With the digital age you need to know even more than you did before. Just like data rights, the depth of deception as to what you actually think you own is colossal. . Read books, read terms and conditions, read contracts, know that when you say equal splits or 50% that it’s 50% of 100% and not 50% of 5%. Make sure you cover the business end first before any creative process begins. . Know what societies handle what and in which territories. Know the difference between mechanical and performance rights. Understand what a Rights owner is. Know the difference between you as an artist, featuring artist, a label, a writer and performer. . Sort out your digital service providers, understand how to use the platforms and how they use you. . Know the role of your manager if you’re fortunate enough to have one. And most importantly, get a lawyer if you can afford to. . Sounds arduous, laborious and all consuming? That’s because it is if you manage yourself. Deel 2 van de reeks afkortingen uit #muziekcontracten; PPD & SRLP. . Waarschijnlijk heb je alleen naar het percentage gekeken in je #platencontract. Bedenk goed dat een percentage een gedeelte over “iets” is (per – cent, 1 van 100). Om te kijken wat jij nou precies krijgt bijgeschreven aan royalties, moet je eerst goed kijken wat “iets” is. De #royalty basis dus. Dat is dus nog het stukje voor “net receipts / netto-inkomsten” of “gross income / bruto-inkomsten”. Wat is de bron? Is dat iets wat een andere artiest ontvangt waarvoor jij een track hebt geproduceerd? Is dat het bedrag dat het label ontvangt? . Dit is waar #PPD en #SRLP in het spel kunnen komen. Het zijn wat verouderde termen, maar nog steeds relevant. . PPD staat voor Published Price to Dealer. Dit is de prijs die de #distributeur rekent aan de winkel. De inkoopprijs, zeg maar. . SRLP staat voor Suggested Retail List Price. Dit is de prijs die bijvoorbeeld #MediaMarkt aan een consument rekent voor de verkoop van #vinyl of #cd. Dit is dus de verkoopprijs, waar PPD de inkoopprijs was. . Je kan je voorstellen dat je als label natuurlijk het liefste de PPD als basis voor de berekening van de royalty van de #artiest wil rekenen. Als artiest wil je natuurlijk de verkoopprijs als basis hebben. More on the Need to Make Clear Who Owns Digital and Social Media Assets

Last week, we wrote about legal issues for podcasters, and made the point that media companies should be making clear by contract or otherwise who owns the podcasts that their employees and independent contractors have created. This week, there was press coverage (see, for instance, the article here) about a law suit filed by a newspaper company against a former employee seeking ownership of a Twitter account used by the employee while at the newspaper and then taken by that employee to his new employer. The company claims that the Twitter account, covering a local college sports team, was property not of the employee, but of the newspaper – pointing out that the account had actually been started by a predecessor employee, and that the employee handbook gave all rights to intellectual property, trade secrets and other intangibles created by the employee during the course of his employment to the newspaper company. The fact that a lawsuit was filed must indicate that the former employee is not ready to accept the newspaper’s position on the subject. For readers of this blog, what it does is reiterate our suggestion last week that media companies make sure that it is clear, in legally binding documents, who owns intellectual property created by employees and contractors. And this should include not just podcasts, but webpages, blogs, and social media accounts and similar assets – all being important aspects of today’s relationship between media companies and their customers.
