FAMILY CODE OF THE PHILIPPINES

ARTICLE. 24. IN ALL CONTRACTUAL, PROPERTY OR OTHER RELATIONS, WHEN ONE OF THE PARTIES IS AT A DISADVANTAGE ON ACCOUNT OF HIS MORAL DEPENDENCE, IGNORANCE, INDIGENCE, MENTAL WEAKNESS, TENDER AGE OR OTHER HANDICAP, THE COURTS MUST BE VIGILANT FOR HIS PROTECTION.
WHO ARE PROTECTED BY LAW?
Reason for the Courts' Protection of the Underdog
The law takes great interest in the welfare of the weak and the handicapped. Thus, we have "parens patriae"
Literally, "parens patriae" means "father or parent of his country". In the U.S. (as in the Philippines), the phrase refers to the sovereign power of the state in safeguarding the rights of the person under disability, such as the insane and the incompetent.
Meaning of "Vigilant for His Protection”
The phrase in general means that in case of doubt, the doubt must be resolved in favor of the underdog. This does not mean that they are above the law, or that they are given preferential status but simply the courts must be vigilant as others might take advantage of their disadvantaged status.
ISSUE ON SOCIAL JUSTICE
Article 24 of the Civil Code is an implementation of the Social Justice Clause in the Constitution. In a message to the National Assembly on February 16, 1938, President Manuel L. Quezon said: We are earnestly concerned with social justice. Without a strict application of social justice to all elements of the community, the general satisfaction of the people with the government is impossible to achieve.
WHAT THE PROTECTION COVERS?
In Valenzuela v. CA, et al., G.R. No. 56168, December 22, 1988.
Facts: An old and illiterate man obtained a loan from a rural bank of P 300.00. His record reflected, however, was P 5,000.00. In action for annulment and or instrument, the lower court ordered the reformation of a contract to reflect the true intention of the parties.
Held: The bank took advantage of the old man, hence, in the exercise of the Court’s duty to protect the rights of people with limited education, it affirmed the lower court’s decision, based on Article 24, NCC. Award of moral damages was also sustained due to the mental anguish and serious anxiety suffered by the heirs as the result of a fraudulent act of the bank.
Law applied in Rape Case
People v. Casipit, 51 SCAD 482, 232 SCRA 638 (May 31, 1994)
Worth noting is the marked receptively of our courts to lend credence to the testimonies of victims who are of tender years regarding their versions of what transpired since the State, as parens patriae, is under obligation to minimize the risk of harm to those who, because of their minority, are not yet able to fully protect themselves.
Parens patriae -- the principle that political authority carries with it the responsibility for the protection of citizens.

Small league au where Sonic tried to get Shadow into League of legends and he got placed in one of the lowest ranks. Sonic thought Shadow would never play again but Shadow felt an indescribable amount of fury being a lower rank than his rival, so he took three months off of GUN and spent the next year hard-grinding and metamaxing league of legends to beat him.

Fases de la etapa preparatoria
Toda queja al juez de instrucción
Tribunal de sentencia conformado por.3 jueces técnicos jueces de carrera
Se encargan de llevar a cabo delitos graves
Art52 cuáles son los delitos que puede conocer un tribunal de sentencia
Duración de la primera fase "etapa preliminar" y su finalidad
Artículo 300 del cpp
Esta etapa tiene por finalidad recolectar todos los indicios suficientes sobre el hecho que se investiga a sí como identificar a los posibles autores
Tiene una duración de 20 días pudiendo ampliarse 60, 80, o 120 días cooperación internacional únicamente o investigación financiera
El juez dice que vencido el plazo de los 60 días va a terminar
Suspensión condicional del proceso
Conclusión de la fase
El fiscal no puede ampliar más de 60 días
Pasan los 80 días saca resolución y termina la etapa preliminar
El juez emite rechazo o una imputación de qyerella
Puede realizar salidas alternativas formas de solución temprana al proceso antes de llegar a un proceso sin llegar a juicio
• Suspencion condicional del proceso
•Procedimiento abreviado
•Conciliación y reitero de oportunidad reglada
Conclusión de la fase preliminar
•Rechazo de querella, denuncia u otras actuaciones art 304
El fiscal deja de investigar cuando a los 80 días se llega a
° determinar qué el hecho no existió,
°que no esté tipificado como delito hecho atípico
o que art 304/1 imputado no participa en el hecho en los 60 días se demuestra que no estaba
Además 2da opción no se pudo individualizar al imputado no se determina quien lo llevo a cabo
3ra opción La investigación no haya aportado elementos suficientes para la acusación
Y cuando exista un obstáculo legal
En estos casos se lleva el rechazo
Solo en el 1er caso cuando se determine que el hecho no existió solo en este caso el proceso termina ahí y no se reactiva
Pero cuando no hay obstáculo legal el proceso puede seguir siempre y cuando haya nuevos elementos puede modificar, variar
Art 180 derecho a impugnar (interponer un recurso reclamo la decisión judicial no estoy de acuerdo )a través de objeción de rechazo
Acción penal pública= el fiscal debe participar
En caso de rechazo se puede pasar a acción penal publica a privada
Si la víctima tiene los recursos, elementos puede convertirse la acción pública en privada
Se puede reactivar art27 causales de extinción 9no reaperturar caso dando plazo de 1 año en caso de ser archivado
Se reactiva Para modificar circunstancias
La conversión de accione publica a Privada art 26 la víctima solicita que a acción penal pública sea acción penal privada( numeral 1)

Numeral 5 pedimos conversión de accione al fiscal departamental cuando el delito sea de instancia de parte sin que haya muerto alguien o cuando se por discriminación
Cuando sale rechazo y objetas solicitas la conversión al juez de instrucción
El rechazo es una opción para conversión de acción
Suspensión condicional del proceso
Antes de que se dicte una sentencia se aplica salida alternativa
Procede cuando sea previsible la suspensión de una pena
O cuando se trate de delitos que tengan pena preventiva de libertad de 6 años
Cualquiera de las partes puede pedir que se suspenda, se paralice
Siempre y cuando el imputado repare el daño y para que a futuro no tenga una sentencia
Esta solicitud se solicita antes de concluida la etapa preparatoria antes de la acusación
O presentando en juicio si es que repara el daño debe existir conformidad de la víctima
No procede en menores de edad
Se realiza ante el juez y el determina si se cumple los requisitos art24 no puede ser menor a 1 año ni mayor a 3 años
Esta resolución solo es apelable por el imputado
Si no cumple se reboca el proceso vontinua su curso hasta dictarse una sentencia
Procedimiento abreviado
reduce la carga procesal "me declaró culpable"
Aceptación libre y voluntario del imputado
Se presenta memorial ante el fiscal
(Negociación con el fiscal )
El juez puede rechazar
Cuando el estime que el juicio pueda llegar con mayor eficiencia "cuando algo no cuadre"
Cuando exista oposición de la víctima (fundamentada)
Conciliación =arreglar acuerdo entre partes
No procede en delitos graves gravisimos donde el interés del menor se vea comprometido
Procede en los delitos culposo donde no hay muerto
Puede ser promovida en cualquier parte del proceso
El juez y el fiscal deben promover la conciliación
Criterio de oportunidad reglada art 21
Se le da la oportunidad al delincuente de no meterlo en proceso
Numeral 2 el victimario se vuelve victima
Numeral 3
Numeral 4 perdón judicial delitos donde la pena no sea mayor de 2 años

Se extingue para el beneficiado si se aplica el procedimiento de criterio de oportunidad reglada
