“Omer Micoll Faces Trial for Murder,” Montreal Gazette. August 6, 1941. Page 11. ---- Judge Fixes Voluntary Statement in Case Over Death of Henri Vezina ---- Omer Micoll, aged 47, will have to face a jury of the King’s Bench on a charge of murdering Henri Vezina early in the morning of July 27. Judge Archambault, after enquete yesterday, decided he would not take the responsibility of dismissing the charge, and fixed voluntary statement for August 12.
Micoll, who lives at 1256 Notre Dame street east, had a party in his room July 26 at which Vezina who lived at 1258 on the same street, was one of the guests. Both men were very drunk, according to the evidence of two women who were present and who testified yesterday. Mrs. Marie Hardy, one of these witnesses, said there was a fight between the two men. The other witness, Miss Yvonne Masson, who was a friend of Vezina said there was no fight in the room, but that it took place outside in the hall. She said that Micoll was so drunk he could hardly stand.
Dr. Jean Marie Roussel, medico-legal expert, who performed the autopsy, testified that Vezina died from the effects of a concussion of the brain. In answer to Omar LeGrand, K.C., Crown Prosecutor, he said that a fall which Vezina had sustained would have been sufficient in itself to have caused death. However, there were only slight signs of injuries shown on the exterior of Vezina’s head. His Lordship decided after hearing these two witnesses that there was sufficient evidence to send Micoll before a jury. The prisoner was represented by Emile Boucher.

José Trinidad Reyes Sevilla was born on June 11, 1797 in San Miguel de Tegucigalpa. A deacon, priest and poet, he was a polemicist defending the rights of women and the poor. Hero of Honduras, he founded the Autonomous University of Honduras. He is a relevant figure in the field of dramaturgy and is considered the initiator of Honduran poetry. He is also the author of texts of political content that honor or denote the memory of various characters. He died on September 20, 1855 in Tegucigalpa.
José Trinidad Reyes Sevilla (San Miguel de Tegucigalpa, June 11, 1797 - Tegucigalpa, September 20, 1855) is the legitimate son of Felipe Santiago Reyes (music teacher) and María Francisca Sevilla. In his childhood and adolescence he learned reading, Christian doctrine, Latin and drawing classes. In 1819 he entered as a novice in the Convent of the Recoletos de León (Nicaragua) and in 1822 he began his religious career as a deacon and priest. In Guatemala he studied Spanish playwrights and Greek and Latin classics, as well as some Mexican dramatic pieces.
José Trinidad is considered a hero of Honduras and founder of the Autonomous University of Honduras, which had previously been used as a Government House "The Society of Entrepreneurial Genius and Good Taste". He organized the first Library in Honduras - called "Biblioteca de la Academia" - and also operated the country's first printing press - "Imprenta de la Academia".
The poetic work of José Trinidad offers a dichotomy between poems of neoclassical influence and texts with a popular and romantic air. He is a relevant figure in the field of dramaturgy; although his legacy in lyrics is very meager, he is considered the initiator of Honduran poetry. He wrote several pastorelas, which are the first theatrical manifestations in Central America. He also produced texts of political content that honor or dent the memory of various characters.
Reyes defended women's rights, from a position very close to the Enlightenment. He fought poverty and its causes, helping the poor and insisting on their right to education not only in matters of faith, but also in more mundane matters such as culture and science.
BIOGRAPHY
He is the legitimate son of Felipe Santiago de Reyes —an honored music teacher, who instructed him in the basics of the subject— and Doña María Francisca Sevilla.
He was baptized on June 14 of the same year, 3 days after his birth, by the Reverend Father Fray Nicolás Hermosilla, and his godmother was Doña María Josefa Araurrenechea. On his baptismal certificate his full name is read; Juan José Sahagún de la Santísima Trinidad.
In 1804 she entered a private school in Tegucigalpa and began to learn the reading and doctrine of the Catholic faith with Miss Gomez, one of the so-called "teachers". In 1812, at the age of fifteen, he learned the Latin language thanks to Friar Juan Altamirano, from the convent of Nuestra Señora de las Mercedes, he also received drawing lessons under the direction of Don Rafael U. Martínez, a Guatemalan painter based in Honduras, as well as music classes.
On January 20, 1815, he left Tegucigalpa for the city of León (Nicaragua), in order to advance in his studies, under the guard of a labrador from the neighborhood of La Plazuela, named Miguel Álvarez, and accompanied by the devotees who went on a pilgrimage to the town of El viejo, in the city of León. While there, he obtained a Bachelor's degree in Philosophy, Theology and Canon Law and, while studying, a position as assistant to the Maestro de Capilla in the cathedral of León, where he perfected his knowledge in music.
Life as a deacon and priest

In 1825, due to the civil war in Nicaragua, the Recoletos were expelled and forced to go to Guatemala. There, Reyes studied the Greek and Latin classics; to the Spanish playwrights Lope de Vega and Calderón de la Barca and recognized some theatrical pieces brought from Mexico, especially from Oaxaca and Chiapas, in addition he also finished his humanist and religious training. In 1828, with the permission of his superiors, he returned to Honduras to spend a season close to his family; passed through the city of Chiquimula and stopped at Esquipulas; where it is said that he lost his sense of sight, although he was healed a few days later. On the afternoon of July 13 of the same year, he arrived at the neighboring town of La Concepción, or Comayagüela, and the next day celebrated his first Mass in the church of La Concepción. Unable to return to Guatemala because of the war that then existed between the conservatives led by Mariano de Aycinena y Piñol and the liberal troops of General Francisco Morazán, he settled in the unoccupied Convent of Nuestra Señora de la Mercedes, located in Tegucigalpa, "which was to be until his death, his usual residence".
In 1830 he wrote in verse a birthday greeting to General Francisco Morazán, then president of Central America and in 1835 he rebuilt the chapel of the temple of La Merced and the temples of San Francisco and El Calvario. He also built the small temples of Las Casitas, the temple of Soraguara and suyapa, the latter famous for its little virgin. He also assisted Mr. Antonio Tranquilino de la Rosa in the repair of the Parish Church of Tegucigalpa, which was in ruins due to earthquakes of 1809.
In February 1837 he delivered a panegyric sermon on the occasion of the restoration of the Parish Church of Tegucigalpa, where he premiered his Mass El Tancredo; the same year, due to the help and comfort he provided to the victims of the Asian cholera that ravaged neighboring Guatemala,2 he suffered an attack from it, but managed to save himself after "being between life and death".
In 1838 he wrote his second pastoral, called Micol, dedicated to misses Juana and Rafaela Robelo. He had previously written Naomi which, according to reliable sources, is the oldest of all, written between 1828 and this year.
In 1840 he wrote his self-Adoration of the Holy Magi, divided into three acts, and in 1841 he premiered in Tegucigalpa his pastoral Micol.
Alleged imprisonment
In his biography of Father Reyes, the liberal writer Ramón Rosa states that Father Reyes had been proposed for bishop of Honduras. When priest Jorge Viteri y Ungo went to Europe in 1840 to visit Pope Gregory XVI, General Francisco Ferrera, then president of Honduras — supposedly suspicious of Reyes' independent ideas — sent Viteri the news to the Vatican that Reyes had died, so the pope appointed priest Campoy y Pérez as bishop of the Diocese. ,7 and that when he returned from Guatemala to Comayagua, in 1845, Father Reyes was there, as a detainee by order of General Ferrera.7 However, in a critical edition of the work in 1891, José Vicente Martínez explained that he carried out detailed investigations to clarify these facts, since Rosa did not explain the sources he used.

Martínez's research shows that Viteri and Ungo were not in Rome in 1840, as it was not until April 6, 1841, that the government of El Salvador informed the government of Honduras that, authorized by Congress, it had appointed Presbyter Viteri and Ungo as its representative to the Holy See to request the creation of the diocese of San Salvador. , and that invited Honduras to send its candidates to the Diocese of Honduras, and thus take advantage of Viteri's trip. Honduras accepted and on February 18, 1842 issued an agreement providing that the shortlist of candidates be sent to Mr. Viteri; among the candidates was Father Reyes. The agreement was communicated to the coadjutor vicar of the Metropolitan Cathedral of Guatemala, Antonio Larrazábal, who chose the ones to be proposed.
Viteri and Ungo represented the governments of Guatemala, Honduras, El Salvador and Costa Rica before the Pontificate, and was received in public audience by Pope Gregory XVI at the Quirinal Palace on August 26, 1842. After the meeting with the pontiff, Viteri and Ungo sent two communiqués to the government of Honduras: on September 1, 1842 he reported that the new Bishop of Honduras might be recommended in November and that the only serious obstacle was the lack of the seven hundred pesos necessary to pay for the issuance of the Bulls. And on October 19, he indicated that the bishop had already been elected —without mentioning the name— and that funds were urgently needed for the preaching in November.10 Meanwhile, on September 13, the Provisor José Xicolás Irías died in his retirement, who before his death conferred the appointment of interim Provisor of this Diocese to Campoy y Pérez. This appointment was approved by the Government and confirmed by the governor of the Metropolitan Church and by The Lord Archbishop Fray Ramón Casaus.
The new Provisor moved to Comayagua on December 9, 1842. On September 31, General Ferrera ended his presidential term, and left power to his Council of Ministers. He received Viteri's communications and approved the required payment. Some of the candidates had already died, and the Council considered that the ideal candidate was then the priest Paula Campoy. The Diocese of San Salvador was erected in the Bull of October 4, 1842, and Lord Viteri was appointed its first Bishop. On January 29, 1843, he was consecrated as such in Rome, and then began his return to Central America. While in Paris, he received the new shortlist that the Honduran government had sent him and immediately sent it to Rome with the attached file; the pope approved the canonical process, which Viteri communicated on August 6, 1843 upon his arrival in Trujillo. The Bull in which Mr. Campoy was appointed bishop of Comayagua was issued on February 8, 1844, making the appointe the grace to dispense him the degree of Doctor, which was then an essential requirement to be a bishop at that time.
As for Reyes' alleged imprisonment, the documents that Martinez investigated showed that there was no arrest of the priest. However, in 1845 he did travel to the city of Comayagua, where he treated the newly consecrated Bishop of Honduras, Campoy y Pérez.

On December 14 of this year, the so-called "Society of Entrepreneurial Genius and Good Taste" was installed in the Government House, the birthplace of the National Autonomous University of Honduras and of which Father Reyes was rector and founder. Reyes, in his capacity as rector, delivers on this occasion an eloquent inauguration speech, the text of which has been rescued by the teacher Esteban Guardiola in his History of the University of Honduras.
In 1846 he met again in Comayagua, where he wrote on May 23 his Elegy to General Don Francisco Ferrera, on the death of his son Fulgencio. This composition shows, relatively, that there was no enmity with General Francisco Ferrera, on the contrary, the text proves a recognized familiarity.
In June 1847 his mother died in Tegucigalpa, for which Reyes returned to that city. On September 19, Reyes inaugurated the University of Honduras, presiding over the ceremony with Head of State Juan Lindo and Bishop Francisco de Paula Campoy y Pérez. That same year, he organized the first Library of Honduras, called the Library of the Academy, and ran the first printing press in the country, also called the Printing Press of the Academy, which was brought to Honduras by General Francisco Morazán in 1829 after confiscating it in Guatemala. Also, Reyes brought the first piano to the city of Tegucigalpa, which is believed to be in the municipality of Ojojona, and was owned by the Díaz Zelaya family, as it is not historically proven.
Later life
In 1847 Reyes wrote one of his well-known When..., satirical compositions full of familiar humor. Of these compositions only two copies are preserved, written in tenth octo syllables and ending with the exclamation "when". In 1848 he wrote, in an invitation made by the students to the society of Tegucigalpa, his well-known: Invitation for the walk to the lagoon, dated February 9. In 1849 his father died, the victim of mental alienation.
On April 16, 1850, Reyes wrote his poem Honduras, which consists of six octaves in deca syllables and is dedicated to the lords generals Don Gerardo Barrios, Don Trinidad Cabañas, and all the soldiers, officers and chiefs of El Salvador and Honduras. On September 29 of the same year he wrote his poem To Independence, consisting of seven octaves in deca syllables, and a quartet by the same author, as an epigraph.
On February 2, 1851, candlemas day, he premiered his Pastorela Elisa, dedicated to MissEs Juana and Jerónima Godoy. It was premiered by Teodora González, after Vigil and Don Juan Ramón Pereda. By then he had already written and premiered his Pastorelas: Neftalia, Selfa and Rubenia. The first was dedicated to Misses Maria and Isidora Reyes, who was chosen for the role of Sephora. The other two pastorelas were dedicated to misses Manuela Vega, after Ugarte; To Juana Velásquez, after Bonilla and to Maclovia Bonilla, after Dávila. This year he also prepared his Pastorela Albano, which he dedicated to Miss Raimunda Milla, whose premiere was announced for 1851, but which was finally only rehearsed. "It was not represented because it was announced that the pastors would be stoned because of the allusions to certain political figures. Others claim that despite the threat, representation was given."

After drinking alcohol at a nightclub with Seaman Recruit Warren,2 Appellant overslept the next morning and missed a pre-deployment firefighting class. Panicked that her tardiness would get her in trouble, she had Seaman Recruit Warren punch her in the face and drive her to a wooded area near base, where she rolled around in the dirt to make it look as though she had been in a struggle. Appellant then went to the base gate and told the security personnel she had been drinking with a man at a club and later woke up in the bushes outside the gate with pain in her vagina. She subsequently reported to the Naval Criminal Investigative Service [NCIS] that she had been drugged and raped, and underwent a sexual assault forensic examination at a nearby hospital. Seven NCIS agents and forensic analysts then spent over 400 hours investigating the case—including identifying and extensively interviewing another Sailor as a possible suspect, collecting his DNA and fingerprints, and searching his cell phone and vehicle—before determining through security camera footage that Appellant’s report was false. 
At trial, Seaman Recruit Warren testified that after waking up late Appellant told Seaman Recruit Warren to “bruise her up” because she could not “go in this late without something being wrong with [her].”3 Appellant admitted making the false report, but testified that it was Seaman Recruit Warren’s idea and that she only participated in the scheme because she was afraid of Seaman Recruit Warren. The members found Appellant guilty of all charges and specifications.

A former Hamtramck, Michigan, Police Department officer was sentenced today in federal court in the Eastern District of Michigan for using unjustified and unreasonable excessive force during an arrest of a civilian and violating that civilian’s civil rights. As a result of the assault, the victim, identified in court documents only as D.M., suffered broken facial bones and lacerations requiring stitches, among other injuries.
Ryan McInerney, 45, of Grosse Ile Township, Michigan, was sentenced by U.S. District Judge Gershwin A. Drain to three years in federal prison followed by three years of supervised release. McInerney pleaded guilty on Jan. 8 to one count of deprivation of rights under color of law. As part of the plea agreement, McInerney also voluntarily relinquished his law enforcement license.***

The Killing of Rhonda Hinson Part 23

 Approximately 12 hours after the killing of Rhonda Hinson—on Dec. 23, 1981—Reggie Donald Smart was “interviewed by Lieutenant Warlick of the Burke County Sheriff’s Department (BCSD) and reporting agent.” The essence of the interrogation was recorded in supplemental document appended to one already submitted by Special Agent John Suttle of the SBI.  
“He [Reggie Smart] stated he was at Lawrence Fulbright’s Garage, which is located approximately one (1) mile north of Valdese, working on his truck, and left that garage at about 1:00 AM on December 23, 1981, returning to his home.  He said as he approached I-40 on the Mineral Springs Mountain Road, he observed a beige car backed into the ditch on the right side of the road in the direction he was traveling.  He said he was not sure of the make of the car, but it was beige and appeared new.  He said he observed a white female with blond hair slumped over the steering wheel, leaning forward, and more to the driver’s side of the car.  He said the door was open and the dome light was on at the time he observed it.”
But that wasn’t all that Mr. Smart witnessed. He described a white male—about 6’0”tall and weighing approximately 170 pounds standing on the outside of the driver’s door.  At that juncture, he could recall neither the color of his hair nor how he was dressed.
In an April 1983 conversation, Mr. Smart elaborated upon his observation of an old model Chevelle that passed him on Eldred  Street (Highway 350) traveling at a high rate of speed and turned onto Pineburr  Avenue.  As he glanced into his rearview mirror, he averred that he noticed a police car turning onto Pineburr behind the Chevelle. The synopsis of the conversation noted that:
“Reggie Smart continues on Highway 350 toward Interstate 40 approximately three-fourths of a mile and sees a car backed off the road, with the front portion in the highway, the headlights are on, the door is open, and a girl (whom Smart describes as Rhonda) was leaning over the steering wheel. The door was open and a white male with blonde hair is standing beside the driver’s door….
Steve Whisenant, of the BCSD, noted that Mr. Smart had undergone hypnosis and “all he said he saw he saw.”
As previously reported, Unsolved Mysteries—Season 2, Episode 7, first televised on Nov.r 15, 1989—aired an excerpt from the taped hypnosis session. In it, Reggie provided more detail about the blue, 1970’s Chevelle that passed him traveling at a high rate of speed, stipulating that it had grey primer on the front end that was “messed up.” He also described “sort of a dark brown-haired guy,” six-foot or 5’ 10” in height, that he initially identified at the driver’s side door of Rhonda’s Datsun 210.

Also previously referenced, on April 1, 1987, Mr. Smart spoke over the telephone with Judy Hinson.  In that conversation, he described the Blue Chevrolet Chevelle, the blonde male who was standing on the bank on the driver’s side of Rhonda’s Datsun, and the driver’s side door being ajar.  Rhonda was still inside the car.  He also described a dark-colored blue Trans-Am and a small blue Toyota parked on the opposite side of the highway with someone inside.  
The former automobile was identified by at least four other individuals as belonging to Mark Micol; the latter was identified by Todd Garrou—in a couple of recent phone conversations with this writer—as belonging to himself.  Todd’s asseveration corroborates that of Reggie Smart who recalled seeing the blue Toyota with someone inside.  Mr. Garrou also averred that he and passenger Brent Smith remained inside the vehicle while Jerry Baker exited to talk with Pons and Micol.

Mr. Smart made no mention—in neither of his statements nor conversation with the Hinsons—of law enforcement being at the crime scene when he drove through.
But Reggie Smart was not the only unwitting witness to the aftermath of a murder.  
Charles Kincaid recounted his recollections of that early late-December morning to Judy Hinson during a taped conversation, circa 1987, and heard by this writer over the weekend past.  “I am sorry for your loss; I am willing to do anything that I can to help,” Mr. Kincaid began.  
It was around 1 a.m., when he was driving his two-tone blue Buick down Eldred Street toward I-40 West and the adjacent town of Morganton.  As he approached the Home and Garden Center, he saw Rhonda’s car back into the ditch on the side of the road on which he was traveling.  It was then that he noticed a tall, slender young man with blonde, almost shoulder-length hair standing by the passenger’s side door.  The door, he maintained, was fully open; and the guy was standing behind it—slightly crouched down, with one foot propped just inside the car; one arm rested atop the vehicle, the other draped over the opened door.  
As Charles approached, he stated that the young man pulled the car door back toward himself and out of the travel lane.
“As I drove past, I made sorta eye contact with him.  I looked in my rearview mirror and saw him standing there still looking in my direction,” Mr. Kincaid remembered.  “I could tell he was still looking at me.”
Admittedly, Charles Kincaid paid more attention to the young fair-haired male than he did to anything else.  When asked by Judy Hinson, he was unable to verify whether or not her daughter was still in the automobile.  
Mr. Kincaid was subsequently interviewed by law enforcement and asked to identify the aforementioned blonde male from amongst a group of photographs.  A number of the snapshots that were shown to him were those of inmates whom he recognized because he was working at the prison at the time.  
“…So you were not able to identify any of them?”  Judy queried.
“Oh no, Ma’am; I did identify one who looked like the guy I saw and told them [law enforcement] so,” Charles responded.  “But it wasn’t anybody that I know.”
During the brief conversation, Mr. Kincaid speculated that he might have been one of the first cars to drive through shortly after Rhonda Hinson was killed.  And he did clarify one misconception.  When told of the encounter that Tim Pons and Mark Micol had with a black man driving a green surveyor-type vehicle that stopped to talk with them, he affirmed that he was not that man.
“We were under the impression that you were that man,” Judy explained.
“No Ma’am, I am not…I was driving a blue, two-toned Buick.”
“Well then, there was apparently another person who came through that morning that we have not identified,” Ms. Hinson responded.
In a document generated on Tuesday Sept. 25, 2001, lead investigator and reporting officer Sgt. Charles Morris charted a timeline of events prior to and subsequent to the killing of Rhonda Hinson.  In the section labeled “1:00 am +/-,” Detective Morris wrote a synopsis of the statements of Reggie Smart and Charles Kincaid—then he added another:
“Jeffrey Allison…drove down Mineral Springs Mtn. Rd. and saw Rhonda’s vehicle in the ditch.  Head lights on—dome light on—driver’s door open—did not see any other vehicles or persons.  However, he saw what he believed to be the top of someone’s head either on the driver’s side inside the vehicle or just outside the driver’s side…
On Saturday, Aug. 10 of this year, this writer was contacted through the Remembering Rhonda Hinson Facebook page by an informant—who wishes to remain anonymous—indicating that a great-uncle drove past the murder scene the early morning of December 23rd.  
“He is a coon hunter.  They had been coon-hunting that night and lost one of the dogs.  After searching for hours, he decided to go to Jack B Quick in Valdese [approximately a mile away from Interstate-40 down Eldred Street] for a cup of coffee before heading back home across Mineral Springs Mountain…He said he saw a vehicle off the road and assumed them to be drunk…He saw someone pulling a young girl out of the car and assumed she was drunk… [He] said that a car then followed him all the way to his home closely.  Later on, a detective reached out to him for information…and he could only recall fragments…He was hypnotized by someone at the department and could remember details including tag numbers.” [Note:  Attempts to contact this witness, via telephone, have been unsuccessful. However, efforts to reach him continue.]
Numerous accounts—interviews, recorded conversations, and statements by law enforcement—place Mark Micol and Tim Pons at the murder scene around 1 a.m., riding in Mr. Micol’s blue Trans-Am, and credit the duo with being the first to discover Rhonda’s Datsun 210.  Joining them from a cabin on Mineral Springs Mountain, were Todd Garrou, driving his blue Toyota, and passengers Jerry Baker and Brent Smith.  
Former classmates, friends, and family members have described each of these young men as they would have appeared in 1981. High School yearbook photos tend to confirm most of the physical traits noted by these aforementioned sources. Mark Micol was described as blonde-headed, lean, and at least six-foot in height.  The late Tim Pons was apparently around 5’ 8” tall with black hair.
Todd Garrou identified himself as red-headed, around 5’ 8” or 5’ 9” in height.  Others described him similarly.  Jerry Baker was described most often as easily 6-foot in height; a well-built football player-type who was, incidentally, a high school MVP; and with dirty-blonde hair.  One acquaintance stated that his hair was brown.  Brent Smith, likely the youngest of the travelers that evening, was less than six-foot tall, with blonde hair.    
Three of these five young men ostensibly exited their vehicles and approached the wrecked Datsun belonging to Rhonda Hinson.
  [Editor’s Note:  As of this writing, Mark Micol has yet to respond.  His comments will appear in an installment when he does.  Efforts are being made to locate Brent Smith for comment.]

Just a side note for those conservatives who seem so concerned about cis girls being victimized in bathrooms and locker rooms by trans girls - Straight, cis girls were the ones that victimized me in bathrooms and locker rooms and gym class in general. (Fuck you for ignoring that shit, Mr Labranch.) (Fuck you, Marina Santiago and Sarah Logan and to a lesser extent Micol Whatever-your-last-name-was). 15 fucking years later and the memories are still actively painful. And now the Republicans making it easier for these fucking bitches to torment and terrorize our most vulnerable kids? FUCK. THAT.

Hello Tumblr!
Apparently, this is my first post here on tumblr.
I don't really know what I'm supposed to do, since I've decided that my tumblr page is going to be my diary. Yeah, I know I could just buy a cheap notebook and write down there all the thing that are going on in my life... but no, somehow my brain decided otherwise  ¯\_(ツ)_/¯.
So, again, what am I supposed to do? Should I present myself? Write a little about my background?

My name is Micol, I'm 22 years old and I live in a city in the north of Italy. I don't have siblings and, sadly, my parents don't want pets in the house – asked for a doggo ages ago, they told me "We'll let you know" like it was a job interview.
Whatever.
I work in one of those stores that are inside of big malls. My colleagues and I sell all kinds of stuff: emoticon pillows, children toys, books to learn how to do yoga – you know, a bunch of shit that you definitely don't need but that you're gonna buy anyway. I remember one time, a guy came there to buy a present for his girlfriend; he told me their third anniversary was coming up. His final choice was a magnet with her name on it... so romantic! 
What else should I say?
I'm a Pluviophile, which means I love when it rains. I think that it's the perfect weather for a hot tea and a book: you can relax, read and enjoy the sound of the rain.
Reading is probably what I like to do the most. Whenever I open a book it's kind of like I'm starting to live a new life: I can go to Hogwarts or the Camp Half-Blood, fight against the White Walkers or ride a dragon with Daenerys, fall in love with Mr Darcy and marrying Mr Tilney.
What else...? I don’t know. 
I should probably end this post righ here and write again some other day. I’m sure all of my readers (0) won’t be able to wait till I update my next post.

The Killing of Rhonda Hinson Part 22

 If we could just know how she got out of the car.—Judy Hinson to Jerry Baker, April 6, 1987
 It was approximately 1 a.m., Dec. 23, 1981, when Mark Micol and the late Tim Pons were driving down Eldred Street, in Mark’s dark blue Trans-Am, away from the town of Valdese and toward a Mineral Springs Mountain cabin belonging to the dad of their friend, Jerry Baker.
As they approached the then Home and Garden Center—now Hawkins Antiques—the duo spotted the beige, 1981 Datsun 210 backed into a ditch, oriented toward Valdese, and in the lane upon which they were traveling.  The young men immediately pulled into an adjacent dirt road, exited their car, and approached the wrecked vehicle.  
According to Mark Micol, he and Pons walked around to the passenger side of the automobile, observed a bullet hole and blood in the front seat.  Neither of the youths attempted to open the passenger’s door.  As Tim Pons ventured around the front of the car toward to driver’s side, Micol interrupted his investigation, told him to stop and that they should, “go get the police.”
In a written transcript of an April 1, 1987 recorded conversation between the Hinsons and Mark Micol, the activities of the two young travelers were subsequently summarized:
“As they [Micol and Pons] were about to leave, Jerry Baker and Todd Garrou stopped at the Valdese Home and Garden Center, called to them, and asked them what had happened.  They told the two boys they did not known [sic] and were going to get the police. It was unclear …if Baker and Garrou waited there, while Micol and Pons went to get the police, or if they left, before the police arrived.  They did not see a vehicle around or anyone on foot.  They drove over town and meet a Valdese Police Officer who he [Micol] thinks was Feimster and, ‘It took him a long time to get back over there.’ Approximately 10 to 12 minutes passed from the time they first found the car until they got the police back over there.”
Mark Micol averred that he never saw Rhonda until Feimster found her.  Feimster, he continued, took their names and told them to go on home.  “I am not sure that Benny Bertalot was with Todd Garrou and Jerry Baker; but, they were in Todd Garrou’s car (a small blue Toyota).”  
Micol also recalled an encounter with a “black man” that he and Tim had prior to going to enlist the assistance of a police officer.  “Oh, yes…when we were there the first time a black man in a green survey-type truck or van came by, going toward the mountain.  He stopped and ask[ed] if we needed help.  I asked if he had a CB Radio and he said ‘no.’ I told him to go on then.  That’s when we left to get the police.”  
The late Tim Pons, who was riding in Micol’s Trans-Am that early morning, spoke with the Hinsons a week later—April 8, 1987—and the conversation was recorded.  Mr. Pons confirmed that they had gone through the crime scene ostensibly right after it happened.  Like his traveling companion, he recalled that a “…black guy,” who was driving something akin to a green survey truck with a long window in the back, stopped to offer assistance.  
“We asked him if he had a CB in it, and he said, ‘no.’ We said, ‘We’ll see you and we got into Mark’s car and come on back to town.  We were in a blue Trans-Am—that was Mark’s car.  When we went back to town, we ran all the stop lights trying to get to somebody.”
When Judy Hinson asked him about Jerry Baker and Todd Garrou, Pons’s recollection of the time sequence varied with that of Mark Micol.
“…We were going toward the mountain…They came down the mountain, when we were there with the police.  They came down the mountain and asked us what had happened.  We told them and everything and told them we would be back up there [Mineral Springs Mountain cabin] and they left.
Ms. Hinson asked if either of them had ventured around to the driver’s side of Rhonda’s Datsun.  “Not till the police got there,” Tim responded succinctly.  He continued:
“When we came back with the police, we parked in the middle of the road.  Todd came down the mountain, while the police were there; they stopped in the travel lane.  They then went toward Valdese.  I never did see them anymore that night after they left (from the scene) right there in the middle of the road.”  
On April 6, 1987, Judy Hinson phoned Jerry Baker who was riding in the blue Toyota owned and driven by Todd Garrou.  Once again, the conversation was recorded.  Baker’s account—especially relative to timeframe—aligned more closely with Mark Micol’s description offered just five days before. “Do you want me to just tell you what I saw?”  Jerry asked Ms. Hinson.
“We were coming from Mineral Springs Mountain.  My dad has a house up there and we were up there playing cards. We were coming home and Mark—I can’t remember who was riding with him (Tim Pons, I think) and myself and Todd Garrou were in my car.  They [Micol and Pons] were already down the hill before we got there and had stopped. When I saw them, I stopped.  I thought somebody had run off the road and they were going to help them get back on the road.  So, we looked around and the door was open; we looked around and didn’t see anybody. And so, we said we better go find the cops.  So we left to get a patrolman.  I think we went and got Feimster….I thought somebody, you know it was Christmas Eve [sic]; I thought somebody had been drinking and had  run off the road.  That’s what we stopped for.”
When Judy asked if any of the young men had walked around to the driver’s side where the door was opened, Baker tersely replied, “Tim Pons did.”  Later he further explained:
“…Tim went around to the other side of the car and he said somebody had been hurt. There is a bullet hole that come [sic] through the seat.  And at that time, I started looking around in the woods [for a possible shooter].  At that time the car was still running.  I didn’t know what was going on.”  
In the course of conversation, Jerry Baker vacillated as to whom was driving that early Yuletide morning.  Initially, he averred that he and Garrou were in his silver-colored Mercury Cougar.  “I am trying to remember; it is hard to remember.  We were either in Todd’s car or my silver Cougar.  Todd’s car was a blue Toyota.”
“We had heard there was a Bertalot boy,” Ms. Hinson suggested.  
“Yes—wait.  No he wasn’t with us.  He had gone on,” Jerry offered.  “He was with us but he was in his car, in front of us.  He stopped and said he was going on home.  We said OK.  I think we were in Todd’s car.”
Baker continued by reporting that he and Garrou stopped near the Home and Garden Center.  He told Judy that neither Brent Smith, Key Mobley, or David Buchanan came through the horrific scene that evening.  Ms. Hinson countered:  
“We knew that Mark Micol and Tim Pons found the car; but, we have heard these other names and really have never known for sure; that is the reason we have started calling and asking questions.  Other people have given us these names.  
“Jerry,” Judy Hinson pressed, “was she in the car? Baker’s response was simply, “No.”
“If we could just know how she got out of the car,” responded Judy—almost pleadingly.  Jerry offered no direct response.
Like Mark Micol, Jerry recalled that Lt. Harry Feimster took down their names and told them to go home.  “Mark left and we went behind him.  I don’t know if he went to the police station or where.”
In a conversation with this writer on Monday Aug. 19 of this year, 58-year-old Jerry Baker spoke of the events of Dec. 23, 1981.  “I can tell you what happened,” he commenced.  
Initially, Baker’s account did not vary much from that offered to the Hinsons in 1987.  
“Me, Todd [Garrou], and Robbie Garrison came down from the cabin headed toward Valdese—we had been drinking and playing cards, he admitted.  We saw a beige car that had run off the road into a ditch. Nobody was around.  We walked up to the car and saw a hole in the driver’s seat and blood.  I said, ‘Boys, we have to get the hell out of here and go get the police.’  We left to find the police and came back down to where the car was.”
When told of Mark Micol’s asseveration that he and Pons left for Valdese and the police after encountering him and Todd Garrou, Mr. Baker amended his story.  “Well, I can’t be certain; I have slept a time or two since then and everything happened so quick, you know; but yes, I guess we did wait for them until they returned with Feimster.”  
During the course of conversation, Mr. Baker also made a slight emendation relative to passenger Robbie Garrison.  “No, Robbie apparently was not with us…Todd was driving, and I was riding with him.”  He couldn’t recall the identity of a third passenger or even if there was one. However, he did remember that Bennie Bertalot was not in Todd’s blue Toyota.  “He was in his own car in front of us.”  
One other matter of significance arose during last Monday’s interview.  On April 13, 1987, Bobby Hinson had a recorded phone conversation with one of Baker’s former high school classmates who opined that he was under the impression that, “Jerry Baker took her [Rhonda] out of the car…The reason that Jerry Baker left that night before the police got there was because he had blood all over his clothes.”  
“I don’t know where you are getting your information, but it is not correct—I had nothing to do with pulling her out of the car,” Baker unequivocally asserted.
Five days after the conversation with Jerry Baker—April 11, 1987—Judy Hinson called Todd Garrou who, at the time, was residing in Charlotte.  Garrou and Baker graduated from East Burke High School together and were friends. They were traveling together on the early morning of Dec. 23, 1981, when Rhonda Hinson’s car was encountered.
Unlike Jerry Baker however, Mr. Garrou was certain of the identities of the passengers inside his blue Toyota.  “Brent Smith and Jerry Baker was [sic] with me.  Me, Brent, and Jerry was [sic] in my car.”  
“Jerry Baker said he knew Brent Smith but that he wasn’t with you,” Judy countered.
“I guess I know who was in the car with me that night.  Brent was with us and the Bertalot boy was not.”
Todd’s account was congruous—relative to timeline—with that proffered by Tim Pons.
“…We were coming down from the mountain; Jerry has a little cabin up there.  We were waiting on Mark Micol and Tim Pons to meet us up there.  As we were coming down the mountain, we saw a car pulled off to the side, and I pulled off to the side of the road—the police were there.  So, I pulled off to the side where that store [Home and Garden Center] was. Jerry got out and talked to Mark and Tim.”
When asked about the number of police vehicles on the crime scene, Mr. Garrou replied, “One police car and the blue light was on; we thought Mark and Tim had been pulled over.”
Then Judy ventured to ask, “Have you ever heard anything about any of [the] boys—a blonde-headed boy—that might have taken her out of the car?”
“No, I never hear anything like that…” Garrou maintained.  
It was Wednesday, Aug. 21, when this writer had the first of two phone conversation with Todd Garrou about the sequence of events on the morning in question.  His 2019 account was consistent with the one offered the Hinsons in 1987.
“When we got there, I remember blue lights flashing.  I really didn’t want to stop.  I was thinking, ‘I am drunk and I want to get out of here.’  But Jerry [Baker] got out of the car to talk to Mark and Tim.  I pulled off the road on the opposite side at the first little street to the right [Hauss Ridge Road] to get out of the way…Brent didn’t get out—he was in the backseat; and, I stayed in the car.  I didn’t want to get out among the police in the shape I was in.”
The interviews with Jerry Baker and Todd Garrou did have one commonality:  both were genuinely shocked when informed that they had been seen just after 1 a.m., on Dec. 23, 1981.  
In an April 1, 1987, recorded phone interview with the Hinsons, the late Reggie Smart recounted that which he observed as he drove through the crime scene—apparently within minutes after the killing of Rhonda Hinson.  A transcribed summary of the conversation encapsulated Mr. Smart’s comments:
“Said when he got to the scene he saw a dark-colored Trans-Am and another car (small Toyota, he thinks) parked on the opposite side of the road from Rhonda’s car. A blond-haired boy was standing on the bank on the driver’s side of her car, and somebody was sitting in the small blue Toyota parked on the opposite side of the highway…I didn’t stop; I’ve wished a thousand times I had, because I could have identified the blonde male if I had.  The driver’s door on Rhonda’s car was open and the interior light was on.  She was in the car; I saw her blonde hair.’  
In none of his several statements did Reggie Smart mention the presence of law enforcement.  According to a police department document, Harry Feimster arrived on the scene at 1:13 a.m.  
Notably, there were at least five young men who were on the crime scene that morning before law enforcement arrived—according to the timelines of Reggie Smart and Mark Micol.  In a later recorded conversation with the Hinsons, Officer Danny Barus did mention that, “Mark Micol and Tim Pons run Harry [Feimster] down over here about Jack B Quick.”  
Yet none of their names—Mark Micol, Tim Pons, Todd Garrou, Brent Smith, and Jerry Baker—appear within the handwritten summary of events subsequently filed by Police Officer Barus—even though there is a block, No. 63, upon which he could have recorded the names, addresses, and phone numbers of witnesses.  
Moreover, in timeline summaries, generated by two Burke County detectives who scrubbed the case at different intervals, only the appellations of Mark Micol and Phillip [Tim] Pons appear.  Absent are the names of every young man who was riding in a blue Toyota driven by Todd Garrou.  But two of the five young witnesses—traveling in either the Toyota or Trans-Am—matched Reggie Smart’s description of a “blonde-haired boy” standing on the bank by the driver’s side of Rhonda Hinson’s automobile.
Editor’s Note:  Mark Micol was contacted along with others mentioned in the story.  He has yet to respond.  When he does, his comments will appear in a subsequent installment.  However a special “thanks” to both Todd Garrou and Jerry Baker who did respond to phone calls and offered comments.
