Covers for Pixy Junket #1-6 by PURE
An original manga created by a former assistant to Masamune Shirow. They put out a few short manga in the early-to-mid 90s, but this marks their only English language release. These six issues were later compiled into a trade paperback.

Licensed by Tokyopop, then by Viz, but both stopped at 12 out of 21 volumes.
The background is in the distant future, a post-apocalyptic world after the destruction brought about by Armageddon. The war between humans (Terran) and vampires (Methuselah) continues, as a struggle between two factions: the Vatican and the New Human Empire.
Yet, amidst the bloodshed and violence, many desire a peaceful co-existence between the two species. However, standing between them and this goal is the Rosenkreuz Orden, a group of vampire extremists who manipulate the two sides and pit them against each other. To combat them, the Vatican special operations group "AX," led by Cardinal Caterina, must use everything they have - even a vampire who preys on the blood of other vampires. Note: Volume 21 concludes the manga in a similar way to the final novel and anime, leaving the plot unresolved due to the author´s death.

The comic store had a sidewalk sale with $1 bins today. I found a couple single issue Viz manga releases from 2003ish. This was back when they were mirroring manga so it would read left to right. Some fun examples of how this caused problems under the cut.
These first two sets of comparisons are from Ceres Celestial Legend. Original Japanese manga caps are on the left, my pics of the Viz English release are on the right.

A big problem with mirroring manga was that any text within artwork got reversed. Above you can see a character's shirt in panel 2 containing the letter "E" above the word "ELLE".
The English release edited this panel to cover the original artwork with a nearly identical design that faced the correct direction once mirrored, though the new text is inside a rectangle. I'm guessing the rectangle was a quick and dirty way to cover up the old text and avoid shading folds for the new text.
If you look on to panel 4 you can see that the English version did not bother to edit the same character's shirt. The top half of a backwards E is visible. Both the edited and unedited shirts make additional appearances later.

Sometimes certain panels were not mirrored, but I don't fully understand why. Choosing NOT to mirror select panels can easily lead to continuity errors or other issues.
Above you can see that the English release kept panel 1 facing it's original orientation. Note how the blonde character and the character in the portrait are wearing kimonos with the left side wrapped over the right. This is the traditionally correct method to wear a kimono (unless you're dead and it's your funeral).
Panel 4 of the English version is mirrored which makes it appear as though the character in the center is wearing a kimono incorrectly. All kimonos in following pages appear to be worn incorrectly as well, since they're mirrored too.
I also saw a few instances of weird choices made when translating Japanese text within artwork. It's unrelated to mirroring, so I'm skipping that stuff.
This next series is Silent Mobius, or as Viz called its issues Silent Mobius Blood and Silent Mobius Hell.

This series has the same problem with select non mirrored panels creating inconsistencies. Here you can see panel 1 of the English release maintained its original orientation while the remainder of the page was mirrored.

The same building appears again a few pages later here in panel 1. The English version is mirrored, so the positions of its towers in relation to each other don't match the other page.
Bonus weird translation direction here btw. I noticed a lot of signs in the Japanese version that originally contained both English and Japanese, but the English release replaced them with awkwardly stretched text in English only. There wasn't even anything on this page to justify mirroring it in the first place. You'd think they could have left it and kept the original signs.
I hit the image limit so I'm going to see if I can reblog this from myself and add another cut. There are two more side-by-sides I want to share.

Hi hi! I have a weird question/thought after seeing the talk about Idia's use of language. There are a lot of things that are just unable to translate from Japanese to English, and some things that get changed as short hand. The whole nerdy implications of Idia using "-Shi" are basically absent from EN, instead he seems to use "Mr." (If I recall correctly) which really doesn't give the same impression? In your personal opinion - is there anyway you'd personally localize it? Stick with the same? Remove it completely? Use "M'lady/M'lord" instead? (haha)
Hello hello!! I love your "M'lady/M'lord" solution more than I can say ♡ It is associated with the past while still being used by some people in present-day just for fun, which is just like how Idia speaks! That would have been so great for the English-language adaptation!
As you say, Idia's honorific for others has (kind of) been translated as "Mr." on EN, but only in a select few places.

For the most part it has just been removed, but the curious continuity makes it seem like he thinks that only Malleus, Azul, Grim and Riddle are (sometimes) worthy of "Mr." (the Riddle screenshots below are even both from the same vignette).

And then there is the Harveston sub-plot between Sebek and Marja, where Sebek refuses to refer to Marja with an honorific until she proves herself worthy of respect (by fixing his plushie).

At that point he awards her with an extremely respectful honorific (equivalent to "-sama," and the same word Silver uses with Lilia).

Marja, however, immediately gives him permission to refer to her in the same way he has been throughout the entire trip.

Idia is a psuedo-narrator for this sub-plot, commenting on Sebek's disrespectful way of speaking in both languages.

But on EN he then proceeds to refer to Marja in the same way as Sebek (and everyone else) does.

This has the unfortunate result of making Idia look odd for mentioning it in the first place, when the odd person is actually Sebek, as everyone else is using a respectful honorific with Marja.

Idia using "M'lady" and everyone else (except Sebek) using "Ms." probably would have been a lot more successful in getting the situation across to people who may not be familiar with such Japanese-language nuances!
As for what I personally would go with...this conundrum reminded me of this amazing joke by @anottercoffee on Twitter:

And I would be very tempted to go for the "fansubber" solution of translating everything literally, but just having the words doesn't mean that the players are going to understand the nuances, and might cause even more confusion.
If "-san" and "-senpai" are just mouth-sounds to someone, they're not going to understand the significance behind Riddle and Azul dropping it from Leona and Riddle's names in important moments, for example.

But maybe that's okay! Because at the moment, the alternative that we have is everything getting removed from everywhere, and no one has the chance to understand anything at all.
The best comparison I have come across is Lord of the Rings and Star Trek, where authors incorporated languages that are completely invented, giving no one any chance of understanding them.

Japanese is a language that already exists, so it seems like it would actually be less of a challenge to introduce world-specific terms like "-sama" and "-chan" for people to either glaze over as a world-building aspect that doesn't interest them, or to gradually adapt to through sheer repetition, so by the end of Book 6 they might have a greater-than-zero understanding of the nuances of a foreign language (much like another magic-school series did with Latin).

The manga is actually approaching the honorifics in a different way than the game and giving “Mr.” to everybody, so Azul’s “Riddle-san," Crowley’s “Trappola-kun” and Deuce’s “Diamond-senpai” are all now Mr. Rosehearts, Mr. Trappola and Mr. Diamond (more here).

So it seems that VIZ Media did not agree with Aniplex USA's localization?
What is going to be the most interesting is the novel! Slated for an August, 2024 official English-language release, the novel is also being overseen by VIZ Media.
This means that we might see "Mr." being used everywhere (to uphold continuity with the manga), but the novel goes much deeper into character relationships than the game, and relationships are what honorifics are all about.
Cater, for example, uses them with everyone:
“Usually, Cater does not ever yobisute anyone. When he calls to Trey, he always adds ‘kun’ to his name...When Cater uses Trey’s name like this, it is only when he is really serious. Only when it is important.” -Twisted Wonderland the first novel

Is Cater going to be calling Trey "Mr. Clover"? And how are they even going to localize these sections describing a feature of a language that is not being spoken? It gives us a lot to look forward to!
In the end, writing out Japanese-specific honorifics into English might actually cause more confusion than it's worth, which is why Twst (and so many other foreign-language-adapting-to-an-English-speaking-audience properties) has gone in the direction that it has.
I like to give them the benefit of the doubt and assume that they know more than we do about what is going on, and that there are important reasons behind the choices they have made.
But I also think that the sheer popularity of the "fansubber" approach to this situation is a good sign that maybe people are sometimes okay with not understanding things, as properties like Lord of the Rings and Star Trek have shown us!
While too late for Twst, it will be interesting to see how this situation continues to evolve in the years to come. Maybe, one day, we will even get an official localization that introduces honorifics directly!
If such an experiment fails it will be most expensive for the localizer, and money is likely a large factor behind why companies might be reluctant to take such a gamble and would rather play it safe and just have everyone say "Mr."

Truck Stop
Christian had never had to go to the bathroom so urgently in his entire life. His bladder almost burst. He chased his Porsche at more than 220 Km/h over the highway. Finally the sign for the exit to the service area. That's when he saw the restroom, right across the street was a parking lot. Okay, it was a truck parking lot, but he couldn't take that into consideration anymore. Running to the restroom, he was already unbuckling the belt and zipper of his suit pants. There were already three men standing at the urinals. Quite hulking, as far as he could tell out of the corner of his eye. Fortunately, one stall was free. He dropped his pants and pissed like a bull. Then he heard a loud fart. Followed by a booming deep laugh. Immediately followed by another fart. My God, what a stench that was. Christian had to get out of here. He pulled up his pants and fastened his belt while turning around. And collided with one of the behemoths standing right behind him in the toilet stall. "Could it be you took my parking spot, fella?" the guy asked. Dirty jeans, dirty wife beater, hairy chest and arms. To see the face, Christian had to crane his head back. A man in his mid-40s with a bald head and unkempt beard. Christian felt uncomfortable. Also because he had pulled up his pants too quickly, a last stream of piss ran down his pant leg. "Payback's a must, lad," the colossus grunted and turned around. Christian was about to push past him when the man let out a huge fart. Christian almost felt sick. The man stepped aside. Christian noticed that the room was filled with six or seven men. Boots, dirty jeans or hi-viz pants, their impressive upper bodies in T-shirts or undershirts. One of the truckers dropped his pants and someone pushed Christian's face into the hairy crack. He held his breath, but just as he came up for air, another fart blew in his face. Christian's eyes went black. When he regained consciousness, he was lying alone on the floor of the toilet. He stood up and realized that he had been lying in a puddle of urine. The whole floor was dirty and stank. He could throw away his suit. But now he had to get out.
In the fresh air, he took a deep breath. Boy, why did he have such a tremendous hunger. Even if he was ashamed of his dirty and smelly clothes, he had to eat something. Urgently. He walked toward the rest area. In the entrance area, he noticed that it was actually a store with clothing. Okay, more like work clothes, of course, but he couldn't go around people like that. He grabbed some work boots, a pair of jeans and a t-shirt. There was no changing room, so he paid and undressed behind the clothing rack. He didn't wonder about the dirty white socks. And about the urine-stained grayed jockstrap. He put on his pants and boots. And then the undershirt. He had foolishly not been able to see that this was not a T-shirt in the package. But anything was better than his filthy clothes, which he simply stuffed into a trash can.
It was late and the selection in the self-service restaurant was slim. Since there was nothing else, he went for the chili con carne. At least the portion was huge. Christian set his tray down on an empty table. He was the only guest for the most part. The chili wasn't bad at all and Christian gobbled it down small. There one of the guys from the restroom sat down to him. And asked if he could have taken a joke. Sure, point of honor, said Chris and stretched out his hand. The two of them slapped hands. A second fella joined them and put three bottles of beer on the table. They toasted. Little by little, the round increased. After the second beer, Chris had to burp like he had never done before in his life. The round laughed bawling. And one after the other did the same. And then Chris farted so loudly that the few other guests and the employees turned around. Again the round laughed up.

"Lads, I've got to take a shit, then I'm off to my bunk," Chris said goodbye to his buddies. When he was out of the restroom, he wiped his paws on his dirty jeans and lit one last cigarette. He still had a few miles to go in his truck tomorrow, so it was time to hit the sack.

The End of Weird Anime

What happens to 80s & 90s anime that arent streaming right now when VHS & DVD completely go away?
The obsession with micro everything, everythings a sound bite, everything is 5 to 7 seconds, even songs, the chorus IS the song now, noone else ever hears anything else.
Only sports, reality TV and competition games can be watched week to week in real time.
All TV series now have to be immediately binged and consumed.
Its essentially bulimia.
Binge Loki in a weekend. Binge Ahsoka in a weekend. Its already done.
Whats next.
What else can I feed the machine with.
No waiting week to week. No such thing as a cliffhanger. No anticipation. No guessing whats next. No watching together as an audience.
Everything segmented, everything bifurcated, nothing in real time, nothing communal.
No season finale, no season premiere.
Same with anime.
Its not VHS or DVD anymore.
Youre not waiting for a release.
Its crunchyroll and Netflix and Funimation and Hulu and streaming.
Its the entire season of Psycho Pass all at once whenever I want to binge and gorge myself.
No asking to be taken to the mall.
No driving to Suncoast Video.
No deciding which $30 VHS or DVD to ask to be bought.
Martian Successor Nadesico or Ayashi no Ceres?
Everything is accessible.
Its less for 3 months of streaming anime than 1 anime used to cost on VHS or DVD.
No downside, if it sucks, move on.
Its not even the old school illegal Crunchyroll which was essentially Limewire for anime where you could illegally download different series.
I didnt waste time downloading for hours on my brothers computer for a shitty anime.
I didnt risk getting a virus on my brothers computer.
I dont have to clear up space.
I dont have to waste time.
I dont have to spend money.
I dont have to risk anything.
I dont have to exert any effort.
Its just, on to the next.
What does the algorithm say a Demon Slayer fan should watch next?
What should I watch now that Attack on Titan is over per the almighty algorithm?
No Viz anime catalogue to pore through.
No RightStuf catalog to highlight and fold the corners of the pages of.
No Animerica to read through every month once it arrives in the mail.
No going through AOL message boards and anime ezboards and geocities and angelfire websites to try to determine what to watch next.
No asking to be taken to your local Blockbuster to check the newest anime rentals in the "Independent/Foreign" section.
Just scroll, select, click and move on.
No need to even download and delete.
Its all streamable, instantly consumed, immediately binged then thats it.
On to the next algorithmic recommendation.
The algorithm never ends.
It always has another suggestion for you.
No meticulously going through myanimelist.com, putting up the hundreds of anime youve watched so far then scouring everyone elses lists to get ideas for new anime to watch.

Ninja Scroll was amazing, I wish I could see Wicked City since its by the same director, Yoshiaki Kawajiri. But I know I wont be allowed to. I had to sneak watch Ninja Scroll at my friends house and her older brother had bought it and thats the only way I even got to see Ninja Scroll at 13.

In Comic-con 2006 Nobuhiro Watsuki was a guest and was interviewed - As for Watsuki, he answered a wide range of questions. He talked about his inspirations and what made his decision to become a manga creator easier, such as a childhood appreciation of Doraemon and his apprenticeship with the manga creator Takeshi Obata, best known in the US for his work on the title Death Note. When pressed for his favorite character, besides the obvious selection of Kenshin himself, Shishio was a close second. People kept on wanting to talk about the anime, especially Watsuki’s involvement in it, not only of the Rurouni Kenshin series but the one of his most recent series Buso Renkin that has yet to be shown on Japanese television. According to the japanese media, more than 90 original goods related to Togashi's works will be sold at the official shop of Yoshihiro Togashi's Exhibition - Puzzle. The exhibition will have 5 main areas, called: "Prologue", "Yu Yu Hakusho", "Level E", "Hunter x Hunter", and "Yoshihiro Togashi" areas.
The "Yu Yu Hakusho" area will display manuscripts with famous scenes and unforgettable lines. The highlight is the carefully selected action scenes of Yusuke, Kuwabara, Hiei, and Kurama gathered in the center of the area.

Where can I read and request manga?
Turns out that finding answers to this can be really daunting for anyone just finding manga. I know that most of it exists, online, for free. However, that can cause a lot of harm to the industry and more importantly, the mangaka who work hard to bring you the content you crave.
Check under the cut for surveys I've found and ways to access officially licensed manga.
You can use regular retailers to buy digital and print: Amazon/Kindle, Kobo, Barnes and Noble, Bookwalker, Google Play, Apple Books, Nook
There are apps available for buying volumes, chapters, using ticket systems to access free content, or with subscriptions.

Please try to support official English releases, because it shows it is a lucrative business decision to continue the manga. Nothing is worse than starting something and being unable to finish it because it stopped getting translated and published. If you like it, do whatever you can to prove it to the mangaka and the translation/publishing industry.

2022 YEAR ROUNDUP: FAVORITE ANTHOLOGIES I READ IN 2022
Separating the long form and short form manga I read this year.   Some one-shot anthologies I read this year that I won’t forget are:

天使も夢みるローソク夜 (Tenshi mo Yumemiru Rosokuya) by A-ko Mutsu [Shueisha, bunko ver]
鬼子母神 (Kishimojin) by Ryoko Yamagishi [Bunshun, bunko ver]
I want to jump straight to my personal highlight: Kenta Fukui has amazing taste because this is one of the greatest best-of anthologies I’ve read. With a special highlight on what he calls the golden era of Science Fiction manga, the 1970′s, this selection is a perfectly even mix of male and female artists of the time who made important contributions to the Sci-fi genre. There’s too many to list here as I find them all to be very noteworthy so please take a look at its anilist page for the full details. 
Speaking of the 1970′s I was able to make even more time for some of the women who got their start during that era. Such as A-ko Mutsu, who immediately captured me with “Tenshi mo Yumemiru Rosokuya”. By far her most memorable stories and a perfect introduction to the fantasy-like world she creates in all of her manga from the 70´s-80´s.  Similarly I got to dive even deeper into the world of Yumiko Oshima and it was her autobiographical work in the Sava series that truly cemented her perspective and worldview to me. In a world full of manga about nothing, the  stories that in all honesty portrayed a luxuriously quiet and uneventful life deeply moved me. Chika Ooya made the switch to the more lucrative career as an illustrator early in her career, but the manga she made before leaving the manga artist life behind is so good varied and this bunko selection really captured that range. With everything from screwball comedy to drama to surreal experiments. On the opposite ends are the unnerving and grotesque stories of Ryoko Yamagishi. This newest best-of compilation themed around toxic mothers includes some of her well known stories like Yasha Gozen, Blue Roses, and Cosmos.
Blue Spring I was able to squeeze in at the end of the year and I already love this rough (in every sense) early years Matsumoto. Truly hope Viz decides to give this one a rerelease.

MHA on Twitter - Part 1 (Manga & Spin-Offs)
Other than endless shipping wars and discourse, Twitter is also a genuinely great source of information on My Hero Academia - because a lot of the Japanese creators involved are active there.  As several people have asked me for the sources I use for my posts, I figured someone may find it useful if I summarize them here. 
Manga
The starting point is of course Horikoshi’s official Twitter account.  He uses it basically only to post his Twitter sketches and retweet (very selectively) some promotion. As far as I know, this is Horikoshi’s only social media presence and he doesn’t make media appearances. @makeste​ made a compilation of different Horikoshi interviews.

@myheroacademia is the official Twitter of the manga, though they are terrible at putting out info, like volume cover art first. But still, it is a useful resource. They retweet the BNHA-info from  @jump_henshubu (which is the official account of Weekly Shonen Jump)
#ヒロアカ is the main hashtag of all things MHA. 
@shonenjump  is the account for the official EN publication by VIZ.  
Shonen Jump News - Unofficial  is a fan account with tons of information about upcoming content, author comments, sales data, etc. 
The EN translator, Caleb Cook has a Twitter account where he used to post his chapter trivia, but stopped it due to fandom drama. The account is now inactive. 
Spin-Offs
Another account worth following is Akiyama Yoco’s (creator of Team-Up Mission, and longtime assistant of Horikoshi). Team-Up Mission is published monthly in Saikyo Jump (Twt:  @SAIKYO_JUMP) and Akiyama has been lately drawing also a lot of the promotional art. In her Twitter, she does lovely promo sketches, both for TUM and for the main Manga.

The recently finished Vigilante spin-off creators  Hideyuki Furuhashi and  Betten Court  (@bet10co10) also both have Twitter account. Though now with the series ending, they will probably moving onto new projects. 
BNHA Smash!  was created also an ex-assistant of Horikoshi, Hirofumi Neda  (@dorori_k) who is also very active on Twitter, though is not involved with BNHA anymore. 
Another ex-assistant is Noguchi (@nstime23) who is now working on his own manga, but still actively posts BNHA sketches (mostly Mirko and Decchan drawings).
I’ll add for the sake of completeness that the writer of School Briefs is Anri Yoshi, but I don’t believe he has a Twitter presence.

Mediation and Conciliation in Civil and Commercial Disputes: A New Horizon

With the launch of the Mediation Rules by the Dubai International Arbitration Centre effective from 01 October 2023, the UAE has introduced a significant piece of legislation at the federal level, consolidating Mediation and Conciliation specifically in Civil and Commercial Disputes viz. Federal Decree Law №40 of 2023 (the “Decree-Law”) which will come into effect on 29 December 2023, thereby repealing Federal Law №6 of 2021 on Mediation in Civil and Commercial Disputes which regulated both the judicial and non-judicial Mediation; and Federal Law №17 of 2016, as amended by Federal Law №5 of 2021, which governs Conciliation and regulates the establishment of court-annexed Conciliation and Mediation centres for civil and commercial disputes; ushering in a new era for alternative dispute resolution (“ADR”) in the UAE.
By nature, the concept of Mediation and Conciliation is profoundly embedded in Arabic culture and Sharia law, as such, the Decree-Law is a welcome step equally for parties and lawyers alike to progress ADR in the UAE. This move aligns with the UAE’s commitment to signing the Singapore Convention on Mediation, announced in March 2022.
Overview
At the outset, Mediation may be conducted in all civil and commercial disputes capable of settlement without conflicting with the existing laws or the public order and morals prevailing in the UAE, without prejudice to the provisions of the local laws that regulate Mediation. This is in accordance with Article 8 of the Decree-Law, while Article 27 of the Decree-Law states about the exclusive competency of Mediation and Conciliation Centre (the “Centre”) to conciliate civil and commercial disputes (i) whose value does not exceed five million (5,000,000) dirhams; and (ii) between spouses or relatives up to the fourth degree, regardless of their value. The adversaries may agree to resort to the Centre for Conciliation of civil and commercial disputes whose value exceeds five million (5,000,000) dirhams, whether before a case is filed or while it is being heard.
That said, as outlined in Article 28 of the Decree-Law, certain disputes do not fall within the jurisdiction of the Centre viz. (i) urgent and interim orders and cases; (ii) cases to which the government is a party, (iii) rental cases heard before special rental dispute committees, (iv) labor cases, personal status cases; and (vi) any other cases decided to be heard before a Centre, committee or other entity of similar jurisdiction.
Establishment of Centres
The Federal Judicial Council (the “Council”) or the chairman of the local judicial authority may establish one or more Centre(s) for Mediation and Conciliation within the territorial jurisdiction of the first-instance courts; and shall issue pertinent regulations to govern the work and operations of the Centre(s). There is also scope for establishing special Centre(s) for Mediation and branches of foreign Mediation Centre(s); with court or the local judicial authority having supervisory authority on its working and formulating the general policies.
Remote Mediation and Conciliation Platform
Article 4 of the Decree-Law empowers the Mediators and Conciliators to conduct Mediation and Conciliation meetings through electronic means and remote communication, subject to regulations and procedures issued by the Minister of Justice, based on the approval of the Council or the chairman of the local judicial authority.
Mediators and Conciliators Accreditation Processes
The Federal Judicial Inspection Department or the local judicial authority shall maintain a roster for registering Mediators from amongst those registered in the experts’ schedule at the Ministry of Justice or with the local judicial authorities, and the expert Mediators named by a decision of the Council or the chairman of the local judicial authority. Normally they shall be selected from amongst retired members of the judiciary, lawyers registered in the schedules of practicing and non-practicing lawyers. Qualification includes practice of the profession for a period of not less than five (5) years prior to their registration in the non-practicing lawyers’ schedule, and other highly qualified experts and international experts in the legal and business fields, who are known for their expertise, integrity and impartiality. Furthermore, Article 15 of the Decree-Law allows appointment of any natural or legal person, known as Private Mediator, entrusted by the Parties with the task of Mediation to amicably resolve the dispute between them, and not registered on the Mediators’ Lists.
The appointment of Conciliators follows a procedure similar to employment. The Federal Judiciary or the president of the local judicial authority will establish the qualification for the post of a Conciliator. The Conciliators must take a legal oath before assuming their duties, and shall be subject to a specific compensation scheme.
Confidentiality and Non-disclosure
The documents and information submitted or agreements or concessions made by the parties to the disputes submitted for Mediation or Conciliation (the “Parties”), and Mediation and Conciliation procedures as a whole are treated with utmost confidentiality, as envisaged in Article 5 of the Decree-Law; except with the consent of the Parties, or as required by law. Exception further extents to document(s) prepared by the Mediator or the Conciliator and signed by the Parties, including the Settlement reached to resolve the dispute, in whole or in part, between them; and the documents and instruments necessary for its enforcement. Failure by the Mediator or Conciliator to adhere to the confidentiality and non-disclosure obligations stipulated herein, attracts disciplinary actions according to Article 40 of the Decree-Law, without prejudice to the provisions of civil and criminal liability.
Prohibitions on the Mediator and Conciliator
Article 6 of the Decree-Law prohibits the Mediator and Conciliator from acting as an arbitrator or expert in the dispute, or accepting to be an attorney in a dispute against any of the Parties regarding the subject matter of the dispute subject to Mediation or Conciliation, or anything arising from it, even after the completion of the Mediation or Conciliation procedures, unless the Parties agree otherwise. Prohibitions further extents to giving testimony against any of the Parties to the dispute regarding the subject matter of the dispute subject to Mediation or Conciliation, or anything arising therefrom, even after the completion of the Mediation or Conciliation procedures, unless authorized by the concerned party or the Parties agree otherwise, except in cases where the testimony is related to a crime; and in case of acting as a Mediator or Conciliator in a dispute where one of the Parties is a spouse or a relative up to the fourth degree by blood or marriage.
Parallel Mediation and Conciliation Structures
While the previous separate federal laws on Mediation and Conciliation laws are now consolidated, these two parallel structures continue to co-exist under the Decree-Law. Concerning Conciliation, under the court-annexed system, mandatory Conciliation is a prerequisite for specific types of disputes prior to litigation proceedings, and with regards to Mediation, voluntary process that can be initiated either through contractual agreement or by court referral, subject to the Parties mutual consent applies. Here, the chief difference is with the role of the “Mediator” opted by the Parties i.e., while in the Mediation process, the Mediator acts as a facilitator aiding the Parties to arrive at an agreement using the Mediation techniques; however, in the Conciliation process, the Mediator only suggests possible paths to the Parties in order to resolve the dispute. Precisely, both the structures share a common goal, which is amicable resolution of the disputes, whether before, or at the stage of the legal proceedings.
Consensual Mediation
In enforcing the agreement between the Parties made either before or after the occurrence of dispute, with the aim of resorting to Mediation for the Settlement of the dispute (“Mediation Agreement”), the Parties may directly resort to the Center to settle the dispute between them, before filing a lawsuit, as per Article 11 of the Decree-Law. This is Consensual Mediation, the initiation of which interrupts legal and judicial deadlines and only resume upon the completion of the Mediation, unless it is concluded by the Parties signing a Settlement Agreement. The procedures for Consensual Mediation are set out in Article 12 of the Decree-Law. In pursuance of Article 13 of the Decree-Law, the court before which a case is filed regarding a dispute brought before a Mediator in enforcing the Medication Agreement, shall decide suspension of the case until the completion of the Mediation procedures, if the defendant urges therefor before making any request or submission on the merits, unless the court finds that the Mediation Agreement is void or impossible to be enforced. The filing the case shall not however, preclude the initiation or continuation of Consensual Mediation procedures.
Court-Referred Mediation
Court-Referred Mediation occurs by virtue of a referral decision made by the subject-matter court competent to hear the lawsuit (“Competent Court”), at any stage of the case, whether proposed by the court with the Parties’ consent or upon their request. Article 14 (3) stipulates that the referral decisions issued by the Competent Court cannot be appealed by any ordinary or extraordinary means of appeal. Mediation shall end as per Article 21 of the Decree-Law if the Parties (i) sign a Settlement Agreement; (ii) agree to end the Mediation before reaching a Settlement Agreement for any reason; (iii) if one of the Parties informs to the Mediator or the Centre of their wish to participate in or continue Mediation; (iv) if the Mediator notifies the Centre, in writing or electronically, that the Mediation: (a) is futile and that there is no possibility of reaching a resolution to the dispute; (b) has been ended due to the absence of any of the Parties from two consecutive Mediation sessions without excuse; and (v) if the Mediation period expires without being renewed.
In all the above cases, the Mediator shall, upon the end of Mediation, deliver to each party any memoranda and documents they presented, and they may not retain them or copies thereof, and shall send a written or electronic report to the Centre on the result of the Mediation within three (3) working days from the date of ending the Mediation for any reason. The Centre shall notify the Parties and the Competent Court, within three (3) days, of the report and the result of the Mediation.
End of Mediation
Mediation if concluded successfully can end by signing the Settlement Agreement. The ratification process of the Settlement Agreement follows three tiers. i.e., from the Mediator to the Centre and finally to the Court. The Mediator shall submit a report to the Centre along with the Settlement Agreement, which the Centre shall send it to the Court within 3 working days. As a final step, the Court shall ratify the Settlement Agreement and issue a decision to end the dispute, wholly or partially, at a session to be scheduled within seven (7) working days from the date of its receipt of the Settlement Agreement. After its ratification, the agreement shall become a writ of execution and an exequatur shall be affixed thereto upon the request of all Parties or one of them, in light of the terms of the agreement submitted to it, and shall be executed according to the procedures stipulated in the Federal Civil Procedure Law.
That said, the aggrieved party has the rights to object or challenge ratification of the Settlement Agreement, by filing an annulment case before the competent Court. The party seeking annulment shall prove one of the reasons viz. (i) lack of legal capacity of one of the Parties to the Settlement Agreement or diminished capacity at the time of its conclusion, (ii) no Settlement Agreement or if the agreement was void or voidable, or if it was made after the expiry of the Mediation period; or (iii) if one of the Parties was unable to present their defence due to invalid service of process or notification of the Mediation procedures or due to them not having been aware thereof for any other reason beyond their control. Pursuant to Article 24 (2) of the Decree-Law, the judgment issued by the court in the annulment case shall be final and can only be appealed through cassation.
Settlement before the Conciliator
If a settlement is reached between the Parties before the Conciliator, either in whole or in part, this shall be recorded in a minutes signed by the Parties and the Conciliator. These minutes shall be ratified by the Supervising Judge, have the force of a writ of execution and the same binding force of court judgments, and are not subject to appeal by any means of appeal. Upon ratification, the minutes shall be affixed with an exequatur upon the request of all or any of the Parties, free of charge, and shall be executed in accordance with the procedures stipulated in the Federal Civil Procedure Law.
