Nex Benedict was a non binary two spirited ingenious 16 year old who died on January 8th 2024 after them and their friend were attacked by three girls in the girls washroom the day prier to their death. Nex had been suspended for so called “fighting” in the washroom when In reality they were being bullied. on the 8th When Nex and their mother Sue Benedict were packing for an appointment Nex suddenly collapsed in there living room Sue their mother quickly called for help. By the time help came Nex was already dead. They were murdered and no one but their family and friends had done anything. When An Oklahoma, lawmaker Tom wood was talking about about the community he called the lgbtq2s+ filth following Nex death. what the fuck Tom wood you say want to protect us kids yet you allow a minor to die and to rub salt in the wound you called their community filth. The only filth here is you Tom you sick bastard. The government of Australia’s northeastern state of Queensland has stunned rights experts by suspending its Human Rights Act for a second time this year to be able to lock up more children.

The ruling Labor Party last month [August 2023] pushed through a suite of legislation to allow under-18s – including children as young as 10 – to be detained indefinitely in police watch houses, because changes to youth justice laws – including jail for young people who breach bail conditions – mean there are no longer enough spaces in designated youth detention centres to house all those being put behind bars. The amended bail laws, introduced earlier this year [2023], also required the Human Rights Act to be suspended.

The moves have shocked Queensland Human Rights Commissioner Scott McDougall, who described human rights protections in Australia as “very fragile”, with no laws that apply nationwide.

“We don’t have a National Human Rights Act. Some of our states and territories have human rights protections [...]. But they’re not constitutionally entrenched so they can be overridden by the parliament,” he told Al Jazeera. The Queensland Human Rights Act – introduced in 2019 – protects children from being detained in adult prison so it had to be suspended for the government to be able to pass its legislation.

Earlier this year, Australia’s Productivity Commission reported that Queensland had the highest number of children in detention of any Australian state. Between 2021-2022, the so-called “Sunshine State” recorded a daily average of 287 people in youth detention, compared with 190 in Australia’s most populous state New South Wales, the second highest. [...]

[M]ore than half the jailed Queensland children are resentenced for new offences within 12 months of their release.

Another report released by the Justice Reform Initiative in November 2022 showed that Queensland’s youth detention numbers had increased by more than 27 percent in seven years.

The push to hold children in police watch houses is viewed by the Queensland government as a means to house these growing numbers. Attached to police stations and courts, a watch house contains small, concrete cells with no windows and is normally used only as a “last resort” for adults awaiting court appearances or required to be locked up by police overnight. [...]

However, McDougall said he has “real concerns about irreversible harm being caused to children” detained in police watch houses, which he described as a “concrete box”. “[A watch house] often has other children in it. There’ll be a toilet that is visible to pretty much anyone,” he said. “Children do not have access to fresh air or sunlight. And there’s been reported cases of a child who was held for 32 days in a watch house whose hair was falling out. [...]"

He also pointed out that 90 percent of imprisoned children and young people were awaiting trial.

“Queensland has extremely high rates of children in detention being held on remand. So these are children who have not been convicted of an offence,” he told Al Jazeera.

Despite Indigenous people making up only 4.6 percent of Queensland’s population, Indigenous children make up nearly 63 percent of those in detention. The rate of incarceration for Indigenous children in Queensland is 33 times the rate of non-Indigenous children. Maggie Munn, a Gunggari person and National Director of First Nations justice advocacy group Change the Record, told Al Jazeera the move to hold children as young as 10 in adult watch houses was “fundamentally cruel and wrong”. [Critics] also told Al Jazeera that the government needed to stop funding “cops and cages” and expressed concern over what [they] described as the “systemic racism, misogyny, and sexism” of the Queensland Police Service.

In 2019, police officers and other staff were recorded joking about beating and burying Black people and making racist comments about African and Muslim people. The recordings also captured sexist remarks [...]. The conversations were recorded in a police watch house, the same detention facilities where Indigenous children can now be held indefinitely.

Australia has repeatedly come under fire at an international level regarding its treatment of children and young people in the criminal justice system. The United Nations has called repeatedly for Australia to raise the age of criminal responsibility from 10 to the international standard of 14 years old [...].

[MR], Queensland’s minister for police and corrective services, [...] – who introduced the legislation, which is due to expire in 2026 – is unrepentant, defending his decision last month [August 2023].

“This government makes no apology for our tough stance on youth crime,” he was quoted as saying in a number of Australian media outlets.

First Nations Development Institute. Information taken from their 'Our Programs' page: Grantmaker dedicated to addressing financial inequality and its many, many negative impacts. In additional to financial aid, FNDI provides job training and participates in policy-making and advocacy, often focusing on environmental concerns, food insecurity, and tribal sovereignty. Some examples of current projects include "Fortifying Our Forests" AKA restoring and protecting sacred land in partnership with the Forest Service, Native Language Immersion Initiative AKA ensuring the survival of Native languages, and Native Farm To School AKA connecting Native youth with traditional means of growing and harvesting food.

Native American Rights Fund A registered non-profit that provides legal representation in matters of Native interest, be that a single individual or an entire tribe. Since their inception, they have won cases that made critical contributions to the advancement of Native rights in the United States. Their efforts have helped uphold tribal sovereignty, compelled museums, universities, and other institutions to return the remains of Native ancestors, and protected the voting rights of pretty much everyone.

Redhawk Native American Arts Council This organization's primary focus is on the preservation of Native American arts through educational programs. We can also thank them for granting scholarships to Native students seeking higher education, and for running a youth program which aims to help Urban Indigenous youth connect with their heritage through the arts.

Seventh Generation Fund A "fiscal sponsor" for smaller community groups that are run by and for Native tribes/individuals, with the focus of preserving heritage and defending tribal sovereignty, as well as continued survival post-genocide. One example of their work is the Flicker Fund, a disaster fund dedicated to supporting Indigenous communities during times of crisis, be that a pandemic, extreme weather, or a severe drought. Another is the Traditions Bearers Fellowship, which provides financial support to tribal community members who carry on pre-colonization traditions.

Quiluete Move To Higher Ground Stephanie Meyer committed a serious of egregious acts of cultural appropriation and exploitation, and made a very large fortune off a very real tribe. This very real tribe now finds themselves living in a tsunami zone and unable to afford a move to a safer area. As of 2022, the move of the Tribal School, the most important phase, is complete, but there's much more work to be done.

Indigenous Women Rising Abortion Fund A fund to provide Native individuals and family access to abortion care, menstrual hygiene supplies, and midwifery. Here are two separate articles verifying their status as the ONLY indigenous specific (and Indigenous led) abortion fund. For more information on how the destruction of Roe V Wade has negatively impacted Indigenous women, look here and here.

South Dakota Historical Society Foundation So, this isn't a Native led or Native specific organization, but, they work closely with Indigenous communities in South Dakota to preserve their heritage alongside the state's history. I recently had a lovely conversation with one of their representatives about the Ghost Shirt their society is sheltering until such a time as the tribe it rightfully belongs to can house it safely. Article about the shirt's repatriation with some cool info on the shirt's history is here.

Indigenous child welfare advocates in B.C. are celebrating a “huge win” in Ottawa on Friday, where a federal law affirming that First Nations, Métis and Inuit people have sole authority to protect their children was upheld in court.

Mary Teegee, chair of the Indigenous Child and Family Services Directors Forum, said she heard the news in a morning phone call from her lawyer, who told her the case had been “won on every point.”

“Of course I screamed, I was really happy, it was just a great wonderful moment for our children — a huge win for our children,” Teegee told Global News. “Our most important resource is our children.”

The Supreme Court of Canada’s decision to deny Quebec’s appeal of Bill C-92 was unanimous. In 2022, Quebec had won in the Court of Appeal, which found parts of the act overstepped federal jurisdiction. [...]

Don’t blame them for misreporting, damn.

It’s not just misreporting. It’s not just ignorance. It’s willful ignorance, willfully deciding that this was “just” a transphobic hate crime and that were no other contributing factors. It’s erasure of the things two-spirit people go through every day and things two spirits have gone through since the genocide began. The willful erasure of the way this is an MMIWG2S/MMIP case, that this is nothing new to our communities, to use Nex’s name and memory as a gotcha against transphobes as if they didn’t know that this would be the result, as if the murder of 2SLGBTQIAP kids was not their goal.

That is what I’m taking issue with. It’s the white queers who say “okay but is their specific identity really important to this?” and the white queers who think it is their place to question someone’s Indigeneity, and the white queers posting corporate comic “remembrances,” and the white queers who constantly only ever see two-spirits as a gotcha moment, because “see, nonbinary people have always existed!” the ones who have no problem erasing the important parts of our identity, that only see us as a tool in their arsenal to fight against pure “transphobia” while ignoring intersectionality and ignoring that there is no amount of perfect quiet queer who will ever be acceptable.

So yes, I’ll blame white queers for their piss poor, disrespectful responses, as I damn well please.

As disabled people around the world and as disabled diasporic Asian queers, we have been grieving heavily and finding as many ways we can to be in solidarity with Palestinians during the last 80 days of the genocide against Palestinian people. 

We want to get money and resources directly to Palestinians in Gaza, however, as many people know, the blockade has made it almost impossible to get cash and resources into Gaza. One way that is possible is getting people eSims. 

The Israeli Occupation Forces have attacked wifi and cellular service over and over again, which stops people from being able to get information, be in touch with their families to let them know they’re alive, and for people to get the word out about bombings and conditions in Gaza. The several times that Israel/the IOF cut off all wireless and cellular service have been chilling and also provided sites where harsh damage, murder and atrocities could occur without media coverage, period, and by the heroic young citizen journalists whose social media accounts are some of the only ways that accurate, up-to-date news has been getting out of Gaza. 

On October 29th, 2023, Egyptian writer and activist Mirna El Helbawi founded #ConnectingGaza to get eSims directly to people in Gaza, with updated information about which carrier is most needed. A few weeks later,  poet and organizer Jane Shi decided to sell her remaining “Immunocompromised people are worth protecting” stickers to raise funds for eSims as well as for Palestinian Youth Movement Toronto’s Community Defense Fund after her friend Divya Kaur (@soft.kaur) suggested fundraising for eSims with art and after her friend Vivian Ly and co-organizer at Masks4EastVan linked Mirna’s instructions in a group chat. Doing so was quick and easy, as her stickers were already listed on her Big Cartel page from when they were previously sold to fundraise for fires and floods impacting predominantly Indigenous families in so-called British Columbia. 

Like many others across her social media feed, Jane was floored when she saw that one of the eSims she purchased, which lasts 20 days and has unlimited data, was activated, meaning that it is currently being used to connect Palestinians in Gaza to the Internet. She excitedly sent the screenshot of the activated eSim to a bunch of her friends and community members, hoping to offer some respite against the high stress of protests, social media posts, and ongoing organizing. 

Amidst the onslaught of violence, criminalization of protest, egregious censorship, and grief, including for the assassination of English professor and poet Refaat Alareer, the small blue “Active” offered a glimmer of hope, however small, however inadequate. 

Poet Rasha Abdulhadi, a disabled, queer Palestinian Southerner, invites us to do everything in our power to refuse the genocide against Palestinian people and in so doing, encourages us to make connections between our struggles and theirs.  In their bio in The Offing and elsewhere, they share, “Wherever you are, whatever sand you can throw on the gears of genocide, do it now. If it’s a handful, throw it. If it’s a fingernail full, scrape it out and throw. Get in the way however you can. The elimination of the Palestinian people is not inevitable. We can refuse with our every breath and action. We must.” As disabled people we owe our disabled kin in Gaza to get in the way. 

In the spirit of many disability justice crowdfunds, like Stacey Park Milbern’s collective fundraiser to buy the Disability Justice Culture Club in 2019, we are organizing this disabled (and ally) crowdfund to buy a shit ton of eSims.  

Anything you can contribute helps. There is power in numbers. We know that as disabled/ sick/ ND/Deaf people we are often poor or broke, but we can pool our money to collectively make a big difference. We also know that there is a rich tradition of poor and working class people donating more than middle class and rich people in general, and of poor and working class disabled people sharing what we have as a form of collective access and solidarity. We also call on people with access to money and/or wealth to contribute as you can.

We are also looking for disabled orgs and collectives to connect with and move money and resources to as asked—we have listed some below. We also recognize that everyone in Gaza is now disabled due to the massive number of deaths, new disabilities, life-threatening illnesses and destruction of medical facilities going on. Such destruction also debilitates the land, water, and air, which will impact Palestinians and all surrounding life for generations to come. We owe our kin in Palestine to throw sand on the gears of genocide with our every breath.

The Palestinian Assembly for Liberation and Al-Awda NY send their highest salutations to the Palestinian Resistance, the Freedom Fighters and Defenders of the indigenous Palestinian people; the sole defense against escalating zionist genocide of Palestinians, the sole hand working against the daily torture meted out by the zionist colonizing usurper, the sole shield against the zionist torture and murder of our children, of our brothers and our sisters, and the sole force daring to implement the rights and protections owed Palestinians under all tenets of international law.

[Ly Two Electric Boogaloo! Hello, everyone. Before I start my speech I also just want to bring light to Jacob Williamson who was an eighteen year old who also died in the past week. He was a trans man. I just have not seen people talking about him and I wanted to have a moment for him. Also before I start the speech I’d like to say “Hello” and “Thank you for being here” on behalf of Representative Liish Kozlowski who couldn’t be here because they have to be there for their own kiddo, but we talked earlier this week and they would like me to remind you that Nex and Savannah are a part of the Missing and Murdered Women and Two-Spirit Indigenous Relatives we have lost. We must uplift and fight for MMIR as much as we fight for trans youth as a whole.

Notes from this week:

I get to make a house I don’t need to go in debt for and also travel without using a car.

It’s building, exploring, crafting, adventuring, and just having fun.

It’s basically just a normal sandbox game with more creatures.

Um, the cats of course. Another note: (From a google search) Zeus is considered the ruler, protector, and father of all humans.

I promise these are not random notes in my notebook. Zeus is the name of Nex’s cat and one of Nex’s favorite games was Minecraft. I work at TIGERRS, an organization for Trans, Intersex, and Gender-Expansive kids — an organization that is youth lead and where those youth decided to create a Minecraft server an exact week before Nex’s murder. And I will be calling it a murder. These are our kids’ favorite things about the game. Nex was sixteen. They liked rock music and head banging. They were kind. They were a straight-A student. And the worst part is, they shouldn’t of had to be. They should have been able to be failing every class, to have been kind of a jerk, and to have the most niche interests the world has ever heard of. They shouldn’t have had to work to be respected. They were a child. They deserved to just be respected. But the beautiful thing is despite how terrible world the can be, they were kind, they were patient. They were remembered for lights, for being a light. Which is why you are here today.

I see Nex in the kids I work with. I see Nex in my little sibling, the same age as them, in them being sixteen, tenth grade, loving Minecraft, nonbinary, and asking them their favorite things about the game. And them looking in the mirror and seeing Nex’s burial shroud instead of their own reflections. When Nex was attacked, they were attacked with another trans friend. A friend who deserves and needs support right now. A friend who deserves flowers and light while they’re still alive, much like the kids here. Nex’s sister is also queer, also dealing with the hate their sibling faces. Our kids here deal with the same, seeing people like them once again not making it to old age. And so in the name of Nex’s love for their friend and their sibling, we will not let despair win. We will see Nex in all the community and things that bring us joy. We will organize and fight, rest, rinse and repeat. We will see Nex in each other and so we will honor and care and protect one another. And we will honor and care and protect our trans kids so this doesn’t happen again. Minnesota is intimately intertwined with what just happened in Oklahoma. We just lost Savannah in Minneapolis to a similar murder. A murder that is using the Trans Panic Defense to plead “not guilty”. The Trans Panic Defense needs to be banned in Minnesota.

This is the homework I am assigning to you today:

Contact your representatives, they’re trying to pass anti trans legislation here and we will not let that happen (I have the website on how to find your rep here up front if you wanna come up here) And you’re going to yell at them for making this state a trans refuge state, but not protecting our native trans siblings from murder. Side note: shoutout to Leigh Finke, who just spoke, Liish Kozlowski, Athena Hollins for doing the work. We see you, we love you, and we need you.

Find a trans youth in the crowd, take the crumpled $20 in your pocket and give it to them so they can go buy a rock album or go to the cat cafe or buy Minecraft or whatever else trans kids don’t get to do because we make them grow up too early. And you will ask them their favorite things, and all of the trans people in your life their favorite things. So if something happens they are not just known as a number. They’re known for naming a cat Zeus, for being patient, for teaching their friends how to head bang safely (by the way, if you’re going to head bang, please do that).

In the words of Aurora Levins Morales, slightly tweaked for tonight, “Imagine winning, this is your sacred task, this is your power. Imagine every detail of winning, the exact smell of the summer streets in which children celebrate themselves, not as an act of revolution, but as an act of every day life. Hold hands, share water, keep imagining so that we and the children of our children’s children can live.” Our struggles are always holding hands. From the genocide of Palestinians, to the genocide of trans people, to the genocide of Native folks and the genocide of people who are in the center of that Venn Diagram. We must be steadfast in solidarity.

This murder happened after attacks on their school district by Chaiya Raichik and Ryan Walters — may they be haunted forever — for having a queer teacher. As school board races start here, pay attention. Do whatever you can to make schools safer for trans students and Native students here. Reach out to trans students across their state borders when you can. Cis people, do better. I do not just mean cis men. Cis women, also get your act together. Kids shouldn’t be fighting for themselves, that’s our job. It is also our job to call an ambulance when needed. Be uncomfortable, invest in mutual aid, flood the streets with tambourines and singing and screaming and cries so that people must pay attention to your love for us. Trans folks, hold each other, uplift each other, also get out on the streets. They are yours. Another world is possible.

May Nex’s memory be a blessing, may be found in everything you do for community, may be rooted in the earth in the cycle of rebirth, may you remember them in stories of gods in the sky, may you remember that they were not alone. They were loved. They are still loved. And the fight continues on. There’s more to their memory than just an excuse and reason to fight, than just being a number, than a vigil. They’re when our kids say their favorite things with a smile. ]

it feels like every second kid in the country is trapped in some fucked divorce/seperation proceedings with the most maliciously incompetent cops, social workers, lawyers and parents. and then everyone wonders why youth crime and shit are so high. and then fucking Christians and other assorted dipshits acting like the solution is MORE nuclear family somehow, like it represents people not being devoted to eachother and not the economy being fucked and families being abusive.

Opposition parties are calling for Minister of Child and Family Development Mitzi Dean to resign after a Tyee report revealed a damning audit showing consistent failures to meet ministry standards for protecting children. The audit found no evidence or documentation that social work teams had made required visits to check on children in at least 14 foster care placements. Karin Kirkpatrick, the BC United critic for MCFD, said the audit revealed “a complete neglect of youth for extended periods.” This was “a clear violation of policy,” Kirkpatrick said during question period Wednesday. “Despite assurances from the minister, the situation has only gotten worse.” The special audit was commissioned by the ministry after two Indigenous children were placed in a home near Chilliwack where they were horrifically abused for months, with no visits from social workers over a seven-month period. One of the children, an 11-year-old boy, died of his injuries in March 2021.
