Sen. Ed Markey (D-Mass.) sent a letter Tuesday to the Department of Homeland Security (DHS) urging it to discontinue the use of a smartphone app required by migrants seeking asylum at the southern border to use.
The CBP One app, which was rolled out in 2021, was established to allow migrants to submit applications for asylum before they cross the U.S. border. Markey said in his letter that requiring migrants to submit sensitive information, including biometric and location data, on the app raises “serious privacy concerns,” and demanded that the DHS cease its use of it.
“This expanded use of the CBP One app raises troubling issues of inequitable access to — and impermissible limits on — asylum, and has been plagued by significant technical problems and privacy concerns. DHS should shelve the CBP One app immediately,” Markey said in his letter.
“Rather than mandating use of an app that is inaccessible to many migrants, and violates both their privacy and international law, DHS should instead implement a compassionate, lawful, and human rights centered approach for those seeking asylum in the United States,” he continued.
He said that the use of this technology has also faced technical problems, including with its facial recognition software misidentifying people of color.
“Technology can facilitate asylum processing, but we cannot allow it to create a tiered system that treats asylum seekers differently based on their economic status — including the ability to pay for travel — language, nationality, or race,” he said.
The app has negative ratings on both the Google Play and Apple app stores, with many users criticizing the app for crashing and other technical issues.

A group of Democratic senators led by Sen. Tina Smith (Minn.) are circulating a letter urging President Biden to invoke his constitutional authority under the 14th Amendment to raise the nation’s debt limit without having to pass legislation through Congress.  
These senators say the spending reforms that Speaker Kevin McCarthy (R-Calif.) has demanded in exchange for raising the debt limit are unacceptable and that Biden should circumvent Republican lawmakers by raising the debt limit unilaterally, something that has never been done before and would almost certainly be challenged in court.  
“We write to urgently request that you prepare to exercise your authority under the 14th Amendment of the Constitution, which clearly states: ‘the validity of the public debt of the United States…shall not be questioned.’ Using this authority would allow the United States to continue to pay its bills on-time, without delay, preventing a global economic catastrophe,” they write in a letter currently circulating through the Senate Democratic conference. 
The signatories on the letter so far include Sens. Jeff Merkley (D-Ore.), Elizabeth Warren (D-Mass.), Bernie Sanders (I-Vt.) and Ed Markey (D-Mass.).  
The lawmakers warned they will not accept any concessions attached to the debt limit that cut federal assistance for low-income Americans without raising taxes on wealthy individuals and corporations.  
“We cannot reach a budget agreement that increases the suffering of millions of Americans who are already living in desperation. At a time of massive wealth and income inequality, we must ask billionaires and large corporations who are doing phenomenally well to start paying their fair share of taxes,” they wrote in response to proposals by House Republicans to increase work requirements for people who rely on Medicaid, the Supplemental Nutrition Assistance Program and Temporary Assistance for Needy Families. 
The Democratic senators warned that Republican proposals in a House-passed bill to raise the debt limit could push as many as 21 million people off of Medicaid and deny nutrition assistance to 1.7 million women, infants and children.

Last week, U.S. Senators Ed Markey, Elizabeth Warren, Bernie Sanders, and Peter Welch introduced the End Solitary Confinement Act, companion legislation to HR 4972 introduced in the House of Representatives by Missouri Rep. Cori Bush in July. This bill would end solitary confinement in all federal custody and incentivize states and localities to do the same. The End Solitary Confinement Act is a product of years of advocacy and activism from campaigns across the country led by people who have survived solitary and had loved ones inside, and draws from the best policy components of enacted and pending legislation. Specifically, the End Solitary Confinement Act does four key things: End all forms of solitary confinement, ensure that all alternatives to solitary are *actual* alternatives, enhance due process protections, and create oversight and enforcement mechanisms. Over 175 organizations nationwide have already endorsed the End Solitary Confinement Act and I hope you will as well. Solitary confinement is torture. We must end this barbaric practice. Thanks.

The rest of “the world’s most exclusive club” may feel compelled to start treating the help a little nicer, as staffers in Sen. Edward J. Markey’s office are set to form the Senate’s first labor union.
Aides formally requested that the Massachusetts Democrat voluntarily recognize their bargaining unit in a staff meeting Wednesday morning. Markey happily complied.
“I applaud these passionate, dedicated workers who are exercising their right to organize through this fundamental, critical exercise in democracy,” Markey said in a written statement. “I am proud of my staff for embodying the commitment not to agonize, but to organize. I recognize their effort to unionize and look forward to engaging with them and the Congressional Workers Union.”
This is the second time Markey staff have made unionization history — his 2020 election team was the first statewide campaign in Massachusetts to unionize.
