This isn’t exactly animal-specific, but it’s animal-world and animal-people related, so I want to talk about it for a second. 

Tumblr has recently been becoming much more conscious of how important it is credit art to the artists that made it and exactly how much damage is done to creators when their work is stolen and/or reposted. With the proliferation of Facebook pages that profit off of screenshotting content from other sites and reposting it with little to no credit, this awareness is thankfully starting to grow on other social media sites as well. But in the real world, art theft and copyright infringement is still a major issue, especially for people who do animal art. 

Recognize this dog? People keep trying to steal him and others like him. 

The artist behind the well-known Doggie Drawings - infographics and posters that teach people about dog body language - is Lili Chin. She’s produced a ton of amazing dog art over the years in a very distinctive style. It seems like every time I turn around she’s fighting a new copyright battle or finding out that yet another company is producing items with her stolen art on them. Lili has had to fight major retailers and their suppliers for the rights to control reproduction of her own work, including Nordstrom, Walmart, and Kohls. 

And now, her work is being stolen by Old Navy, and they’re using all their corporate might to try to squash an independent artist’s ability to fight back. As she said in her blog post linked above:

“I have been through many copyright infringement cases - some have been resolved amicably, and there are ones that have taken more work. This case against Old Navy (Gap) is not getting resolved right now because Old Navy is denying copyright infringement. 

They are being totally unapologetic, and have said that it would be a “bad business decision” for me to expect to be reasonably compensated for the use of my art. Instead of compensating me, they have chosen to pay a large law firm to fight me, and have even asked the judge to order me to pay THEIR legal fees.

When a company as large and mainstream as Old Navy steals my art and profits from it, and is unapologetic about it, I cannot afford NOT to fight this. My lawyers and I will be fighting this for as long as it takes.”

To support the artists who draw the cute puppers you love, alert them if you think you’ve seen copyright infringement, and please, please make sure you’re buying from them directly and not purchasing things with their designs on them from the companies that are ripping off their work.

Since Lili’s original post (the one linked above) is also on tumblr, I highly suggest reblogging it directly and/or sharing it to other social media sites as a way to help her get more visibility for her case.

Let’s talk about Copyright

First and foremost: I am in no way an expert in this topic nor do I have any legal background. This comes from my own understanding of copyright, the internet, and intellectual copyright.

Secondly: There has been a huge issue with content theft, in both art and writing, but I rarely see any information about how copyright works with writing and ideas put on a public platform so that is what I will be addressing in this post!

“Almost everything that is an expression of an idea is automatically copyrighted! The author is the initial copyright owner even if the work is unfinished, unpublished, unmarked, or unregistered” [ this is a quote from tumblr user: doggiedrawings post which you can find here]

Intellectual Property:

The way this works is that once you write/publish something (on a blog or anywhere else), you own it. It is protected under the copyright law.

For this instance, both Discord and tumblr have copyright laws and you can read them Here [discord] and here [tumblr]

It doesn’t matter if you post an idea for a character or fic, on discord, or tumblr, once you have stated it, the content exclusively belongs to you.

Here are some things to remember specifically in the otome community, as it’s something I see quite a lot, especially with discord groups becoming more and more popular.

Just because someone has a conversation with you about their character  does not give you permission to use them without their express consent. 

Discussion of a fic topic does not give you permission to take the idea and do it yourself. [This can be slippery, because a broad topic may be used in different ways; Speak to the original poster and ASK them if you can make an idea similar but with your own twists. OPEN COMMUNICATION IS KEY.

There has been posts going around saying “Yes I’d love for you to draw my OC” and people reblog it giving permission to do so. It’s still always best to approach the creator and tell them if you want to do anything with their creation. Nearly all the time, creators will happily give permission and will likely be freaking out in happiness, but that might not always be the case. 

Always ASK before using any idea/character that you did not create yourself. This community is so giving and lenient. A lot of creators are willing to collab or allow use of their character if you’d only ask.

Respect when someone says no. They don’t need to explain themselves. If they say no, thank them for their time and move on.

There are some instances where miscommunication is the problem behind some issues. If someone comes to you and says that it was their idea [with proof], most of the time, the creator is just looking for an apology and for the issue to be addressed.

Plagiarizing other people’s ideas/character/fic ideas is not cool.

Hi everyone!

For those who are not already subscribed to my newsletter (doggiedrawings.net), a little reminder that I am closing shop temporarily as I will be travelling to Malaysia for a family event. 

My shop will reopen on October 31st! All pins and prints will be 25% off! 

As a one-person business; I wear all the hats, and as much as I love doing everything, I will need to take off some hats next month so that I can concentrate on a new book project that requires my full attention.
