A federal judge in Austin on Thursday halted a new state law that would allow Texas police to arrest people suspected of crossing the Texas-Mexico border illegally.

The law, Senate Bill 4, was scheduled to take effect Tuesday. U.S. District Judge David Ezra issued a preliminary injunction that will keep it from being enforced while a court battle continues playing out. Texas is being sued by the federal government and several immigration advocacy organizations. Texas appealed the ruling to the conservative 5th U.S. Circuit Court of Appeals.

Ezra said in his order Thursday that the federal government “will suffer grave irreparable harm” if the law took effect because it could inspire other states to pass their own immigration laws, creating an inconsistent patchwork of rules about immigration, which has historically been upheld as being solely within the jurisdiction of the federal government.

“SB 4 threatens the fundamental notion that the United States must regulate immigration with one voice,” Ezra wrote.

Ezra also wrote that if the state arrested and deported migrants who may be eligible for political asylum, that would violate the Constitution and also be "in violation of U.S. treaty obligations."

"Finally, the Court does not doubt the risk that cartels and drug trafficking pose to many people in Texas," Ezra wrote in his ruling. "But as explained, Texas can and does already criminalize those activities. Nothing in this Order stops those enforcement efforts. No matter how emphatic Texas’s criticism of the Federal Governments handling of immigration on the border may be to some, disagreement with the federal government’s immigration policy does not justify a violation of the Supremacy Clause."

Gov. Greg Abbott signed SB 4 in December, marking Texas’ latest attempt to try to deter people from crossing the Rio Grande after several years of historic numbers of migrants arriving at the Texas-Mexico border.

In a statement, Abbott said the state "will not back down in our fight" and that he expects this case would eventually be decided by the U.S. Supreme Court. On social media, he wrote that he is "not worried" because "this was fully expected."

"Texas has solid legal grounds to defend against an invasion," he added.

State Attorney General Ken Paxton, whose office is defending SB 4 in court, said in a statement that he "will do everything possible to defend Texas’s right to defend herself."

The law seeks to make illegally crossing the border a Class B misdemeanor, carrying a punishment of up to six months in jail. Repeat offenders could face a second-degree felony with a punishment of two to 20 years in prison.

The law also seeks to require state judges to order migrants returned to Mexico if they are convicted; local law enforcement would be responsible for transporting migrants to the border. A judge could drop the charges if a migrant agrees to return to Mexico voluntarily.

In December, the American Civil Liberties Union, the ACLU of Texas and the Texas Civil Rights Project sued Texas on behalf of El Paso County and two immigrant rights organizations — El Paso-based Las Americas Immigrant Advocacy Center and Austin-based American Gateways — over the new state law. The following month, the U.S. Department of Justice filed its lawsuit against Texas. The lawsuits have since been combined.

During a court hearing on Feb. 15 in Austin, the Department of Justice argued that SB 4 is unconstitutional because courts have ruled that immigration solely falls under the federal government’s authority.

The lawyer representing Texas, Ryan Walters, argued that the high number of migrants arriving at the border — some of them smuggled by drug cartels — constitutes an invasion and Texas has a right to defend itself under Article I, Section 10 of the U.S. Constitution, which prohibits states from engaging in war on their own “unless actually invaded.”

Ezra said that he “is not unsympathetic to the concerns raised by Abbott,” but appeared unconvinced by Walters’ argument.

"I haven't seen, and the state of Texas can't point me to any type of military invasion in Texas," Ezra said. "I don't see evidence that Texas is at war."

Immigrant rights advocates around the state celebrated the ruling because they worried that SB 4 would lead to border residents' rights being violated.

"We celebrate today’s win, blocking this extreme law from going into effect before it has the opportunity to harm Texas communities," said Aron Thorn, senior attorney for the Beyond Border Program at Texas Civil Rights Project. "This is a major step in showing the State of Texas and Governor Abbott that they do not have the power to enforce unconstitutional, state-run immigration policies."

Edna Yang, co-executive director at American Gateways, said that SB 4 does not fix “our broken immigration system” and it will divide communities.

“This decision is a victory for all our communities as it stops a harmful, unconstitutional, and discriminatory state policy from taking effect and impacting the lives of millions of Texans," she said. "Local officials should not be federal immigration agents, and our state should not be creating its own laws that deny people their right to seek protection here in the U.S."

David Donatti, senior staff attorney at the ACLU of Texas, said the ruling is an "important win for Texas values, human rights, and the U.S. Constitution."

"Our current immigration system needs repair because it forces millions of Americans into the shadows and shuts the door on people in need of safety. S.B. 4 would only make things worse," he said. "Cruelty to migrants is not a policy solution.”

Republican attorneys general in Indiana, Missouri, Tennessee, and Texas have been using “abusive legal demands” to collect transgender patients’ medical records in pursuit of “ideological and political goals,” according to a 10-page report recently released by the staff of the U.S. Senate Finance Committee’s Democratic majority.

The report accuses the attorneys general of using misleading legal pretexts to make civil investigative demands of gender-affirming healthcare providers. The investigations have contributed to hostile anti-LGBTQ+ social and political climates and have also worsened queer people’s mental health, leading to “suicidal ideation, severe depression, and intense anxiety,” the report added. Tennessee Attorney General Jonathan Skrmetti’s investigation alleged clinicians’ misuse of Medicaid funds as a “money-making scheme.” Indiana Attorney General Todd Rokita and Missouri Attorney General Andrew Bailey both alleged that gender-affirming clinics had violated consumer protection laws. Texas Attorney General Ken Paxton demanded records from clinics in his state, Georgia, and Washington state without ever explaining why. All four states mentioned above have passed bans on gender-affirming care for minors. “In their sweeping anti-LGBTQIA+ campaigns, Attorney General offices demand a host of invasive items such as unredacted physical and mental health records, photographs of children’s bodies, correspondence to hospitals’ general email addresses for LGBTQIA+ patients, and lists of people referred for transgender health care,” the report stated.

A 10-page report from the Senate Finance Committee revealed that 4 Republican AGs committed abusive privacy-eroding practices to obtain trans patient data as part of their crusade against gender-affirming care for trans minors.

The 4 Republican Attorneys General named in the report are: Todd Rokita (IN), Andrew Bailey (MO), Ken Paxton (TX), and Jonathan Skrmetti (TN).

As is sometimes the case in American politics, a bill that many people are likely not paying a great deal of attention to is likely to have enormous impact on the nation’s future.

That $110.5 billion national security supplemental package was designed to provide additional funding for Ukraine in its war to fight off Russia’s invasion; security assistance to Israel, primarily for missile defense systems; humanitarian assistance to citizens in Gaza and the West Bank, Ukraine, and elsewhere; funding to replenish U.S. weapon stockpiles; assistance to regional partners in the Indo-Pacific; investments in efforts to stop illegal fentanyl from coming into the U.S. and to dismantle international drug cartels; and investment in U.S. Customs and Border Protection to enhance border security and speed up migrant processing.

President Joe Biden asked for the supplemental funding in late October. Such a package is broadly popular among lawmakers of both parties who like that Ukraine is holding back Russian expansion that would threaten countries that make up the North Atlantic Treaty Organization (NATO). If Russia attacks a NATO country, all NATO members, including the U.S., are required to respond.

Since supplying Ukraine with weapons to maintain its fight essentially means sending Ukraine outdated weapons while paying U.S. workers to build new ones, creating jobs largely in Republican-dominated states, and since Ukraine is weakening Russia for about 5% of the U.S. defense budget, it would seem to be a program both parties would want to maintain. Today, even Trump’s former Secretary of State Mike Pompeo said: “If Ukraine loses, the cost to America will be far greater than the aid we have given Ukraine. The least costly way to move forward is to provide Ukraine with the weapons needed to win and end the war.”

But now that former president Trump has made immigration a leading part of his campaign and a Trump loyalist, Mike Johnson (R-LA), is House speaker, Republican extremists are demanding their own immigration policies be added to the package.

Those demands amount to a so-called poison pill for the measure. The House Republicans' own immigration bill significantly narrows the right to apply for asylum in the U.S.—which is a right recognized in both domestic and international law—and prevents the federal government from permitting blanket asylum in emergency cases, such as for Afghan and Ukrainian refugees. It ends the asylum program that permits people to enter the U.S. with a sponsor, a program that has reduced illegal entry by up to 95%.

It requires the government to build Trump’s wall and allows the seizure of private land to do it.

When the House passed its immigration measure in May 2023, the administration responded that it “strongly supports productive efforts to reform the Nation’s immigration system” but opposed this measure, “which makes elements of our immigration system worse.”

And yet House Republicans are so determined to force the country to accept their extreme anti-immigration policies, they are willing to kill the aid to Ukraine that even their own lawmakers want, leaving that country undersupplied as it goes into the winter.

When he brought the supplemental bill up last week, Senate majority leader Chuck Schumer (D-NY) promised the Republicans that he would let them make whatever immigration amendments they wanted to the bill to be voted on, if only they would let the bill get to the floor. But all Senate Republicans refused, essentially threatening to use the filibuster to keep the measure from the floor until it includes the House Republicans' demands.

This unwillingness to fund a crucial partner in its fight against Russia has resurrected concerns that the Trump-supporting MAGA Republicans are working not for the United States but for Russian president Vladimir Putin, who badly needs the U.S. to abandon Ukraine in order to help him win his war.

Media outlets in Moscow reinforced this sense when they celebrated the Senate vote, gloating that Ukraine is now in “agony” and that it was “difficult to imagine a bigger humiliation.” One analyst said: “The downfall of Ukraine means the downfall of Biden! Two birds with one stone!” Another: “Well done, Republicans! They’re standing firm! That’s good for us.”

Today, allies of Hungary’s far-right prime minister Viktor Orbán were in Washington, D.C., where they are participating in an effort to derail further military support for Ukraine (an effort that in itself suggests Putin is concerned about how the war is going). Flora Garamvolgyi and David Smith of The Guardian explained that the right-wing Heritage Foundation think tank, which leads Project 2025—the far-right blueprint for a MAGA administration—and which strongly opposes aid to Ukraine, is hosting a two-day event about the war and about “transatlantic culture wars.”

This conference appears explicitly to tie the themes of the far right to an attack on Ukraine aid. Orbán has dismantled democracy in his own country, charging that the equality before the law established in democracies weakens a nation both by allowing immigration and by accepting that women, people of color, and LGBTQ+ people should have the same rights as heterosexual white men, principles that he maintains undermine Christianity. In Hungary, Orbán has cracked down on immigration, LGBTQ+ rights, and women’s rights while gathering power into his own hands.

In the U.S. the Conservative Political Action Conference (CPAC) and its allies—including former Fox News Channel personality Tucker Carlson and Arizona representative Paul Gosar—openly admire Orbán’s Hungary as a model for the U.S. Indeed, some of the anti-LGBTQ+ laws Florida governor Ron DeSantis has pushed through the Florida legislature appear to have been patterned directly on Hungarian laws.

Orbán—a close ally of Russia’s president Vladimir Putin, who embraces the same “illiberal democracy” or “Christian democracy” Orbán does—is currently working to stop the European Union from funding Ukraine. Now Orbán’s allies are openly urging their right-wing counterparts in the U.S. to join him in backing Putin. A diplomatic source close to the Hungarian embassy told Garamvolgyi and Smith: “Orbán is confident that the Ukraine aid will not pass in Congress. That is why he is trying to block assistance from the EU as well.”

Former U.S. ambassador to Russia Michael McFaul today noted that even the delay in funding has hurt the U.S. “Delaying a vote on aid to Ukraine, Israel, and Taiwan will do great damage to America's reputation as a reliable global leader in a very dangerous world. Delay is a gift to Putin, Xi, and the mullahs in Iran,” he wrote. “The stakes are very high.”

Republican determination to push their own immigration plan seems in part to be an attempt to come up with an issue to compete with abortion as the central concern of the 2024 election. As soon as he took office, Biden asked for funding to increase border security and process asylum seekers, and he has repeatedly said he wants to modernize the immigration system. To pass the national security supplemental appropriation, he has emphasized that he is willing to compromise on immigration, but the Republicans are insisting instead on a policy that echoes Trump’s extreme policies.

Immigration, on which Orbán rose to power, has the potential to outweigh abortion, which is hurting Republicans quite badly.

We’ll see. The story out of Texas, where 31-year-old Kate Cox has been unable to get an abortion despite the fact that the fetus she is carrying has a fatal condition and the pregnancy is endangering her health and her ability to carry another child in the future, illuminates just how dangerous the Republicans’ abortion bans are. Under Texas’s abortion ban, doctors would not perform an abortion, so Cox went to a state court for permission to obtain one.

The state court ruled in Cox’s favor, but Texas attorney general Ken Paxton immediately threatened any doctor who performed the abortion, and appealed to the Texas Supreme Court to block the lower court’s order, saying that allowing Cox to obtain an abortion would irreparably harm the people of Texas. All nine of the justices on the state supreme court are Republicans.

Late Friday night the Texas Supreme Court blocked the lower court’s order, pending review, and today, Cox’s lawyers said she had left the state to obtain urgently needed health care. This evening the Texas Supreme Court ruled against Cox, saying she was not entitled to a medical exception from the state’s abortion ban.

The image of a woman forced by the state to carry a fetus with a fatal condition at the risk of her own health and future fertility until finally she has to flee her state for medical care is one that will not be erased easily.

Meanwhile, Russian opposition leader Alexei Navalny has disappeared. His lawyer says he was told Navalny was “no longer listed” in the files of the prison where he was being held, and Navalny’s associates have not been able to contact him for six days.

The U.S. District Court for the Western District of Texas ruled yesterday that portions of Texas Senate Bill 1, adopted in September 2021, violate the Civil Rights Act of 1964. The court found that parts of S.B. 1 require officials to reject mail-in ballot applications and mail-in ballots based on errors or omissions that are not material in determining whether voters are qualified under Texas law to vote or cast a mail ballot.

“The District Court’s decision affirms what the Justice Department has argued for nearly two years: these provisions of Texas Senate Bill 1 unlawfully restrict the ability of eligible Texas voters to vote by mail and to have that vote counted,” said Attorney General Merrick B. Garland. “The Justice Department will continue to defend against unlawful efforts that undermine the right to vote and restrict participation in our democracy.”

“In requiring rejection of mail ballots and mail ballot applications from eligible voters based on minor paperwork errors or omissions, Texas Senate Bill 1 violates the Civil Rights Act,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division. “This ruling sends a clear message that states may not impose unlawful and unnecessary requirements that disenfranchise eligible voters seeking to participate in our democracy. The Justice Department will continue to use every available tool to protect all Americans’ right to vote and to ensure that their voices are heard.”

“The right to vote is one of the fundamental rights in our democracy,” said U.S. Attorney Jaime Esparza for the Western District of Texas. “This important ruling protects the rights of eligible Texas voters to cast a vote and have it counted consistent with federal law.”

The court issued a preliminary ruling yesterday in favor of the United States’ motion for summary judgment, which asserts that two provisions of S.B. 1 violate Section 101 of the Civil Rights Act by requiring rejection of mail ballots and mail ballot request forms because of paperwork errors that are not material to establishing a voter’s eligibility to cast a ballot. The first provision requires that early voting clerks “shall reject” mail ballot applications that do not include a Texas driver’s license or ID number that identifies “the same voter identified on the applicant’s application for voter registration.” The second provision provides that a mail ballot “may be accepted only if” the ID numbers on the carrier envelope or signature sheet identifies “the same voter identified on the applicant’s application for voter registration.”

Section 5.07 requires that early voting clerks ��shall reject” mail ballot applications that do not include a Department of Public Safety (DPS) number or the last four digits of a Social Security Number (SSN) that identifies “the same voter identified on the applicant’s application for voter registration.” Section 5.13 provides that a mail ballot “may be accepted only if” the DPS number or last four digits of an SSN on the carrier envelope or signature sheet identifies “the same voter identified on the applicant’s application for voter registration.”

The United States presented evidence to the court that S.B. 1 has resulted in Texas election officials rejecting tens of thousands of mail ballot applications and mail ballots cast in elections since the bill was enacted in 2021. The Department asserts that these rejections violate federal law, denying Texas voters the statutory right to vote protected by Section 101.

Yesterday’s preliminary ruling from the court grants the Justice Department’s motion for summary judgment, which the Department filed in May 2023, in its entirety. The decision addresses the Justice Department’s sole pending claim in La Unión del Pueblo Entero v. Abbott, No. 5:21-cv-844 (WDTX), a case in which the United States and several private parties are challenging various aspects of S.B. 1. The court noted that the ruling will be followed in the coming weeks by a final written opinion and order. A group of private plaintiffs will be going to trial on the remaining claims in the case, which have not yet been resolved. That trial is scheduled to begin on Sept. 11.
