even if there’s a solution to a “problem”, someone can still talk abt how they don’t like said problem… you know that right? it’s always “then ignore them” or write them yourself”… who says that ppl don’t do that already. it was one opinion. no one was demanding black writers to not write wtv they want, the person only shared their view and everyone went crazy… you legit wrote a think piece over this. There shouldn’t be fighting yeah, but maybe ppl should stop feeling butthurt over opinions. users make the most trivial things a bigger issue on tumblr, legit arguing with a minor lmao

i ask you to read all of this before sending another ask, its another “think piece” but its literally the answer to why what these woman are askin is lowkey problematic and i dont blame folks for not noticing dogwhistles. im also not say all “soft girls” are spouting this stuff. (hell im one of them). im also not calling these women evil, cuz they may not truly know what they saying is problematic as we live in a capitalist yt supremacist system. im more than happy to answer more. im not somebody that gon dismiss you if you wanna have discourse💖

but yes, you can talk about a problem when its in good faith as it actually cultivates productive insight. but bad faith arguments distract us from the real problems that both groups actually want to see fixed. however we need to acknowledge that most ADULTS who come with this “soft life fic” opinion be in bad faith.

bad faith is trying to get us to come back to things both parties already agree on. we all agree that soft fic aint seen much. what we are saying is why you keep coming in the dark/urban fic inbox stating it for people who have no problem with you? we’ve assessed the “problem” and we all agree it needs fixing. its like we running in circles, instead of different directions to fix other problems. the question is how are you going to contribute to fixing it in a healthy way and how do you want us to help.

im sure cherry and her friends would love to recommend a homegirls work so long as shes respectful. HELL I’LL EVEN DO IT!!!

tho i don’t recommend coming into blogs who are strictly dark and askin’ them for anything other than that. just like how soft writers don’t want to primarily write dark.

its not butthurt when you come on someone’s page calling them “ghetto” “baby mamas” then try and position it against “soft life” “divine feminine” “old money” aesthetics.

im not saying thats what this little girl did, but ive seen grown adult women do that. and thats nasty as hell to be positioning that.

the reason she probably caught flack is because she unfortunately used a simple question thats been hijacked and used by bad faith arguers when they come to urban fic accounts.

thats usually the question to get a leg in the door to start spouting off lowkey antiblack and classist shit.

and i dont know where soft being only afforded to the croquette looking girls came from. some of the softest girls i know are high fem baddies. so thats very weird, especially when you consider that black women make up majority of that aesthetic.

essentially its respectability politics and thats why its not trivial. to most, this looks like a minor creative liberties dispute, but the underlying theme is actually steeped in so much politics that affect black women for real.

i mean just look at the whole bonnet and pajama pants debate. or the straight hair or braids for your birthday/formal event debate. or the wigs vs natural hair debate. baby mama vs wifey debate (if you believe how a woman carries herself in a way thats nondestructive to others, is a reason as to why she doesn’t deserve respect; you not a feminist.)

not even gon hold you, i didn’t know that was a minor. just reblogged @chrollohearttags post on my dash. anybody doing anything other than telling that little girl to get off they page is a weirdo. but cherry made a general post thats been a topic of discussion AMONGST BLACK WOMEN since we’ve been writing stories. so ofc thats what my “think piece” is about. she may have commented one question but some iteration of that same question has been around for years. i’m responding to that.

since i now know this is a minor, they could have very well been wanting to know why there is a saturation of these fics on here. and i would have told her about the culture of urban fic being ONE of the first pioneers in Black Smut Fiction. it literally helped shape the black writing culture whether bad or good. then i wouldve told her that when she’s older she could contribute to said culture. but right now she should not be consuming any sexual media.

and to ask a question like that, its clear she has some gripes about the way general media treats black women; which those are well-founded. i understand hating the “ride or die”, or the “settling for less” when it comes to media for black women. but how can you read about a specific aesthetic or lifestyle and immediately know thats was going on?

these women used to have valid points and some still do but like this little girl, they cant tell the difference and if they can, they want any kind of reputation for “ghetto” girls out the window. there’s nothing wrong with being “ghetto” and nothing wrong with being a “the soft divine feminine” but we do need to talk about why the latter feels comfortable coming on someone like cherry’s page too disparage girls who aesthetics and social values don’t align with them.

writers like cherry aren’t advocating abuse, their characters are living they best lives. doing “ghetto” shit and truly loving the partners they’re with.

there are legit women out there who are “ghetto” that love they life. and are in healthy relationships. its vile to say that the way someone simply chooses to exist is a direct result of how black women face abuse, especially as something as silly as wigs, body con dresses and long nails. or even activities like twerking, having babies, doing drugs and partying.

its kinda like this whole Sukiana situation vs the Home Depot girl. Both were sexually harrassed but people tried to victim blame Suki more cuz of the way she dress and act. thats nasty. (plus there was no versus to begin with cuz neither one deserved it)

like there IS something to be said about how women who tend to write urban fic -at least in its early days- really do live the lives they are writing about. granted, looking back, some of these women were so unhealed that they ended up romanticizing abuse. but most girls now understand that you can live a hood lifestyle and not put up with bullshit.

somewhere along the way, the “city girl/ghetto/high fem” aesthetic got associated with abuse, crime, and poverty. which is crazy cuz girls who look like JT be havin’ money, a good life and still have plug/rapper boyfriends who not killing or getting them killed.

so if these women would be honest, its not about the way the “urban” girls look or behave. the real problem is the abuse that these women face.

which i see how thats a problem but abuse doesn’t correlate to aesthetics and its not a causation of abuse either.

soft girls can experience abuse. they experience financial, domestic abuse, sexual abuse. these women who hate urban fic, keep forgetting that the soft girl is modeled after the tradition yt housewife who faced abuse too. just cuz you get out the hood and get a financial stable man that isnt a plug or gangbanger dont mean he not gon beat yo ass or expect loyalty when he do some dubious shit.

they disagree with any depiction of your so called city girl —whether good or bad.

it’s counterproductive to feminism. it quite literally antichoice feminism which is a huge problem with feminism today because it relies too much on this yt viewpoint of responsibility politics. i suggest people really read “Hood Feminism” by Mikki Kendall.

anyway thats whats been making people like cherry become upset and rather than having patience, they ain’t got no more to give cuz they keep having to defend themselves and explain why talking like this is a microaggression. they exhausted.

"And you didn't kiss, again?" Zawe said, she took a sip from her wine glass and take her hand to her forehead with exasperation. "This has been going on forever now, I'm done, Caroline you take care now"

"Don't look at me, I basically push them together what else can I do? Lock them inside my office? Trust me I have thought about it." The other woman said.

"Excuse me, I'm still here and I can hear you" Y/N said questioning why did she agree to have lunch with them in the first place, however she had chose to only tell them about the invitation to an ex's wedding and the late tea at Tom's flat and not a single thing else "And what does again is supposed to mean?"

"New year two years ago" Caroline started "I was dating that gorgeous Greek guy with the most beautiful abs I have ever seen, and everyone kissed at midnight, and what did you do? You leave the dance floor to go vomit in my bathroom"

"Oysters and champagne don't mix" Y/N said getting red remembering the night "And Stavros was only kind of hot" she add making Caroline sigh with pretend indignation.

"What about january last year?" Zawe continued "Bobby was sick and he was on call for his last movie, and you take a week off to stay at his place to help him out"

"First of all I love that dog, and I did that for him more than for Tom, and second I didn't stayed at his place" She answered knowing pretty well she was lying "I only get there super early and went out late at night, but I would have done that for you guys too"

They continued laughing and talking about nothing in particular, with the subject coming up time to time, they meant well and Y/N knew it, even if they didn't knew the whole story.

"Being honest he is as guilty as you are" Caroline said signaling the waiter to get the check. "Last year on November you were at that gynecology symposium on Madrid, and he acted like he was losing his mind until he got in to a plane to met you there, and what brilliant excuse did he give you? He said he needed a flu shot and don't trust his doctor here, also all those times he had crashed at your apartment are total bullshit I was with him the other night and he didn't have a single drop, and I'm getting tired of helping him pretend he does"

"Oh please stop it already" they were walking towards Zawe's car and she was as amused to find the truth about that obvious lie as she was exasperated by her friends "You are right ok? at least on my side. I have been childish about all of this. But if I'm honest I don't know what could I do? In the end I'm still a general practitioner from a tiny hospital and he is Tom Hiddleston"

"Well darling, he could be the sound engineer of the theater or the Prime Minister himself" Said Zawe once they were inside the car "He still is crazy about you. What you have to do is take the leap, talk about it like adults, go to the bloody wedding and enjoy yourself without thinking of anyone else"

"And for once don't run away like a scared chicken when things get personal" Caroline said happy that she finally was able to acknowledge her feelings.

"Sure... why not? By the way I been meaning to tell you something..."

The conversation fade away in other topics, a few more relevant than others, but Y/N mind was far away in the past thinking of the last time she risked all for him and how tremendously wrong it all have turn out.

They had agree he will pick her up at her place, after the most demanding shift she ever had, she took a quick shower and put on a flowy dress, and her coat, and in an effort to look more decent a pair of earrings.

She was trying desperately to make her makeup work when an alarm went off in her phone, a reminder to make a call and before she could think it trough she was already listening the dial tone, praying for him to don't pick up.

"Hi there" his voice finally said when she was about to hang up "so glad to hear you. It's everything alright?"

"Completely, how about you? Did you change your job as you wanted?" She said, now trapped in the conversation.

"I did, and them I changed it again, that's why you should call people more than once a year, otherwise you never know the full story. What's new with you?"

"I start working part time at a theater, as a personal doctor for the manager" she said getting close to what she wanted to say to him.

"Oh that's great, have you met someone interesting there? Are you dating some gorgeous Shakespearean actor... actress??" He still knew her well enough to make things easy for her to talk about.

"I do, in fact I have a date... soon, it's that ok?" She said the last a bit doubtful, she didn't want to hurt him again.

"That's amazing Y/N" David said sincerely "And relax, is not me who you should be worried about, I want you to be happy, just don't go sabotaging things like you use to. I love you girl, but if I'm honest I think you chose to be miserable even when other people try their best to make you happy"

They talked for another couple minutes and when she finally said goodbye his words kept resonating in her mind, but he was wrong, it was not sabotaging, it was self preservation, like this stupid idea of a date. She was quite sure he was trying to make her feel less ashamed for her drunken advances on him, a nice dinner, some talking so she could go on with her life thinking "It simply didn't work, but he is such a nice man"

And she hated herself for ending up in such pathetic position, thinking of how much fun tom must have had watching her making a fool of herself. She was determined then to call off the date, make a graceful scape before she could embarrassing herself but before she could called him there was a ring at her door.

He was gorgeous of course, his beard as well maintained as always and his hair combed to de back of his head in beautiful waves that she wanted to touch since the first time she saw him. He was wearing a coat over a simple dark grey shirt and jeans.

He smiled fondly at her when he saw her, there were dark circles under her eyes and he thought they looked beautiful, something refreshing about a woman who worked that hard on something that she loved.

Y/N intrigued him, she seemed to live like a mature functioning adult, but there was a childish sparkle in her eyes when she started to talk that made him want to know more about her, but then that ever present hint of sadness always refraining her to talk to much, all of which made her the most interesting puzzle.

"Something in mind you would like to eat?" He asked once they were inside his car, with his tinted windows up, he liked driving alone, but he liked his privacy more and they have proven to be an effective solution.

"Not really, anywhere you pick will be fine" she said smiling and he drove to a nice restaurant, making small talk about work, their mutual friends and the weather.

Once they arrived the valet took his keys and gave her what he thought was a meaningful almost impertinent smile.

"I really need to apologize for my behavior" She started once their food was ordered and the waiter had served them two big glasses of wine "It was inappropriate for me to act like that. I am deeply sorry"

"Don't be, we were all a little drunk. But it was nice talking to you" they ate in silence, other than, what she felt, empty mutual compliments on each others carreras. Proving what she had fear since the night before. Until he finally spoke again "I've been meaning to ask you, did you enjoy the play?"

"Absolutely, Mister Cox and Miss Ashton are outstanding, and you obviously it's an incredible play, all things considered" she said taken aback by the question and cursing herself for the last part.

"What things considered?" He asked now genuinely intrigued.

"Oh I'm sorry, I misspoke, it's something stupid actually" she said nervously trying to avoid his gaze and failing.

"Come on, I'm a big boy, I can take some criticism" he lean back on his chair and open his arms, as if he waited for a punch, his eyes still fix on Y/N.

"Ok, but do notice this is coming from Y/N the feminist doctor who spend her free time protesting and not Y/N the fan of theater and literature." She said finally looking back at him decided "I think somehow it demonizes Emma's betrayal and eventual "punishment" while it glorifies the male ego of the two men. And also Robert Down is a prick"

He opened his mouth slightly surprised and then closed his lips in a thin line and let go a chuckle, with a mild blush crossing his face.

"Auch" He said finally, "Well it's and old play... and he amm of course is not a good person, I guess if you are not familiarized with Pinter's work you may have that kind of conclusion"

He had trouble finding his words to debate her, although he was impressed with her honesty, but since it was a sensible matter he wanted to be clear, however Y/N interpreted as him trying to dismiss her statement and change the subject, which put her one step closer to anger.

"You really are that nice aren't you?" She started, with her voice cold and sharp "And I don't mean it as a compliment, but you are right. I don't know Harold Pinter's work but I do know he is factually wrong, there's no deep intricate meaning behind betrayal, in the end is quite simple, people can't make the choice of remaining truthful either to themselves or the people who they love without being bitches about it. You like to shag around no strings attached fine do that don't complain is it doesn't feel like a home, you want a successful marriage fine forget about any other bloody temptation and be decent. But I guess in the end lies are what keeps people together. Once the truth is out, love dies and so the relationship" he was astonished, however the passion in her voice made him answered to her in a similar tone, changing completely the direction he had imagine for the evening.

"Don't be absurd, that would imply people need to systematically lie in order to keep their relationships, if anything the play is a critique on those precise actions, while normal people try to have loving relationships in honesty, even when sometimes is easier to say a lie. And there's a complete difference between lying to save your arse and conceal your dishonesty, and lying to be socially functional"

"So you never lie?" She asked now completely furious of what she felt was hypocrisy.

"Everybody lies, that's the point, there is a difference in being oblivious on other people's feelings imposing your wrong personal opinions and pretend that's some moral high honesty, and being polite enough to avoid subjects that may hurt others" He said now crossing her arms, pleased with her momentary silence until she start to look for something in her purse trying to hide the hurt in her face.

"Exactly" She said finally putting a couple £50 notes on the table and looking at him with anger in her eyes "Like asking stupid women out so they don't feel like total idiots for hitting on you while they were drunk? That kind of politeness?"

"What?" He said flabbergasted finally rising his voice "That's why you think I asked you out?"

"Oh don't patronize me!" She said also rising her voice and standing up "It must've been so funny, asking a girl who is obsessed with you on a date, what amazingly beautiful act of chivalry. You know what you are? You are an entitled selfish bastard, who gets off on the world worshiping him." She took her purse of the table and put her coat back on, and before leaving she add "And men can't be feminist, you would know that if you read a book on feminist theory instead the glorified misogynistic bastards you adore"

She quickly move away from the table leaving a perplex Tom behind, but before she could exit the restaurant he started following her, reaching her just a couple meters from the valet parking station next to the restauran small planters.

"Oh this is very mature of you" he called her "You owe me an explanation"

"I don't owe you shit" He was close enough so he catch her by her wrist.

"Or at least let me take you home" he said turning her around, she rise her other hand and he prepared his right cheek for what he anticipated will be a slap, but something caught her eye and instead and she took her hand to her ear and to his surprise she change her voice to a high pitch whining, causing him to let her go.

"Oh whe is it? Where did I leave it? It must have fallen here" she started looking for something in the planters and kneeling near the fence.

"Are you having a stroke?" He asked getting down to her level "what are you looking for?"

"There's a guy with a camera hiding behind a car two meters from you" she said rapidly in a whisper, she quickly put one of her earrings in his hand and said: "Follow my lead, don't look back. Stand up now"

He did as she told him and they stand up, he was still holding the earring in his hand when she took it smiling wide, and putting it back on, and then for his surprise hugging him.

"Smile, get back inside, go to the bar, order a drink and then come back and ask for your car" she said using the proximity to whisper in his ear.

"Why?" He asked and the breaking the contact.

"Just trust me" she said between her teeth and smiling again. He returned the smile and nodded, going back in completely clueless of what was happening, in inside corner of his eye he could see the man with the camera.

He order a glass of wine, but he barely even touch it, the ten minutes he waited felt like eternity and finally he exited the place again. He give the ticket to the valet. The young man went for it immediately and he couldn't help to feel observed. When his car finally arrived and he tried to tip him the guy simply said "it's taken care of, drive safe" He nodded and get in his car not surprised to see Y/N already in the passenger seat.

He drove off and once they were a couple blocks away they looked at each other, and before anyone could talk they started laughing hysterically but it also felt cathartic.

"Care to explain what happened love?" He asked now back to his normal tone "Did you break into my car?"

"Of course not, Philip amm... the valet guy, he works half time as a medical assistant in my hospital. A couple weeks ago he told me that sometimes the waiters of that restaurant call the papers to get scoops on celebrities, and I assumed you didn't want my stupid tantrum in the first page tomorrow"

"Well no, but at least I'm glad you admit it was a tantrum. Can I know what happened?"

"Oh, the guy with the camera come asking me why you were chasing after me, I told him I made a scene in the restaurant because I couldn't find my late grandmother earrings and this handsome" She said exaggerating an innocent voice "who I didn't catch his name, help me found it, then I texted Philip to let me get inside your car, because I supposed he will be waiting for you to come out"

"That's amazing and clever" he said genuinely impressed by her story "But I meant at the restaurant"

"Oh... I had a terrible day, and I leashed out on you" she said turning red. "I am really sorry, you are not an entitled bastard, and everything I said... it was just out of place. I completely respect your acting, and I shouldn't have expressed myself that way" she apologized for all the things she have said without him interrupting her while he drive back to her place.

"Don't worry about it" he said finally smiling at Y/N again with the most candid smile he had given her yet "I'm sure other people have called me worst, just not to my face, and I do appreciate your honesty. Just one thing." He said parking the car at her door. "That's not why I asked out, and I apologize because I didn't make my intentions clear in the beginning. Nevertheless this was a fun experience"

"Said that again" she said without thinking.

"This was really fun I actually enjoyed your company..."

"No, that word 'nevertheless' sounds way more powerful when you say it."

"Nevertheless?" He said getting out of the car.

"Yeah, I actually have a tattoo that says nevertheless she persisted" she started playing with her keys in her doorway, looking pleased by the interest he show on that detail.

"You do go out protesting huh?" He said taking one step closer.

"I do, and I'm really sorry again" she said looking away and finally putting the keys in the lock.

"And again it's nothing really, so now... am I'll guess..."

"I'll see you around" she said, he kissed her on the cheek and she entered her flat, wishing to forget everything about that day.

By the time she was back at the theater next day, she was hoping to leave all behind, but everyone seemed to be obsessed with Tom's random act of kindness to a stranger that thank goodness the camera hadn't focused well.

She chose to hide inside her office the rest of the night until by the time she assumed everyone will be leaving someone knocked on her door, she opened thinking Caroline may be needing something, but she was surprised when she saw Tom standing there.

"Today it's my birthday, and we are going to celebrate, would you like to come by? I can't help to remind how you called Charlie and Zawe mister and miss, and I think they would like you" he said passing his fingers trough his hair distractedly.

"I know, yeah I would love too" She said immediately "But first, please come in, I... um... I actually got you something, it's a birthday present and also a peace offering for the way I acted yesterday" She went to her desk with him following behind her. She took something from the drawer "You are an amazing Robert, and I know you like to research your characters, I mean you probably have read this already but I thought you might like it" she give him a neatly wrapped brown package with a nice blue ribbon on top.

He opened unceremoniously with a child like expressions, touched by her gesture. And he opened his mouth in excitement and disbelief when he saw the book inside.

"It's perfect actually" he said already carefully opening the book "This is too much, thank you"

"Your welcome" she took her purse and stand up ready to leave. "So where are we going?"

"Right right" He said standing up too. "You are gonna love this guys".

That had been the end of their would be romance and also the beginning of their friendship, but while Y/N tried on one of the multiple dresses Zewe had chosen for her the idea of trying again started to look less and less crazy, her plan was already in motion, she only hoped now that he would feel the same, and even more important than that, she prayed she wouldn't loose him in case he didn't.

so i woke up this morning (so apologies if i sound a bit off or groggy in this haha) but i awoke to a lot of posts discussing about “drama” and speciffically first saw @turquoisemagpie​ ‘s geniuinely curious post about the community’s status.

i’ll start off by saying 1) im also genuinely curious about all this. i care about this community and ive been in the tumblr one specifically for 4 years now, and this seems to be the first anomaly ive seen in my time here that hasn’t been one off but “underlying”.

2) im human, lol. i’ll be honest, ive never gotten involved with stuff like this (the only one i think would barely count was when the community was debating over anti’s portrayal back in december 2017). this is just what i think in as objective and analytical of a way i can place it, and it’s not wrong nor right. just my own thoughts. (also note, i have two exams tomorrow, so i  probs wont be on here afterwards anyway cos i need to study else i die lol, but i just wanted to chime in like anyone else would)

ok first point- the drama is not shallow enough to solely revolved around the intro outro changing.

it is not the issue itself; rather it is the situation, or window that is giving us a bigger picture in the new, wierd mood that the community has been in for a while. 

im human, but personally, in the large amount of time ive spent everyday scrolling thru the tag i have not legitamentely seen a post saying “oh i dont like that jack isnt doing the intro anymore im unsubscribing.” it doesnt seem logical to me that someone who dedicates themselves enough to the channel that they are a active member of the tumbtlr community, to throw all that away just for an intro.

what i have seen instead are 2 things:

1) usually when i scroll thru the tag and see a current hot topic, i try to scroll back up til i find the post that probably originally started it all. this, along with the first type ive seen in the tag, are people saying that “some people are unsubscribing cos of outro...how can they do that..they have to understand change is normal...people act like children sometimes...i cant believe it those people are not part of the community they should just leave...etc

2)the people i have seen saying “ah man i miss the intro and outro....i miss them it feels a little weird without them...i hope they dont go away forever i’d miss it”..etc

number 2 does not match with the people number 1 are talking about. unless i am wrong (i am human so if you have actually seen this on tumblr send me a link to the person’s blog or post) the people missing the outros have never said they would leave the community. Simply expressing a sentiment for something that has always been the norm that is now changing, that’s all it is for most people.

BUT, the misunderstanding/missalignment i see between 1 and 2, is that people in 2 is either being generalized/misslabeled/or lumped by others as the “leaving the community” group. and this can even apply to number 1, where some who genuine simplly want to say “the outro might be gone, but it’s ok to change” are grouped into the others saying “leave the community you kids dont belong here” and this is the window into the main problem i think in the community.

jack is changing. this is the happiest ive seen him be in 4 years and you have no idea how happy i am for him that he is choosing to take care of himself more and finding/discovering what he truly wants for himself, his style of commentary, the channel, and the community. 

No one wants to get in the way of that. not 1, not 2, no one here wants to legit do that because we all so so deeply care about him. he brought us so much happiness, friendships, friggin several couples proposed in front of him over the years cause he indirectly helped them find love. we care about jack so much, that as a community we’re trying our best to give him the best atmosphere to change. but it’s a big community, so of course people have different ways of doing so.

we love him fiercely, so we either protect fiercely or we speak up fiercely. and then the whole tag is on fire. you’re on fire. you try pouring comforting pics on it oh no that was gasoline help-

people want to help jack and the channel/community through feedback; if something is felt to be wrong by a person, they’d want to let the captain know that something’s amiss and how/why it is and if they can fix it.

people want to help jack and the channel/community by protecting/managing it; if we dont want to sink the ship, we have to keep up and remember the duties as a member what we should be doing so that if we see a hurricane coming, we can deal with it the best without getting the ship damaged.

both are good, you can’t have one without the other. without proper management the ship will sink, but if there’s a solution outside of protocol it should be considered. if the new idea/solution/feedback is faulty enough that it would put us at even greater peril, the rules serve as a guide of judgement in doing what’s best for the ship.

no one side is right on its own. if there’s no way of feedback or communication to the captain, or anarchy is assumed among the members and the captain is overthrown, the ship will sink.

cooperation is key. nothing is black and white, its gray and our relationship with jack is a conversation. 

agree or disagree, we need to not dismiss one in favor of ourself, we need to listen, be open, and use other’s ideas (whether good or bad, evil or rightous, selfish or selfless, or just plain neutral) in forming our own and vice versa, creating a cycle of healthy conversation rather than attacking or defending blindly. 

and as well, the captain has had years of hard work, dedication, knowledge, and experience to get to his position. and ultimately it is Jack who is the one to decide how to run this ship. there can be members whose feedback is unjustified, or even hate-filled. there can be members who feel a one particular way is the right one over all else . but Jack is the one who chooses what to take into himself and the channel. does he think this feedback is valid? he’s open to taking it into consideration. does he disagree with it? that’s ok too, he still decides what he’ll take from it, good or bad, and move on.

experiencing things, toxic or healthy, we as individuals have the power to choose what to take in, not take in, and how we proceed with the information we take in. the actions of others have no rule over you, you rule over yourself. you choose what to take in and how. if we restrain ourselves/others, or protect ourselves/others, from this, then that right to choose is taken away before we even get a chance to choose. we just become isolated and very very, very alone.

just gonna rant about my health issues to no one in particular for a bit under the cut sooo

im just so fucking tired of being sick all the time like. its been almost 2 years now of actively Going To Doctors And Having Tests Done And Trying To Get A Diagnosis and fucking!!! nothing works!!! and i only have until the end of this coming school year to get it figured out before my insurance runs out otherwise im just fucked!!! because im sure as hell not gonna be able to afford a fucking mri every six months making 10 bucks an hour at some retail shithole but so far ive seen SIX different fucking doctors (not counting 2 ER visits) because they all just keep shuffling me back and forth like “idk maybe have someone else deal with this? weird lol” or like “have you considered that maybe you might have anxiety :) you seem stressed :)” 

like yeah its a fucking stressful situation getting progressively fucking sicker for two goddamn years wasting thousands of dollars and reaching the end of a fucking ticking clock because almost every doctor ive seen is an incompetent jackass who does NOTHING but waste my time and money and then fucking condescend to me about anxiety like!!! yeah i probably DO have anxiety and depression and autism and what the fuck ever else but this isnt THAT 

and the literal ONE TIME i had ANY treatment that worked AT ALL helping with my eye spasms (literally One of Many Symptoms that i deal with on a fucking daily basis that still manages to completely fuck up my life) is something i cant take anymore because it damaged my fucking eyes!!! possibly permanently!!! i already HAD issues wtih light sensitivity that this medicine made WAYYY fucking worse and guess whats one of the WORST things at setting off my eye spasms??? anything to do with fucking light so YEAH thANKS for that @ the opthalmologist who had me take those damn eye drops for two months straight, which other neuro opthalmologist said was bullshit when i saw her again, not that im letting HER off the hook either since she REFERRED me to that incompetent bitch in the first place and then had NO solution other than “hm well you definitely shouldnt take that medicine again, but theres literally No Other Treatment, maybe blow another $400 in a few months to come see me again so i can continue to Not Help You In Any Way”

and its getting wORSE ALL THE TIME!!! and the best thing doctors can think of is “hm well maybe wait a bit to see if it gets worse? and maybe then we’ll know what it is?” well its getting worse!!!! but they still dont seem to know what it is!!! like at first it was just my vision going out of focus for a few seconds at a time, then it was a few minutes, then i was having visual distortion (or maybe hallucinations? who knows! certainly not any of the fucking doctors ive seen!), then awful fucking eye strain headaches, then spasms in my neck, then my jaw, then my arms, then my legs, now all fucking over, and now i get sick and dizzy just by moving my HEAD too far or too suddenly and like at work earlier today i was just stumbling around for two hours bc there was too much pressure in my head and everything felt tilted and i was just grabbing at every surface trying not to fall with my head like on my shoulder bc keeping my neck straight was too fucking hard and i swear to fuckign god a couple nights ago there was this weird buzzing on the side of my face??? and like it felt like my mouth was moving slower than it should??? but i dont even KNOW if thats a Real SymptomTM or if i was just freaked out and tired and imagining things or if i really am just getting to be a paranoid delusional nutcase about my health because every little thing terrifies me at this point, like ive been coughing for a couple weeks and instead of being like “oh its a bad cold” im like “maybe now my immune systems fucked up too maybe this is A New Symptom” i literally cant tell anymore i have no fucking idea 

and i dont WANT to think about all this All The Fucking Time but i do!!!!! i literally HAVE to bc it affects my life in every fucking possible way and i cant escape it like even rn the light from the fuckign computer is hurting my eyes and i cant even see what im typing half the time bc my eyes keep going out of focus and my teeth keep chattering and my head hurts or ill go to get a drink of water but then just Stand there for a few minutes bc i dont trust myself to hold a cup full of water and not spill it bc im having spasms or ill have to wear sunglasses at the dinner table bc my fucking idiot asshole dad got the BRIGHTEST possible lightbulbs for the dining room and i physically cant stand them 

or like im already dreading having to explain all this shit to my professors this semester about how like “oh so i probably wont be able to keep up with daily readings, especialyl not if theyre on physical paper and i cant scale up the text because my eyes just spontaneously stop working and i cant read..... and ill need a computer to take notes, i can Usually hold a pencil but one time i had a spasm in class and flung it across the room and it was super embarrassing and i ltierally skipped that class for weeks because of it so id really rather not deal with that again.... and even though im a fuckign AMAZING public speaker like, state champion debate level public speaking, ill still probably get super fucking nervous and suck at any kind of in class presentation bc ill just be thinking about my spasms the whole time and wont be able to focus....... and ill have to wear sunglasses all the time too so hopefully thats not an issue........ and also ill probably miss a lot of class bc whether or not i can handle walking half a mile Varies Wildly from day to day and also i have a lot of doctors appointments and sometimes im on medicine that completely ruins my sleep schedule so you know... looking forward to a great semester, hope i dont completely fail your class” 

and i have fuckign work tomorrow where ill have to deal with trying to pretend like even the most minor tasks arent painful and difficult and deal with awful btichy entitled customers complaining that im not SMILEY enough for you like the motherfucker who asked me how i was and i said fine and he was like “jUuUUuuuST fINE” like shut the everlasting FUCK UP with that ive met my obligation leave me ALONE my day isnt FINE im in awful pain and i HATE you and everyone like you or ill have to deal with my coworkers giving me weird looks while im having spasms or outright MOCKING me for them like the asshole that called me TWITCH (and a whore, but thats Another Fucking Story) or just not knowing how to deal and making bad taste jokes like when my teeth are chattering bc I Physically Cant Make It Stop like “haha are you chewing an invisible piece of gum lol” like no bitch im a neurological nightmare and my brain doesnt work and im Barely Holding Together would you PLEASE shut the fuck up 

and most of the time i just feel like everyone thinks im a fucking freak like even just sitting in the waiting room to see the neurologist or opthalmologist or whatever and everyone else there is Old and im the only person even remotely close to my age there and even the doctors dont seem to take me that seriously bc of it like “oh shes young, cant be that bad, all these old people out here are gonna die like tomorrow so why worry about this girl, its probably just anxiety from being on her period or having a test to study for lol” like straight up when the movement disorder neurologist was examining me she was like “im not used to seeing anyone this young or healthy’ and i know she meant it relatively speaking but like!!! clearly im NOT healthy or i wouldnt BE here like obviously something is wrong with me and its ruining my life and its serious and id like it fixed thanks!!!!! 

and i feel like No One Gets It like, obviously there are people wayyyy sicker than i am who suffer a lot more or people in similar situations but like. i dont Personally Know someone like that i can just talk to and like, of course i have friends who can Listen but.................................. theres a difference from being able to listen and being able to actually Understand and sometimes you just cant Get It unless youve gone through it like i really dont think ANYONE in my life has any idea how serious this is or how much it affects me and i know i cant expect everyone to just Always Think Of My IssuesTM but little things!!! like maybe NOT having the brighest possible lightbulbs in the dining room!!!! my brother NOT having his birthday party at dave and busters, which i had TONS of spasms at last time i went (and im even worse now!) AND the staff gave me shit about wearing sunglasses so now im nervous about That too or just! idk! people respecting and listening to me when i tell them that i Cant Do Something or that Doing That Thing Hurts and not just brushing me off or telling me im overreacting and then getting all shocked pikachu face when their dumbassery actually physically HURTS me and i get pissed with them for it!!!!

i dont think anyone gets how much it scares me all the time or how its Always on my mind and i literally cant think about anything else like. this could be the rest of my life. this could end my life. i dont know what i have. i might get diagnosed in the next month and have it completely cured, i might get a diagnosis and still be sick forever, i might not find out until its too late and i have LITERALLY NO FUCKING IDEA WHICH ONE!!!! What I mean when I say Ex-Gay

Over the 2015/16 festive period I had two epiphanies: (i) I wasn’t gay and (ii) there is a God.

There was a gap of around a month between the two. During that month, I unpicked my former identity, and I realised that I had been had: the concept of homosexual identity is lie, and the way that the lie is maintained is incredibly complex and damaging. At first, I wondered how I could become a secular voice who could help people see what I had seen, but God had other plans. In a few short weeks he had saved me for Himself, and now I knew that my message would be so outrageous there was no chance of being listened to. I knew what I was like before, and there was no way I would have listened… or maybe I would have listened a little bit, secretly. I might therefore have read on, if just to be outraged.

Having crossed the boundaries between the two worlds, I realised there is a problem to which there are four parts:

(i)            LGBT people do not understand Christianity

(ii)           Christians do not understand LGBT people

(iii)         LGBT people do not understand themselves

(iv)          Christians do not understand Christianity

So, as far debate and dialogue between LGBT people and Christians are concerned, things were never going to go well. As someone who has now experienced both, this blog sets out to address that a bit.

First, to state what I do not support. A couple of weeks back, there was an episode ofRupaul’s Drag Race (which I find fascinating) where one of the competitors broke down crying as he described his Christian parents subjecting him to an exorcism to rid him of a gay demon. That is spiritual abuse. No one can change for the sake of someone else. We each have a cross to bear, and it is our choice in how to bear it. It must be acknowledged that once a child is an adult, then they are on their own journey. Whilst love and guidance remain essential, that guidance must not be authoritarian (in fact authoritarian parenting may have been part of the problem in the first place). It goes without saying that verbal, physical, spiritual and emotional abuse (including shunning) play no part at all. I will write about parenting fully, later on.

However, there are a number of videos doing the rounds on YouTube, where people speak of amazing hole-on-one spiritual experiences where some charismatic preacher lays their hands on them, and they receive the holy spirit and “over-come” their sexuality all the same moment. If that is true, that’s great for them, I suppose, but it lies well beyond the bounds of realism for most. Maybe there is a leap of faith so profound that these people do just change their sexuality through belief, but as Rosario Champagne Butterfield, a Christian writer who also came through homosexuality, says, expecting it to happen is really prosperity gospel territory (the heretical and blatantly untrue belief that becoming a Christian is going to make you well, and bring financial prosperity because God knows you deserve it). What if these individuals discover that still struggle with same-sex desire? Who will they talk to about it? What if they don’t talk about it, and then act on it secretly? Either way, I am afraid to say that the euphoria of discovering God wears off overtime. You discover that you still do get ill, you still make terrible mistakes, your loved ones still die unsaved and you do still experience same-sex desire after all. Relying on Him and trusting Him can become harder. God doesn’t remove us from Earthly reality, he shows us what it truly is and if we understand what He is seeking in us, rather than us just expecting things of Him, He will help us to bear its challenges. That is why the prosperity gospel is absolute pap. There needs to be more credible and accessible explanations and courses of action, for the sake of everybody including charismatics.

It seems to be me, that most LGBT people who come to faith in Jesus, certainly within the UK evangelical culture in which I exist, still talk about experiencing same-sex attraction and choose to be celibate (Those who say that they are following Jesus and actively pursuing an LGBT lifestyle at that same time, aren’t Christians and I am not going to discuss that particular issue here). So, we have the two basic Christian views that seem to float around in culture and imagination:

I)              Over-the-top, all encompassing, instantaneous, spiritual theatrics/histrionics

II)            Celibacy

Celibacy is problematic though as it just says, “This is me and don’t ask question.” Although the way of dealing with it is different, this is basically the same thing as that that mainstream LGBT community says, often with extreme defensiveness, and there is a big reason for that. The thing that LGBT people fear above all other things is self-knowledge.

Self-knowledge is terrifying, because through self-knowledge an LGBT person will see that the person who is hurting them, the person who is humiliating them, who is filling their body with drink and drugs at the weekend (if they are that way inclined), who is causing their mental anxiety, who is generating these feelings of exclusion and who is preventing them from taking their role in God’s created order, is themselves. The sinful world has told them a lie about themselves, and they have believed it. They have not only believed it, they have run with it and through forging community with other LGBT people they have created a self-perpetuating social force that tells them that change is impossible, and any attempt to change is extremely damaging or laughable.

As these communities have sucked men and women in to them, grown ever larger and gained influence, they have taken it upon themselves to proclaim all science and psychology that suggest that homosexual or trans identity is even remotely changeable, linked to other mental health/personality disorders or liable to damage the individual further, have been irrefutably debunked. But they haven’t. My own lived experience show there is profound truths in much of the psychological writings of the pre-“liberation” era that have been excluded from contemporary discourse with such vehemence, it is almost impossible to access them, let alone hear them be discussed with any seriousness. There has been such a force of will and pressure from the LGBT community that they have managed to suppress the thought that these theories could have any truth in them at all. That is because discovering the truth in them is terrifying as it shows them that they are far less in control of their own bodies and minds than they think they are. This terror is as real for Christian LGBT people and those within the mainstream.

We can see this process happening just now with the gender-neutral debate. Previously, no one believed this thing existed as anything other than attention seeking linked in with certain pathologies, but slowly the debate is being crushed. Maintaining the idea that there even is a debate to be had, is portrayed as morally abhorrent. People become afraid to speak out. This is “not even up for debate” stance inevitably seeps in and affects the Christian world just as much as mainstream culture. Hence, I am not satisfied with the celibacy answer, because I think those who pursue it remain within the lie when greater and deeper recognition of your God-created reality is possible. And if full change proves elusive, at least there can come a greater ability to understand same-sex desire/LGBT-identity better and struggle with it less. To all intents and purposes, I am still celibate, and I don’t see that changing in the near future. But it’s not because I am resisting same-sex attraction, but because I am still beset with emotional issues from the past and I don’t feel able to cope with a relationship with a woman (again I will discuss this further later on). But more importantly I am saved, and I am not living within a lie that places a barrier between me and the true nature of reality anymore. In some ways, it is exactly like The Matrix. The world Neo wakes up can seem one hell of a lot harder to deal with than existing within the Matrix, but it is real, and that is profoundly more meaningful that living within the safe confines of a lie. And in reality, the lie is not safe at all. It cleverly disguises it dangers. Addiction issues, mental health issues, suicide, domestic violence, loneliness, anxiety, sexual promiscuity and narcissism are all far more prevalent in LGBT people than they are in the non-LGBT population. Their unacknowledged realties are screaming out against the lie that is being forced on to them, and this is without even going into the more metaphysical realms of damnation and exclusion from God’s Eternal Kingdom that lie will breed in time.

Christian celibacy is better, but it is not yet forceful enough to bring about the culture change that needs to happen. Ed Shaw has written a book called The Plausibility Problem, in which he discusses the problem of presenting celibacy as a plausible lifestyle choice for LGBT people as they seek Jesus. I think it is a huge problem, and it will always remain a minority choice. I think there is a more radical solution that even the church is now too afraid of. God create man and woman to be together. LGBT-identity is a lie, and we need to stop contributing to that lie. We need to undo it. Same-sex attraction is an issue deeply related to LGBT-identity, but it is also separate as it can exist independent of the LGBT-identity. Likewise, same-sex attraction is a lie. It is not part of God’s created order.  We need to undo that too, rather than preach repression. The solution to both lie in language and how people and feelings are described. This process of re-description is deeply disturbing, often very upsetting and above all, terrifying. The road down which I have travelled in the few years has often been hard to bare; and I have found myself gasping with desperation “but who am I then?” To endure such mental turmoil and chaos, the individual must have security in something larger than themselves. Therefore, whilst I believe that coming to faith and overcoming LGBT-identity/same-sex desire are separate things that require separate processes, I doubt that the latter transformation is possible without a total reliance and trust in the peace, love and purpose that God has provided for us.

God and the goodness of his created order are the medicine, but Pinocchio is right, they do seem more terrifying than the illness, even when the illness promises death. That is especially the case when that illness is sin of our own making. So, my last word is this; do not be afraid of the medicine. Although it may seem bitter thing to swallow at first, it is very good indeed.

Schaper yields that there is debate around just how efficient the therapy in fact is, yet insisted it is science-based and stated her clients have actually reported advantages. "We go by the success tales we've seen in our clients that have received regular treatment," she said. "I do not negate there are individuals who claim it doesn't work. I just do not believe it's traditional understanding. Anytime there's anything new, you're always going to have individuals asking you to confirm it functions."

Having tried the treatment, albeit when, I can't personally back Schaper's claim. I additionally do not struggle with persistent pain. However, I have pals as well as associates that in the past ritualistically visited their closest nutrient drip clinic after evenings of moderate to hefty drinking. So I fell off the wagon, didnt remember to write about my weekend. I've decided to put a reminder on my phone to do my entries into my new "journal", life journey. Because, it only dawned on me this morning how much I need this to work, and more importantly work effectively.

My subconscious, coinciding with my body lets me know when something is wrong, I've come to realize. I was irritable all day today; sweaty palms and just a general uneasiness and unfocused throughout. Throughout the day, my primary thoughts was my if its a gd idea to have my therapy/counselling ever restarting is something I'd like to do, how's my baby sister ( who's actually 17 years old ) and my mother getting into it, this threesome idea my boyfriend is pushing and my closest friends Kenlyn, Keane and Jerry, and, ofc my severed relationship with people who used to be dearest to my person, my twin sister Alisha and Yokell, who used to be one of my BEST FRIENDS and maybe even an unproclaimed lover a few years back. Ive also been thinking about doing a nude photoshoot, oh, and of course this peculiar and honestly totally unnecessary "relationship", or lack thereof, with a girl by the name of........ We'd just call her Kay. These ideas seemed to plague me of recent days for you obvious reasons.

Therapy/counselling and I have a "comme ce comme ca" type of relationship. For those of you who may read this and isn't aware of what that means, it means "so so" in French. I've never seen the used for it as I was under the impression it was unneeded and counterproductive. I also have a lot of bad connotations and memories related to such. Personally, I've looked at it from all angles and as much as I think because I'm now, finally, open to it it may work, however the universe is trying to tell me something; every time I've scheduled an appointment for the past month something goes wrong, usually with my therapist and/or her family, and we have to reschedule. Since the month began I haven't been to session, however, I was doing peer counselling with some old friends for two months prior to moving into a more personal setting and I must say, it did help. I don't know if its the fact that I was speaking to a friend or someone I looked up to that took the pressure off my thoughts and opinions, or if it just felt like I could finally find genuine Guidance and objectiveness but I did open up a bit, mostly about my relationship with my boyfriend, which was falling apart at the time and about my relationship with my mother. Until those session, I wasn't aware that my relationship with my mother and my boyfriend became synonymous. My first thoughts about restarting is what about journalling my thoughts and experiences and I have, maybe, 2 session a month OR maybe I should just continue peer conselling maybe now, with my actual best friends and not persue personal counselling at all. Having two session a month may be best in my opinion as I would have already thought things through and I'd have another party to either validate my thoughts or show me where my thought pattern may be unhealthy and wrong. Someone who would allow me the space I need to feel and think through issues without the pressure of immediately finding a solution, which was a large issue my boyfriend and I had until recent. I truly feel like I'm at a place where in capable of dealing with my issues mostly in my own, with the help of someone to help navigate my thoughts and feelings until I'm capable of doing both on my own, if the day would ever come.

My mother and baby sister have had a pretty wishy washy, mostly the latter, for as far as I could remember. She was never "a favourite" of my mother's, they rarely ever agreed on the same things and their attitudes towards each other is, and always has been truly disgusting. However, as of recent years, its truly gotten worse, which I never thought would happen because of primarily two reasons, my mother is an adulterous whore and she doesnt pay much, if any attention to Azariah at all. Let me first say, my mother, according to many therapists and research of done via the internet and her mental medical history, has a personality disorder. Which one or two or more, is up for debate. Personally, I believe she may have split personalities with acute bipolarism and she may even be schizophrenic. So, truly, I've come to realize,many times, her actions and what she says isn't her own fault. My mother has struggled with relationships since her and my father got divorced and has since self sabotaged many if not all of her relationships since then. And this relationship, she has had with my "stepfather" for the past 8-10 years have been no different. She's cheated on him with multiple men, and she hasn't been able to ever trust him fully since they've been together. Their relationship falling apart wasn't entirely her fault, as he was always absent, and dismissive. They've recently called it quits and since then our family has basically fallen apart. I, however, am grateful for this as it has caused my biological father and I to become closer and maybe even mend a bit of our issues and my mother and I have also reconciled our broken relationship. Azariah hasn't been able to do this with either of our parents, she hasnt entirely emotionally developed over the years and truly isn't capable of reconciliation due to this. This also serves as the reason why she hasn't been able to forgive my mother for her failed relationship with our "stepfather", whom, if I didnt mentioned, she's very fond of and quite literally refers and thinks of him as our one ans only father figure. She's extremely attached to him and has taken his side in the breakup, being even more volatile to mom. Because of this, she now lives with my twin sister Alisha, who eeveryone knows is a bad influence on her. We were trying to get her to live with me but because of my "alliance" with my parents she's being resistant which is making this process of custody a lot harder and emotionally draining on myself. Everything is extremely hazy with everyone's relationships within out strange family as of recent apart from my relationships with everyone, with the exception of Alisha and my "stepfather". I have generally good relationships with everyone, communication wise anyway. Maybe its best if they don't speak to each other in depth until she's healed herself from the many years of neglect and miscommunication with mom because its proving to be toxic, their conversations that is, as of now.

This threesome. God help me. My boyfriend has been pushing this as of recent, for the second time. Maybe its because we're "okay"/ "better" now that he thinks its okay to bring this back up again but I'm not ready for this yet. Right now, I'm just healing, or trying to anyway, from the hurt of the past few months between him and I, also, from the rest of my life with my parents. I've put everything and everyone's wants and needs before my own and thanks to him and counseling I've realized I need to put my needs first for a while to be the best version of myself I can be. I feel dismissed by him bringing this up again, it just feels very selfish for him to do this at this point. I should mention, him and I are in an open relationship so I'm sure the next thing I say would come as a shock to you all now, but my thoughts are, if he wants a threesome so badly, he could rounds up some other bitches and leave me out until I'm ready to move forward with this idea. Granted, I did entertain this idea previously because I did want to please him and at that point I felt like it was the only way I could think of but I'm thinking of me now and that's not gd for me at this point. I'd never stop him from doing what he truly desires so I understand if he chooses to move forward with it but at thus point, I'm not open to this idea until I've healed from the emotional and psychological abuse of the past few months with him.

Truly, one of the greatest joys in my life are my amazing friends who've stood with me since we've formed these unions. There's honestly not much I could say on this other than. I love them and I truly do need to be better people and friends to/for them. Especially Keane, my truest companion. I truly would more than likely be anorexic and maybe even insane without him. I owe him EVERYTHING I am and have. Not to discredit ANYTHING my boyfriend has done for me, because without him I'd also be much worse, psychologically weak being the main thing. My boyfriend has done everything I could ask, and more of any partner I've ever had and I'll more than like continue to live my life trying to repay him in anyway I can, which is, as I've realized extremely unhealthy thinking, which is why we ended up with so many issues in the first place. He is truly the most extraordinary person in my life without a doubt but he/we have our kinks as any other couple does. My friends deserve nothing less than the best, regardless of if thats me or someone else and I truly hope that if its not me they go out and find it regardless of if it hurts me or not. And that also goes for my boyfriend.

Alisha and Yokell. I'd be lying if I said I didn't miss them as much as I love them. Alisha, my twin sister, and I haven't seen eye to eye or even been friends for about 5 years now. She's had two children and is only 19 and I haven't been able to accept this of her to this day, which, more than likely, is half of the anger I have towards her. She was in an abusive relationship for about 4 out of the 5 years her and I have had issues. In my opinion, she's a younger version of my mother, minus the adulterous whore part. Ive made my peace with our relationship never reconciling and even the fact that she may never be grateful to me for all I've done for her growing up. I've extended my hand to her on numerous occasions to fix things but I do think its for the best that we don't have a relationship. Its only going to be filled with animosity. Yokell on the other hand, my unproclaimed lover, as I've mentioned him prior, don't have a relationship anymore due to the fact that he was/is madly in love with me and I'm in love with someone else, my boyfriend who's a friend of his for years prior to my knowing either of them. The issue at hand is ever since he essentially asked me to choose between him and my boyfriend he's been terrible depressed, according to popular belief of course, and is terribly reclusive. I've been struggling to accept that thus is no fault of mine but I do believe I am responsible. Maybe if I'd told him I had feelings for him when I first discovered them things would be better, maybe if we actually had a conversation about everything or even just try to figure what is neat for us both we wouldn't be here. I truly believe I neglected him and the entire situation as I never really reached out to him past that "ultimatum" he gave me out of respect for my current romantic relationship. I've been trying to figure out if I should try to be a better/bigger presence in his life but there truly is nothing I can do really other than be in skl more often or message more and hope he responds. Unfortunately I don't know if I'm even prepared to do this at this particular point in my life.

I honestly wasn't happy with myself or my body until I started modeling, hence the thought of a nude shoot being considered. A final step to acceptance of myself in every flaw and imperfection I may have. I've already ran the idea by my boyfriend, who has yet to respond, and I'm ready for this to happen but I won't do it if he's uncomfortable but I do truly want to do this. This isn't only for my exterior but for my mental and psychological health. I've grown tremendously over the past few years and I'm proud of where I am. I'm in the right environment to go only up from here in every aspect of my life and I'm proud of myself.

My boyfriend had this odd encounter with Kay a few months into our relationship in that she was throwing her at at him and when he was about to act on it she pulled out and freaked out because not only did she have a boyfriend but she saw me as a friend. Ever since then she's totally avoided me until, I'm guessing, she made peace with it with her partner and herself, and has yet been being excessively "buddy buddy" with me as if nothing happened. I truly am not upset the situation itself,between her and my boyfriend, however, you CANNOT play me like that. LEAVE ME OUT OF THE SITUATION. DO NOT TRY TO BE FRIENDS WITH ME AFTER YOU WERE BEING FRAUDULENT. Anyway, I've been battling with myself and my boyfriend as to if I should "make and issue" of it or not. I'm truly fed up of her constantly trying to push a friendship with me. Its getting old and I'm losing my cool. I'd rather she just leave me alone and pass me like a bus but she isn't facilitating this and all I'm left with is being abrasive and rude towards her. I wished someone would just speak to her before I do because it would be nasty. I've thought maybe I'm over reacting, which I possibly am, but, I'm at my wits end and I'm truly not too sure how much longer I can keep this up.

In conclusion, I've realized based on today I've become much better dealing with my anxiety as I didn't reach for my anti anxiety meds during the day. However I did find another way to deal with these issues, I surrounded myself with friends and activities throughout the day, especially after work. I went to a football game, I had a friend over with my room mates of course, always showering me with affection and we played cards and watched movies until really late. I couldn't sleep well however, which is something I need to work on

My weekly roundup of these I am doing and looking at. Topics include the Biden energy plan, current vs. advanced nuclear, the construction industry, population trends, pesticides, and agglomeration.

The Biden Energy Plan

This week the Biden campaign put out an energy/climate plan. I won’t try to do a comprehensive rundown, but here are a few of my thoughts.

The core of the plan is $2 trillion of spending on clean energy infrastructure: renewable energy, electric vehicles, transit, housing, and building energy efficiency. I don’t find any of this to be objectionable, though it can be hard to forecast how cost effective spending approaches will be.

There is nothing on carbon pricing. I regard carbon pricing as essential to any credible decarbonization plan. With carbon pricing we know how cost effective decarbonization will be because cost-effectiveness is set.

The plan calls for $400B on R&D (that’s about two and a half Apollo Programs in modern dollar figures), with a wide range of areas including advanced nuclear, carbon capture, novel grid storage, electrofuels, and other areas. I consider R&D investment to be the other essential component to a credible decarbonization plan. This aspect of the Biden plan looks very good. The advanced nuclear concept has sparked some debate (see the next item). My friend Dan Rejto gives mixed reviews for the food and agriculture aspects of the plan. He notes some positive elements on the R&D side but the lack of funding for alternative proteins is a major omission.

There is lots and lots of emphasis on union jobs. I’m not really a big union enthusiast and wonder how this impacts the overall cost for a given result. There’s some rhetoric on trade that sounds vaguely protectionist.

The environmental justice section emphasizes enforcement of pollution laws, which sounds good, and “a goal that disadvantaged communities receive 40% of overall benefits of spending in the areas of clean energy and energy efficiency deployment”. I get nervous when EJ becomes a vehicle for passing out goodies. I see this all the time in local planning and the process can quickly devolve into a patronage system.

There’s no nonsense on curbing population, redefining GDP, or other such things. I didn’t expect there would be, but it is still a relief.

There’s nothing about NEPA reform or other regulatory reforms. There really needs to be when considering disbursing such large sums of money. Decarbonizing the power sector by 2035--at most 14 years after the plan could be become a legislative reality--will be difficult under ideal circumstances and impossible if we can’t build high voltage transmission, power plants, and other necessary infrastructure in a timely manner.

I think the plan is very smart politically. It basically serves the function of the Green New Deal, as envisioned by the progressive wing of the party, but it is being employed for party unity. Labor and social justice advocates both have much they can be happy with.

As far as policy merits, I’m in a good mood right now so I’ll give it three stars out of five.

Current versus Advanced Nuclear

The Biden energy plan calls for R&D into advanced nuclear, among other things, but the only line about current generation nuclear is “It would also mean continuing to leverage the carbon-pollution free energy provided by existing sources like nuclear and hydropower...” so at least that should mean avoiding premature nuclear closures. What about building new nuclear power with existing technology?

Among nuclear advocates, this is a major point of debate. One view is that current nuclear technology is too expensive and so we need to develop new technologies, such as small modular reactors (allow for fast and standardized factory construction), sodium-cooled reactors (avoid the need for elaborate containment systems). Or maybe we should go straight for fusion. The second view is that we should push for an asston of nuclear construction, like the French did, and make it cheap by standardizing it and building up a strong workforce.

I confess some agnosticism on this debate but am leaning ever more toward the second camp. Early SMR cost estimates don’t look especially promising, nor do the hypothetical costings I have seen for Gen IV nuclear or fusion. My fear is that if the focus is too much on R&D for the next generation, we won’t solve the fundamental problems that plague the current generation. Furthermore, I would expect that building out a strong nuclear engineering workforce will accelerate the development of new technology. So it’s not like “current vs. advanced” is actually a dichotomous choice.

What actually is the problem that plagues the current generation? I don’t entirely know. But I suspect it is a combination of general megaproject management problems identified by Bent Flyvbjerg, overregulation, and an industry that has gotten lazy.

Construction Technology

Speaking of construction, TechCrunch has a profile this week of a company called Social Construct, founded by Ben Huh of Cheezburger fame. The goal is to use CAD and modular construction to lower construction costs. For decades the industry has been plagued by cost and productivity problems that greatly exceed most other industries.

I have been interested in this topic for a while now and see construction costs as a major weak link in any credible effort to address housing costs. There would be great, broad-based social value for developing tools for turning around productivity trends. My suspicion is that the major bottleneck the industry faces is fragmentation. Not until we start seeing some major vertical (and maybe horizontal as well) integration will we see better planning and the opportunity to employ building information modeling, modular construction, robotics, 3D printing, or whatever other high tech tools people imagine.

As for Social Construct, I hope they’re successful. I’m a fan of I Can Has Cheezburger, Huh’s other notable work. But recent past efforts to modernize the construction industry, such as Google X’s endeavors, Katerra, and Plant Prefab, for instance, have not (yet) turned the industry around.

Population Trends

There was a major new study in The Lancet this week which forecast a peak human population in 2064 and a decline to a world TFR of 1.7 by 2100. This dire (from my pronatalist perspective) forecast seems to me to be a better reflection of actual trends than the standard UN forecast, which does not envision a peak population until around the turn of the century.

I think the study should be taken as a wakeup call for policy makers to take falling fertility seriously. The paper itself focuses on adaptation and immigration as solutions, generally pouring cold water on pronatalist policies (ducking the question of where the migrants will come from if the whole world sees sub-replacement fertility).

As a forecast, I think the paper is a good reflection of mainstream understanding and functions well as a reference point. But I still see wildcards which are not well understood (at least not by me) and could, over the course of 80 years, result in a reality quite different from forecasts. It is hard to imagine that more countries will not adopt much more aggressive pronatalist policies, perhaps going as far as state-sponsored child rearing and ectogenesis, if they become sufficiently alarmed. Culture can change in ways that are not predictable and not the same as past changes. Sooner or later natural selection should become noticeable as a factor causing a fertility rebound.

Pesticides

I haven’t done as much new content lately as usual for Urban Cruise Ship, since I’ve been focused on this longer term social endeavors project and some other things that aren’t going online for a while, but I did draft up a section on pesticides (sans graphics). A few observations.

I found several estimates on the externalized damages of agricultural pesticides at $4-19/kg. The world uses about 3.5 million tons per year, so that’s about $14-66 billion of externalized damages per year. These kinds of numbers are always fuzzy (and previously I’ve seen some higher estimates), but orders of magnitude estimates help us rank environmental issues by seriousness. Annualized damages from climate change, nitrogen runoff, and deforestation are in the trillions each. Land use and biodiversity loss may each reach into the tens of trillions. Poor ocean management, water pollution, and ozone depletion are in the hundreds of billions. So pesticides may be an order of magnitude or more lower than these other issues.

The world hasn’t seen a peak in pesticide usage overall or per acre, but there may have been a peak in per calorie of food.

The value of pesticides in modern agriculture is indisputable. Without them yields would probably be about half of what we see. That would mean either a massive conversion to additional cropland, labor costs from working the land, or we wouldn’t be able to feed the world. But we may be overusing pesticides relative to the optimum. China in particular.

Integrated pest management is the solution I see most often as to how to cut pesticide usage. It’s a fairly broad term that encompasses a range of tactics to control pests. The main barrier to expanding IPM is that it requires specialized knowledge and training, so labor costs come into play. IPM may be a bit like recycling in that regard, where labor can substitute for environmental harm. But in a world of growing wealth, and urbanizing, peaking, and aging population, solutions that involve more labor are not very attractive. This is probably an area where advancements in precision agriculture will be important.

Agglomerationists

Anton Howes discussed “the agglomerationists” in his newsletter this week. The idea that having more and better connected people fosters commerce and creates wealth is a thread that connects a range of policy views: pronatalism, urbanism, free trade, and free migration, for instance. This is something I have been thinking for a while and am grateful that Anton has articulated the concept better than I have.

One can take the agglomeration principle in a different direction though and see it as a challenge. In any system characterized by returns to scale, there is likely to be a diminishing returns problem, and I think we see plenty of evidence of this nowadays with stagnating productivity, high cost of urban living, and subreplacement fertility, for instance. It may be that the real agglomeration challenge is not to increase the scale of the economy so much as to develop less scale-dependent modes of production. I’m not sure if this goal is possible or desirable, but it would be good to be open minded.

What Is Anticipatory Breach?

You never know what legal troubles are going to sprout up, until you’re neck-deep in one.

As I write this, I’m dealing with a new issue; one that you will all suggest I should have seen coming, but one that I have never experienced before nonetheless.

I sold a condo in December that went through a series of sign-backs, and as those of you who have been through this before know, the paper is almost illegible by the time you’re done.

Almost illegible, that is.  Lots of words, prices, initials, and items crossed out, but at the end of the day, you still know what the final agreement said.

One day before the closing of this condo, the buyer’s lawyer called the seller’s lawyer to ask what the final sale price was.

The final sale price was $725,000, of course.  This should never have been in doubt.  But the “$715,000” price that’s written under the $725,000 price on the Agreement of Purchase & Sale hadn’t been crossed out with a thick-enough pen, or a dark enough line in an electronic signature program.

A case could be made that the Agreement of Purchase & Sale showed two possible sale prices.

This was all much ado about nothing, since the two parties had agreed to $725,000, and the sale price had been reported on MLS as $725,000, but it still didn’t stop the buyer’s lawyer from making a fuss.

I have no doubt that the buyer wasn’t making this an issue.  Consider that if you are the buyer, and you’re 24 hours away from closing on your first condo, you have packed up your apartment, and you’ve booked a moving van for Saturday, you want your deal to close!  But is it possible that the buyer’s lawyer told him, “We could try to squeeze out some money here”?

As the son of a criminal lawyer of 40+ years, I know the way lawyers think.  They don’t ever want to see anything as clear; there is no black and white, everything is grey.  Everything is up for discussion and debate.  I actually felt that the seller’s lawyer (my client is the seller), rather than nipping this in the bud right away, fell back into his lawyerly ways and started to debate the merits of “two sale prices.”  It’s just habit for most lawyers, who love to debate, and whose favourite word is “could.”

“Well, there could be a case here that there are two sale prices agreed upon.”

“The buyer could have a viable objection in this case.”

Even though the seller’s lawyer knows he works for the seller, it’s just second-nature to want to look at possibilities, and scenarios, and potential situations, ad nauseam.  Not all lawyers think like this, but only lawyers think like this!

After speaking to my seller’s lawyer directly, my beliefs were confirmed; this was more of interest to the lawyer as a case study than it was, in practice, working for his client.

Frustrated as I was, I kept everybody in the situation cool, and ultimately the buyer did want to close on the transaction, and the buyer’s agent did confirm that we had agreed on $725,000, and all worked out in the end.

But looking back on this as I now am, I can’t help but give my head a shake.  How could I not see this coming?  How could I not look at that faint line crossing out the “$715,000” and think that, perhaps, it could be challenged?

I’m being partially facetious here, but I’ve always felt that learning from your mistakes not only enables you to use real-world experiences as a guide, but also ensures you don’t replicate your failures.

So in the spirit of trying to look ahead and anticipate future legal squabbles, let me introduce you to a concept called “Anticipatory Breach.”

I feel that this is a subject we might see and hear more about in the 2019 market, and my solution to the issue is one that I think many of you will benefit from.

When you sell your property, you will always require a deposit in consideration of the agreed-upon offer.

An agreement without consideration is not an agreement.

And thus we routinely submit a deposit cheque with the offer, or thereafter.

Different market conditions call for different procedures with respect to the deposit.  For example, in a red-hot market, where you have a property listed with a specified offer date, and where there are multiple offers, you would expect that any offer submitted is accompanied by a certified cheque or bank draft for 5% to serve as a deposit.  In a cool market, there would be no issue with making an offer without a deposit, waiting for an agreement, and then delivering the deposit the next day.

It’s that latter situation that I want to talk about, because I feel as though many people have been burned in the past year by not addressing this properly.

In every Agreement of Purchase & Sale, there is a section that describes how the deposit will be received.  There are three options:

1) Herewith – meaning that the deposit is in hand when the offer is made, and in practice, the cheque is often paper-clipped to the physical offer.

2) Upon Acceptance – meaning that a deposit will be delivered after the offer is accepted, in accordance with the provisions laid out thereafter in the APS.

3) As Otherwise Described – meaning that the Schedule A will outline how the deposit is to be delivered, and we see this when there are multiple layers to the deposit, ie. the deposit is $50,000 but only $25,000 will be provided “herewith” and a further sum of $25,000 will be provided within three business days.

So if you’re a seller and you receive an offer on your property, pull the trigger and sign the APS, and the deposit is to be delivered “Upon Acceptance,” what should you expect?

Well it’s outlined pretty clearly in the Agreement:

There you go, they even put “Upon Acceptance” in quotations!

“Upon Acceptance” shall mean that the Buyer is required to deliver the deposit to the Deposit Holder within 24 hours of the acceptance of this Agreement.

But what’s missing here, folks?

The lawyers among you, tell me what you see here.  Tell me what we’re missing, and why this can become troublesome?

Anybody catching on here before I divulge?

Okay, so after that last section, “…within 24 hours of the acceptance of this Agreement,” it’s missing anything pertaining to what happens if the deposit is not delivered within 24 hours.  And unfortunately, the Realtor community is not up to speed on this.

I sold a condo last year, representing the buyer, where the listing agent threw an absolute fit that we didn’t have the deposit cheque “on time.”  Technically-speaking, he was right.  We did the deal at noon on a Tuesday, and he wanted the cheque on Tuesday morning.  I may have been too cavalier about it, suggesting that “one day” was essentially “24 hours,” but my buyer-client had the deposit cheque and was going to drop it off at the listing brokerage at 5pm after work.

“Not good enough!” I was told by the listing agent, and again, he was right.  Technically-speaking.  I’m not trying to give myself a pass here, but for a condo that had been on the market for three weeks, and an offer that took four days to turn into an agreement, forgive me if we were 4-5 hours late.

The issue was, the listing agent decided that at 12:01pm, the offer was null and void.

But it wasn’t.

It doesn’t work that way.

And for those of you that caught on to the verbiage (or lack thereof…) in the deposit section from the Agreement of Purchase & Sale above, there is no explanation of what happens if the deposit isn’t received within 24 hours.

The listing agent in this case was a drama queen with an over-inflated sense of self-importance, who thought he was on Million Dollar Listing, and decided he would play fast and loose by suggesting that we “top up” our offer price in lieu of having the deposit delivered on time.

In the end, my client dropped the deposit off at 5pm, received a deposit receipt, and once the two brokerages had all the paperwork and the transaction was processed, the listing agent just faded away.

But what if the situation were different?

What if the buyer just never showed up, and was never heard from again?

Would the offer be null and void?

Could the seller then enter into another Agreement of Purchase & Sale with another buyer.

No, and no.

What happens in reality is you need to unwind the transaction.  Legally-speaking, you, the seller, are still bound by the Agreement.  Even though the buyer never produced a deposit, you are still tied to that Agreement, and cannot sell the property to another party until a Mutual Release has been signed.

And that is where the anticipatory breach comes into play.

If you, as the seller, anticipate that a breach is possible, then it’s best to get out ahead of it.

Again, we’re talking about a very small fraction of deals here; to suggest this is 1% would be overstating things.

But if you’re a seller, and you have two interested parties, and agree with one of them, you want to keep the door open to dealing with the second party if the first party neglects to show up with the deposit.

If you simply enter into the Agreement as most do, with the deposit delivered in accordance with the verbiage above, then would need a mutual release to be signed in order to sell to the second party.

How do you get around this?

Simple.  Make the offer conditional upon receiving the deposit.

This Agreement is conditional upon the Buyer delivering to the Seller or the Seller’s agent a negotiable cheque to serve as a deposit for the real property stated herein, within 24 hours of acceptance of this offer, failing which this offer shall be null and void.

There.

I just wrote that off the top of my head.  It’s not rocket science, and I’m sure we could clean that up a bit, and/or have a lawyer actually draft it, but you get the idea.

A buyer who intends to show up the next day, or even that evening, with a deposit cheque has no issue with this condition.  And it allows the seller to keep the door open to working with a second party if, and only if, the first party never materializes with the deposit.

Through fifteen years in this business, I have only come across this situation twice.  The first time was when my client, after purchasing a condo, called me the next day and started with, “You know, David, last night I sat down with a scotch and got to thinking…,” and suffice it to say, he pulled out of the deal.  He did so illegally, but basically said, “I’m not giving them the cheque, so figure a way out of this for me and let me know when it’s done.”  The second time was when I represented a seller of a Corktown condo, and the buyer’s agent told me his client “got cold feet.”  I had another buyer waiting in the wings, and had resold the property conditional on the first party being released from the existing Agreement.  We got the mutual release from the first party, and the sale to the second party went through.

I don’t expect that this is going to become a common theme in this market, but it’s good to have this in your knowledge-bank, as a seller.

And if you’re a buyer and you see this condition, just know that there’s nothing funny about it.  So long as you bring a cheque as required, you have nothing to worry about.

Now, I know my car insurance rates are high because I'm young and a guy, but here's the problem. My younger brother even, he's had his license for a year, he's 19, and had 3 speeding tickets and still pays less than me. On average for my car insurance rates, getting quotes online range from about $1500 all the way up to $2500 for 6 months! I used old vehicles, new vehicles, safe vehicles, unsafe vehicles, every kind of car/truck you could imagine and my projected rates are still through the roof. For example, for full coverage with the minimum amounts and highest deductibles, my insurance on a 2010 Mazda 3 would be about $1800-$2300 for 6 months. However, I also got a quote for a 1997 Ford Escort and the same exact coverage is still $1200-$1300. I don't get why my rates are so much higher. A coworker of mine is 21 years old, not married, no tickets, and has had his license since 18 like me, and he has a 2007 Mazda 6 and he only pays about $170 a month, which translates to about ~$1050 for 6 months. I put in my information including SSN on the same company's web site that he uses (Geico) and my insurance rates are about $1700 for 6 months. So my question is why are my insurance rates so high? I have no tickets, no moving violations, no accidents, nothing, and yet insurance rates are so high. I figure SOMETHING has to be on my driving record, but I can't imagine what. How can get a copy of or look at my driving record? One day before the closing of this condo, the buyer’s lawyer called the seller’s lawyer to ask what the final sale price was.

The final sale price was $725,000, of course.  This should never have been in doubt.  But the “$715,000” price that’s written under the $725,000 price on the Agreement of Purchase & Sale hadn’t been crossed out with a thick-enough pen, or a dark enough line in an electronic signature program.

A case could be made that the Agreement of Purchase & Sale showed two possible sale prices.

This was all much ado about nothing, since the two parties had agreed to $725,000, and the sale price had been reported on MLS as $725,000, but it still didn’t stop the buyer’s lawyer from making a fuss.

I have no doubt that the buyer wasn’t making this an issue.  Consider that if you are the buyer, and you’re 24 hours away from closing on your first condo, you have packed up your apartment, and you’ve booked a moving van for Saturday, you want your deal to close!  But is it possible that the buyer’s lawyer told him, “We could try to squeeze out some money here”?

As the son of a criminal lawyer of 40+ years, I know the way lawyers think.  They don’t ever want to see anything as clear; there is no black and white, everything is grey.  Everything is up for discussion and debate.  I actually felt that the seller’s lawyer (my client is the seller), rather than nipping this in the bud right away, fell back into his lawyerly ways and started to debate the merits of “two sale prices.”  It’s just habit for most lawyers, who love to debate, and whose favourite word is “could.”

“Well, there could be a case here that there are two sale prices agreed upon.”

“The buyer could have a viable objection in this case.”

Even though the seller’s lawyer knows he works for the seller, it’s just second-nature to want to look at possibilities, and scenarios, and potential situations, ad nauseam.  Not all lawyers think like this, but only lawyers think like this!

After speaking to my seller’s lawyer directly, my beliefs were confirmed; this was more of interest to the lawyer as a case study than it was, in practice, working for his client.

Frustrated as I was, I kept everybody in the situation cool, and ultimately the buyer did want to close on the transaction, and the buyer’s agent did confirm that we had agreed on $725,000, and all worked out in the end.

But looking back on this as I now am, I can’t help but give my head a shake.  How could I not see this coming?  How could I not look at that faint line crossing out the “$715,000” and think that, perhaps, it could be challenged?

I’m being partially facetious here, but I’ve always felt that learning from your mistakes not only enables you to use real-world experiences as a guide, but also ensures you don’t replicate your failures.

So in the spirit of trying to look ahead and anticipate future legal squabbles, let me introduce you to a concept called “Anticipatory Breach.”

I feel that this is a subject we might see and hear more about in the 2019 market, and my solution to the issue is one that I think many of you will benefit from.

When you sell your property, you will always require a deposit in consideration of the agreed-upon offer.

An agreement without consideration is not an agreement.

And thus we routinely submit a deposit cheque with the offer, or thereafter.

Different market conditions call for different procedures with respect to the deposit.  For example, in a red-hot market, where you have a property listed with a specified offer date, and where there are multiple offers, you would expect that any offer submitted is accompanied by a certified cheque or bank draft for 5% to serve as a deposit.  In a cool market, there would be no issue with making an offer without a deposit, waiting for an agreement, and then delivering the deposit the next day.

It’s that latter situation that I want to talk about, because I feel as though many people have been burned in the past year by not addressing this properly.

In every Agreement of Purchase & Sale, there is a section that describes how the deposit will be received.  There are three options:

1) Herewith – meaning that the deposit is in hand when the offer is made, and in practice, the cheque is often paper-clipped to the physical offer.

2) Upon Acceptance – meaning that a deposit will be delivered after the offer is accepted, in accordance with the provisions laid out thereafter in the APS.

3) As Otherwise Described – meaning that the Schedule A will outline how the deposit is to be delivered, and we see this when there are multiple layers to the deposit, ie. the deposit is $50,000 but only $25,000 will be provided “herewith” and a further sum of $25,000 will be provided within three business days.

So if you’re a seller and you receive an offer on your property, pull the trigger and sign the APS, and the deposit is to be delivered “Upon Acceptance,” what should you expect?

Well it’s outlined pretty clearly in the Agreement:

There you go, they even put “Upon Acceptance” in quotations!

“Upon Acceptance” shall mean that the Buyer is required to deliver the deposit to the Deposit Holder within 24 hours of the acceptance of this Agreement.

But what’s missing here, folks?

The lawyers among you, tell me what you see here.  Tell me what we’re missing, and why this can become troublesome?

Anybody catching on here before I divulge?

Okay, so after that last section, “…within 24 hours of the acceptance of this Agreement,” it’s missing anything pertaining to what happens if the deposit is not delivered within 24 hours.  And unfortunately, the Realtor community is not up to speed on this.

I sold a condo last year, representing the buyer, where the listing agent threw an absolute fit that we didn’t have the deposit cheque “on time.”  Technically-speaking, he was right.  We did the deal at noon on a Tuesday, and he wanted the cheque on Tuesday morning.  I may have been too cavalier about it, suggesting that “one day” was essentially “24 hours,” but my buyer-client had the deposit cheque and was going to drop it off at the listing brokerage at 5pm after work.

“Not good enough!” I was told by the listing agent, and again, he was right.  Technically-speaking.  I’m not trying to give myself a pass here, but for a condo that had been on the market for three weeks, and an offer that took four days to turn into an agreement, forgive me if we were 4-5 hours late.

The issue was, the listing agent decided that at 12:01pm, the offer was null and void.

But it wasn’t.

It doesn’t work that way.

And for those of you that caught on to the verbiage (or lack thereof…) in the deposit section from the Agreement of Purchase & Sale above, there is no explanation of what happens if the deposit isn’t received within 24 hours.

The listing agent in this case was a drama queen with an over-inflated sense of self-importance, who thought he was on Million Dollar Listing, and decided he would play fast and loose by suggesting that we “top up” our offer price in lieu of having the deposit delivered on time.

In the end, my client dropped the deposit off at 5pm, received a deposit receipt, and once the two brokerages had all the paperwork and the transaction was processed, the listing agent just faded away.

But what if the situation were different?

What if the buyer just never showed up, and was never heard from again?

Would the offer be null and void?

Could the seller then enter into another Agreement of Purchase & Sale with another buyer.

No, and no.

What happens in reality is you need to unwind the transaction.  Legally-speaking, you, the seller, are still bound by the Agreement.  Even though the buyer never produced a deposit, you are still tied to that Agreement, and cannot sell the property to another party until a Mutual Release has been signed.

And that is where the anticipatory breach comes into play.

If you, as the seller, anticipate that a breach is possible, then it’s best to get out ahead of it.

Again, we’re talking about a very small fraction of deals here; to suggest this is 1% would be overstating things.

But if you’re a seller, and you have two interested parties, and agree with one of them, you want to keep the door open to dealing with the second party if the first party neglects to show up with the deposit.

If you simply enter into the Agreement as most do, with the deposit delivered in accordance with the verbiage above, then would need a mutual release to be signed in order to sell to the second party.

How do you get around this?

Simple.  Make the offer conditional upon receiving the deposit.

This Agreement is conditional upon the Buyer delivering to the Seller or the Seller’s agent a negotiable cheque to serve as a deposit for the real property stated herein, within 24 hours of acceptance of this offer, failing which this offer shall be null and void.

There.

I just wrote that off the top of my head.  It’s not rocket science, and I’m sure we could clean that up a bit, and/or have a lawyer actually draft it, but you get the idea.

A buyer who intends to show up the next day, or even that evening, with a deposit cheque has no issue with this condition.  And it allows the seller to keep the door open to working with a second party if, and only if, the first party never materializes with the deposit.

Through fifteen years in this business, I have only come across this situation twice.  The first time was when my client, after purchasing a condo, called me the next day and started with, “You know, David, last night I sat down with a scotch and got to thinking…,” and suffice it to say, he pulled out of the deal.  He did so illegally, but basically said, “I’m not giving them the cheque, so figure a way out of this for me and let me know when it’s done.”  The second time was when I represented a seller of a Corktown condo, and the buyer’s agent told me his client “got cold feet.”  I had another buyer waiting in the wings, and had resold the property conditional on the first party being released from the existing Agreement.  We got the mutual release from the first party, and the sale to the second party went through.

I don’t expect that this is going to become a common theme in this market, but it’s good to have this in your knowledge-bank, as a seller.

And if you’re a buyer and you see this condition, just know that there’s nothing funny about it.  So long as you bring a cheque as required, you have nothing to worry about.
