Lookie Here, My Dear is a weekly column that spotlights albums that have evaded the Big Sites (Pitchfork, Stereogum, Allmusic, etc,). This week’s album is one that especially needs some extra love and support: Of Montreal’s 21st album: I Feel Safe With You, Trash.

Of Montreal is the closest I have gotten to embracing a Phish/Grateful Dead style fandom over a band. I would absolutely drop everything I am doing in my life to follow of Montreal on tour. I am singing along to every song. I don’t have the songs consciously memorized, they have been programmed into me. I have listened to a full bootleg version of False Priest and have seen them live more than any other musical act in my lifetime (Around 10 times in three different states and one different country). As an aggressively weird and emotional kid growing up in the South that wanted to break through the gender binary and frighten and challenge the “normals,” you couldn’t ask for a better soundtrack than Of Montreal. I discovered them in 2007, the year of Hissing Fauna, Are You The Destroyer? The last album Of Montreal would earn Pitchfork and Big Publication’s laurels and respect.

There have been 10 albums out since Hissing Fauna and I love the majority of these albums to various degrees. There is a B-sides rarity compilation Daughter of Cloud that I haven’t really spent time with and a couple of real dud LPs: Innocence Reaches and UR Fun. UR Fun was the most recent Of Montreal album that came out in the beginning of 2020 and was more or less written off as a complete failure by critics and online fairweather fans. Critics have actively grown disdainful over Barnes’ eccentricities and their overwhelming unfashionability, there hasn’t been anything trendy about of Montreal in nearly 14 years. Real of Montreal fans know there’s usually one middling album that paves the way for a much stronger release. Mainly evident in the jump of quality between Innocence Reaches and White is Relic. The leap in quality between Trash and UR Fun is astonishing.

UR Fun has some choice cuts and even the worst Of Montreal albums are more interesting than a good deal of today’s musical landscape. I saw Of Montreal live for UR Fun in February 2020, one of the last full capacity shows that would ever happen in Brooklyn’s Brooklyn Steel venue, perhaps forever. Unfortunately it was one of the most unpleasant oM concerts I attended and no fault of the band but due to the audience. Restless and rude bodies going back and forth, forth and back to the bar or who knows elsewhere and shoving people around. An absolute covid nightmare. Nobody attending concerts in January and February 2020 were appreciating them as much as they should.

Of Montreal had been releasing their albums on Polyvinyl since their sixth LP, the critical breakthrough Satanic Panic in the Attic. At that point Barnes had already spent 8 years building up a devoted cult following and making hysterically ornate psychedelic pop and lo-fi rock confections. Of Montreal seem to have a layered working relationship and have been a stable home for Barnes’ adventurous output. What’s remarkable is that none of these shifts in sound ever feel like counter culture role play or trying on an EDM hat or a alternative country hat, they are always distinctively an Of Montreal album. Besides stylistic adventurousness the other running throughline that connects the of Montreal discography together is Barnes’ penchant for hyper-literate, bold everything and the kitchen sink approach to lyricism and songwriting. The highly divisive, gloriously deranged Hissing Fauna follow-up LP, Skeletal Lamping is where the free-verse, songs within songs approach fully becomes a mainstay for Barnes. Even though I Feel Safe With You, Trash is being released on a separate personal vanity label, Sybaritic Peer, Of Montreal and Polyvinyl continue to be a fertile label and artist relationship.

I Feel Safe With You, Trash is also notably the longest album released by Of Montreal since 2004’s Coquelicot Asleep in the Poppies (1 hr 9 mins) clocking in at 1 hr 6 mins. As of writing this article I have already listened to the album three times and counting upon its official release date. Not because I have a moral principal about how many times a person should experience art before analyzing it, but because the album is so damn replayable. Of Montreal at their best, and this album represents Barnes at the height of their powers, reminds me why I love and obsess over music. Hardly anyone making music today is making music this bold and adventurous. At this point in their career Barnes has more than solidified their status as bonafide Japanese word for a Music Witch.

Barnes has been performing and producing every single instrument and singing every backing track on their albums for over two decades now, and still indicates not even a sliver of fatigue. There are days where I can barely write a single thought down because I know it won’t get a single like, it won’t lead me any closer to picking up the camera and nailing that perfect monologue. I can be salty about the life of obscurity I have built for myself, but then I have to remember Kevin Barnes. A bonafide musical genius that hardly bothers to get the word out. Barnes seems incapable of stopping making the sort of albums a person can get lost in for days. They are my biggest musical heroes, they represent exactly the sort of path I want to carve out for myself.

I Feel Safe with You, Trash is the embodiment of the gift that keeps on giving. A portrait of an LGTBQI+ artist 25 years into a career completely devoid of diminishing returns. There have been some missteps along the way with “Georgie Fruit'' and having too much fun during a mid-life crisis with UR Fun. More importantly I Feel Safe with You, Trash represents real, critical growth for Of Montreal. And this is Album One of Two of 2021, the year Of Montreal continued to take up a considerable portion of my mental bandwidth, it’s pure bliss.

Notable Tracks:

Aries Equals Good Trash - The first obvious “single” for the album that has a serious swaying lilting, uneasy beat. The vocals on this track are indicative of the overall shift in quality in Barnes vocals that have gotten a lot less strained and smoother. Favorite lyric/delivery:

“I compare thee to a saturnalia (ha!) if I may be so rude.”

The song also touches upon Barnes’ relating to be on the spectrum, both the gender/sexual spectrum and the cognitive one. Music for people breaking new ground with a broken brain.

Now That’s What I Call Freewave -

“Every time I look at my phone I get brain damaged. By every blamedead person I get lobotomized"

This song is also the first song in the Western music canon to introduce the phrase “feelbad songs of Covid summer.” This song also marks the first appearance of several where Barnes is absolutely shredding the guitar. I don’t really listen to much music that places and emphasis on “solos” or melting the fret board, but how can you not get excited by that burst of guitar? Also leave it to Barnes to find a way to also shout out an experimental cinema deep cut, Chick Strand’s Soft Fiction. I also discovered the Czech film Valerie and Her Week of Wonders through the song “st. exquisite’s confessions.” Why not also use your songs as a chance to shout out cool obscure cinema?

True Beauty Forever - Of Montreal go future funk. If you don’t know what that means don’t worry I’m brewing up a whole story on the joys of future funk.

Fuckheads Is the Auto-correction - Okay I need to nix that phrase from my vocabulary because nearly every song on this album could be considered a new favorite. How can you top this opening couplet:

Am I a creep because I don’t have a chosen pronoun? Am I a creep because my mind is the Odeon of the multiverse?

Drowner's TeÃrs - The use of pitched up vocals is an example of some of the new bells and whistles added to the oM sound palette.

Fingerless Gloves & Kcrraanggaanngg!! - Find Barnes doing death core, metal styled goblin shrieks and it really, really works. More absolutely gnarly and nasty fret work.

Yamagate Florest Flutes & ThRam Rammaged Ã Man-Mod - Reggae/Dub Of Montreal? :O

Notes Of ViOlate SPectates A Flatter Of Male & So Chill Then (o Portão) - On an album this dense and frenetic there had to be some more ambient and chill passages and having So Chill Then as the album closer makes for a satisfying, soft landing.

A Portrait Of The Artist With Foot In Mouth Syndrome

Due to a combination of school closures and massive construction projects taking place at certain primary schools, my freshman year of high school was actually eighth grade.

That’s not important here. What’s important is that I have dodged the biggest bullet ever.

I had been making art since I was four years old, and at this time, I wanted to post my art on the internet. Aware of the dangers of giving away any personally identifiable information, I came up with an online nom de plume when I set up my Photobucket account. I punched in the painfully obvious moniker of "Fake Name".

I was still at risk. The same week that I set up my account, we had an assembly at school where the theme was “be careful about what you post”. The vice principal told us about a girl who got into some deep trouble because she wrote some weird poem about a silver banana. Someone interpreted the poem to be extremely phallic (obscene, even). She had no choice but to flee the country. The VP said it didn’t matter but she didn’t put it under her real name. They looked up her IP address, and used that to identify her.

That story scared the shit out of me. Who knew what others would think of my creative endeavours? Would they think they were obscene? violent? some other bad thing? There was no way of preemptively knowing.

I mainly restricted the art I put on Photobucket to the most anodyne things I could think of: lame-o abstracts that I made with the auto shapes in PowerPoint that I would cut and paste them into MS Paint. But that changed quickly. Within a week, I had moved on to bigger and better things: digital collages. The collages started off as your typical hodgepodge of snippets from photos in the news and incredibly generic backgrounds that you see online.

My art became more diverse as I learned new technology (such as photoshop) and I got bolder. My digital collages became more reflective of what I really thought and felt. They even incorporated my own drawings. Then came the day I learn how to code fractals. My digital collage got really wild after that.

But, there was one picture I did that became more significant in my mind than all the others.

I saw a thing on the Discovery Channel that talked about spontaneous human combustion. In high school I thought the idea of a person spontaneously combusting was very funny. It sounds terrible, but I found something about a person bursting into flames without any initial source of ignition inexplicably hilarious. One minute, you could be walking to get your mail and the next, you're doing your best impersonation of a Ford Pinto. Consequently, I made it my mission to do a piece related to spontaneous human combustion.

When I made the image, I tapped into my affinity for bad puns. I based my image on some play on the phrase "X is on fire!" (since, if you spontaneously combusted, you would literally be on fire). The end result had a black background with red, flame like dragon curves arranged to look like fire emanating from a girl in a hooded raincoat.

Months later, I began to have second thoughts. It occurred to me that when most people see a picture of a person bursting into flames, their first thought isn't "X is spontaneously combusting"...their first thought is "burn in hell, X". It didn't help that the image I used as a reference came from a Google search of the phrase "hell fire".

By Christmas, I started to worry that the girl's family would trace back my spontaneous human combustion picture to my computer, identify me, and I'd have to deal with the full extent of the wrath. It was so bad that I would get an intense feeling of dread if anyone mentioned bullying (not strictly cyber bullying, but also regular bullying), people getting fired/arrested over things they did online, or political correctness.

My anxiety got really bad in the spring. It bothered me so muhc that I felt compelled to come up with a hell of a defence (just in case it ever came up in court). It took me four months to get everything organized and write up the case. By the time I was done, it was 104 pages long.

Here’s a rough summary of what I wrote: "I understand that the girl in the picture was Eden Richmond of Sydney, Australia. I found the picture online at least a year and a half ago. At no point between now and then did I know that Eden had a terminal disease, let alone that she would eventually succumb to the disease less than 24 hours after I posted the image commonly known as This Girl is on Fire on Photobucket on. As an artist, I often represent scenarios that come into my mind, either dreams or my interpretations of current events. In this case, I attempted to represent the concept of spontaneous human combustion in a humorous and parodic manner. The idea behind such a representation lies in how I perceive the notion of a person combusting without any outside source of ignition. I personally consider the idea of spontaneous human combustion completely ridiculous and, in a strange way, funny. There is no objective evidence of spontaneously combusting people, and, through this, spontaneous combustion of a human being is nothing more than an urban legend and/or a dark element in absurdist humour. At no point was an image intended to represent spontaneous human combustion supposed to be a visual shorthand for "burn in hell", nor was it intended to represent anyone being eternally damned for any reason (if it were, there'd be a devil or two equipped with a very sharp pitchfork). I understand that placing an image of a person surrounded by flames can be construed as a visual shorthand for "burn in hell". I find it very strange that somebody would interpret this image as “burn in hell“, since it's the person, not the environment, that's combusting. However, I can see that it would make more sense to have the flames emanating from the person to convey the idea of the individual combusting spontaneously. From now on, I will make sure that I will adjust my art style before I attempt something like this again."

After writing it up, I felt better knowing that if I ever got in trouble for that picture, I was at least prepared to defend myself.

About a year came and went without anyone even caring about the picture. By that time, I had moved onto other computer programming related pursuits (demoscene, for example). The case that I wrote up about the spontaneous combustion picture stayed in a notebook in a drawer of a dresser in our basement; a relic of my adolescent paranoia. Time wore on, and so did my life. I went off to college, I worked a myriad of decent summer jobs, and all without repercussions of my spontaneous combustion picture.

Today, I realized that I dodged a bullet. When I signed up for Photobucket way back when, I came up with a handle (which was displayed) and my pseudonym (which wasn't, at least at the time). Nowadays, however; they updated the site so that your handle and your name are displayed together. It's a good job that I put my name as "Fake Name" when I signed up for it, because otherwise; I would have had my infamous spontaneous combustion picture linked to my real name.

You tend to not put a period at the end of your last sentence, start your announcements with "Hey guys", occasionally don't put a ' in words, have a really unique way of doing keysmashes, say "pfffffffft" a lot, and tend to talk about being thankful for having online friends. You also like talking about all the characters you have and often refer to roleplays with seertale

In ask games you give out slightly short answers and react to kindness or gifts with a key smash. You also tend to tag very little and use " - " a lot.

Thats only what I noticed from the 10 min I took writing this and scrolling through a bit of your blog, but I could probably figure out a bit more if you give me the time.

Also yes. I use - as if I'm cutting myself off. Basically I cut myself off like I would in real life but put it in my writing

Also about the characters, yea.

Pfft is my way of laughing. I also forget apostrophes a lot because I heavily rely on auto correct cause I type with the speed of my thoughts. That equals really fast.

And you do too well with acting like I do traditional art. I'm naturally better at traditional artwork but a lot of the time my body is so sore (we think I have fibromyalgia) that I've grown more accustomed to just drawing digitally.

And yea. My roleplay with @seertale created a lot of ocs but I love them all and they will all find lives in stories outside the roleplay or the books we are making based off our roleplay.

And if it isnt obvious, I treasure my online friends just as much and my irl friends and I dont take compliments and a lot of kindness well.

That spurs from past trauma and being basically brainwashed to think the world is cold and I have to grow up fast. I cant expect people to always be nice.

But I'm healing and with everyone constantly proving what I was told (my someone hardly in my life anymore) wrong, I know I'll be able to take kindness soon

Why I stopped hacking. For good. Part 2. by Menmaro

Allow me to preface this second part by thanking those who read my first part and enjoyed it. I would like to apologise for any poor grammar/spelling or formatting as I am writing this on my on my phone so formatting is extremely difficult. My laptop is in another country at the moment so when I return home I will format these stories and future ones properly. Please bear with me and enjoy part 2.

I would also like to add that this tale is of an encounter of a friend of mine. I did not experience this first hand and thus I have to make up what his thoughts were (some are his exact thoughts) to what I would have expected him to feel from knowing him. This story is how he told me so as far as I know it is true. He has stopped hacking and spends most of his time gaming and working.

I stood frozen in horror. Panic swept over my body and thoughts flooded my mind. What happened to my mother? Is she OK? What is this son of a bitch doing with her phone? I knew I had to calm down, something didn't seem right. I picked up the phone and looked at the caller ID. It just said mum, no number. Fuck, how could I be so stupid, he was just masking his caller ID, must be to throw me off balance. I'll play along, there must be something I'm missing.

"Wh.. What are you doing with my mum's phone? Where is she? Is she OK?"

A laugh came from the other end, a deep, disgusting laugh. I decided to record the call, maybe I can play around with the recording and find this caller’s real voice. It may not be much, but this asshole knows where I live and probably who my parents are. He starts talking.

"Danni, Danni, Danni. The safety of your mother depends on the outcome of our little game. I told you one's life is on the line but, I should have elaborated and said it shouldn't necessarily be the player's life. So, are you ready to play?"

At this point I had a thought; How can James see me? I have no cameras connected to the WiFi, my desktop camera is disconnected and I ripped out my laptop camera when I got the damn thing. Another option would be he broke into my apartment and installed cameras when I was out. But why would he risk getting caught like that. I may have cameras at home and catch him doing it. No he must be using one of my devices.

“Doesn't seem like I have a choice James. Let's fucking play.”

I braced myself for what he would say. We’ve all watched those horror movies, these games weren’t exactly Mario Kart sort of level. Suddenly I knew, I wanted to throw myself from my apartment for how stupid I'd been. In my hand I held the single device that had a camera and was connected to my WiFi. My fucking phone. I didn't want to jump to the conclusion that that was the only camera that was being used, so I decided to test it. Before I do anything though, he begins to speak.

“Well well Danni, I must say, you’ve got balls. Most guys would have started to cry or beg me to stop. This will most certainly be fun.”

I've had enough of this shit. I start to test my theory. I started googling shit like “how to track a phone call”, and “how to find cameras in a house”. I wanted to see if he could see my screen and sure enough the confirmation came through.

“Oh Danni, it’s cute you’re still trying to fight back. But I can assure you, you will not be able to track this call and you will not find out how I can see you.”

Challenge accepted dickhead. I angle my phone away from my bag and take out a USB dongle. If this asshole is on my WiFi I'm gonna make him think he's controlling all of my devices. I look for my laptop whilst trying to make as little noise as possible and again, angling the phone away from what I am doing. I find my laptop, boot it up and plug my dongle into it.

“Yeah well, I'm one tough son of a bitch… so when we playing James? And do go over the rules properly yeah? I'd like to whoop your ass playing by your rules dipshit.”

My strategy was to show no fear. In truth, I was terrified. But I knew the instant he smelled fear, he would have total control over me, and I'd fuck up and forget basic stuff like I had when this shit show first started. My laptop finished booting up. Excellent. I knew this fucker was using my network somehow. So I decided to hack my own network and see how he got in. Maybe he left something behind.

“The rules are simple Danni. You wanted to play judge, jury and executioner. We are going to go through your history of white knight justice, and see just how much of a hero you really are.”

Hero… huh… there was a time when I thought I was a hero… maybe it was when I made that child molestor end his own life. I told myself I was a hero because he wouldn't hurt another child. In truth, was I a murderer? Was this my past coming to haunt me? No time to think about this. It isn't just my life on the line here, everyone I care about is in danger and there's no time to be selfish.

“Ha… hero… that’s cute James, but I’ve always known I was the devil. A necessary evil. But sure, let's take a walk down memory lane. Maybe that will remind you who the fuck you’re dealing with.”

My attempts were bringing up nothing. I managed to break into my own network many times but I couldn't find a trace of another device, not a trace of information transfer. Wait… information transfer. Outgoing and incoming traffic. Fuck I'm stupid. He can see a stream of my screen which means I have outgoing traffic somewhere right? I start monitoring my outgoing traffic. Encrypted of course but there was still an address. A server that this information was going through. I find the address of the server and decide to do something extremely stupid and might sentence myself to prison or worse, no access to a computer. But I decide that is a small price to pay for the safety of my family.

“Well well Danni, watch your screen as the images pop up. Leeeeets roll the tape ladies and gentlemen.”

What a fucking psycho, I don't pay much attention to the tone of his voice as I set up my botnet for a distributed denial of service attack. My hope is that if I bring down the server for a bit, I'll be able to see where the requests are coming from and track it from there. It is a long shot but it might work. As I'm doing this I also stop recording the call and send the recording over to my laptop. All the while I’m angling my phone away from my laptop, and since he hasn't spoken of it, my theory that the only camera being my phone turns out to be correct. I finally feel like I'm making the right moves in this twisted game of chess, I'm just hoping I'll be the one to say checkmate at the end though.

“Victim number one; Brock. 16 years old. You destroyed his relationship and got him kicked out of his home. He spent 3 years on the streets before overdosing on heroine. That wasn’t a nice thing to do Danni.”

A picture of 16 year old Brock pops up. He died? Fuck, he was an asshole but didn't deserve to die. I went to far… I went to far… but I couldn't admit it. Not to this psycho. I had to show him that I had no heart.

“Well life sucks, survival of the fittest and all that shit. Maybe he should have been careful with whom he messed with.”

Another disgusting laugh. James is enjoying himself… should I be? No time for that right now. I put the phone on loudspeaker and placed it on my desk, weary that the front camera may be used I kept it well out of my sight and put an earphone into my left ear. Time to tweak around with this recording and “unmodulate” this voice.

“Danni, this isn't gonna end up well if you show no remorse. Now the fun begins. Remember his girlfriend? It’s confession time Danniiiii.”

As if it were alive, my PC opened up Skype and auto signed in. Fuck I'm so stupid, was I really that lazy? A number is entered into it and it starts dialling. Ring ring…

“What do you want me to do James? Tell her the online babe was me and Brock wasn't a cheating dickhead? What's that going to change?”

My botnet was ready and I started my attack on the server address instantly. I then watched my incoming and outgoing traffic closely. All I needed was a hiccup, something that will lead me to James. In that moment it was like the entire world grinded to a halt. In that moment, it wouldn't matter to me if the moon was crashing down onto the Earth to end all life as we knew it. All that mattered was this stream of information. Tick tock tick tock tick tock. I could hear the second hand on my watch ticking…

There! A clue… phew, was starting to lose hope. I start work on it, did James notice? I'd imagine his connection to my network might have dropped since I saw a request ping but nothing going back. Was he too busy trying to guilt trip me that he got too cocky and didn't notice? My Skype was still ringing was she going to pick up?

“Hello?” A girl's voice. She sounds kinda cute actually, is James hooking us up? Wrong time for jokes there.

James speaks to me “Go on Danni, answer her. Tell her your name and what you did to Brock.”

I decide to play along, true he didn't call me from my mum’s number, but that doesn't mean he still can't hurt her.

“Liz? It’s Daniel Kurt. We went to school together with Brock.”

There was a pause, I can't imagine how awkward this must be for her. I didn't have time to care though, I ran a search on the address and whilst that was going on, I continued tweaking with the recording.

“Danni? That loony kid that used to get beaten up all the time?”

Ahhh what a bitch. Hooking us up my ass. I had to fight back the urge to shout and educate her ignorant ass on what autism was. Whatever though, not my concern. At least breaking this news to here won't be as painful to me as I thought.

“Yeah that's me, the loony kid.” I laughed and I could swear I heard James laughing too. Asshole. “So listen, don't suppose you remember Brock Leland? You kinda slept with him at that time.” Maybe not the best choice of words.

“Yeah I remember him, I heard he died from drug overdose, makes me feel horrible breaking up with him…” another pause, “why?”

Fuck. How do I say this? This is a confession, if she takes this to the police I'm fucking screwed. Fuck any chance I have of getting away with this. I was 16 though, does it matter? I read somewhere that crimes committed before 18 aren't dealt with anymore. I was just a kid? Damn it. To hell with this, I need to stop this madness before he makes me call a victim of an attack I committed after 18.

“Yeah well, it’s my fault he did this. He made my life shit for when I was at school. So I decided to fight back. He never cheated on you, I made it look like he was.”

A really long pause. Gives me time to work on this recording. Nothing remotely human yet. Still searching that address, why is it taking forever?

“Danni.” Her voice was extremely soft. I was expecting something else. An angrier tone would have made more sense.

“Yeah...?”

“I know.”

Why It’s Important to ‘Get It in Writing’

“Get it in writing!” That’s a phrase we hear often. In things like bills of sale, freelance contracts, or employee compensation packages—if you and other parties are making an agreement, there’s value in using written language to document it.

We often relate the phrase “Get it in writing” to fancy legal contracts drafted by lawyers, whose time is expensive. But getting something in writing doesn’t have to entail a contract. It can be as simple as a quick email solidifying a verbal agreement.

An Example of What It Means to ‘Get It in Writing’

I’ve volunteered on the board of directors for several small nonprofits over the years. Groups like these are notorious for . . . well, all the things that happen when you put a bunch volunteers with different talents, abilities, and personalities together. Because their efforts are secondary to their busy lives, it’s common for volunteers to get their wires crossed and for things to slip through the cracks.

On one club’s board of directors, where part of my responsibilities included crafting a newsletter, I learned the value of getting conversations in writing. Although the club’s president told me verbally that a member’s article contributions were filler for when space allowed, my leaving one out and rescheduling it for the next newsletter ended up causing hurt feelings. And all that could have been avoided had I taken a moment to get the conversation in writing. Here’s what I wish I’d written:

Hi Bob,

Thanks for chatting with me about the newsletter at last night’s meeting. I’m excited for next month’s issue!

Things were hectic last night, so I’d like to make sure I have our conversation straight. As I understand it, Ralph’s articles are to appear in the newsletter as space permits, and it’s okay to push one back to the next issue if we have a full four-page newsletter already.

Would you take a moment to reply and confirm whether that’s correct? And, of course, if there’s anything you need to clarify, this would be a great opportunity to do that.

My email would’ve served a couple of purposes. First, it would have given me the opportunity to reiterate my understanding of the conversation. Bob had said, “Consider Ralph’s articles filler for when we have space.” The second paragraph of my letter clarifies exactly how I interpret what he said.

Second, getting our conversation in writing would have given Bob a chance to follow up with me if it turned out I’d misinterpreted what he’d told me. It would have also given him the chance to present me with an addendum, perhaps something like, “It’s okay to leave Ralph’s article out, but it’s best to email him to tell him why that’s happening so he doesn’t feel slighted.”

When leaving Ralph’s article out of the newsletter resulted in hurt feelings, a record of the conversation would have allowed me to cover myself—I could have referred to the email exchange I’d had with with Bob. Bob wouldn’t have been able to backpedal and claim no knowledge of the conversation. (Which, incidentally, is exactly what he did.) More to the point, he would have been less likely to, knowing that our conversation was recorded in text.

Although we often think of getting it in writing when it comes to legal matters like sales agreements and employment contracts, getting day-to-day conversations (that might result in a misunderstanding) in writing can be incredibly useful. It’s a powerful tool for avoiding confusion and disagreements.

What types of things do require legal contracts?

Although both written agreements and verbal “handshake” agreements are considered legally binding, the “he said/she said” nature of verbal agreements makes them difficult to enforce in a court of law. And some high-stakes contracts should be drafted by a lawyer, or at least templated by one.

Some transactions that should have legal contracts include:

Real estate sales

Agreements to pay someone else’s debts

Contracts that take longer than one year to complete

Real estate leases for longer than one year

Contracts for over a certain amount of money (depending on the state)

Contracts that will last longer than the life of the party performing the contract

A transfer of property at the death of the party performing the contract

Of course, this article isn’t intended as legal advice. When in doubt, get legal counsel. If you’re wondering whether an agreement should have a lawyer-prepared contract, consider whether conflict over the terms could have significant legal or financial ramifications. If it would, then involving an attorney or using a legal template is a good idea.

Contract templates are often available online, but finding a reputable source can be tricky. Be sure to do your homework before handing over credit card info to sites that require payment for creating and printing contracts.

Here’s a tip: Try searching for the type of contract you need plus your state. For instance, if you’re selling your car and you live in California, enter “auto sale contract California.” State government and law sites often have free contracts available for download. My search turned up a contract from the California DMV. You’ll know you’re dealing with an official site if it’s located at a .gov Internet address.

The Benefits of Getting It in Writing

Whether or not it’s required, a written agreement is proof of the terms you discussed. It prevents people from forgetting what was agreed to, denying what they’ve said, or changing their story (like Bob did.) Written documents can also serve as legal evidence in court, if necessary.

According to the Shake Law blog:

Get everything in writing! Everything. Even if it’s just on a napkin, get it in writing. Samuel Goldwyn said ‘Verbal contracts aren’t worth the paper they’re written on.’ And it’s true — verbal contracts may be legally binding in theory, but try enforcing one!

So, put those writing skills to use! Take time to think through and record the agreements you make. Clearly laying out the verbal covenants in text can save a lot of hassles down the line.
