Konsep Dasar Pendidikan Inklusif

“Sesuai dengan amanat undang-undang nomor 20 tahun 2003 tentang sistem Pendidikan Nasional. Pendidikan di indonesia diselenggarakan secara demokratis dan berkeadilan serta tidak diskriminatif dengan menjunjung  tinggi hak asasi manusia, nilai keagamaan, nilai kultural dan kemajemukan bangsa.”

Paradigma pendidikan khusus saat ini terus berkembang menuju arah yang lebih positif yang berlandaskan pada hak-hak dasar anak untuk memperoleh pendidikan yang layak. Konsep Anak Berkebutuhan Khusus (Children With Special Needs) memiliki makna dan spektrum yang lebih luas dibandingkan dengan konsep Anak Luar Biasa (Exceptional Children).

Anak Berkebutuhan Khusus (ABK) adala anak yang memerlukan layanan yang secara spesifik berbeda karena adanya hambatan belajar dan hambatan perkembangan.

Secara umum tujuan pendidikan bagi anak ABK adalah untuk mengoptimalkan segala potensi yang dimiliki oleh individu sehingga mampu menampilkan eksistensi sebagai warga negara yang cakap dan mandiri.

Pasal 1 Ayat 1 UU No. 8 Tahun 2016 Tentang Penyandang Disabilitas

Penyandang Disabilitas adalah setiap orang yag mengalami keterbatasan fisik, intelektual, mental, dan/atau sensorik dalam jangka waktu lama yang dalam berinteraksi dengan lingkungan dapat mengalami hambatan dan kesulitan untuk berpartisipasi secara penuh dan efektif dengan warga negara lainnya berdasarkan kesamaan hak.

Dasar Pemenuhan Hak Peyandang Disabilitas

Pelaksanaan dan Pemenuhan hak Penyandang Disabilitas berdasarkan: 1. Penghormatan terhadap martabat 2. otonomi individu 3. Tanpa diskriminasi 4. Partisipasi penuh 5. keragaman manusia dan kemanusiaan 6. kesamaan kesempatan 7. kesetaraan 8. Aksesibilitas 9. Kapasitas yang terus berkembang dan identitas anak 10. inklusif 11. perlakuan khusus dan perlindungan lebih.

Hak Penyandang Disabilitas

1. Hidup 2. Bebas dari Stigma 3. privasi 4. keadilan dan perlindungan hukum 5. pendidikan 6. pekerjaan, kewirausahaan dan koperasi 7. kesehatan 8. politik 9. keagamaan 10. keolahragaan 11. Kebudayaan dan Pariwisata 12. kesejahteraan sosial 13. Aksesibilitas 14. Pelayanan publik 15. perlindungan dari bencana 16. habilitasi dan rehabilitasi 17. konsesi 18. pendataan 19. hidup secara mandiri dan dilibatkan dalam masyarakat 20. berekspresi, berkomunikasi dan memperoleh informasi 21. berpindah tempat dan kewarganegaraan 22. bebas dari tindakan Diskriminasi, penelantaran, Penyiksaan dan eksploitasi. (Ayat 1 Pasal 5 UU No. 8 tahun 2016)

Selain Hak Penyandang disabilitas sebagaimana dimaksud pada ayat (1), anak penyandang disabilitas memiliki hak: 1. mendapatkan perlindungan khusus dari diskriminasi, penelantaran, pelecehan, eksploitasi, serta kekerasan dan kejahatan seksual. 2. Mendapatkan perawatan da pengasuhan keluarga atau keluarga pengganti untuk tumbuh kembang secara optimal. 3. dilindungi kepentingannya dalam pengambilan keputusan, diperlakukan anak secara manusiawi sesuai degan martabat dan hak anak. 4. pemenuhan kebutuhan khusus. 5. pengakuan yang sama dengan anak alain untuk mencapai integrasi sosial dan pengembangan individu 6. mendapatkan pendampingan sosial. (Ayat 3 Pasal 5 UU Nomor 8 Tahun 2016)
