Lallybroch: copyright vs. trademark
An excellent question was asked by our friend @rosfrank in the comments thread to 'The door faces North' post and given the cosmic amount of uninformed bullshit being ventilated for almost ten years in this fandom, I think it's time to answer it once and for all:

Whenever we are informally talking about 'owning the rights to something', I think it's very important to bear in mind a fundamental distinction between two different categories of ownership rights: copyright and trademark.
The copyright is the most familiar one to many of you. It is what you usually find on those annoying and apparently useless first or last pages of all the printed or digital editions on this planet. Something like this:

In the US, copyright issues are regulated by the Copyright Act of 1976, as included in Title 17 of the US Code. The US public authority competent for registering and managing copyright is, as predictable, the US Copyright Office.
Perhaps the most seminal US Supreme Court decision, as far as copyright is concerned, is the 1991 Feist Publications, Inc., v. Rural Telephone Service Co. In it, the Court ruled that mere compilations of information or facts (such as, for example, telephone books) are not protected by copyright, according to US law. In other words, the ancient legal concept of 'sweat of the brow' (which simply means the amount of work required to gather and compile those facts/information) is not enough to qualify a work for copyright protection, if no creative effort is added to enhance its content. This is why I have always considered absolutely ridiculous Marple's efforts to watermark public information screenshots: it is useless (to the extent that it legally protects her from nothing) and, as her timelines, a mere compilation of facts (legally ditto). A similar approach is preferred by the UK and also by many Roman law legal systems, such as the French one - just making things clearer, here, by the way.

But I am rambling. In my view, Lallybroch, as a pivotal concept used in Diana Gabaldon's books, is protected by the copyright granted to each and every of her books mentioning it, according to the Roman law principle 'accessorium sequitur principale' (the accessory follows the principal). So it will remain protected for at least 70 years since the last of her books mentioning it would have been published under copyright. Unless she chooses to separately protect the entire finished cycle as a whole, once Book Ten (fingers crossed) is published, preferably during our foreseeable lifetimes.
That being said, that goes only for one copyright category: (published) text - you cannot copyright that secret diary in your drawer, LOL. This is why, the current US Copyright Office records concerning Lallybroch look like this:

Sony Pictures Television Inc owns the copyright to the fictional name Lallybroch in the motion pictures category, as it is the title of the Episode 12, in Season 1 - DG has been handsomely compensated for this, no worries. And someone I have no idea about owns the rights to an original musical score she has written and titled Lallybroch in the music category, since October 2013.
Onwards to the trademark. This is something different and this is all about making your name/concept/idea profitable. It is all about branding it, putting it on a product and selling it under that brand. It includes all the graphic elements and the logo of the brand (accessorium...) - in short, its visual identity to the consumers. In the US, trademark issues are regulated by the 1946 Lanham Act and the public competent authority is the good old US Patent and Trade Office (USPTO).
Right now, the situation for the Lallybroch trademark is as follows:

So, we see three different trademarks: two of them, owned by Diana Gabaldon, are classified as 'dead' (cancelled and/or abandoned) and the third, Lallybroch Spirits, owned by S's Great Glen Company is pending approval - he will not be able to label any booze bottle Lallybroch Drink Me before permission is granted by the USPTO.
Let's unpack:
Both Lallybroch trademarks formerly owned by Diana Gabaldon were filed at the USPTO on February 21, 2000 and granted on December 12, 2000. The first was aimed at producing 'tartan fabrics for the manufacturer of clothing' and it was abandoned in December 2003:

The reason is that the owner did not file in any Statement of Use after the trademark was granted. She had three years to do so, and since she chose not to do anything about it, the trademark was deemed abandoned (Stacy K. Smith is the attorney hired by Herself, btw). That means she specifically implied not to intend using it in the future. As such, she may claim NO rights on a now free to use mark:

The second trademark was aimed at producing 'clothing, namely, t-shirts, dresses and headwear' and also 'jewelry, namely, rings, pins and necklaces'- to cut the story short: OL merchandise - and it was cancelled on March 1st, 2013:

The reason is that the owner did not file the Section 8 declaration (of continuous use for five years) within the allowed legal timeframe (6 months after the fifth anniversary of the trademark granting renewal). Her trademark federal rights are now deemed canceled (but not her state law and/or common law rights!) and if she wants to ever use that name again, she would have to start the whole process over, bearing in mind the trademark could have been granted to someone else, in the meanwhile (not her case).
And for anyone who might ask, 'Erself does not own any other trademarks whatsoever:

The other (Doll Lab - LOL for ages) Diana Gabaldon is a pharmacist from Albuquerque, NM. Chill. 🤣🤣🤣
The owner of the copyright to the fictional toponym Lallybroch, as far as published text is concerned, is Diana Galabdon.
The owner of the copyright to the fictional toponym Lallybroch, as far as motion pictures are concerned, is Sony Pictures Television Inc.
The owner of the copyright to the fictional toponym Lallybroch, as a personal work of music, is Mrs. Kelly Ruth Davis, of Pennsylvania, USA.
The owner of the Lallybroch Spirits trademark will be Sam Roland Heughan, when that trademark is granted by the USPTO.

Why Rating Your Work Matters

In my many years of lurking around or actively being part of fandoms, I've seen a lot of fanfic authors ignore ratings. But they shouldn’t. Ratings are fundamental tools in many forms of fictional and entertainment pieces, whether its creator do it professionally or not. Which is why I don’t understand the hesitation to use it. But instead of trying to understand why, I’ll give you reasons to use it and how you can do it properly.
It can be hard to know how to rate your work. Unless you started writing fics in a website which includes ratings as a requirement to post fics, most likely new fanfic authors have no idea why they should add ratings. Which it is alright, I’ve been there. And I’m sure very few people will judge you for not knowing.
In my personal experience, I thought it was easy to rate fics. Because we see ratings all the time on movies, series, music and games, I believed it wasn’t that hard. But once I started writing, I found so many forms of rating systems (from Motion Picture Association of America’s Rating Board to citrus scale). Aside from that, the country I live has its own rating system, whic is so different from what I see in movies, games and fanworks. So I know it can be confusing. Yet, my mission is to uncomplicate things and help. So, let’s start.
Ratings exist to tell the reader who’s the author’s target audience. It isn’t as specific as a warning, but it gives them an idea of the subjects they might find in it. To have a better notion of how it works, let’s consider some rating components specified by Motion Picture Association: language, violence, drugs and sex.
General (G, K, K+ | age 9 and below) is a rating suitable for most people, including children. Fanfics rated as general are usually fluff and they lack mentions of sex or substance abuse. Violence and language are rarely seen. They can be vaguely mentioned, but never described with details (a fade to black scene before an act of violence happens or characters saying shoot instead of shit). I’ve seen writers say mild language can be included and avoid angst. But that’s up to each author.
Teen (T, PG, orange | age: 13 to 15) is a rating used to content suitable for audience over thirteen years old. Readers may find curse words, but sex, drugs and violence are still just mentioned or briefly described. Kids from age 10 to 12 aren’t included here is because they’re in a gray area where certain topics rated teen will be okay for them, but most of time, they’re still part of general audiences.
Mature (M, R, lime | age: 16+) is used for works unsuitable for minor audiences. Readers should expect some description of violence, sex, curse words and substance abuse, but not in so many details. Though these mature and explicit ratings are quite similar, the first is more focused on scenes involving complex emotional issues like mental illnesses, consequences of violence in its many forms and grief. Given that these themes can be upsetting, fanworks with this rating often come with specific warnings for triggering subjects.
Explicit (NC-17, E, MA, lemon | age: 18+) is also unsuitable for minor audiences. But unlike mature, fanworks with this rating usually contain extreme violence, substance abuse and graphic description of sex. Some works might need specific warnings for triggering subjects.
If you consider those main topics and the level of details you used to describe them, you’ll be able to see your target audience and choose the appropriate rating to your fanwork. This is a crucial item to promote your fanfic. It shows that you know and care about the person who will read your fic because putting that rating there says “hey, this is for you!” or “nope! Try again in a few years”.
But in case you still wondering why it’s so important if you’re already using warnings, here’s something you should know: warnings are only necessary for works that have potentially disturbing content. Language, light to moderate alcohol consumption, betrayal, fanfiction genres, sexual innuendos and common sexual activities aren’t triggering subjects for most people. Therefore, you don’t need to add warnings all the time. E.g. if your fic is rated as mature or explicit, you don’t need to add warning for language because your readers will expect curse words in it.
When rating a work, keep in mind that explicit doesn’t mean dark. You can write fluff in a fanfiction rated as explicit (I do it all the time). Higher ratings don’t demand warnings every single time. What you have to do is to know clearly the story you’re writing to be sure your readers will only be caught by surprise with plot twists, not because you failed to let them know what they can expect of your work.

Digging Deeper
Thank you to my radiant wonderful friend @alienfuckeronmain for sending me EXACTLY the type of self indulgent wind-down activity I wanted on this otherwise depressing weekend! If anyone else wants to answer FORTY-NINE QUESTIONS about themselves, I’m super nosy and will read it all! @fight-the-seether @ptolemyofchaos @butchwizard @metalbutch @nyndelion @comrade-ziltoid @leatherdear @kristalknobb Enjoy, friends!
1. Do you prefer writing with a black pen or blue pen? I prefer black, but I always feel like I write neater in blue??
2. Would you prefer to live in the country or city? The city, but only if it has breathable air, green infrastructure, and decent public transit. So like... definitely no city in America lmao
3. If you could learn a new skill what would it be? The ability to quickly become fluent in another language! I’ve been struggling with Spanish for literal YEARS and it’s honestly pathetic. My brain is so stuck on English.
4. Do you drink your tea/coffee with sugar? Look pal. If I wanna drink sugar, I’m gonna have a soda, not herb water or bean juice.
5. What was your favorite book as a child? I was OBSESSED with The Wish List, by Eoin Colfer (of Artemis Fowl fame). I remember being so fascinated by how dark it was?? It’s an afterlife adventure, where the main character has to escape purgatory by atoning for her crimes of robbery and fraud and whatever. I had a crush on her, so basically this book made me want to pursue a life of crime, even though it explicitly condemns crime and depicts Hell as a very real and horrible place. I was in like fourth grade and was super morbidly curious about Hell and the possibility of going there! Lol
6. Do you prefer baths or showers? Baths... but only when I’m not actually dirty going in. A bath is leisure, not hygiene.
7. If you could be a mythical creature, which one would you be? 100% fae! I would build my dwelling within a sidhe mound, steal shiny things in the middle of the night, make bastardly little contracts for no reason, and cause harmless mayhem and mischief because mortals really are fools (go off, robin goodfellow!) Also I love mushroom circles and dancing in the moonlight.
8. Paper or electronic books? Paper all the way! I read much more content electronically, but it’s usually in the short story or article format. Books are much better in print, I think.
9. What is your favorite item of clothing? Probably my rust-brown overalls.
10. Do you like your name or would you like to change it? I’ve always hated my name but no alternative has ever stuck, unfortunately. My name is Amy, and I don’t think it fits at all. If I knew I’d never have to correct anyone on it, I’d probably just change it to Amelia?
11. Who is a mentor to you? My little brother! He’s this genius musician, and he has taught me so much about song structure, polyrhythms, guitar technique, production tricks, all kinds of trivia that really deepen my appreciation for music and the LABOR that goes into it.
12. Would you like to be famous and if so, what for? No, never, not for anything. I cherish my anonimity so much, I don’t even put searchable tags on this blog cuz I get an adrenaline spike from anxiety if too many people interact with me. I also just think fame is a fucking hideous construct. I don’t think it’s even slightly cool or desirable.
13. Are you a restless sleeper? No, I’m a fucking log. I can easily sleep for 12 hours straight. Thanks, depression!
14. Do you consider yourself a romantic person? No, actually. I’m very much in love, and it brings me lots of joy to do nice things with and for my partner! But romance feels very difficult for me to connect with. I’m super domestic, like, I love the idea of marriage but not necessarily a wedding, or a moonstruck romance or whatever. Those dramatic gestures feel very awkward for me.
15. Which element best represents you? EARTH. Specifically, like... dirt, or soil.
16. Who do you want to be closer to? I want to be geographically closer to my family. We’re thick as thieves, but we all live like 50 miles apart from each other. I miss my brothers and my parents so much, I feel so incomplete and depressed without them to hang out with, especially since quarantine.
17. Do you miss someone at the moment? See above! Lol
18. Tell us about an early childhood memory. When my little brother was a baby, he had this grey car seat with a folding mechanism which held his legs in place. It made a very satisfying clicking sound when the mechanism moved, AND when it was fully unfolded, it looked a lot like a Klingon battle cruiser. (Or so my five year old brain thought.) So! My older brother and I would take this seat out of the car CONSTANTLY so that we could unfold it and “sing” the Klingon theme music from Star Trek: The Motion Picture while we scooched our car seat battle cruiser across the living room floor, pretending to shoot phasers into the TV or the dining table or whatever else got in our way.
19. What is the strangest thing you have eaten? Gifilte fish, maybe?
20. What are you most thankful for? My family, including my wonderful partner and all the cats in our lives!
21. Do you like spicy food? Yes! But my tolerance for extreme spice decreases every year, unfortunately. So I can’t handle as much heat as I used to, but I do enjoy a good kick.
22. Have you ever met someone famous? Lmaooo I made the regretful decision to PAY FOR a meet&greet with Fall Out Boy in like 2006, which was so fucking awkward and painful, I vowed to never approach that level of lame again.
23. Do you keep a diary or a journal? TONS! I’m an obsessive record keeper. Some years I journal more than others, and I’ve found that it is super difficult to keep up with it while working full time. But it’s absolutely one of my favorite hobbies.
24. Do you prefer to use a pen or pencil? Pen for writing. Pencil for drawing, and math.
25. What is your star sign? Virgo sun, Aquarius moon, Scorpio rising 🙃
26. Do you like your cereal soggy or crunchy? Crunchy! A shallow bath in that milk is key.
27. What would you want your legacy to be? My artwork. I go through these aesthetic phases every year that I become super obsessed with/ focused on, and I’ve always meant to catalogue them in annual art journals, but I’ve NEVER FINISHED ONE! They always get pushed aside by the need to work, and I hate that so much. If I could just take a year off work and backfill all of my missed concepts into completed books, I would be so happy. But I literally have NO WAY to pay for that, absolutely none. I fucking hate capitalism.
28. Do you like reading, what was the last book you read? I love to read, but finishing a whole book has been A STRUGGLE lately! Right now I’m chipping away at Tending Brigid’s Flame, which is a quaint lil devotional for the Celtic fire goddess. Very new agey, like cheesy Wiccan vibes. I love that shit!
29. How do you show someone you love them? Quality time!
30. Do you like ice in your drinks? Only if I have a straw. Ice touching my teeth kinda makes me wince.
31. What are you afraid of? Incompetance, doing a bad job, letting someone down, taking up too much space, being a nussiance, etc
32. What is your favourite scent? Incense! Especially cinnamon, dragon’s blood, and amber.
33. Do you address older people by their name or surname? I always call people, regardless of age, by the name they ask me to use. Sometimes it’s a surname or title, usually it’s a first name. I’ll ask their preference if I’m unsure. But I definitely don’t default toward a surname, that’s weird.
34. If money was not a factor, how would you live your life? COMPLETELY DIFFERENTLY!!!!!! The need for money rules literally every single hour of my entire life, and I hate it so much. I’m naturally nocturnal, but my job requires me to get up super early and sit in a car for 11 hours a day. I wake up at 5am, come home front work at 5pm, spend an hour or two trying to unwind, then go to bed and do it all over again. I hate my life! Really! I never see the stars, I never exercise, I am completely exhausted and burnt out all the time, and I barely get any quality time with my partner. If money were no object, I would sleep til noon or 1, make art and hike all day, ride my bike and stargaze all night, stay up til 4am reading and playing with my cats, and sleep like a baby. My partner and I would cook dinner for each other and watch Star Trek and collaborate on art projects and I would be so happy.
35. Do you prefer swimming in pools or the ocean? Here’s my hierarchy: Private pool > ocean > public pool
36. What would you do if you found £50 on the ground? I’d look around to see if anyone obviously dropped it and try to give it back. If I couldn’t find anyone, I’d exchange it for dollars and deposit that shit into my account!
37. Have you ever seen a shooting star? Of course!! Hundreds!
38. What is the one thing you would want to teach your children? America is evil and needs to be destroyed.
39. If you had to have a tattoo, what would it be and where would you get it? Lmao this is so cute. If you HAD TO HAVE a tattoo! I really wanna finish my damn sleeves, they’re literally 9 years in the making and barely half finished. But I’d also love more art on my legs! I DESPERATELY want Ziltoid in a lacy valentine heart on my thigh.
40. What can you hear now? Our fish tank water bubbling and my fan on full blast.
41. Where do you feel the safest? Home alone, doors locked, windows covered, lights low. I absolutely LOVE to not be seen or perceived in any way.
42. What is the one thing you want to overcome/conquer? My fear of discomfort

“Of course he is,” she said with a sigh. He was not one to stay up late doing homework like she was, but she had at least hoped to catch him in the middle of a late night video game marathon. But it didn’t matter; she really didn’t have a good reason for calling. She would have said something about their assignment, but he would not have any answers for her. Mostly, she just wanted to hear his voice.
“Guess what I had for dinner every day?” Aryll said.
Mipha smiled. “What?”
“A peanut butter and banana sandwich!”
“That sounds… weird. Was it good?”
Aryll nodded. “Link made it for me. Daddy said it was Mom’s favorite.”

Aryll grinned excitedly. “Okay! Me and you and Urbosa and Riju.” She paused. “And maybe Link, too? So he doesn't feel left out.”
“I guess Link can tag along,” Mipha said playfully.
“Okay, good. Mipha?”
“Yes, Ary?”
“I'm glad you're friends with Link. We're friends too, right?”
“Of course we are, silly. I like you better than Link.”
Aryll grinned. “Good, because I love you, Mipha. And I love Urbosa and Riju and Daruk and Link and Daddy.”

Film Review - Spider-Man: Into the Spider-Verse (2018)

Spider-Man: Into the Spider-Verse is a shining display of the skills of the talented artists and animators who worked on it, but they are used on a film with little to no direction, except for repeating the same clichés it aims to subvert in a franchise that is already becoming oversaturated by its own offerings in an attempt to reinvent itself for a modern audience, relying purely on fan-service and relatable pop culture references. It boasts a colourful cast of characters which it spends little to no time developing due to the haste with which the plot moves in an incredibly small timeframe of events. Ultimately, an experience that is pleasing to the eye with its skillful execution, but vapid in substance due to poor screenwriting choices.
To preface this review, one ought to know that review will not be from the perspective of an avid superhero aficionado but rather from a viewpoint of one with little to no exposure when it comes to the Spider-Man comic books, graphic novels or anything besides the Sam Raimi film trilogy and the 1994 animated series for that matter. As such, there won’t really be any discussion as to the quality of adaptation when it comes to characters and how they relate to existing plot lines as compared to those of the film; however, to compensate, that would contribute to a more objective viewing of the picture on its own merits. One other contentious aspect of the film is its music. The influence of the east coast hip-hop culture is written into the DNA of the protagonist and the film’s setting, and the soundtrack reflects that by making liberal use of licensed music, featuring heavy breakbeats with an electronic flair. Daniel Pemberton’s score is a more classical offering, mixing orchestral and synthesized sounds to elevate moments of humor or tragedy, but taking influence from 70’s funk, as well as more eastern or ragtime infused bits from different styles of animation. Virtually everyone invited to join the academy accepts, though not all. One of the industry’s most prominent Black directors, Ryan Coogler (“Black Panther”) recently revealed that he did not accept the academy’s overtures. Last year, the academy announced a plan that will require films to meet diversity criteria to be eligible for a best-picture nomination, starting with the 2024 awards. Still, those who have been critical of the way the film industry operates are not ready to heap too much praise on the academy’s efforts. “What we have to constantly recognize is that an institution like the academy didn’t give anything to Black people,” said Rashad Robinson, president of the racial justice organization Color of Change. “What the academy has done over the years is have a system and a set of rules that has stalled Black careers, which has prevented people from being able to be fully seen, which has had an economic impact on folks. Now that they are working to make some changes, let’s acknowledge those changes but let’s not give them any awards that they haven’t earned.” The yearslong process has been wrenching for the academy. Inside the secretive organization, factions formed, with some people insisting that the problem was not with the academy, but with film companies and the lack of opportunities they provide for people of color. That many of the academy members also worked for these companies was another point of contention. A glimpse of the animosity came when Bill Mechanic, an Oscar-nominated producer and former studio executive, resigned from the academy’s board in 2018. “We have settled on numeric answers to the problem of inclusion, barely recognizing that this is the industry’s problem far, far more than it is the academy’s,” Mr. Mechanic wrote in his resignation letter, which was leaked to the news media. “Instead we react to pressure. One governor even went as far as suggesting we don’t admit a single white male to the academy, regardless of merit!” At the same time, some people have turned away from the Oscars because of its lack of diversity.
