Members of the multibillionaire philanthropic Sackler family that owns the maker of prescription painkiller OxyContin are facing mass litigation and likely criminal investigation over the opioids crisis still ravaging America.
Some of the Sacklers wholly own Connecticut-based Purdue Pharma, the company that created and sells the legal narcotic OxyContin, a drug at the center of the opioid epidemic that now kills almost 200 people a day across the US.
Suffolk county in Long Island, New York, recently sued several family members personally over the overdose deaths and painkiller addiction blighting local communities. Now lawyers warn that action will be a catalyst for hundreds of other US cities, counties and states to follow suit.
At the same time, prosecutors in Connecticut and New York are understood to be considering criminal fraud and racketeering charges against leading family members over the way OxyContin has allegedly been dangerouslyoverprescribed and deceptively marketed to doctors and the public over the years, legal sources told the Guardian last week.
“This is essentially a crime family … drug dealers in nice suits and dresses,” said Paul Hanly, a New York city lawyer who represents Suffolk county and is also a lead attorney in a huge civil action playing out in federal court in Cleveland, Ohio, involving opioid manufacturers and distributors.
The Sackler name is prominently attached to prestigious cultural and academic institutions that have accepted millions donated by the family in the US and the UK. It is now inscribed on a lawsuit alleging members of the family “actively participated in conspiracy and fraud to portray the prescription painkiller as non-addictive, even though they knew it was dangerously addictive”.
Named in the Suffolk county complaint filed in New York state court are Richard, Jonathan, Kathe and Mortimer David Alfons Sackler, and Ilene Sackler Lefcourt – adult children of deceased brothers Mortimer and Raymond Sackler who developed Purdue Pharma and launched OxyContin in the mid-1990s.
Also named are Theresa and Beverly Sackler, the widows of those two brothers, and David Sackler, son of Richard. Theresa Sackler lives in Londonand the others named lived in the US, mainly in New York and Connecticut.
These eight family members serve or have served on the board of Purdue. Forbes magazine estimates that a core group of 20 Sacklers in the Mortimer and Raymond branches of the secretive family, including the eight named above, are collectively worth $13bn.
Hanly said: “What Purdue Pharma and the Sackler family have done to society through their aggressive peddling of opioids is unconscionable.”
OxyContin was originally widely marketed as a safe wonder drug because of the unique slow-release mechanism of its active ingredient, the narcotic oxycodone. But it turned out to be highly addictive and easily abused.
Suffolk county has already sued Purdue and then filed against the Sacklers in an amended complaint last month.
Now Hanly and other high-profile lawyers working on opioid litigation expect the family members to be sued by name as part of the multi-district litigation in Ohio. In federal court, lawsuits filed by more than 1,200 cities, counties and municipalities across the US, against Purdue and other corporate defendants, have been brought together in the hands of federal judge Dan Polster.
The first trials are due next year in three bellwether cases from two Ohio counties and the city of Cleveland.
Purdue is also being sued by at least 30 states in state court. The first trial in that sequence is expected next spring in Louisiana.
But it is more widely expected that all parties will negotiate a huge global settlement like the approximate $250bn deal agreed in a landmark Big Tobacco case in 1997.
“I’m assuming every single plaintiff’s attorney in the country will copy our complaint naming the Sacklers in the coming weeks,” said attorney Jayne Conroy of Simmons Hanly Conroy, who also represents Suffolk county and is involved in the litigation in Ohio, alongside colleague Paul Hanly.
Hanly said that the economic cost of the opioids crisis in the US, from healthcare to lost productivity, have been put at $1tn between 2002 and 2018, by some leading studies. “Other estimates put the current cost at up to $500bn a year,” he said.
According to a source familiar with the litigation, who cannot be named because they are disclosing confidential information, Purdue Pharma has been arguing behind closed doors to Polster that it can’t afford large-scale damages.
“Of course the company doesn’t have much money left in it because the Sacklers have taken it, they own it, they’ve siphoned it off over the years,” the source said.
Plaintiffs are now determined to make the Sacklers pay, even though their money is scattered in property, charitable foundations, trusts, a multitude of companies and overseas bank accounts.
“I don’t know where it all is yet, but I’ll find it,” Conroy said.
Beyond any civil penalties, some family members could face criminal charges in future.
“I know there are a couple of criminal investigations going on at the federal level, against Purdue, the Sacklers, other defendants, all of them. People are digging, US attorney’s offices are conducting criminal investigations,” said one source.
Purdue and senior executives, but not the Sacklers, was prosecuted and pleaded guilty in federal criminal court in 2007 to misleading regulators, doctors and patients.
A spokesman for John Durham, the US attorney for Connecticut, declined to comment. Prosecutors for the southern and eastern federal districts of New York state did not immediately respond to requests for comment. A spokesman for the northern district of New York said the Department of Justice does not confirm, deny or comment on the existence of any investigation. A spokeswoman for the western district of New York declined to confirm or deny whether the US attorney is conducting a criminal investigation into the Sacklers. A spokesman for Purdue Pharma declined to comment on behalf of the company and the relevant members of the Sackler family.
Those same Sacklers were also sued by name in a lawsuit filed by Massachusetts in June. This alleges that Purdue, its directors and owners “deceived prescribers and patients to get more people to use Purdue’s opioid products, at higher doses, for longer periods” by misrepresenting and downplaying the addictive and deadly risks of the drug. And even claiming that OxyContin, which is derived from opium, was safer than paracetamol or ibuprofen, the common painkillers sold over the counter, the state alleges.
The Massachusetts attorney general, Maura Healey, told the Guardian that experts estimate that the epidemic cost the state almost $15bn in 2017 alone in lost productivity, public safety and healthcare, to say nothing of the human tragedy that has cost thousands of lives in that state alone.
She said she thought the Sacklers were “well aware” of the damage their drug was doing. “But for them it’s greed, it was all about profits over people … I feel very confident naming the family members,” she said.
Asked if Massachusetts was considering a criminal investigation of the company, its executives or owners, Healey said: “I’m focused on using my legal authority to make sure we get restitution for families … damages and penalties for illegal conduct and we are going to continue to pursue this in court.”
She added: To the extent they [the Sacklers] made their fortune on the backs of sick and vulnerable people, then they should turn it over. I have no sympathies for them.”

Relatives of Arthur Sackler, the older brother of Raymond and Mortimer, who died before OxyContin came to market, are not suspected of any wrongdoing in relation to the drug.
The American art photographer Nan Goldin almost died from an addiction to OxyContin and is now in recovery. She leads a campaign to persuade cultural institutions to reject Sackler donations, and to shame the Sacklers into paying for treatment facilities for opioid dependency instead, not “reputation laundering” as she and other critics dub their philanthropy.
She said the prospect of any criminal charges against family members was “great” and called the family “complicit” in the opioids crisis.
“I’m sick of these people behind the scenes, controlling companies and getting away with murder while their faces are never shown,” she told the Guardian.
The Mississippi lawyer Mike Moore, who helped secure the Big Tobacco settlement and the $20bn settlement against BP for the 2010 Deepwater Horizon oil spill, is involved in the federal case in Ohio and state cases. He said it was right the Sacklers should be targeted.
“They’ve been hiding behind a corporate structure and it’s high time they paid a price,” he said.

Exercise 1 - YouDescribe
Step 1 - Spend some time searching for an amateur video on YouTube. Look for something that speaks to you - a hobby, interest, or something you feel passionate about. Step 2 - Try to write a description of your video. The description can be long or short, complicated or simple. Don’t worry about making it too sophisticated at this stage, just get some words down. If it’s a long video then you can always just describe a small section. Step 3 - When you have finished, try another description. You can use the same video or look for a new one. Repeat until the time is up. Save your work somewhere! Tip 1 - Questions you might think about: What can you see? What can you hear? How does the video start? How does it end? Are there any people? What do they look like? What are they wearing? Are they talking? What do they sound like? What are their motivations for making the video? Where is the video made? Can you describe the environment? What’s the weather like? Do any details stand out to you? Does it remind you of anywhere? What is the most striking part of the video for you? How do you feel as you watch it? Why did you choose this video? Tip 2 - Try changing your approach between descriptions. Write a long, comprehensive description, then a quick, short one. Try switching between long and short words and sentences. How does this affect the feel of your text? You might try a text full of concrete nouns (dog, cloud, barnacle) or a text with more abstract words (justice, love, truth). Pay close attention to small details (the dirt on someone’s sleeve, a flag in the background). Tip 3 - Feel free to introduce fictional elements into you description. Imagine an alternative ending, or a fictional backstory for one of the people.
Exercise 2 - YouDraw
Step 1 - Spend some time searching for an amateur video on YouTube. You can use a video from the first exercise or something totally different. As before, it should be something that speaks to you. Step 2 - Make a drawing or digital image that represents or responds to the video. How you do this is up to you! Step 3 - When you have finished, try another image. You can use the same video or look for a new one. Repeat until the time is up. Save your work somewhere! Tip 1 - Try changing your approach between images. To begin with you might try drawing a single moment from the video. Then you could try mapping out the entire story of the video, by drawing multiple different moments spread out over the page. Try drawing a portrait of one of the people/animals/objects. Or draw one of the landscapes in the video. Switch up the time you’re spending on each image - make a quick sketch, then a more considered composition. Pay close attention to small details (the tassels on an armchair, the kind of flowers in the garden). Experiment with the weight and fluidity of your line. If you’re making a digital image you might try adding in stills from the video or other images found online. Tip 2 - Feel free to introduce fictional elements to your drawings. Imagine new scenarios, people, settings, and endings.

Andrea Büttner’s (*1972/D, lives in London and Frankfurt) artistic practice is multifaceted and creates an area of tension between ethics and aesthetics, and subjectivity and culture. Büttner deals with themes such as the attribution of value, poverty and shame, using various media including woodcuts, sculptures, textile works and video installations. For her first exhibition at a Swiss institution Büttner is focussing on woodcuts from various series and setting them in a new context: on the one hand her works appear in relation to an exhibition about Simone Weil by the Friedensbibliothek/Antikriegsmuseum in Berlin-Brandenburg (Peace Library/Anti-War Museum of the Protestant Church in Berlin-Brandenburg) and on the other, David Raymond Conroy’s video (You (People) Are All The Same) augments the contextual range. «Gesamtzusammenhang» («Bigger Picture») brings together artistic and non-artistic questions which encompass humanity in connection with work, community and belief. Andrea Büttner is interested in moments of transition, as shown by the religiously and symbolically charged motifs of the woodcuts on view in each room. Subjects such as dancing nuns, tents, beggars and sentences like ‘Yes, I believe every word you say’ challenge contemporary expectations, as does the medium of the woodcut. This centuries-old technique communicates simply and directly but retains an artistic and decelerating aura of the process of its making. A characteristic that is shared by the exhibition wall of the Friedensbibliothek/Antikriegsmuseum, all be it from a non-artistic perspective. Hand-written quotes from the work of the French philosopher Simone Weil (1909 – 1943) hang on an elaborate construction, partly developed back in the time of the GDR, with illustrations by various photographers.
The integrated exhibition from the Friedensbibliothek/Antikriegsmuseum poses questions about the efficiency of messages and their display. Büttner thereby also examines her own art in direct confrontation with aesthetic practices which are both close to and different from her own. The woodcuts and the Simone Weil presentation enter into a reciprocal survey of dividing lines between handwork and art, spiritual experience and contemplation.
The juxtaposition of the two displays is evident in view of Büttner’s artistic practice. Her installative works were created in the context of the early 1990s. Postmodern art discourse such as post-conceptualism and institutional critique attempted to renegotiate the interface between politics and art and pursue a media-based vocabulary but spawned a very normative and mostly male aesthetic. Büttner wants to break with this reception and apply methods that extract a certain sexiness.
The Friedenbibliothek/Antikriegsmuseum was also searching for its own form of expression. Founded in the GDR under the auspices of the Protestant Church in Berlin-Brandenburg, the Friedenbibliothek/Antikriegsmuseum with its mobile exhibitions, subtle critiques of the regime and social networking was part of a resistance movement. Jochen Schmidt, who was part of the team responsible, says that the political changes in Germany brought a feeling of rootlessness. A system, which so many thought could not be brought down, collapsed overnight. At this time Schmidt and his colleagues discovered Simone Weil, a Jewish philosopher whose thought is coloured both by socialism and mystical Christianity. The exhibition on show here is primarily concerned with her posthumously published work The Need for Roots, in which she goes into ‘the most important and least recognised need of the human soul’ as well as ‘uprootedness’ and ‘the growing of root
Büttner has been concerned with Simone Weil for a long time, especially because Weil also addressed philosophical, political and religious questions. With the help of this borrowed exhibition Büttner can import Weil into her work without having to participate in the current notable appropriation of the philosopher. Büttner is interested in Weil’s ideas and her fragmented, historically complex life. The artist is similarly fascinated by monastic activism in France during the 1930s and 1940s and the lifestyle concepts of nuns between religion and politics.
For example, for dOCUMENTA (13) Büttner produced a film about nuns in a religious order who operate a stall at an amusement park in Rome and formulated a theory of smallness, humility, reserve and simplicity. From this work came the Tent Series from which various exhibits are on show. Her dynamic composition of seven dancing figures as a symbol of a positive space is also concerned with nuns. On the other hand, I want to let the work fall down (2005) and Yes, I believe every word you say (2007) are reminiscent of the pop art works of the activist nun Corita Kent. Bush (2010) comes from the cycle about Saint Francis of Assisi whereas Corner (2011-12) is the product of a materialistic examination of the woodcut. Duck and Daisy (2015) is based on the artist’s observation of an intimate moment between a disguised couple of lovers begging in a pedestrian zone in Frankfurt.
In addition, Büttner poses the question of the moral dimension of appropriation in «Gesamtzusammenhang». Alongside the inclusion of the exhibition about Simone Weil, David Raymond Conroy’s film also takes up this theme of appropriation and exposition. In (You (People) Are All The Same) he expounds the problems of the ‘artist as observer of others’ and examines to what extent good art and good gestures correlate. His work reflects the creation process of a film about homeless people in Las Vegas in which Conroy confronts possibilities for the honest production of art. The chosen narrative technique is also central. A female voice describes and comments upon the artist’s process in a way that creates closeness and suggestively allows us to participate in Conroy’s dilemma. We repeatedly hear a catchy melody that accompanies scenes of mostly deserted panoramas.
Like Büttner, Conroy is fascinated by honest, authentic and direct situations and evaluation processes. He suggests that the attribution of value takes place between a feeling of insecurity and the impulse to decide and asks whether there is a gap between what we are and what we want to be or whether it is precisely in this gap that the humane is to be found.
In the same room Büttner adds benches to the exhibition which are simultaneously sculptures and seats. The back rests can be seen as a kind of painting in the background and the bulky wooden benches, on which visitors may sit, also serve as a starting position for viewing art. With both the benches and the luminous orange architectonic interventions Büttner addresses the social connotation of textiles: metaphorically as social fabric as well as in relation to the exhibition and the use of materials. Büttner had the back rests produced by nuns and people with disabilities and for the coverings of the panels used textiles which are usually found in work clothes. The artist deploys these panels as monochrome, as wall covering and to dim the light.
In the third room the luminous orange panel functions as a display for a work from the Beggar Series. The colourful woodcuts Beggar (2017) show veiled figures in begging positions. With this image formula, which goes back to Ernst Barlach, Büttner articulates the interaction of poverty and shame, showing and receiving, shame and ostentation. Shame determines what we show or hide and how we make judgements about art and non-art. The artist also worked on monastic poverty movements and the Arte Povera movement of the 20th century. The newly-produced Potatoes (2017), Coins (2017) and Breadpebble (2017) from the Saint Francis cycle can also be read in this context.
«Gesamtzusammenhang» reflects a certain temperature of subjectivity, community and questions of value. In the process Büttner shifts attention from specific issues to overriding questions: humanity is approached in its philosophical, religious, artistic and political dimensions. Her examination of warmth, empathy, human dignity and equitable coexistence extends through the exhibition. Her reflection on the contemporary is also important, whether empathetic or as a critique of the ‘contemporary’ as a narrow, normative aesthetic practice. Easter Sunday: Learning more about David Raymond Conroy 
Today was grey and grizzly again, so after a big Easter meal, I did a bit of research on the artists whose work I found interesting in the exhibition I visited yesterday. David Raymond Conroy was one who stood out to me – his film was playing on a loop in a little side room from the main space. I wandered in to watch a few minutes, and I ended up staying for the full half hour running time! It makes sense that his work would be so enticing, as it is centred around themes of seduction and addiction. Grainy mobile phone footage is overlaid with clear, story-like voiceovers in the familiar style of a podcast. As an emerging artist, he is doing well for himself, exhibiting and performing internationally in leading galleries. However, what I most liked about his work is that this success has lent no cockiness to it – rather, it had a real honesty and earnestness. I listened to some of his performance lectures online after seeing this film, and they had a similar quality of earnest questioning as cultural critique, which I find both refreshing and effective.
I am really glad to have experienced David Raymond Conroy’s work, and I am excited to see where it goes - look out for what he does next!
