recognize a need that they are not capable of handling, or you can clearly see that they are in legitimate danger of serious injury. Children too young to be aware of the consequences of their actions would also be an exception. Otherwise, difficult as it may be to see others struggle, it’s generally not your job to override someone else’s choices and timing. Once you’ve made yourself available for substantive assistance, it may be necessary to step back and allow them to learn through experience if that’s what they choose. Some lessons only stick if they’re learned this way anyway, frustrating as that might be to the observer!

Most spiritual traditions include the concept of acceptance—not as in, you must accept a condition you don’t like and never seek solutions, but as in, it’s important to be able to find a place of calm and acceptance within yourself. This might be through meditation, prayer, deep breathing, a physical practice like yoga, journaling, or whatever works for you. If you formulate a plan and take action without having done so first, you risk making decisions from a reactive, fearful place, which is not the best state from which to deliver your best and brightest offerings. If a life-and-death decision doesn't not need to be made, and you don’t feel able to accept rejection of your help by the other person, then you might want to save the offer until you do. I also believe that there are times when it’s not appropriate to offer help because you are not capable of doing a good job with the task at that moment. If you are overwhelmed, very tired, or emotionally overwrought yourself, it’s probably best to attend to your own needs before trying to assist someone else. Another consideration is whether this particular person or situation seems like a good match for your skills and your passion. There is someone out there who would love to help in any given kind of situation, and leave the endeavor feeling wonderful and energized in some way. In other situations that same person would feel overwhelmed, frightened, and find themselves shutting down, becoming a burden themselves. It’s a good idea to get to know your strengths, and to consider whether this situation is one in which you can be helpful, or whether it requires skills and qualities you don’t possess. If someone needs a surgeon, and you’ve never had a day of medical training in your life, if you want to help, you need to spend your time in handling basic first aid and getting them to that surgeon—not trying to handle the situation yourself. Most people appreciate an offer of help when it comes from a calm desire to do them a good turn (even if there would be payment of some sort involved) rather than a need to have the offer accepted. When you bring a sense of distress and need into your offer, the person on the receiving end may feel that you’re trying to manipulate them, and run in the other direction! Then an opportunity that might have been rewarding for both parties is lost, at least temporarily.

On the other hand, if someone knows that you’re on the sidelines willing and waiting to help whenever they need it, that can be tremendously reassuring. When you don’t overstep or force yourself into their process, you become someone who will be very easy to turn to when the person is ready to accept help. In the meantime, you can just listen and celebrate the person’s wins, and still be a supportive part of getting them to the finish line. This can be quite challenging, and we may all become overzealous at times because of our own internal baggage; if you find that you have gone overboard, an apology and affirmation that you have faith in the other person goes a long way. Afterward it might be useful to take a look at why it was hard for you to remain calm in that situation, and do some work on that through Tapping or some other method you find helpful, to increase your ability to recognize that situation if it resurfaces and choose another way.

Helping others can be one of the most fulfilling aspects of living. It can be one of the best expressions of love for others, and it often brings joy and upliftment where there was struggle. Being able to be an effective part of this of wonderful exchange is worth some occasional work and self-reflection. Building your skills around balanced helping will bring you the opportunity for more frequent fulfillment of this kind, and the opportunity to co-create better results with others. Next time you’re looking to help, see if you can do so from a calm, centered place and notice what happens when you do.

Insys Therapeutics: The Company Fueling The Opioid Epidemic

According to the National Center for Health Statistics, more than 770,000 Americans have died from drug overdoses since 1999 – and 7 out of every 10 overdoses are due to opioids [1]. While this epidemic and its causes are multifaceted, it is undeniable that large drug companies manufacturing opioids have contributed to the problem.

Insys Therapeutics, a pharmaceutical company based in Arizona, has consequently received strict legal scrutiny for their role in the opioid epidemic. In 2012, the company embarked on an elaborate racketeering scheme to increase sales of their drug Subsys, a “rapid onset opioid approved to treat breakthrough cancer pain” meant only for a “small, crowded, and tightly controlled market” [2]. The Fetanyl Spray contained risks for “misuse, abuse, addiction, overdose, and serious complications due to medication errors,” and could easily be abused in the same way that other illegal opioids could [2].

The company’s top executives received their sentencing in January of this year – eight years after the initial scheme launched. John Kapoor, the founder of Insys Therapeutics received five and a half years in prison, while the former vice president of sales Alec Burlakoff, was sentenced to 26 months in prison [3]. These sentencings come after years of litigation and indictment hearings dating back to December of 2016.

The initial indictment included many top executives of Insys Therapeutics, many of which held regional sales manager positions. The criminal violations of these individuals were extensive, including (but not limited to) racketeering conspiracy, mail fraud conspiracy, and wire fraud conspiracy [2].

Essential to Insys’s marketing scheme were licensed practitioners that would write large numbers of Fetanyl Spray prescriptions in exchange for company paying them off in the form of what Insys called “speaker program events” [2]. These speaker program events were hidden under the claim that they were peer-to-peer educational meetings discussing the Fetanyl Spray. However, many of these events “involved no education and no presentations,” involved the same repeat attendees who were mostly support staff of the practitioner with no ability to prescribe the drug, and were often mere “social gatherings at high-priced restaurants” [2]. In fact, Insys sales representatives were encouraged to pay practitioners to prescribe the Fentanyl Spray, and not worry about the speaking abilities of these medical professionals. Alec Burlakoff, the Vice President of Sales at Insys, told a representative that she need not worry about the communication skills of the practitioners – “they do not need to be good speakers, they need to write a lot of [Fetanyl Spray prescriptions]” [2].

Insys sales representatives tracked these professionals around the country and ranked them in groups called “deciles” on a scale of one to ten [2]. Those who wrote the most prescriptions of painkiller products were ranked in decile ten – these “high decile” practitioners were targeted by Insys’s sales team [2]. In addition to these identified high deccile practitioners, the Insys sales team actively recruited practitioners known to have shady prescribing habits, whose pain clinics were colloquially named “pill mills” [2].

Although these professionals were bound by their license from the Drug Enforcement Administration to “refrain from accepting or agreeing to accept bribes and kickbacks in exchange for prescribing any drug,” their duties were disregarded in pursuit of the luxurious promises Insys made [2]. The company sales team instructed practitioners to prescribe Subsys to patients without cancer, moving its purpose to all breakthrough pain –ignoring the constrictions of the FDA approval [2]. Theco-conspirator practitioners averaged as much as 11 Fetanyl Spray prescriptions per week, forgoing the drug’s approval solely for breakthrough cancer pain and prescribing it for non-cancer patients [2]. While they encountered risk for their unlawful prescriptions, payout was large for practitioners, at times reaching over $250,000 in checks for speaker events [2]. This partnership between Insys Therapeutics led to countless patients receiving prescriptions for highly addictive Fetanyl Spray and encountering all the risks that came with Subsys – without even needing the prescription.

While the co-conspiracy with practitioners was essential to the scheme of Insys Therapeutics, the company’s criminal actions extended much further than handing out prescriptions to people who did not need them. Insys engaged in insurance fraud to receive payment for their drug. It was difficult for the practitioners’ offices to obtain prior authorization for Subsys, so Insys utilized their kickback program to assist their co-conspirators, gifting them support staff to fill out and fax authorization paperwork [2]. However, this was not enough for Insys Therapeutics – insurers and pharmacy benefit managers approved payment for only about 30-33 percent of Subsys prescriptions[2]. To solve this hiccup, Insys created a team to seek prior authorizations directly from insurers on behalf of patients – in the first week, approval jumped to 46 percent [2].

The scam continued, and the Reimbursement Unit was created when need for help with insurance approval increased. This unit rewarded prior authorization approvals with bonuses for employees, setting a minimum threshold for the whole unit [2]. These employees were often given a script and list of best practices to use to gain prior authorization, including “false and fraudulent pretenses, representations, and promises” [2]. The company tracked communication with insurers and pharmacy benefit managers to discover what phrases resulted in denial of prior authorization. They learned that phrases like calling “on behalf” of a doctor to act like they were calling from the doctor’s office, and to answer with a script when asked why the patient was being treated for breakthrough cancer pain when they did not have cancer [2]. By gaining prior authorization through deliberate manipulation of insurers and pharmacy benefit managers, Insys allowed countless patients access to a dangerous drug.

While the Insys Therapeutics executives involved in this scam have been sentenced in court, the greater picture this case presents cannot be ignored. It exposes the deep influence drug companies have in aiding the opioid epidemic, and the ability of these businesses to forgo the health of their fellow human beings in pursuit of profits. Insys is just one example of profit overcoming morality in the pharmaceutical industry – who will be next, and what will that mean for public health?

It was late and Martin A. Kits van Heyningen feared he was letting the group down at the company he co-founded, KVH Industries. Instead of lay off employees in reaction to the coronavirus pandemic, he had actually chosen to cut salaries, and when he emailed a video describing his choice at 3 a.m. last month, he was prepared for a barrage of complaints.
