India's construction industry is an example of uneven legislation and confusing interpretation, which causes disagreements and extended litigation in the construction laws. The 1872 Contract Act, comprehensive statutory provisions in labour laws, a few particular statutes, such the Building and Other Construction Workers Act, 1996, and other state-specific rules and regulations all control construction laws in India.
Lack of a standard construction contract structure leads to the necessity for amalgamated construction law/commercial construction law. This in turn causes issues of its own, leading to unfair contract terms, late payments, and protracted dispute resolution.
The rationale behind Construction Contracts
Every contract in India must comply with the Indian Contract Act, 1872, which stipulates that there must be two or more parties to the agreement who are legally able to do so, that the parties entered into the agreement voluntarily, for a legitimate consideration, and with a lawful goal.
Construction contracts must adhere to the aforementioned conditions, just like any other contract, in order to be legally enforceable. The Indian Contract Act primarily governs contracts between contractors and employers. Construction contract forms are chosen from organisations having a global reputation.
Disputes in construction contracts and the disparity in interpretation by arbitrators and courts: a global perspective
Contract performance delays are the main topic of construction disputes. It is crucial to point out that how these disagreements are resolved by construction law - arbitrators or courts of law exposes how linked laws are actually put to use and illustrates the inescapable discrepancy in interpretation.
In December 2019, New Delhi hosted a three-day international conference on construction law and arbitration. The Chartered Institute of Arbitrators-India and the Society of Construction Law-India jointly hosted it. Concurrent delay in construction projects does not have a single, agreed definition. A more specific definition of "true concurrency" is when both the employer and the contractor experience delays at the same time and for the same amount of time, sharing the same start and end dates.
If either of these delays occurs in the absence of the other, it is likely that the project will take longer to complete. In many jurisdictions around the world, arbitrators and courts generally adhere to two main methods for construction laws.
The Malmaison approach
The UK's Technology and Construction Court (TCC), in the case of Henry Boot Construction Ltd v. Malmaison Hotel, clearly explains this strategy. In essence, if there are two concurrent causes of delay, one of which is a significant event outside of the contractor's control and the other is not, then the contractor is entitled to an extension of time induced by the relevant event in such a situation.
Apportionment approach
In City Inn v. Shepherd Construction Ltd.5, the Scottish courts established the apportionment technique, rejecting the Malmaison approach. In summary, the delay must be divided between the contractor and the employer when there are two competing reasons of delay, neither of which is dominant.
The High Court of Hong Kong likewise adopted this strategy in Hing Construction Co Ltd v. Boost Investments Ltd, which the Scottish courts approved and followed in the City Inn Case. Articles 287, 290, and 291 of the United Arab Emirates Civil Code likewise contain comparable ideas along similar lines.
Exclusionary clauses
Exclusionary clauses are those in construction contracts that limit the employer's responsibility for delays brought on by the employer. It is well-known that government contracts in India favour the government employer and frequently contain clauses that give the government the upper hand when negotiating with contractors.
It has made it possible for exclusionary clauses to be incorporated into contracts, meaning that even if there are delays that may be attributable to the employer, the contractor cannot sue for damages.
It is important to remember that Section 54 of India's Contract Act states that when a party breaches a contract and receives a benefit, that party cannot keep the benefit and must pay the non-defaulting party compensation.
Consolidated construction law can boost development and broaden the industry's reach. No matter how many sections there are in India's construction laws, they must be united in a way that may effectively convey the purpose of the legislation.

COUNTESS OF WESSEX CONTINUES HER WORK ON PREVENTING SEXUAL VIOLENCE
The Countess of Wessex, newly returned from a whirlwind trip to New York and Canada, today took numerous meetings with filmmakers and government officials associated with the Preventing Sexual Violence in Conflict Initiative (PSVI) on Monday at the Foreign and Commonwealth Office (FCO) in London. She also attended a luncheon with survivors of sexual violence.

Unfortunately, as with many of her engagements, was not documented by the press. Sophie announced her patronage of PSVI and the Women, Peace, and Security (WPS) agenda last year on 3rd March, International Women’s Day, with a reception at Buckingham Palace. The organisations recognise the disproportionate impact of conflict on women and girls and the positive role women play in building peace and stability. Since becoming patron, the Countess has participated in numerous events and conferences at home and abroad, including the United States, India, and Kosovo.
PSVI has a diverse and impressive list of partners, including the United Nations (UN) Development Programme, the UN Department of Peacekeeping, UN High Commission on Human Rights, and UNICEF. Charitable institutions are also on board, such as Care International, Save the Children, Human Rights Watch, and the International Committee of the Red Cross. Academia is represented as well, and previously this year the Countess attended a film screening at the London School of Economics’s Centre for Women, Peace, and Security, alongside actress and activist Angelina Jolie.

     London was host the “Time for Justice” conference this week, which would have convened participants from PSVI’s diverse and impressive list of partners; however, the decision was made to postpone the event to 2020 due to the upcoming general election on 12th December. Lord Ahmad, the Prime Minister’s Special Representative on Preventing Sexual Violence in Conflict, issued a statement confirming the government’s commitment “to ensuring survivors and their views, needs, advice and expertise are at the heart of the international response,” according to 4 November press release.
Next Sophie hosted an afternoon reception at St James’s Palace in her role as Global Ambassador to the Women of the Future Programme. The organisation hosted its annual Kindness and Leadership 50 Leading Lights competition previously this year, and winners were treated to tea and conversation. Joanna Kingston-Davies, the Chief Operating Officer of the Jackson Lees Group, was selected for her kindness and authenticity, two qualities not normally associated with high-profile law firms.

Recently I was at the mall and found myself in EarthBound once again. I remember fondly how few clothing they used to carry, and the fact that the labels read “made in America.” Upon my return I was shocked to see half the store was now cute hippie clothing, that seemed to have a little bit less quality to it but at the same price… then, GASP, a made in India tag? Well, surely they must have information about the companies they work with overseas in India. I was weary… I needed to check out more, so I emailed them. I inquired about their wages and ethics they use with suppliers in India. While I understand “trade secrets,” would not be shared I left it open for them to give me a figure or proof of wage minimum they imply. If you’re not familiar with India, it has a terribly low minimum wage, that is legal but also unlivable. It keeps people a slave to their own hunger while they work full time, to only have just enough to stay alive and not thrive. American companies often take advantage of the people in these economies. They pay cents on the dollars for products they still charge $29.99 on, the same price as before with the made in america products (except now they profit even more.) I received back an email, bland an corporate, telling me that “clothing is primarily proprietary and that the information will not be released.” This raised my suspicions. I looked more into their semantics…. turns out, EarthBound “Trading Company” is NOT certified free trade. I reply once more and let them know I will no longer be supporting them, as they profit from the pain and suffering of the Indian people. The email above is what I got after, it starts out with them calling me assumptive and implying that I am wrong… then goes on to admit, we are not free trade certified. They try to excuse it by saying they follow the national standards of the countries they work in…. but you know as well as I do, it’s criminal. Sweatshops are wrong. Point blank, simple. They create the product, pay them accordingly. There would be no earthbound without the pain of people. Please if you shop there, don’t. With a facade of hippie happiness, this company takes advantage of the human race and deserves to be called out for it. The second photo is from how HARD they blocked me on Instagram, simply for asking about work ethics, and wages. I will not support them and I have convinced a new total of 315 people to agree that they do not want their money to go to these greedy people! They just want the hippie dollar and they won’t get anything from me. They cannot silence me. They have been communicating with me daily via email trying to get me to believe them but I was in marketing, and I see through them. Do me a favor and email EarthBound asap! Ask them about their sweatshops!
