This week's Friday Reads and Fiction Friday recommendation!
It's surprising that no live-action production company/producer has taken notice of Peter F, Hamilton's Commonwealth universe/series.
This franchise can be adapted into a movie trilogy, or a TV/web series spanning 5 to 7 seasons with 16‒25 episodes each. This fictional universe that Peter F. Hamilton created tackled countless current social issues, and these were written years ago and still valid to this day.
Not to mention, there were also technological ideas that we started to see a few years after they were introduced in his novels.
Thus, for my Friday Reads and Fiction Friday recommendation, I highly encourage reading these great space opera novels by Peter F. Hamilton.

OpenAI Partially Prevails as Judge Dismisses Copyright Lawsuits by Silverman and Tremblay
Tumblr media
Federal Judge Rules on OpenAI’s Use of Authors’ Works in Training AI Model
In a significant development, two copyright infringement lawsuits filed against artificial intelligence company OpenAI by comedian Sarah Silverman and novelist Paul Tremblay have been partially dismissed by a federal judge in California. The cases alleged that OpenAI unlawfully utilized their books to train ChatGPT, the large language model powering its artificial intelligence tool that generates human-like text in response to prompts.
Key Rulings and Dismissals
District court judge Araceli Martínez-Olguín granted the majority of OpenAI’s motion to dismiss several claims brought by the authors. Notably, the claim of vicarious copyright infringement lawsuits was dismissed because the authors failed to demonstrate “substantial similarity” between their books and the output generated by ChatGPT. Additionally, the assertion that all ChatGPT outputs are “infringing derivative work” was deemed insufficient.
Other dismissed claims included allegations of negligence, unjust enrichment, and violations of the Digital Millennium Copyright Act. However, OpenAI still faces an allegation that it violated unfair competition law by using copyrighted books without obtaining author permission.
Consolidation and Ongoing Allegations
The judge further ruled to consolidate these cases with a similar lawsuit brought by another group of authors, including Michael Chabon, Ta-Nehisi Coates, and Andrew Sean Greer.
While the vicarious infringement claim was dismissed, OpenAI continues to confront allegations of violating unfair competition law by incorporating copyrighted material without proper authorization. This ruling mirrors a case brought by Silverman against Meta, where the judge broadly sided with Meta but allowed the claim of direct copyright infringement lawsuits to proceed to the discovery phase.
Forum Shopping and Future Developments
Last week, the group of authors involved in the California lawsuit sought to halt a similar suit in New York, accusing OpenAI of “forum shopping for the most favorable schedule.” This legal maneuvering underscores the complex nature of the litigation surrounding AI training using copyrighted material.
In August, it was revealed that over 170,000 books, including works by Zadie Smith, Stephen King, Rachel Cusk, and Elena Ferrante, were used to train Meta’s LLaMA and possibly other generative-AI tools. OpenAI’s practices have come under scrutiny, with allegations that “shadow libraries” like Library Genesis (LibGen) were sources for the vast material used in training ChatGPT-3.
Judge Martínez-Olguín has given the authors until March 13 to amend their complaint, signaling the ongoing legal battle between content creators and AI companies over the use of copyrighted works in training artificial intelligence models.

The Italian Plumber Problem
The “Italian Plumber Problem” is a fascinating and humorous lens to explore the significant and complex issue of training generative Artificial Intelligence (AI) on unlicensed content. This term, inspired by the world-famous video game character Mario from a number of games developed by Nintendo, symbolizes the broader challenges and ethical considerations AI developers face when using…

Generative-AI as Unfair Trade Practice
FTC Press Release exceprt While Congress and the courts are grappling with the copyright issues that AI has generated, the federal government’s primary consumer watchdog has made a rare entry into the the realm of copyright law. The Federal Trade Commission (FTC) has filed a Comment with the U.S. Copyright Office suggesting that generative-AI could be (or be used as) an unfair or deceptive trade…

“Back when the Bible was written, then edited, then rewritten, then rewritten, then re-edited, then translated from dead languages, then re-translated, then edited, then rewritten, then given to kings for them to take their favorite parts, then rewritten, then re-rewritten, then translated again, then given to the pope for him to approve, then rewritten, then edited again, then re-re-re-re-rewritten again… all based on stories that were told, orally, 30 to 90 years AFTER they happened. to people who didn’t know how to write.. so…” ― David Cross
On October 7th, 2023 the Palestinian political and military organization known as Hamas, executed a sneak attack, from the Hamas controlled, Gaza Strip into Israel. Hamas is considered a terrorist group by most democratic countries, including the United States and Israel. Hamas has a long-standing conflict with Israel and is known for its militant activities and calls for the destruction of Israel.
The ongoing military conflict started off with Hamas’s announcement of "Operation Al-Aqsa Flood", a rocket barrage of at least 3,000+ rockets from the Gaza Strip into Israel within a span of 20 minutes. Simultaneously, approximately 2,500 Palestinian Hamas militants breached the Gaza–Israel barrier via paragliders, attacked a music festival from three sides, trapping civilians and pursuing those that fled. The attack also included Israeli military bases and massacring civilians in neighboring Israeli communities. The number of casualties are said to be at least 1,300 Israelis were killed including 260 people who were massacred at the music festival. Unarmed civilian hostages and captured Israeli soldiers were also taken to the Gaza Strip, including women and children. Explosions were reported in areas surrounding the Strip and in cities in the Sharon Plain including Gedera, Herzliyya, Tel Aviv, and Ashkelon. Air raid sirens were also activated in Beer Sheva, Jerusalem, Rehovot, Rishon Lezion, and Palmachim Airbase. Hamas issued a call to arms, with senior military commander Mohammad Deif calling on "Muslims everywhere to launch an attack."
So, let's dive into the thrilling saga of the Israel-Palestine conflict, a narrative so complex and lengthy it could give "Inception" a run for its money. It's like a never-ending reality TV show, except with more rockets, way less romance and a “My God’s Dick is bigger than your God’s Dick” contest. Lately, the Palestinian side, more specifically, Hamas, has waged a brutal sneak attack into Israel controlled territory killing and capturing peoples of all makes, models, sizes, colors, creeds, ages and sexes. That’s right... Hamas killed hundreds at a music festival, capturing whomever they could and killing the rest. There are stories coming out of the gang raping of Israeli captured women and the butchering of Israeli children. Babies burned and their heads chopped off. This is the narrative that most are seeing and labeling that as the truth.
As always truth tends to have multiple personalities and different versions or variations of what truth actually is. In the early chapters, we find ourselves transported back to ancient times, around 1000 BC, when the Israelite monarchy was established. The region was hopping with various conquerors, each trying to stake their claim. Of course, it didn't help that the Roman Empire decided to rebrand the place as "Palestine" just to insult the Jewish connection to the land of Israel. Soon, Christianity became the dominant religion, and the Arab conquest was in full swing, spreading Islam faster than you can say "not it, NOT IT." Oh, but hold onto your lamb skin rubbers folks, because here comes the Christian crusades! Spreading death, chaos and famine, all in the name of Jesus Christ… They were like the original tourists, determined to take back the holy city from the "wrong" religious group. Meanwhile, more Jews were jumping on board with a little movement called Zionism. Their dream? To create a Jewish national state in their ancient homeland. Fast forward to 1923 when the British, feeling a bit generous, decided to make it official with the Balfour Declaration. That led to some awkward family dynamics, with Jews and Arabs both claiming the same piece of land like it was the last piece of pizza at a party that was serving literal shit, from the toilet, for pizza.
Now, let's flip to the action-packed scenes of the 1948 Arab-Israeli War. Five Arab nations suddenly swooped in, like that unexpected friend of a friend, party crasher, aiming to create a unified Arab Palestine. The result? Over 750,000 Palestinians were forced to pack their bags and leave, a drama known as "al-Nakba" or "the catastrophe." As we zoom through the years, we encounter the 6-Day War in 1967, where Israel grabbed control of the Golan Heights from Syria, and the West Bank and East Jerusalem got an occupation makeover. With more Israeli settlers moving into Palestinian territories, the PLO, (Palestine Liberation Organization), emerged and started throwing punches at Israel. Then came the first intifada, which is just a fancy word for violent Palestinian uprisings against Israeli military occupation. The peace process decided to make an appearance, with Israel and the PLO signing the Oslo Accords. However, that did not last long, and we soon found ourselves in the middle of the second intifada, with debates about Jerusalem, refugee rights, and those pesky Jewish settlements fueling the fire.
Fast forward to more recent seasons of this show. In 2018, the relocation of the US embassy to Jerusalem was like a plot twist that nobody saw coming, causing the Palestinians to feel like America was picking sides. And don't even get us started on the events of 2021. East Jerusalem became a “powder keg,” leading to a series of violent showdowns until they finally decided to hit the pause button with a ceasefire agreement in May. But make no mistake; this story is far from over. If you want a more detailed account of this history I highly recommend this video here,
https://youtu.be/m19F4IHTVGc?si=vQuoEgIiOnnif-dR (History of Israel-Palestine Conflict) from the YouTube Channel – History on Maps - https://www.youtube.com/@historyonmaps
This video was pretty solid with the information it presents and the tone at which it delivers it. To me, it does not seem biased over which side is right/wrong/bad/good/evil. It just states what each side has done to one another. This video is also two years old so this point of view is before the attacks of 10/7/2023. I have tried to be extremely objective on this subject and other stuff like this. I try to listen to both sides. I try to find what works and what does not work. What makes sense and what does not make sense, which is very little that actually makes logical sense with this specific topic. That is what I do. I look at things a lot deeper than the Flat Earther, conspiracy pirates that look at Twitter/X as NEWS that requires no validity and/or look at CNN/FOX/NBC/NewsMax as the only places to get news. Only a portion of this information is being covered by legacy news media networks, all at the same time, at the time of this writing. If you want to know what/where/how/why… People… You have to actually do real research. You have to look deeply into things to have a real and/or better understanding as to how they work and more importantly why they work the way they do. This is probably gonna be the easiest way to get this kind of data on this specific subject, fast and simple. Most of the other stuff I am seeing is overly biased or straight up exaggeration.
The YouTube video is an interesting non-biased breakdown of the facts and events that has led up to this moment. There is only one error I could find and that was probably due to the AI-generated voice. The error I am referring to here is the audio in the video that says sixty day war rather than the 6-day war. This video being two years old, those older AIs might not be as accurate as the ones generating audio now, but that is beside the point. I thought I’d make mention of it though in the case anyone wants to watch the video on the history between these groups. I am not saying this is 100% fact either. However, if you want a more generalized understanding of why these two groups hate one another, at this level of hatred, this isn't a bad start in that direction. The video just saves you time, which is the most valuable resource any one of us has.
I am not here to debate each side either with this blog. Since I am not a religious personality I tend to put a warning in my writings that, in my opinion, ALL religion, is by MOST humans, interpreted incorrectly, used for their own personal vices or you get people that are hubris. Hubris, in all its glory, is the cringe cocktail of delusion and granger, where one believes they're a divine gift to humanity, they are God, and their wisdom and actions are beyond reproach. It's the epitome of arrogance in human spirituality. Any religion that promotes violence for simply NOT believing in that religion isn’t just wrong. It’s as fundamentally wrong as Earth being a flat disc on the back of a giant space Turtle. Any argument of self-defense and any part of that self-defense is to plot, kill and/or capture innocent concert goers, women and children, rape and behead them and then take video of those acts and promote it on the INTERNET as justice.
Yeah… No One is Going to Listen to that Argument.
Israel is the only true democratic state/country in the region and it is their sovereignty that is being attacked. What if Mexico sneak attacked the USA and bombed some cities along the border. How would the USA respond? Ok, perhaps, we should said it like, How would the USA respond with Regan as President? Mexico City would be something out of T2 or Mad Max, there simply would not be a Mexico City anymore. That is what Israel has intended to do with Hamas. There were hopes that economic engagement and peace agreements, like the Abraham Accords, would lead to a better future for the region. However, Hamas has never shown any interest in peaceful coexistence with Israel. They have walked away from negotiation talks several times and has consistently expressed a desire to destroy Israel and Jews where ever they can. Some individuals and pseudo-intellectuals here in the United States support Hamas or criticize Israel, even when Hamas openly advocates violence and the destruction of Israel. I actually saw some pro-Hamas protesters say the kidnaps, rapes and beheading of children were all lies and not true, even though most of the world believes this to be an accurate account of what has been happening.
There has always been a need for Israel to protect itself from Hamas, as the group poses an existential threat. It also calls for a change in the perception of Israel and a more critical view of those who support or apologize for Hamas. The more that I look at this stuff the more this looks like how the Nazis were able to gain sympathy during the years where it was very small but was gaining traction. Well, it was a cute idea, really, that maybe we could turn over a new leaf and bring about some prosperity and peace in the region. I mean, who doesn't love a good Disney-style ending? But, of course, what we've got flashing across our screens, folks, is nothing short of a carnival of horrors courtesy of Hamas – Lo and behold, our beloved mainstream media, the champions of misinformation, are telling us that we're just not getting the full picture. Well, aren't they generous? The "context" they're feeding us? Let me tell you, it's like a buffet of bantha-poohdoo. I am trying very hard to not just dismiss Palestinian complaints here, but I cannot hear their arguments when this is their resolve. Violence, crimes against women and children, open murder. Yeah, if this is what that God preaches, keep that shit in the desert, buried in the sand man… That is where this ends… Hamas lives in the sand and will be buried in it… That is how this ends… It’s already being written that way.
This whole conjured up pseudo-sophisticated narrative trying to find some wiggle room where these atrocities are acceptable is just that, pseudo-sophisticated  – oh, how fancy! But guess what? "Pseudo" is just a fancy word for "made up." It's their ticket to justify the annihilation of Jews, plain and simple. It's a masterclass in sleight of hand. They want you to think that all these rants about territories are sincere, that the Palestinian Authority, Islamic Jihad, and Hamas are just fighting over real estate. But here's the kicker: Hamas isn't exactly shy about its true agenda. They're screaming it from the rooftops, folks – they want every Jew in the vicinity to meet a grim fate. No, it's not a dinner invitation; it's a call for bloodshed.
We keep looking at this from some sort of “sophisticated,” there goes that word again, miss communication in politics with some religious land claims sprinkled in there like parmesan cheese. This whole blog stems from a hypothetical thought I had that if Iran gets involved what would be the likely hood that Israel uses nuclear weapons against them? Israel has been labeling this their “Pearl Harbor,” their “9/11.” So if this is how they are seeing this and treating this, I feel a nuclear response isn’t some hypothetical thought, but rather more of a likelihood. Now, the question, does Israel actually have nuclear weapons or not? Israel has not officially confirmed nor denied the possession of nuclear weapons. However, it is widely believed that Israel does possess nuclear weapons, although the Israeli government maintains a policy of ambiguity regarding its nuclear capabilities.
Israel has adhered to a stance known as "nuclear opacity" or the "nuclear ambiguity policy," which means that it neither confirms nor denies having nuclear weapons. This policy has been in place for many years, and Israel has not signed the Treaty on the Non-Proliferation of Nuclear Weapons (NPT), which would require it to openly declare its nuclear arsenal. While Israel's nuclear capabilities are not openly discussed or confirmed by the government, it is widely believed that the country has developed a nuclear arsenal. Several reports, experts, and intelligence assessments suggest that Israel possesses a significant number of nuclear warheads. The main points of this conflict revolve around competing national identities, religious ideologies and territorial claims in a relatively small geographical area. Both Israelis and Palestinians have deep religious, historical and emotional ties to the land, particularly Jerusalem, which holds immense religious significance for Jews, Christians, and Muslims alike. Let’s not forget that Palestinians systemically hate the Jews…
Historical events, including the establishment of the State of Israel in 1948, led to the displacement of hundreds of thousands of Palestinians, creating a refugee crisis that persists to this day. This has not been fixed. This is still affecting the region today, 75 years later. This displacement, known as the Nakba, remains a deeply ingrained trauma in Palestinian collective memory. Israel is on the books on trying to find solutions to these issues. However, the Palestinian contingent cannot agree with one another or unify, to sit, and have these sorts of talks. Israel will work with and talk with a Palestinian group and a new one pops up in its place with voices of disgust. The conflict has been marked by cycles of violence, with both sides having experienced loss, suffering, and grievances. Attempts at peace agreements have faltered due to issues like borders, security, settlements, and the status of Jerusalem. Where deviations in each other’s religion just fuel this outrage. Additionally, the rise of extremist groups on both sides has further fueled animosity.
Both sides paint the other side as inhuman, evil, wrong, bad. The involvement of regional and international actors has also complicated the situation. Geopolitical interests, religious considerations, and international support have added layers of complexity to the conflict. The only people that are paying this heavy toll are the regular, normal, everyday people that are just trying to live their lives to the fullest. Regardless if they practice a religion or not is irrelevant. Targeting and killing people not directly involved in the arena of war, where many of them are women and children is wrong. Both sides are guilty of treating the other poorly and both sides cry foul when the other does something to the other and want the world governments to do something about it. Under those circumstances, there is no good or evil side. There are no victims and there are no terrorists. Under these circumstances, ALL involved pay the price. There will not be a resolution here till one or both sides wipe the other out. This is sort of how it has been with these groups of people during the entire run of human history.
There has been a considerable effort to paint the Palestinians as bad/evil and the Israelis as the peace loving innocent victim in the media. As I stated before I am not here to really do that, but it is hard to battle that outrage at the senseless loss of innocent life perpetrated by the Hamas sneak attack of 10/7/2023. The horror stories coming out are still coming. I do understand what the “Real Estate” argument is, but that isn’t a good enough excuse, hell, it is NO excuse at all. If the Palestinians never acted out in violent acts as its response to their injustices, perhaps there would be more people out there willing to listen. Now… Right Now, no one will listen. Hamas really stirred something up in people and not just Israelis, Americans too. Many Americans immediately remembered how we felt during 9/11. There was much anti-Muslim sentiment over here from the everyday people and there still is. I, like many, not only wouldn’t listen to pro Muslim sentiment whatsoever, we wouldn’t even open our hearts to listen. This just ads to that. Veterans over here are raising their eyebrow and saying: “Told ya so, told you ALL so…”
I Tend To Treat All Faiths the Same. I Look At Them All the Same.
I have always had a hard time having really deep-thought conversations about consciousness, life, the Universe, emergence, entropy, the beginning, the end and infinity. The essence of my logic is what can one prove to be real and what one can only speculate with belief and faith that a thing, “any-thing,” is true and real? I have talked about this so many times in the past and that is;
“What is a Fact?” “What is Truth?”
If a thing advertised as truth and facts when it’s really just opinion and belief, which can be part of truth and facts, but is not solely depended upon it as merit. If a person makes a statement and they say this is a true statement. That what is in this statement is true. It is a fact. What this is –is real and their evidence is only based on opinion and belief than fundamentally that cannot be a fact or truth. What we see on the social media is advertised as real, truth and that this is real. This is one of those subjects where every person’s individual perspective is based on their own personal experience. I understand that in a technical way, that isn't clearly understood, that we control what we see on Social Media. However, most, if not all, those settings are so buried, most, if not the majority, that use social media, do not even know they even exist. I work, fairly hard, to tailor what I see and how I see it as best as I know how, based on the settings I see. It’s very possible all of us see very different things through our personalized social media experience. Be it something interesting to dive into person to person or person to person over far enough distances. Most of my thoughts here stems from X (formally known as Twitter) going all weird with pushing news stories that some are legit and others are just nonsense, all while displayed as legit news stories. I had to mute around 100 accounts before I started noticing less and less of that. Granted I may miss a real story that is actually a big story, but that is the kind of crap that would get under my skin. I have gotten rid of most of the people that would post about something happening in the world and it be the most useless trashy take on the subject and they would post like this about serious stuff all the time and it always is something crazy and trashy like that.
In the ever-complicated reality TV of the Israel-Palestine saga, we've touched on the history, the geography, the present day conflicts, and the real-world impact of recent events. We really didn’t dive too far into the religious points of view here between the two different groups of people. While I understand how important faith is to both groups I cannot directly relate to it. I wrote a blog on my feelings on religion and faith back in March (2023) and this blog is written under the assumption whomever is reading this, has read that one. I will link it below… In short: The main points discussed include the potential threat of religious beliefs to government control, the distinction between religious "facts" and scientific evidence, the possibility of alternative explanations for religious experiences, the differences between atheists and agnostics, and the pitfalls of binary thinking. It also touches on the consequences of faith in decision-making, changing language definitions (war on language), the influence of faith on group identity, and recent gender identity debates. I highlight the importance for logical thinking and the separation of faith from empirical evidence in discussions about religion and society.
Excerpt(s) from: “The Redemption of Time: A Three-Body Problem Novel” ― Baoshu
“There is a cause for every effect, but not all causes are responsible for all effects. To trace all causes and all effects is to end up in a twisted web with no end.” “We are moved most not by the grand mysteries of the universe, but by the emotional personal truths that define our individual pasts.” “No single person can make decisions independently; every choice is the result of changes and inputs from everyone else.” “I wish you all to remember that time is a precious gift from the Creator. Don't waste it! Everything ultimately will return to nothingness, but you must enjoy every time grain, every time node, every time strand- that is the true meaning of life.”
As we watch this story unfold, remember that behind the politics and the passions, there are real lives at stake. There are real people on the ground paying this price. People ask me all the time why I don’t believe in God in the ways and/or context that everyone else does? AND its stuff like this, examples like this, over and over again. All through our history there are examples that this one belief has done way more harm than good. Follow the data… What does the data say? That is your truth. Learn math, not scripture… Learn logic, not prayer… Learn to problem solve, not kill in your God’s name… Learn Love, not Hate… “As the World Falls Down…” ― David Bowie

The Science Fiction elements here are a coincidence. That I just so happened to read these books during all this and the existential horror the narrative suggests really has helped me over the months of making sense of how perverted Religion, and an overly strong belief in the one God creation myth can be and it is a myth, not fact, but myth:

The concept of fair use, codified at 17 U.S.C. §107,  is one of the most important and widely discussed topics in copyright law, and perhaps one of most widely misunderstood as well.   The Supreme Court has described the concept of copyright as the engine of free expression.  That being true, I would extend the metaphor to say that the concept of fair use is the oil that keeps the engine running…

apologies if this doesn’t fit your policies, but what are your thoughts on the ilymation drama? i tried to make sense of but it’s hard without delving into seeing fatphobic rhetoric due to the nature of her original video and how most people that discuss it don’t seem to understand the nature of fatphobia as a whole. but what do you think of it?
I don't remember if I watched her original video or not but my understanding of the situation is she made a video and people were responding to it and she was using the DMCA system to strike down videos.
Given the typical nature of people that would be upset enough to do a response video to an animation I can imagine its a lot of fatphobia, diet culture and pop science defending. 🙄
The crux of the issue is that she's not a commentator by nature so it probably feels very violating to have someone take your personal video and have someone be a clown about it under the guise of a "response". So I understand the instinct to protect your content. However unlike YouTube itself, the user base does not fuck around over trying to protect fairuse. Which has more and more self righteous fatphobes responding. I'm sure they are especially nasty if they think the response was 'correct' and her original was body positive.
It is fairuse to make a 'response' to the original video. It is an abuse of the take down system to flag those videos. And she doesn't have the skill set to navigate this frustrating situation because she is not a content creator that gets into fights or has people come after her normally. My heart goes out to her, I have seen other work from her, she's very personal, raw and vulnerable.
It probably felt like someone punched her in the heart. She wanted to protect herself and made the wrong choice. Now everyone is being assholes.

Does AI Infringe Copyright?
Here I explain the issues involved in the copyright infringement cases that have been filed against artificial intelligence firms
The Input Question in AI Copyright Law by Thomas James, Minnesota attorney In a previous blog post, I discussed the question whether AI-generated creations are protected by copyright. This could be called the “output question” in the artificial intelligence area of copyright law. Another question is whether using copyright-protected works as input for AI generative processes infringes the…

The Decline of YouTube
Tumblr media
Welcome to another episode on What the FK is up with YouTube these days. I have been on YouTube, well, I have had an account with YouTube since 2006. I used the platform before right after beta testing, but I did not have an official channel till 2006. I have watched YouTube grow so fast in the early years that I didn’t even realize what was happening. Sure, I posted, but I didn’t use for it for monetary gain. I am a film graduate, so I used the platform to upload my video projects so that I had a space to where I could link people to them in the case they wanted to possibly hire me to do their small scale video production work. Now anyone with an iPhone and access to AI tools is a “video production specialist.” However, I wouldn’t ask them technical questions on video production aspects. Lighting, what Dutch angles are, etc… It is likely they will not know what the hell you are even talking about. What I am going to cover here is a few of the more popular topics people tend to complain about with the philosophy and the functionality of how YouTube works currently in 2023. Much of this is going to be logical opinion driven. I will try to pull facts where I can, but more or less, this blog just serves as another cliff note on YouTube and some of the issues I have run into over the years to where I did blogs about them so that if I had to go back and do something YouTube related and ran into another problem I could refer to those blogs to help me figure out the issue. Also, I thought it was a good idea to blog these out for other people who may also run into the same unique issues I have over the years…
YouTube’s Fair Use Policy:
“Fair use is a legal doctrine that says use of copyright-protected material under certain circumstances is allowed without permission from the copyright holder.” ~ChatGPT’s summary.
Fair Use, while clearly defined in the writing of YouTube’s Terms of Service “TOS”, still has that subjective nature to it and it is clear that nature now is being abused. I get that “some” people will attempt to upload full movies on the YouTube platform. There are whole channels dedicated to uploading full length movies. However, many of these channels upload either very old, out of circulation films or films that do not follow the strict copyright laws like some of those really old drive-in style flicks from the 1950s, 60s and 70s. YouTube only cares when copyright claims are filed. If a person, or company doesn’t do that then there isn’t an issue. YouTube is basically saying if you try to pirate newer popular titles we will strike and/or block the account outright. While, I feel, it should be alright for rare, out of circulation, independent, perhaps, banned, or clearly B and C quality movie territory, just so an audience can find them and enjoy them. Popular movies should not be allowed. I mean, I feel like the spirit of the algorithm that supports this is where the problem is.
I do not know how it works specifically. This is all speculation and creative thinking on my side of this. I am not going to pretend I am a coder and I know how this stuff works. I do not have that knowledge. However, if it were me, I would have it looking for big uploads. I mean if we are strictly talking movies here and not music or music video, just movies, these would be massive uploads. Even if compressed, these files would be fairly large. I would have the algorithm look at all large uploads to check for copyright. That would narrow down a lot of the “auto-block” issues that many channels have to deal with that use anything that could be a copyright strike against them. This seems to be a major issue among channels that do reviews or critical breakdown videos. If the algorithm is looking for copyrighted materials, in general, no wonder so many videos are being auto-blocked. They are treating all uploads, all of the time, as possible copyright infringements. While there should be separate layers to it. There should be levels to what is what, how it is labeled in the system, and how it is being used. They use this “algorithm” to do what, exactly? Ok… Fine… Program it a little smarter then. I will role play as the algorithm:
1) There is an upload.
2) Scan file for length
3) Scan file’s video/audio source and content.
4) If length is under (insert generic length of average movie here) ignore as full movie copyright.
5) If file containing possible copyrighted materials, apply rules for use (whatever those rules are).
Again… I do not know how it all works and whatever. This is a sarcastic example. I am simply saying; if we are now using AI for so much. We cannot train it to scan all videos coming in using rules of logic to figure out if said uploads violate the rules of the platform’s Terms of Service (TOS) regarding “Fair Use?” To me this should be broken down into a more binary form for the software to handle anyway.
When I was in computer school, years ago, I learned what an ACL is and how to program one. ACL stands for “Access Control List.” ACLs are a security list that manages permissions, ensuring only authorized users can access resources like files, networks, or systems. It works like a binary switch. If the switch is on to block specific traffic from (insert IP Address here). It will block that traffic and users from the IP or IP ranges from access to that data, which could be a site or platform or specific portions of that platform or website. So to me, this is why I feel like the algorithm’s logic is programed, well, to not accept the rules as they are in the TOS. Either the engineers did not physically do the work to program the specifics or they were told not to. It’s either on purpose or an oversight. It takes a very special mind to sort out and write ACLs. Its pain staking and one can mess up fairly easily. I, personally, was not good at this. I understood, conceptually, how to interpret the data. However, writing the instructions? Not so good…
As Far As Copyright Companies Go…
Yeah, they clearly do not understand the “fair use” laws as they are written. It is a fight that could cost you money or the potential to make money and for what? They have the power and the money to squash your argument. This is why if AI were doing it and the rules followed the physical rules and logic of those rules and their intentions, it would be cut n’ dry. From that, it would be based on a 0 or a 1, conceptually. It either broke a policy or it did not. If it were that simple, most, if not all, of this would be adverted. AI/software is going to behave how we program it to behave. If the TOS says a thing and it is programmed that way in the algorithm it will follow the rule. Take that logic and apply it to what the algorithm actually does and see if it actually matches what the TOS says.
There is also this arrogant attitude from companies about what advanced technology can do to an inflated sense of self-belief in its actual ability to work. This attitude that their program, their policy, their protocol, and their company could, ever be, WRONG… This is a huge problem. Not just in technology, but also in bigger tech and biggest tech, insanely, obnoxiously humongous tech. “Ludicrous Speed! GO!” It terrifies me with its relationships with religion, politics, reality, existential existence itself. We have rules to govern how we do things and the very things that require the rules to operate correctly do not follow the rules and we are told to just ignore them. Is it really a surprise the world is in the turmoil it is in, even at this smallish scale of a video hosting platform for independent creators? That is what YouTube was when it started. For people who couldn’t get their voice out there and now Big Tech and Mass Media have literally stole it with their promises of ad revenue.
YouTube’s Corporate Culture:
Over the time where Google purchased YouTube and what YouTube currently focuses on with issues related to corporate advertising and the platform's shift towards a more corporate and advertising-focused direction. There is an extensive use of advertisements by large corporations on the platform. You all know these by the ads that often annoy, interrupt and disrupt the viewing experience per video. Another significant concern is the abundance of mainstream corporate news content now dominating YouTube. This presence of mainstream news content can overshadow and reduce the visibility of alternative opinions and independent creators. Currently, YouTube is a result of the platform's monetization strategy. YouTube allows content creators to earn revenue through ads displayed on their videos. While this has enabled many creators to earn a living from their content, it has also led to an influx of corporate advertisements, sometimes making the viewing experience less enjoyable for users and less is understating it.
YouTube has drifted away from its original appeal as the be-all-end-all platform for independent creators. It should be noted that Twitch and Rumble are now catching up. They are never gonna be YouTube, but they can take YouTube’s spot for small-time independent creators to go and get a better experience. Perhaps even a better monetization process. The platform initially gained popularity for allowing individuals to upload and share their content, fostering a sense of creativity, entertainment, education and community. YouTube's increasing corporate focus, which is evident in the platform's prioritization of corporate advertising and mainstream news content. This shift has led to a growing perception that YouTube is prioritizing corporate interests over those of independent content creators. These concerns and critiques are rooted in the evolving nature of YouTube as a digital platform.
YouTube has increasingly become a platform for news dissemination. Many mainstream news organizations have established their presence on the platform, uploading news segments and reports. While this provides users with access to a wide range of news content, it can also make it challenging for alternative or independent news sources to gain visibility. There is also pressure from the legacy mass media that what they report is FACT and if other, smaller, independent channels post a video as a news worthy story and it contradicts the reporting from the mainstream media that the uploader’s video is now in question of being labeled as misinformation. This is also a potential problem that is understated most of the time. Mainly due to many of the uploads being opinion-based anyway. Where actual, small time, independent news channels might have a problem there. That part is hard to say, as I do not follow any on the platform. YouTube's shift towards a more corporate and advertising-focused direction is partly a response to the need for profitability. To sustain the platform, YouTube has pursued partnerships with advertisers and legacy media organizations, which has led to the proliferation of corporate content. However, this shift has raised concerns about the platform's commitment to supporting and promoting independent creators. These concerns reflect broader discussions about the role and direction of digital platforms in the modern media landscape, where balancing corporate interests with the needs of the user and independent content creators remains a complex challenge.
What X (formally known as Twitter) is trying to do is be the YouTube of old with promoting everyday X users to report news where they are in the event “something news worthy is happening live” on the platform. While a good thought, I do not think it will succeed. What is more likely to happen is X (formally known as Twitter) will eventually get itself shut down and something new will spark from it. That new “thing” will be what X (formally known as Twitter) is trying to do, mixed in with what YouTube used to be in the early days, before YouTuber, Influencer and Content Creator were even phrases. Most of my thoughts here stems from X (formally known as Twitter) going all weird with pushing news stories that some are legit and others are just nonsense, all while displayed as legit news stories. I had to mute around 100 accounts before I started noticing less and less of that. Granted I may miss a real story that is actually a big story, but I look at things a lot deeper than the Flat Earther, conspiracy pirates that look at Twitter/X as NEWS that requires no validity; and/or look at CNN/FOX/NBC/NewsMax’s YouTube channels as the only places to get news.
YouTube’s Thumbs Up/Down Rating System:
Due to the corporate influencing on YouTube; videos were getting rated worse and worse. This is and was due to us, the viewer, that hates corporate ANYTHING and EVERYTHING… We left cable due to that gross, icky, dirty corporate feeling. These videos were getting lowered and not viewed as much. These companies were paying top dollar for these ads and they are now either not being seen at all or voted as low quality videos. I doubt companies want their ad on videos considered trash. So YouTube changed their rating system to a thumbs-up, thumbs-down where at first we could all see both votes. Flash-forward some years later and they switch the thumbs-down to be hidden at all times. One now can never see the amount of thumbs-down votes a video could have. At this point, it is not possible, before you click on a video to know whether or not the rating system is being honest with itself.
Rather than this idiotic thumbs-up, thumbs-down system, which is currently defunct thanks to YouTube blocking our ability to see any and all thumbs-down, so the system itself is pointless. YouTube now uses this for analytics and the almighty algorithm that basically dictates whether a video is good enough to label as “monetize this video.” I have heard so many horror stories that if the video doesn’t get liked it messes with the amount of monetization the video can get. The more thumbs up, the more money that creator will get for their efforts. This is not what the intention was for the thumbs up and thumbs down or maybe it was, in its current form. I can't help but think of the early days of YouTube when we had the star rating system. It was a system that offered so much more variety. If I found a video to be decent but not stellar or even terrible, I could give it a one, two, three, four, or five-star rating. Now, if a video truly stood out, I'd gladly grant it a five-star rating. This allowed for an averaged assessment of content quality that was our voice on what is good/bad.
Back then, this system served as a natural filter for weeding out subpar quality content. When I searched for a specific topic, all kinds of different videos would come up, and I could quickly gauge their worth to what it is I am interested in at that time. Even before clicking, I could see the star ratings. For instance, if a video boasted 250,000 views and a five-star rating, I knew it was likely to be what I am looking for or, at the very least, be up to the standard described in the title and thumbnail, which now feels all click-baity. Click-Bait came a little later. This is not a very good quality excuse for YouTube to blame Click-Bait for why the rating system was changed. It was changed so they can control how something appears on their website under the impression it is based on our votes. This isn’t much different than me hacking into your computer while you are on your bank website and I change the displayed HTML text in the background of your web browser; displaying whatever text I wanted it to. I could make it literally say anything. Oh, the implications… How is this any different from YouTube? They are literally controlling, telling us, what is good and we should watch this. If I am a million dollar company and I want to advertise on YouTube. Depending on how much money I want to spend I could have my ads on all the popular videos on YouTube, but from YouTube’s algorithm’s point of view.
The star rating system; videos with misleading titles, thumbnails, or poor-quality content would face the consequences of low ratings, because us, the viewers, were thumbs downing these videos. Their videos would display a dismal one-star rating, serving as a clear signal to other viewers that the content was trash. Granted that does not mean the video won’t be enjoyed by others, but it’s extremely implied, and it should be that way. This system was great the way it was. It sifted through the junk, simplified content search-ability, and allowed me to tailor my YouTube experience to my preferences. It's a shame we lost this feature.
YouTube’s Search Engine:
YouTube’s current search engine, how it currently operates, is extremely limited at trying to find something specific. With the evolution of chatbot language modals like ChatGPT. I’d love to see YouTube adapt a language modal AI, like this, to replace YouTube’s search engine or at least as an ad-on. You could have a short conversation with YouTubeSearch, let’s call her ‘Syrche,’ with what specifically you want to see in your search results or what you do not want to see.
An example prompt could be: “Syrche… Please display YouTube’s 15 most watched videos on Starcluster formations. Please display these 15 videos from channels that have between 100,000 and 200,000 subscription followers. Other video search criteria: only show results for Videos that are under 11 minutes and have no mid-video sponsored ads.” Should be noted that ads are to be expected, but what I am specifically asking in my search results are videos that have no “mid-video” ads. This means no breaks during the video. The search results could show me videos with an ad at the beginning of the video, which is to be expected, and ads that might be at the end of the video. There also could be ads in the creation of the video content itself that are not added by YouTube. They would be part of the video uploaded from the uploader. That is the beauty of using a language modal AI for this. It understands the context of your query in conversational form. The thing about AI language prompts is being extremely specific but doing it in the simplest way possible to your own abilities. If I want a more mainstream results driven approach in my search results I would just use the search like normal. If you want something extremely specific include an advanced search engine that is really a prompt answer language AI. I mean, why not? Everyone is using this now.
I guess the Future YouTube or FutureTube would be like YouTube but completely AI dependent. That would be interesting to see. Just imagine a thing like YouTube where you talk to an AI about what you want to watch or even Tell AI what to create for your channel. Maybe even before the end of the decade? Be interesting… Ciao…
