I Ramble About The Ending For A Long Time
ok hello i am insane yes yes 
however when else are you going to see me write c!crime meta
what’s important first off is that the emotional core of the story is still there. that’s the only reason why this works for me. this was a story about two bored brothers who make a story that turns into a nation together, and under that it’s about communication and loyalty and the strain mental illness places on a relationship and underneath even that it’s a story about two streamers in a pandemic who wanted content and to make each other laugh. 
that is never undermined or taken less than 100% seriously; it’s the emotional core of the whole thing. as wild as it gets and as bold choices are made, both wilburs love both tommys and vice versa. 
it’s a similar story with the line at the end: “I never did quite forgive myself” isn’t undermined, isn’t played for laughs. The argument c!crime have is incredibly well done and people will write actual analysis about that so you should go read it, but the gist of it is that c!crime are what they’ve always been: more than a bit unhealthy, perpetually arguing, but never quite willing to give up on each other.
with that being said, I felt like that was what I wanted out of the finale achieved. now to get into the wild parts.
the interesting part for me is how c!wilbur’s insane mindset is, for the first time, actually challenged and beat.
we’ve been saying for months that one of c!wilbur’s biggest issues is that his paranoia manifests in believing he is in a story, that there are roles like heroes and villains, that he has to play his part and there is nothing he can do about it. he’s his own self-fulfilling prophecy, he takes himself incredibly seriously, and most importantly, he is aware of the audience.
and nothing could break that. everyone around wilbur confirmed to his narrative, letting his vague statements that were clearly a narrative foreshadowing to suicide slip by. he’s getting swallowed up again by his own story, he is the one putting chekov’s gun on the wall, never quite saying something, but implying just enough that he was willing it into reality.
(he does the same thing in season 1, remember? he tells everyone he’s going to press the button enough times that by the end he feels like he has to because he’s foreshadowed it, because it’s who he is now. eret said it was never meant to be and thus it wasn’t. if you’re in an improv rp and you know it, speaking things is enough to make them real.)
and it almost works again! he almost follows the exact same trajectory of self-deprecation and sealing his fate. except. tommy’s not taking it this time.
tommy, having gone through everything he’s gone through, finally gets to win this. he looks the entire force of wilbur’s simultaneously self-aggrandizing and deprecating mindset dead in the eye and says tell me what you’re fucking talking about. 
he says the words! he looks at wilbur and says we’ve both been in this story before, I know what you’re doing, I know who you are and what this is and I’m not going to let it happen again. tell me, are you going to kill yourself? he enters into wilbur’s spiral and says this can’t be redemption if you still won’t be honest with me and you can’t leave without apologizing. 
he gets right to the core, no subtext, with all the blunt honesty he’s ever had, and c!wilbur, worn down from fighting and apologizing and the exhaustion of it all, finally gives in. he stops lying. 
his backstory was never cool. he was a gas station attendee, never any sort of leader before coming to the smp, and his jacket was just another uniform. he isn’t even european. he somehow sailed here from a landlocked state, because why not. this is Not the type of backstory for the type of person he’s trying to build himself up to be, this isn’t the fit for the genre at all! 
but insanely, impossibly, it’s true. it’s canon. just like the fish fucking and the fridge mom and everything else. it is ridiculous! and with that, it’s the realization that wilbur’s story has always been a serious character with serious feelings in ridiculous circumstance. his very real suicide was attempted via looney-tunes-esque sticks of dynamite in a pile, his ghost talks in a high-pitched voice and gives out blue dye. none of this undermines the seriousness of c!wilbur’s feelings, but it does undermine how he views himself as some great evil out of Game of Thrones. 
he died and got revived by a book! his depression fort was named pogtopia! he has always existed just under the threshold of ridiculousness by just how seriously he takes it all, how seriously everyone takes it. 
and c!tommy has always loved the person under the narrative he paints, and that’s why, at the end of it all, he can get through to him. tommy knows the story, he loves parts of it (l’manburg, the family, etc), but he doesn’t love this part, and for once, he gets to choose. he pushes and pushes and says you love me enough to not shy away from this, I am banking on you loving me enough not to push me away again, and he’s completely right! he breaks the cycle by being the same kid he’s always been.
and so wilbur’s end is ridiculous. it’s absurd, but it’s not him killing himself again. it’s not drenched in the belief that everything he made should be destroyed, but full of callbacks and nods to who he was. he never did quite forgive himself, but he’s not looking to the audience for forgiveness anymore, either. 
there are no more looks into the camera, and the book he gives for tommy is for his eyes alone, unlike every other speech like apology we’ve seen so far. he says things that the audience won’t reach. he invites us, one last time, to look upon his works and despair, to tell us that nothing remains. but he is still there, even if there is no story to watch. he is not part of a story anymore. the cameras are cut, and he survived. he is nothing more than himself.

Roleplay Rules:
The "Canon Claims" channel is for those who would like to be the server's "Main" version of any Baldur's Gate 3 canon character (Astarion, Shadowheart, Gale, etc). The channel works on a first-come first-serve basis.
Duplicates are allowed, but not considered "canon" to server-wide events and can only be played in "Non-Canon threads". (See further down)
All RP channels are required to use appropriate tags for threads. These tags include Public, Private, NSFW, Canon, and AU/Non-Canon.
In order to request a thread be marked "Canon", you must request the tag from admins. This is to avoid accidentally mismarking a thread or mismarking a thread in bad faith.
Private threads should list participants. Those not listed should ask the thread starter for an invitation first if they'd like to join the thread.
Canon Threads will be held to a higher standard of quality and realism than AU/Non-Canon threads, in order to maintain a cohesive narrative.
Questions and Answers:
Q: Are Duplicates allowed? A: Yes and no. For "Canon Threads", there is only 1 version of each canon muse allowed server-wide. However, there is no limit on duplicates in "AU/Non-Canon" threads.
Q: How many characters am I allowed to play? A: Currently, we want to limit Origin and Companion Canon muses to one per person. There is no limit on Tavs/OCs, characters from other franchises translated into BG3 (from anime series, live action shows, video games, etc), or non-Companion canon characters (such as Cazador, Raphael, Scratch, Thorm, Orin, Gortash, Orpheus, etc).
Q: Am I required to play a character infected with an Illithid/Mind Flayer parasite? A: No. In fact, we encourage that some not be.

small things to stop doing in your fics
(or any kind of writing, but i live on ao3. we begin with flat-out crimes and then slowly start moving into things that just bug me personally but aren’t wrong)
epithets. if i’ve said it once, i’ve said it a thousand times. you should only be using epithets for characters whose names we do not know. they can also be used VERY rarely to break up the repetition of names/pronouns or to emphasize characters’ relationships/viewpoints, ie “his boyfriend” or “the asshole.”
writing out accents. please stop. you can include a couple of small things, like “somethin’” or “ya” (for “you”), but even keep that to a minimum. specific turns of phrase/references go way farther imo to establish a character’s culture/background/etc. a little goes a long way, and doing it repeatedly can make sentences hard to parse. this also! applies! to children and babytalk! have you ever listened to a child speak? toddlers can enunciate pretty well!
not enough commas. put commas before names and titles. it’s not “Hey John” or “I’m on it captain,” it’s “Hey, John” and “I’m on it, captain.” also, put them after discourse markers/interjections such as “well,” “so,” and “now.” you should be writing “So, how are the kids?” not “So how are the kids?” even if your character is speaking quickly, you still want the commas because of grammar. it can occasionally be acceptable to omit them if you want to indicate extreme excitement/panic/anger/etc, but use it sparingly.
too many commas. i’m a comma fiend like the rest of you so i’m guilty here too, but we gotta at least stop with the comma splices. commas split and independent and dependent clause, meaning that one part of the sentence cannot grammatically stand alone. if all parts are complete sentences on their own, that’s a comma splice. try splitting it into two sentences, using a semicolon, or rewriting. this is usually fine in dialogue, though, that’s just how people talk.
also, using a lot of commas to denote panic is something i used to be HUGELY guilty of and now i hate it. instead of, “I, I, I don’t, I don’t know,” you can try, “I-I…I don’t—I don’t know!” probably not that much punctuation that close together, but for the sake of example. emdashes and ellipses, my beloveds 🫶
roleplay speak. i don’t know what else to succinctly call this? i’m referring to the tendency to be redundant and over-explain, especially in dialogue. it’s a phenomenon i see constantly in rp circles, usually because of post length requirements (and i have little issue with it there, it’s just the culture). things like:
“Surprise!” Adam shouted, popping out from behind the door.
“Oh my god!” Scott screamed, having been completely startled and not expecting Adam to be home yet.
yeah, we can guess that Scott is startled, right? because of the screaming? and clearly if Adam is surprising Scott it stands to reason his presence is unexpected? why are we stating this twice?
i believe this also comes from the mistaken idea that every line of dialogue needs a tag attached, which is….horrible. you can let the dialogue exist on its own sometimes, friends. you can also include an action beat without a tag. like above, i could have just said “Adam popped out from behind the door” and omitted the shouting altogether. we can assume he is being loud because that’s usually how people do surprises. anyway. moving on.
condescending to readers. this isn’t so much about writing as it is author’s notes and the like, and “condescending” may be a strong word, but i’m trying to be succinct. at any rate, please stop telling your audience to not read your fic? “do not read if sensitive to [blank]” or “if you have [disorder] skip this fic!” is a horrible way to trigger warn. people know their own boundaries. tell them what the work actually contains and let them self-select.
i also find “rest stop/check-in” type notes condescending, like “if you are reading this between the hours of 10pm-4am, go to sleep” and “STOP! have you eaten/drank/walked around in the past few hours? go do that!” again, we know ourselves. i’m not your kid, don’t tell me what to do. i don’t mind a polite, casual little “thanks for reading, remember to drink water and take your meds, bye” note, though.
the others in this category? i will straight up not read the fic over that on some days. ESPECIALLY because, in my experience, the people who are most intense about warning for every little thing are the ones with the mildest fics, and that’s not what i’m here for.
complaining about your own wrong tags. this is, admittedly, such a nitpick, and it definitely is more common in certain communities than others. but as longtime followers may know, i’m a bit obsessed with ao3’s tagging system and it drives me BONKERS when people use the wrong tags and follow it with “not actually but there’s no tag for xyz.” here’s the thing: you can still look at all the works that have ANY tag, just the non-canonized ones can’t be filtered on. and the best way to get a tag canonized is, guess what, to USE it! imagine that. also, if you’re using the wrong tag, you’re just going to clog the filter results and get people who don’t actually want to read your fic. just stop.

As we get closer to the new year, I just wanted to talk about where I wanna go with this blog. The fact is, I am not someone who’s rp style is incredibly compatible with a majority of others in the rpc. My interest is only kept with plot, weaving storylines, and meaningful character-centric exchanges. It’s become a crime in the RPC to say that you’re not willing to wait months for a reply on a thread, but unfortunately my interest does wane pretty quickly with long waits (either on my own part or on the part of a partner), and that’s something I have to keep in mind going forward.
Please note, there is nothing intrinsically wrong with taking a while to respond to rp stuff. It is a hobby, and you should respond at your own pace. However, like dnd, if we can only get a group together to play once every few months? It’s just not the vibe I’m interested in. That doesn’t make how you do things wrong, just not compatible with me.
What is wrong is following me and not responding to any of my attempts to reach out and start something and expecting me to still follow you. I am not here to pad follower numbers, I literally don’t care about my own follower count, and this blog exists purely for me to write with other people.
So next Wednesday (a week from tomorrow), I am going on an unfollowing spree for people I’ve tried to interact with but just haven’t heard back from. I am going to focus more on partners I have detailed plots and storylines with — and I’m always open to more of these, but for now that’s going to be my focus.

stoned chibi me has several Controversial(tm) Things (aka topics I ran away from in fear of discourse over the last two decades) that she would like to announce before I sober up and morality ocd and bpd start beating my ass for oversharing.
sometimes (especially age regressed) I'm still a girl even though I am transmasc non-binary physically and to the offline world. identifying as a girl sometimes in safe spaces like online does not make me a cis girl and does not invalidate my experience as a trans person. I am non-binary. my gender is allowed to be more than one thing, including female in a non-cis way.
I do not know the origin of my system. maybe it's bpdgenic because I had traits of it in childhood. maybe it's median, maybe it's endogenic. maybe it all started out as a lonely little girl who was so afraid of abandonment that she made a bunch of friends in her own head so she couldn't be alone and that was just a survival skill that she had without any labels for it. that doesn't make me any less of a valid plural system and I wouldn't be as stable as I am now without my other selves.
I'm a paraphile who has been ashamed of having a paraphilia my whole life. it existed even when I was a toddler. in fact I'm so ashamed of having said paraphilia that I've only ever told a handful of people what it is and have a fear of even saying the word itself because it's so obscure. anyone I've ever actually told, their reaction has always been 'that's adorable' or 'I can completely understand why that's appealing to you'. I have never hurt anyone with my paraphilia and finding someone attractive for something specific cannot harm them because thought crime does not exist and I never engage with the people personally unless there is consent involved.
I'm pro-incest. I think what consenting related people do at home is none of my business in the same way that what anyone else is doing at home or at a friend's is none of my business. what consenting adults do is absolutely none of my business and doesn't affect me.
I'm anti-censorship and I believe that people should be able to make any content they want, or have sex however they want as long as it is consensual for all 18+ parties involved (if irl roleplay or live-action porn) and/or entirely fictional content (art, fic, rp, etc). fictional characters under the age of 18 and/or fictional characters who are related to each other are still fictional and therefore do not require anyone's consent. don't like? don't look.

Usually there’s a reason for stuff like this, so lemme jump to the biggest most extreme conclusion and get that outta the way. If you’re uncomfortable exclusively by the act of playing a gender, or thinking like a gender, and acting like a gender, and feel like you’re just playing a role with no connection to specifically a gender and nothing else... Maybe you don’t want to play/be/act as that gender? I mean, it could be anything setting you off, but this is important to point out, especially with your wording, subconscious though it may be. You don’t have to RP as a guy. It’s okay. Be anything you want, that’s what RP is for. To have fun, and be comfortable, and do what feels good to you. There’s no shame in just saying no to RPing anything. Settings, characters, genders, themes, tropes, even just roleplaying if you’re not in the mood! Roleplay is, again, for fun, and you should probably communicate that you’re no longer having it. That you want to explore other options. I mean this could be as simple as you don’t have chemistry with those partners, to as complex as realizing you may not have a real connection to a specific gender... even IRL. 
Like, I’m not gonna lie, I have seen a large number of people who have realized they identify as something else because they’ve played other genders, tried out the ol’ mental space with RP, and found something that fit them better. Might not be applicable to you, that’s fine. This is a deeply personal decision though, I’m just pointing it out as an aside because some people need that little push to go ‘oh’ and this answer is going to be an open letter to everyone who is in this situation as usual. So hey, it doesn’t have to be too serious, and if questioning your labels isn’t your speed, no issue. Just thought it was wise to point it out, rather than ignore it and pretend it didn’t set off a tiny alarm in my head saying ‘hang on a sec’. So yes, with that out of the way— Of course that’s not the only reason things might feel ‘off’! Like I mention above, there’s plenty of other things, so now that we have a quick ‘I’d be a jerk if I didn’t say this does happen’ out of the way, let’s explore things like chemistry, and why your characters don’t resonate with you personally, but end up seeming to be more for your partner in crime over there. AKA: Playing for other people, and why it doesn’t really work out.
So when you RP a character and they don’t sync with you personally? That’s a big thing buddy! That’s a sign you’re not playing what you love or vibe with. That doesn’t seem like something you should get upset about, we all do stuff that we feel pretty neutral or vaguely bored by for friends and family, but it really really can be draining over time. Playing something deeply out of your personal experience is a fun challenge, but I would never say do that for a long term if you’re not getting comfortable as you do it. You can burn yourself out, by pushing too hard and making so much work for yourself you lose the thread of fun supposedly throughout all RP.
Me? I have trouble with happy, perky characters. I can do it, and I do it well judging by the reaction of people around me, but it just doesn’t feel right. It feels like someone is very slowly spreading me thinner and thinner trying to react against my natural instincts. I know it’s actually another problem that some people feel like they play too many similar characters, but that’s a natural inclination to play something that suits you, so you can give your full attention to the details surrounding that character instead of questioning everything you do. 
Being able to act on auto pilot helps a ton when you want to focus on the important parts, like the plot instead of figuring out how this character would feel if it’s not what you kneejerk understand. Second guessing is hard! As anyone who deals with second guessing everything they do all day: it leads to exhaustion because it’s an extra hidden layer of emotional labor.
So! Why are dudes uncomfortable for you? We’ve got an obvious problem here that an external force (your RP buddies over there) may have trained you to believe that you only have one purpose. That male characters are romance fodder, and have to fall in love with an OC. That your OC’s aren’t important. That’s gonna be a whoooole different problem right there. This is a problem with your RP partner, who is using you to fulfill their happiness. There’s a huge problem with the power dynamic in this OOC relationship, just going by this little snippet.
Your partner should never make you feel like you’re only roleplaying for their sake.  
I’m leaving that line all alone so you can really look at it, and reread it. I’m going to say it again in fact: Your partner should never make you feel like you’re only roleplaying for their sake. There’s various reasons why that’s icky, but I’ll just touch on what stands out to me most. One of those things is that this makes roleplaying a job. 
Instead of letting yourself explore the mind of a character you enjoy, you’ve come to expect that you will follow a certain order of things, and that your job is to fill the emotional labor required of your partner to keep them happy. They respond to you requesting similar emotional labor (which in a healthy relationship should be give-and-take) by ignoring you. This is painful for you, maybe not like getting pinched, but feeling like what you’ve made isn’t good enough? That you’re not good enough by extension because our RP kids are totally extensions of ourselves? That’s unfair. Unfair to you.
However! Even if something seems to be a pattern, like not playing dudes, it’s always good to test run characters from all walks of life. Any character couldn’t be the exception to or that your mood could change. That means, don’t feel guilty if you’ve said “this label doesn’t feel right” for a while, and then you have an exception. It just means it’s an exception, you’re fine. You’re not breaking your own rules, you’re learning more about what works with you.
Finding yourself at a loss with OC’s or characters you enjoy may point to your environment being one that’s hostile to new things. They don’t understand an OC, there’s no blueprint giving them an idea of what to expect. OC’s are also one of the easiest ways for players to get into the game, which means newbies who lack social graces tend to gravitate towards them because ‘there’s no rules to break’ in how they portray them. Unfortunately since they don’t know how to approach others in socially appropriate ways, this gives OC’s a reputation for being awful to play with. They break etiquette, they push too hard, they don’t get why someone may be backing away. This isn’t the OC’s fault, it’s the player, but it’s seen more in OC’s because of ease-of-entry. So... they gain a reputation.
That means approaching on an OC is definitely going to come with people looking for standard red flags, and they’ll need to see you in action long enough to get comfortable with you! You have to be stellar in everything to get attention, and you have to have a hook. Your character has to be stand-out, interesting, and fun. Something people get grabbed by the summary of, so they can emotionally attach to it the same way they did major series, which give a character time to come out of their shell, and audiences time to connect to them. That’s why canons are popular: They bought the time it took to get under people’s skin by having a plot to follow. Without that, OC’s are like hearing about a character from another fandom you’re not interested in.
There’s also, unfortunately, an online beef against the ladies in plot. I’m not gonna sugar coat it, people have gotten it into their heads that girls being roleplayed tend to be shallow, vapid characters designed just for romance. So it can be hard to egt people interested because of stereotypes. The worst part is, I see this stereotype most often from male writers playing women, who have no idea hoiw to treat them as a person, and have instead made them a cardboard cut out designed to reach their goals. This is even worse on adult websites where smut is an option, ladies get the short stick SO often because of years where female characters have been treated as a plot device. 
This goes way back to the idea of a sexy lamp: If your female character can be replaced with a sexy lamp, they aren’t expanded enough on. They aren’t a person. Some of the strongest female characters have been, say, Ripley from Alien. Why? She was a male character in the script, they just didn’t change anything but her gender and rolled with it. Which, duh, worked because women is people. A wild concept for some reason. Can you tell this is something that gets my goat, because baaaa, motherfucker, baaaa.
That means you end up working against a lot of shit to just try and play around and have fun. It can be exhausting, and more than once I’ve seen people give up. Don’t, though. People need to hear your voice. If you’re in a position where things are hard, remember. Trying the same things over and over expecting it to change is just silly. You need to change parts of your approach, whether it be the environment, the people, or simply how you word things. Push back on what’s making you feel bad, and put down boundaries. “If I do this, I would appreciate if you gave back with this.” Ask for space, you deserve space to explore what makes you happy. Say no more often to things you’re not comfortable with. You don’t have any obligation to fit a mold for another person.
Find your comfort zone, and defend it. If that means moving onto a new group of people, or just doing something extraordinary with what you have, or finding a new way to approach stuff, then maybe that’s what you need to do! Spread your wings, and find what makes you happy. Don’t look for advice on how to tamp yourself down into what you feel like you should be doing, if it’s not right for you. EXPERIENCE / HOW MANY YEARS?: 9-10 years? i started in the shitty ims of quizilla, didn't realize this is something ppl actually did as a hobby for another year before i moved to tumblr. i believe i was on-and-off for about four years before in 2018, i made calum, where the hobby became more permanent, took a year long break and then came back in 2021....u're all stuck with me for life now :)

RP PET PEEVES?: admittedly, a lot :'D but moving blogs has helped with getting away from constantly encountering these pet peeves :D if i have to name one then recently i've been getting turned off by ppl who are always their soapboxes lecturing about rp. they talk about how rp should be and how people should interact with one another, but most of the time? i hardly see them practice what they preach. if you want quality partners, you have to be one first- that's how you find ur people :/ also excessive, consistent saltiness- i get uncomfortable.
FLUFF, ANGST, OR SMUT?: i don't really care, just as long as there's character/relationship development going on. that being said- if you want pain that will make u yell at me in the dms, hit me up ♡ ( i have references :DD )
PLOTS OR MEMES?: honestly plots all the way, but i'm also very picky with who i plot with in-depth, so memes are good ways to break the ice.
LONG OR SHORT REPLIES?: i tend to match my partners so most of the time my replies end up on the longer side...that being said, i am always down for shorter threads, it's a good exercise in brevity.
TIME TO WRITE?: recently it's been more on the weekends as i have solo writing projects i work on during the week although i do tend to hold onto completed replies/memes so that i can mass post them when i have a few more completed.

Would love to hear what you think are correct reasons to play rogue or sorcerer.
Zac plays a rogue or the rogue equivalent because it is the correct move for the character. He plays them because they are a rogue in the sense of the actual word, not just the D&D class; a liar and a grifter. Norman Takamori, Skip, and Pib are all people for whom it makes sense to be slippery and sneaky, with certain particularly good skills. The thing is, rogues in D&D don't have a ton of flavor, but people tend to focus on sneak attack or the mere possession of expertise for the flavor. This is wrong. (Or they focus on wearing black and skulking and sulking, which is even worse. Literally any class can do that.) The flavor is that you get one attack and unless the stars align perfectly your damage is shitty but HOT DAMN are you good at either sneaking or lying or both, and at running away. And Zac plays rogues like that. That is exactly what Puss in Boots, or a rebel brain slug prince, or a guy who definitely did Space Crimes out of cowardice and apathy should be.
Similarly, as Brennan Lee Mulligan said, sorcerers are the 1%. You were born hot and you have magic you didn't need to work for. You have zero useful skills. Mavrus the Unskooled is literally just fucking around and being an unhelpful asshole at all times (while still being helpful in combat). I should note Mavrus also works because he was always grouped up with tanks and utility only. The thing about sorcerers is that in-game, they are kind of like, the secret weapon who has some bananas damaging spells, but also both in and out of game they are kind of a liability. NADDPod and TAZ have NEVER had a straight-up sorcerer character in the main 3, and that's because they are totally not useful enough to serve in a 3 person party. If you're getting a new game together and someone is like yeah I want to be a sorcerer? Unless you have a large party, that really changes the whole game because everyone else needs to reconfigure unless they were all playing bulky tanks or support, because you need to serve as the trampoline on which the tissue paper cannon falls.
Basically too many people play rogue or sorcerer because of some kind of Captain Ahab-level obsession with One Big Damage Roll, which is very silly because rarely does One Big Damage Roll matter in the course of D&D 5e, and also wizards and barbarians and fighters and paladins are all way better at doing so. You should instead play a rogue or sorcerer because you want to play the worst roommate you've ever had in your life, and you are also good at being a coward or an ass in RP but a generous player at the real-life table. And Zac is very, very good at this.

Law question!
Is "what counts as reasonable" (as in how a reasonable person would act/reasonable doubt etc.) something that people in the legal world have different opinions how to interpreter? And could those disagreements lead to a case going to court instead of being solved without needing to go to court?
I just found it fascinating that a lot of things (right?) seem to depend on the reasonability of it. Which do makes sense that such a sentence needs to be there, but also doesn't it make the law - a very objective-presented thing - a bit open to... subjectivity?? But it's also really good because you do need to consider the circumstanses and context of things when rulings are done. Right?
I know nothing about law, but the implications of reasonabilty fascinates me and I want to know more!
(Also, I may or may not have started to ponder it because I tried to write a scene where Matt and Foggy is sleepdeprivied and studying for finals and I wanted them to talk about something law-adjacent...)
THIS IS MY FAVORITE ASK EVER BECAUSE YEAH.
Law is all "we're so smart and everything is defined and our arguments are so precise" and then "but what is a reasonable person?" absolutely smacks you in the face.
So the "reasonable person" standard (RPS) (which, fun fact, used to be the "reasonable man" standard and I'm thankful we've moved beyond that) is considered an objective standard, meaning that it doesn't matter if any specific person thinks or feels a certain way, based on their unique knowledge, feelings, experiences, etc. (that would be subjective). This mythical "reasonable person" who supposedly represents all of us is recognized to be a "legal fiction" (which is where, for legal purposes, we act like something is true even when we know it's probably not true).
This objective fact is one that must be determined by a fact-finder: aka a jury (unless a person waives their right to a jury trial, in which case the judge will be the sole fact-finder). So in reality, the "reasonable person" is whatever a jury of 6-12 think.
And yes, cases will absolutely go to court just because each side believes that the RPS will turn in their favor.
For example, the crime of stalking, in my state, has objective and subjective elements. The subjective element is that the victim feels alarm or annoyance. The objective element is that a "reasonable person" in the victim's situation would also feel alarm and annoyance.
So if a stalking case went to trial, the victim could take the stand and testify for hours about how truly alarmed or annoyed they felt, and maybe the jury would even believe: "Yep, this person was definitely alarmed/annoyed."
However, that's not enough for a conviction - the jury also has to believe, "A reasonable person who experienced what the victim experienced would also be alarmed/annoyed."
So the prosecution will argue to the jury why a reasonable person (read: the jury) would definitely feel alarmed/annoyed in those circumstances, whereas the defense will argue that...well...you can imagine how ugly those arguments can get, essentially saying that the victim is lying or crazy or overly emotional, etc.
All this raises some serious questions. What if the defendant is a male, and the victim is a female? Would a jury of women be more likely to imagine that a reasonable person would feel alarm from a male stalking them, yet perhaps men would feel that a reasonable person would not be alarmed by another man stalking them? We deliberately moved away from the "reasonable man" standard, but in cases like this, should the jury actually be instructed to ask, "What would a reasonable woman feel in this situation?"
(If you want to see a fascinating yet unofficial illustration of this, watch this youtuber's reaction to the movie Hush, and then read the older comments or watch his response video which highlights some of those comments. Admittedly, part of the youtuber's reaction is colored by him viewing the situation as purely fictional, but he also acknowledged that the movie failed to properly situate him in the protagonist's situation - in other words, the movie failed to help him see the objective reasonableness of the protagonist's subjective feelings and reactions.)
You can imagine other areas where this is discussed. Should the jury be asked in cases involving children about what a "reasonable person" would do, or what a "reasonable child" would do? Or in cases involving a Black defendant and police, should a jury ask what a "reasonable person" would feel or do in that situation, or should the jury ask what a "reasonable Black person" would feel or do in that situation? What if the jury in this case is all white?
And where do we stop? What traits are relevant or not? Even if we can all agree that gender and race should be factors in the RPS, should we also consider sexuality? Should we always consider sexuality, or only in certain cases? Should we consider religion? Should we consider mental illness? Should we consider everything a person might include in their tumblr bio?
And arguably, if you take that too far, you end up with a bunch of laws that are almost impossibly vague to interpret. Like, if I want to send a person a couple of notes, do I need to know all the possible traits of my would-be victim (their age, their race, their gender, their sexuality, their religion, their mental illnesses, etc.) to determine the likelihood that a reasonable person in their shoes would consider my behavior to be stalking?
Additionally, you risk opening the door to some scary prejudice. Like, if a hypothetical person is 18 years old, Black, trans, female, gay, and autistic...would the standard applied to her be different from a person who is 26, white, cis, male, straight, and neurotypical? Would these different standards really make things more fair? How would you safeguard against prejudice?
It gets very sticky. This is one (of many) reasons why I prefer criminal law. See, the RPS does pop up in criminal law, usually with crimes like assault and stalking; also with certain defenses, like self-defense, which requires that a defendant's actions in self-defense were objectively reasonable. However, most criminal charges don't involve the RPS.
For example: did you operate a motor vehicle? Were you intoxicated? Okay, you committed a DUI, case closed - the jury doesn't have to worry about reasonableness at all.
Anyway, the short answer is: you're absolutely right and you've hit on one of law's dirty secrets that, if scrutinized too closely, causes a lot of dominos start to fall. It's very fascinating, especially as we as society become increasingly aware of intersectionality and the ways that subjective experiences correlated with group identity (like race, gender, sexuality, religion, etc.) can influence a person's view of what is objective.
And yes, Matt and Foggy would absolutely debate this incessantly, either as part of their studies or to procrastinate from studying, and if you do in fact write this, please tag me in it so I can read it!

it wasn't bad!
most actual plays do about 0.5 systems - they nominally use dnd 5e but mainly just do freestyle rp. it's wild to hear someone kitbash together what, 6 fucking systems? multiple groups of players operating at multiple levels asymmetrically? what a big swing! it's so fucking ambitious! i don't even know if it's a good idea!
the big downside of the variety in systems means that a huge chunk of the airtime is spent explaining, discussing and negotiating mechanics. the mechnoir portion was the absolute worst for this and i think part of what made the first session or two so rough was the players just not understanding the game or how to effectively use their characters. the benefit of this immense variety of systems is...i don't know? maybe it's fun to play? i didn't feel like the extended kingdom interlude was that interesting and i would have definitely preferred the events of that to be relayed to me in a 10-minute convo rather than negotiated through another system where the players seem barely cognizant of the stakes.
i found it very difficult to understand what was going on with the setting. a lot of setting names are thrown at you very fast and at this point i still don't know if i could confidently describe all of the big movers and shakers in the setting. still not 100% on who the rapid evening are, who diego rose was, who most of the big corps are and why they matter. i don't hate any of what i learned but i'm not sold on the divines in general. rigour is cool because i understand what rigour is and does. i don't get how righteousness works, nor any of the divines which aren't a giant robot. even at the end, when they were saying shit like 'ooh grace won't like that' i still didn't understand what that meant or why it mattered. maybe i'm just too stupid. that said, the parts that i did understand i thought were pretty decent.
i liked the chime and i liked the cast. audy was cool and had some great moments tho as i said, still don't know why their status as a divine matters. aria seemed like an insanely poor fit for the group but i like ali acampora as an entertainer so it balances out. mako was consistently delightful and the introduction of larry was my favourite character beat in the season. cass didn't make that much of an impression on me and it was too easy to forget they were royalty. i think austin should have laid down the law super hard in the first session and been like 'hey you guys are criminals, you are mercenaries, you do crimes for money, be on that wavelength' instead of like, however the fuck he described their deal with orth.
big fucking mistake: the custom XP triggers he worked out. podcast or no, do NOT ever give players a mechanical incentive to play suboptimally. players already play suboptimally; the mechanics should lead them by the nose into optimal play strategies. i would not recommend giving a player like keith an incentive to fuck up the mission with antics unless you want to ruin your friendships.
i think i would have enjoyed a less structured game along the lines of what is actually suggested by the rules of the sprawl. i guess this is just actual play podcasts in general but the thing is, most PBTA games make it pretty explicit that the game works best when you come in with a set of starting positions and assumptions instead of a predetermined storyline. austin can't help but come in with a big sheaf of predetermined storylines, down to specific planned scenes and even fucking maps. i would love to hear a podcast where someone plays the game as written for once.
i have no idea where to go from here. i'm sure as shit not listening to marielda because i know it will make me big nerd angry. i am not so invested in the setting that i absolutely must find out what happens in twilight mirage. if the hieron stuff is good maybe i'll listen to that next but i think i'm gonna give fatt a break for a while.

Gather around children, I'm about to tell you a story about not the most unhinged person I have ever met through roleplay. So this happened about 10 years ago I like many many unpopular teenagers enjoyed writing and doing rp on this hellsite. 2012 is a wild time because I'm a lil bitch that loved lord of the rings and those new hobbit movies were out making lortr cool again to interact with in fandom. I've been doing roleplay online for a very long time it's just a little hobby I have. So naturally in 2013 I joined this weird hobbit rp group.
I had just come out of another group and was looking for something that was a little different but still kind of related to the whole Tolkien thing. I found a 16+ group, it was hobbit based, not open yet and it was a modern au (it was a whole crime family thing, not really my thing but I decided to give it ago) and so I sent my application in for my character just before the deadline and I found myself in a mixed group of teenagers and adults. Mostly adults though.
So the structure of the group was we did dash rp, and had an out of character group chat in skype where we could touch base and talk about what was going on in the group.
The group was run by three mods. Let's call them Gemma, Kenny and Terry. They were all adults, around 21ish. I think I was the youngest person in the group at 16 going on 17. We rp for a bit and things are fine? There's the usual RP drama but nothing scandalous except for Gemma and Kenny doing really explicit puppy play kink just on the dash in front of everyone. That should have been my first red flag honestly but you know as a child with unsupervised internet access (which was the style at the time) honestly I had seen worse and didn't understand how they found this sexy (I actually still don't really understand it ngl I'm not kink shaming or anything you do you I'll just look away this is a me issue) Then out of nowhere a member let's call her Maria leaves the group and Maria posts a very long post about the group.

This is red flag number 2 again I'm stupid and 16 so I should have jumped ship but I didn't. The group chat is frankly confused. She ends her time in the group by reblogging "So long and thanks for all the fish"

Now Terry was never really an active mod and he actually dropped off the face of the earth three days after the group opened. I don't know what happened behind closed doors but Kerry and Gemma claimed that Terry just didn't want to be involved in the group anymore. Terry played kind of a very important character one of the leaders of the families that my character was in so it left plotting really up in the air when it came to uhhh what do we even do?? But the Remaining two Admins appointed Kerry cocksucker and long term friend "Cap" admin in Terry's place. After a week or two of complaining that hey our groups leader is AWOL we need this character back, the Admin team were like "haha don't even worry guys we'll open applications for the big cheese and pick one in a week." So the week passes and a new person gets picked to play this big cheese character I can't remember who this person was called but let's call her Lydia. So Lydia, joins the group chat and she's rarely seen online. This is red flag number three.
Another group member let's call her Jenny puts me, her rp buddies and a few other group members that aren't the admin team in to a big group chat on skype. She has become buddy buddy with the admin crew and was put in to their super secret super private group chat on whats app and it turns out... there is no Lydia. Kerry is Lydia because the only people who had applied for The Big Cheese was current group members and he hated ALLL of us to the point where he and his admin team had black listed all of our blogs names on the dash so they didn't have to see us rp their characters "wrong" but they especially hated Mimi who played a very minor character in the whole group. They couldn't stand her or her character and they were talking shit about every single member of the group in this group chat. So everyone is rightfully pissed. Not only was he talking shit about us but he was talking shit about Mimi! And we did not stand for Mimi slander. So we hatched a plan. A big, Fuck you guys and your shitty kink on our dash! plan. It was very simple. We would rp as normal for the next week and then on monday we would post "So long and thanks for all the fish icb you did this to us post and we would reblog Maria's original so long post and we would all leave, take the characters we were playing and just write them separately on tumblr as indie blogs where we would just rp with ourselves.
Honestly Kerry was shook apparently this mass exodus of users traumatized him (as if he didn't traumatize us enough on the dash with his puppy play threads with Gemma) I don't have a screen shot of this again it was ten years ago and Kerry has deleted all but one of the posts he made about the situation on the rp hub but he went off about how he was going to sue us for "stealing" his characters once he figured out that we were just doing indie rps by ourselves. Please keep in mind that these are lord of the rings characters in a very generic crime family AU setting. There's nothing original about them. Any oc that was "stolen" from the original bios honestly at the point of 6 months of rp was so far removed from what was in the original bio I wouldn't claim they were his property anymore.
He tried to revamp the group but honestly i think we took the drive and the energy out of him. They hated Mimi and her character so much that in the shortlived revamp they actually killed off her character in the rp lore, talk about petty.

He send us asks and dms on skype for a little bit threatening to sue us but he stopped when none of us like replied to him.
A year later Maria must have found out what happened and made a post about it. Perhaps Kerry was still ranting and raving about how we stole his rp.

You know, a lot of people talk about the bad implications of morality in different games and stuff, but like, I think one thing I never see talked about is Skyrim just expecting you to kill Paarthurnax?
Like people talk about how it sucks, no one knows why you'd do it, how it's bad you can't turn it down
But no one ever seems to talk about the moral implications of how the quest is presented?
Most quests you can turn down if you don't agree with them morally, or even complete them in different ways. Not a lot and not complexly, Skyrim's not known for deep choices, but usually there's some options.
At the very least there's usually a choice to turn down a quest entirely, and then just get told "the quest is here if you change your mind"
The ones you can't do that though are the big main quests and daedric quests usually, ones where like, avoiding them entirely feels almost weird. They're things where you might not get a lot, if any, choices, but there's a reason the game would want you to have a reminder they're there.
Even then, starting said quest line is usually fully optional, with it being a miscellaneous marker reminding you it's there. Something like "investigate this" "inquire here" etc. Exceptions included definitely, but usually once again for only these big things where you have some choice on how it's done (several daedric quests have a couple options for completing even)
Not for killing Paarthurnax though.
Killing Paarthurnax is a quest you're told to do without even talking to someone, you have no choice in accepting it and no choice in turning it down. It's not a case of saying "I won't do this" "well talk to me if you change your mind and want to join us" it's something you're given and have no way to complete or fail.
You can't really abandon the blades, betray them, or anything like that outside of the rp of failing to complete the quest. If you complete the game without doing it it disappears, but this doesn't really feel fulfilling, it doesn't even give you a notice. It feels more like "we didn't record post game content for this happening"
Likewise, you're not really allowed to argue with the Blades at all
Like, yeah, Skyrim not known for in depth storytelling, but the way you're not allowed to argue is telling. The Blades tell you Paarthurnax was evil in the past and needs to die, and when you confront him he basically just says "is it better to be born good or to be evil and become good despite that".
The idea presented is pretty much that Paarthurnax has change, but the question is should he be punished for actions in the past. You may only argue he's good now or that he still needs to be punished. The idea of redemption is absent, with the only option being punishment for the crime.
You're not really even able to bring up the idea that Paarthurnax has made up for his actions. You're not allowed to bring up he's saved more lives than he's ever taken, that he literally helped you save the world, that he's quite literally been in penitence for his actions this whole time
There's a pretty strong theme of "the only reaction to a crime is punishment," that redemption is about becoming a different person or that there's no way to make up for crimes.
It basically takes an iconic Fantasy archetype, "the formerly evil character who redeems his actions by helping the hero" and refuses to engage with the positive moral implications of it while expecting the player to not expect or desire it to be seem as redemption and rehabilitation
