La decisión de la Cámara fue adoptada con los votos de los magistrados José Alejandro Sudera y Andrea García Vior, que integran la sala de feria de la Cámara del Trabajo junto con la jueza Dora González, que postuló remitir la causa a la Cámara Contencioso Administrativo Federal para que defina qué fuero debe tramitar el expediente. "No se evidenciaría objetivamente la ´necesidad´ de adoptar tan numerosas medidas y que, aunque ello pudiera -hipotéticamente- intentar justificarse en la referencias genéricas a 'un hecho demostrado', lo cierto y jurídicamente relevante es que no se avizorarían las que se alegan constituyan razones de 'urgencia' para eludir la debida intervención del Poder Legislativo en lo que hace a la legislación de fondo", sostuvieron los jueces que conformaron la mayoría, según surge del fallo al que accedió Télam. "Varias de las normas que el Poder Ejecutivo Nacional pretende modificar sin darle intervención a los legisladores tienen naturaleza represiva o sancionatoria al punto que se las ha incluido como integrativas del derecho penal laboral, calificadas como 'leyes antievasión'", agregaron los magistrados. Los jueces destacaron, además, que "no se explica cómo las reformas planteadas, de aplicarse en forma inmediata y por fuera del trámite normal de sanción de las leyes, podrían remediar la situación referida a la generación de empleo formal, máxime cuando el propio decreto reconoce que se encuentra estancada hace 12 años, lo que impide -en principio- considerar la irrupción de alguna circunstancia súbita, imprevisible o de extrema 'excepcionalidad'". "En lo que hace al trámite legislativo que el decreto pretende obviar, cabe mencionar que el Presidente de la Nación se encuentra facultado a convocar al Congreso a sesiones extraordinarias (art. 99 inc. 9 de la Constitución Nacional) y que tanto el Reglamento de la Cámara de Diputados como el de la Cámara de Senadores poseen herramientas que permitirían darle mayor celeridad al tratamiento de cada proyecto en caso de que sus autoridades o integrantes de los cuerpos lo requieran (tramitación en comisiones de manera conjunta y mociones de preferencia o de tratamiento "sobre tablas")", recordaron. Además, señalaron que "resulta, al respecto, insoslayable que mediante el Decreto 76/23 (BO 26/12/23) se ejerció esa facultad y se convocó al Congreso de la Nación a sesiones extraordinarias desde el 26/12/23 y hasta el 31/1/24, a fin de tratar -entre muchísimos otros temas- la ratificación del DNyU 70/23". Los magistrados también resaltaron que es una "inveterada doctrina del máximo tribunal que las consideraciones genéricas expuestas en los considerandos de los Decretos de Necesidad y Urgencia resultan inhábiles para justificar el dictado de medidas legislativas por parte del Poder Ejecutivo Nacional". Algunas de las modificaciones en materia laboral establecidas en el decreto de necesidad y urgencia (DNU) que firmó el presidente Milei, que ahora quedaron provisoriamente suspendidas, son la ampliación del periodo de prueba hasta los 8 meses, la incorporación de los bloqueos o tomas de establecimientos como causa de despido y cambios en el sistema de indemnizaciones. En materia de convenciones colectivas de trabajo, el DNU indica que esa materia "solamente mantendrá subsistentes las normas referidas a las condiciones de trabajo establecidas en virtud de ellas y hasta tanto entre en vigencia una nueva convención colectiva o exista un acuerdo de partes que la prorrogue". "El resto de las cláusulas (obligacionales) podrán mantener su vigencia, solo por acuerdo de partes o por la específica prórroga dispuesta por el Poder Ejecutivo Nacional", señala el DNU.

TORVAIANICA, Italy/VATICAN CITY, Nov 19 (Reuters) - The run-down beach town of Torvaianica is about 35 kms (20 miles) south of the Vatican.

But for transgender women who live there it had seemed light years away until a rapprochement with the Catholic Church that began during the COVID-19 lockdown and led to an invitation to have lunch with Pope Francis on Sunday.

Claudia Victoria Salas, 55, and Carla Segovia, 46, both Argentinian, were in a group of transgender people, among about 1,200 poor and homeless people, who attended the lunch on the Church's World Day of the poor.

To her surprise, Salas, a former sex worker, found herself seated opposite the pope, who is also Argentinian, at the main table in the auditorium, where the pontiff holds his general audiences in winter.

"We transgenders here in Italy feel a bit more human because the fact that Pope Francis brings us closer to the Church is a beautiful thing," Carla Segovia, 46, a sex worker, said earlier this week on the deserted windy beach of Torvaianica.

"Because we need some love," she said.

Last week, the Vatican's doctrinal office issued a statement saying transgender people can be godparents at Roman Catholic baptisms, witnesses at religious weddings and receive baptism themselves.

LGBT rights advocates in the church welcomed the move while conservatives condemned it, accusing Francis of sending confusing signals about sexual morality to the faithful.

Francis, 86, has tried to make the Church more welcoming to the LGBT community without changing Church teachings, including one saying that same-sex attraction is not sinful but same-sex acts are.

At the height of the COVID-19 pandemic, Father Andrea Conocchia, the pastor of the Blessed Immaculate Virgin parish in Torvaianica helped the transgender community with food and other assistance.

Parish resources were stretched at the time because many people were cut off from income, so Conocchia asked for help from the cardinal who runs the pope's charities.

As well as sending money, the cardinal arranged for them to have COVID vaccinations in the Vatican and to meet the pope.

"For us, he is our saint," Salas said of Conocchia last week.

On Sunday, Conocchia arrived at the Vatican on a bus with about 50 poor from his parish, including transgender people, both foreign born and Italian.

"This is a fantastic opportunity for all of us transsexuals," Segovia said, as she entered the auditorium. "I send the pope a big kiss".
