こふたつ - kofutatsu
A wintertime picture for the wonderful blog @straycatj, inspired by Landlady's recent posts about Mr. J and Kofuku enjoying the kotatsu!
(Kofu is the black cat, and Mr. J is the toasted marshmallow)

i wish people would leave straycatj alone. she brought up a great point that whilst its apparently acceptable to paint someones picture 1:1 copy in america and it be considered fair use. this is not a custom in japan, a professional and gallery artist wouldnt do this, i struggle to see how a professional artist in the states could get away with this without crediting the original photographer. because when i studied painting we were not allowed to use anything that wasnt free use and we were still required to include a source even then.. this is australia though but do you see where she's coming from, outside of america crediting a photographer is mandatory and also most cases you'd need permission to display the work in a gallery or auction.
another thing people are bashing her about is that she called them not a real artist and i think this is a little bit understood and blown out of proportion because in other rbs and posts she says that the painter isn't behaving as a professional artist or conforming to those principles. i also think its really stupid to hound her over wording like this. no ones ever mentioned it but straycatj is an ARTIST HERSELF for her photographs.
straycatj has often rb and praised fanart so its so silly to act as if she's entitled over her own copyrighted work. pointing out that people are harsh on how she phrases things in her non native tongue and asking for replies in japanese is justified. people are cruel to her on her wording but then can't speak a word in her native tongue, funny and ironic.

The jump to assuming any artist who defends not having their art essentially stolen or even downright traced is calling for heavy copyright laws is giving leech. It’s giving parasite. It sounds like bitches have no talent of their own. 🤭 there’s a difference between inspiration, homage, and straight up copying. If the straycatj lady leaves tumblr, I better not see people crying because it’s their fault for constantly screaming at her.
literally. like i didnt bother to answer back to that person bc they obviously aren't a creative but there are a lot of things in the art world that is legal but is frowned upon in a social way? like painting someone's photo, or doing a screenshot redraw is absolutely transformative and if you give credit and/or acknowledge its fanart it's fine. the waters just get muddied when you're making PROFIT off it 😭😭😭😭 and like i said you can hate that people don't want people to make profit off their work but you gotta see where they're coming from.
cuz its like no one can FORCE you to not copy their stuff and you're not LEGALLY in the wrong but in the social sphere of artists some ppl are gonna have a problem w you! and when you start selling w no credit it just makes the original creators less inclined to put out content bc they know randos are gonna make bank off them w absolutely no credit and then everyone cries that tumblr is nothing but tiktok reposts lol. and im sure it looks sooooooooo petty to someone on the outside and i'd never advocate for strict ip laws bc it would be a disaster but it is absolutely a problem that bigger creatives online (hobby or professional) constantly have ppl taking liberties with everything they post and it just frustrates them and then for whatever reason ppl think oh you're a big account get over it instead of showing ANY fucking kindness

honestly i’m glad i’m not the only one put off by how straycatj’s landlady is reacting to all this …. in situations like this i start off trying to understand where the offended party is coming from but like right away i just could not parse why she is so angry. i really think if the art had been presented like any other fanart it would have been praised and embraced by her but since it’s in a gallery… ?????
same loool to me it just comes off as someone who gets so much attention on a social media platform that they think they deserve special treatment. i could totally be wrong but thats why im saying like dude. you based ur whole persona on giving voices to your cats. sit down….

this straycatj drama is so bizarre i thought it was like. basic artist unwritten rules that tracing/copying is fine as long as you don't sell it without proper permissions. as far as i see people keep trying to make this about things that it's not like it's not about fanart or copyright law or even about tracing the main issue the straycatj lady seems to have is literally just that it was sold (which is like. an extremely reasonable issue. i dont understand why people are upset about her having this problem). i dont understand why people are making it into this huge fuss outside of like typical social media need to over-exaggerate drama

I feel bad for the woman behind the straycatJ blog, imagine having your photo traced and then put up on display in a New York art exhibit with nary a mention of the source or context? I would be upset too, especially since she's an MFA herself. And then being harassed by people constantly in english over it because they willfully misinterpreted you. She has never said that using a reference photo makes you a fake artist, she literally reblogs fanart recreations of Mr. J photos all the time.

the straycatj stuff is. something
i think “meme artists” are at worst, annoying, but wouldn’t equate it to full intellectual theft or anything like that. and i would still classify them as artists. they’re not my favorite (the genre of “some guy recreated popular meme images as paintings” has been overdone for half a decade now) but it’s still an artistic practice
seems odd that landlady is so caught up in this one. does she want compensation? she shares lots of paintings and fanart of the cats. the guy likely doesn’t follow the blog or know the whole background involved. not that i intend to defend him much either, but idk. very bizarre.
love spending my saturday morning involved in cat blog drama

Of all the things I woke up to I didn't expect "Landlady from the straycatj blog getting into an bilingual argument on copyright over a painting of one of her cat photos"
Anyway, if you see this, before barging in with your own take, please first consider:
1) Japanese, American and UK copyright laws are all different, the artist may be working from a different idea of what's acceptable compared compared to you (especially if you learned about copyright from 2010's Internet critics) or Landlady
2) Photos can have trademarks but that's usually stock photos, in the UK/EU there's some privacy laws if the Photo has your face in it. But a cat photo uploaded to the Internet wouldn't be covered by this
3) This is more a battle of courtesy than copyright, Landlady has liked and encouraged (what was probably also heavily referenced/traced) fanart of her cats before. The difference is that those artists link back to the blog/@ her and don't start selling the art
My limited understanding of Japanese copyright (albeit from big corporations not individual cat blogs) is that stuff is quite lax (but this is more of a grey area of generosity) until you start profiting from anything then the legal hammer is swift. This is where you see stuff like ghibli not wanting any movie clips in reviews of their movies or Nintendo wanting let's players to be part of their specific partner program before streaming the latest Mario game
In summary: The art (taking a photo of cats and painting it on canvas/linen) is transformative. Like, lots of painters paint over traced sketches of photos, it's not 'easy' like a photoshop job to do and requires additional artistic skills to do well ('photoshop job' as in taking a pic and putting a filter over it, not digital painting in general) Although I'd this dispute got to courts it'd depend on the country as to if it was ok to sell.
But it would've been better if the artist just mentioned the heavy straycatj reference or contacted Landlady before selling their art
(Given that the artist is selling other 'meme cats' I wonder if they even knew the source of the photo they referenced beyond being a funny cat image...)

for the record i think regarding the discourse w straycatj and the guy who painted her cats without permission (and put it in an art gallery and is selling it in a book if not just as an art piece for real money as well???) i think landlady is completely in the right and i think youre a giant cunt if youre using her being upset that someone one to one copied a photo of her cats without asking for a professional piece of art to say that she loves copyright laws and is suing the guy for painting her cats or something. shut the hell up. she obviously does not mind when people make art of her cats because she reblogs fanart all the time. it was disrespectful and hes making MONEY off of it. shut the hell up being like well *i* would be flattered its not about YOU
