Vigilantes Ch. 125 Review (the penultimate one, sob!!!)
It’s always hard to say goodbye. But it seems like we’re getting a good ending that fits thematically with both this series AND with MHA, and that gives me such a comforting feeling!!! Ok, the big news first…..
KOICHI IS A PRO HERO IN NEW YORK CITY!! KOICHI GETS THE SPIDER-MAN ENDING! And he’s no longer “just” the ground crawler or the wall crawler…he’s the SKYCRAWLER! Bless him for keeping the hoodie on his uniform.

Koichi examining his scar in the mirror was a great callback to Chapter 1, when Koichi got into his first battle with Soga (defending Pop!) and Soga slashed his cheek in the same spot.

Speaking of, Pop is still recovering in Naruhata, but I like that Soga is watching over her while Koichi is away. Considering that the series started with Soga as a villain assaulting Pop, seeing him go out of his way to take care of her is sweet. It’s also a great parallel to MHA, where this week’s chapter has Shoto convincing Dabi that he can choose a different path for his life. In case anyone’s curious about whether the MHA villains will be given second chances….yeah, they will.

And then, there’s AFO. He’s confused and baffled how an “utterly average civilian” could become so powerful. Circumstance, life experience, and “force of will” are not things he can manipulate or control, no matter how much money AFO spends.

AFO is very willing to pay a very exorbitant cost to keep OFA from interfering with his plans to live forever. But even with his funding, how can he possibly stop civilians from rising up and taking action? How can he destroy their hope? He can destroy their Symbol of Peace…..

Thinking about Tim’s 16th birthday and how it contrasts and compares to what his 15th birthday could’ve been…
Tim and Jack both forget Tim’s 16th birthday is coming up, but Tim’s new stepmom Dana remembers, despite only being around for at most one other birthday. (She became Jack’s girlfriend when Tim was 14 and married Jack when Tim was 15, so the only birthday she’d know him for was the 15th.) Once Dana reminds Jack they plan the surprise party with all Tim’s favorite foods and friends—all in all a much better reaction to Tim’s 16th birthday than what Bruce and Alfred did.
But here’s the thing. Tim’s 15th birthday occurred during No Man’s Land, when the islands of Gotham were cut off from the mainland and it was considered an illegal and dangerous place to be. Tim ran away to NML around July 7th, and was still there 2 weeks later (using this timeline for reference) sometime after which his dad managed to get him extracted from NML via a helicopter (lol). This means Tim was in No Man’s Land at least from around July 7th to July 21st…and Tim’s birthday is July 19th.
There’s no way to be confident what happened for Tim’s birthday, because it had never been mentioned yet. One idea is that in the chaos, Tim & Jack once again forgot. However, this wouldn’t quite explain both Dana knowing Tim’s birthday and being surprised when they forgot it.
Dana could have looked it up or asked when she became Tim’s stepmom, but also. We know Dana was with Jack the whole time Tim was in No Man’s Land. Considering how stressed and worried Jack was about Tim being in No Man’s Land, my guess is he could’ve made a big deal about Tim turning 15 while he was stuck in NML. If Jack made a big deal about the date, that would explain why next year, Dana remembered Tim’s birthdate was coming up, despite having never celebrated it before.
Edit: Remembered/found a panel in Robin #125 where Tim says Jack used to proudly tell stories every year on Tim’s birthdays + Christmas about Tim’s grandpa lying about his age to enlist in WW2 at 15. I dunno if this adds much to my analysis but it’s deeply ironic and funny to me.

re-reading the jake kim arc for funsies AND i just want to say something : no hate to yeonhui but if either one of sinu or jake was a woman their story would be seen as one of the greatest romances ever written... but ptj wrote sinu - a character that is synonymous in the webtoon with the ideal of "romance" - into a relationship that is as bland as coleslaw. maybe it just irks me because there is no real emotional depth that i can draw from sinu's storyline and it feels like he was just given the token "happy ending" with npc 125. and there are two instances that strike me particularly - 1) the "just who am i to you" "my everything" exchange between sinu and jake in 2nd affiliate, and 2) "jake, everything is for you" during the hunt for big deal.
sinu and jake just exhibit such extraordinary levels of soul-matism. if lookism were a romance webtoon, and again, if either of them were female, the perception of their relationship would be immediately altered among a greater portion of readers. sinu always needed someone strong to share his burden for protecting the street and the people he cared about, and jake was just the right person at a not-so-right time. jake who always viewed the idea of romance as a vulgar, perverted, depraved caricature of itself because of his father's infidelity and emotional neglect, had his life altered by sinu's passion and romance, the two ideals with which he protected his family and street.
jake let go of his morals and self-respect and knelt before the same gangsters that he despised, ran an illegal gambling operation, had his teeth knocked out quite literally, went to juvie, lied to and manipulated the people who cared about him, and sacrificed the better days of his youth just for his revenge, his eternal quest to get sinu back. he was even ready to leave sinu with mitsuki, if that's what made sinu happy.
and sinu survived everyday in the indescribable hell of the circus with nothing but his steadfast belief in jake keeping him alive - his unfaltering hope that jake will come for him, no matter what.
the heteronormativity in shonen makes me chuckle sometimes because the writers will literally pen a love story for the ages, a Greek tragedy of star-crossed lovers between two "bros", and call it a day.

*SIGH* Finances in the shinobi world... I have thought about this way too often. It should've been a way bigger part of Naruto's worldbuilding, considering the many money driven motvations we see in the story, but it sadly isn't. For the sake of this post I will convert everything into USD, but feel free to convert that into any currency of your choosing. This will be a mixture of canon and headcanon, you've been warned.
Money in the shinobi world
Let's see what the wiki has to say about money in the shinobi world first.
The ryō (両) is the currency used in the Naruto world. It is based on an old Japanese gold coin that was used in Japan before the Meiji period. It was later replaced by the yen. The exchange rate of 1 ryō is 10 yen. Although money isn't focused on much in the story, certain prices and sums of money have been mentioned. For example, Asuma Sarutobi had a bounty of 35,000,000 ryō (...) The Mujina Bandits made a demand to the Ikkyū Madoka, the daimyō of the Land of Fire, of a ransom of 500,000,000 ryō for the safe return of his son, Tentō Madoka, which Ikkyū had to make preparations to gather.
35,000,000 ryō are about $430,000 while 500,000,000 ryō are about $6.24 million.
Shinobi usually earn their money from completing missions. The rewards for these range from 5,000 ryō for a D-rank mission to more than 1,000,000 ryō for an S-rank mission.
5,000 ryō is about $60, while 1,000,000 ryō equate to about $12,400.
Currency
There are three types of currency in the shinobi world, one being copper coins, the other actual money bills and the last one being gold ingots. Copper coins are the most commonly spent currency, while ingots are the rarest. Bills start from 100 ryō ($1.25) and go up to 10,000 ryō ($125), while there are ingots from 10,000 to 1,000,000 ryō ($12,500).
Pricing
In Naruto Part 1, we see Naruto and Jiraya bump into a man who says his designer jacket is worth 10,000 ryō ($1250), to which Jiraya (who is loaded btw) says that designer jackets of that quality aren't usually "that" expensive. Aside from revealing designer brands exist in the shinobi world, it also implies that the pricing in Naruto isn't comparable to our world, since 1000 dollars for a designer jacket isn't outrageously expensive.
While hubs of economy, the ninja villages are mainly used to produce ninjas and economic growth is not their first priority. Most money is made (and exchanged) in the capital cities of the continent, which is where most of the rich and wealthy live.
I do think there is some basic universal healthcare in the hidden leaf village, however, long term/large scale treatments often have to be paid out of pocket. (ex. Mukai Kohinata, Shisui Uchiha)
Salaries
Given the large majority of missions go along the hokage village and a part of the money is taken by the village and the large position of power that the hokage position provides, it's reasonable to assume the hokage earns quite a lot. My estimate is about 100M ryō, which equates to $1.25M.
The average genin, assumed they do 4 D-Rank missions a week and pays an income tax of 20%, makes about $10,300 anually, most of which will be spent on ninja weapons and training equipment.
Aside from official missions, there are also ways to 'illegally' hire ninja, especially when talking about rogue ninja outside of the village. They are directly payed without paying taxes to their village. Aside from state sponsored killing, there are other missions to do, like transporting intel or other goods, which Sasuke most likely could've done during his time in exile, considering he traveled so much. People with ninja skills are a rarity outside of the ninja villages, so hiring a nukenin to do a job for you is a viable option, at least for more wealthy civilians.
When talking about Sasuke in Orochimaru's hideout, I think he gets an allowance from Oro as well as making money doing "illegal" missions. I think Orochimaru comes from a wealthy family and he makes a lot of money from his lab work and experiments. You can hire him/his men for intel gathering and experiments, as well as medical services if you're a nukenin. Out of the sannin, Oro is probably the richest of the three of them.

Why Mori indirectly killed Oda + Why he led Dazai out of the pm
A very short analysis
Killing Oda was the most logical solution, it was; to kill a lower member or to kill more pm members that possibly were higher rank, it didn’t make sense, and even Dazai in the light novel dark era recognized it:
Dazai glances at the at the muzzle still pointed at his face, following which, he turns back towards the center of the room, standing right in front of Ougai, quietly speaking. “I’ve been thinking. Between the mafia, Mimic, and the Black Special Ops Forces, who is the one manipulating these three organizations? When I realized Ango was a member of the Special Ability Department, I reached a conclusion. That conclusion was that this is the Special Ability Department’s plan. Their motive was to let the mafia and Mimic, two illegal organizations causing the government a headache, to kill each other off. If they were lucky, they would both perish together – I thought this was a playbook written by the Special Ability Department, that this was the real reason behind this war. But I was wrong.” Dazai pauses after these words, looking at Ougai. Ougai smiles, shrugging his shoulders, “I’m listening.” “The person who painted this picture was you, Boss. Using the illegal organization Mimic as a threat, you pulled the Special Ability Department onto the negotiation table. And the pawn in the center of this plan was Ango.” Dazai speaks with half lidded eyes. “Boss, the reason you sent Ango to infiltrate Mimic’s ranks was not to obtain information on Mimic. Because you knew that Ango was a spy from the Special Ability Department from the very beginning. Am I right?” Ougai does not affirm or refute this, only saying, “Huh.” “If you think about it that way, the meaning behind several truths will change accordingly. At the same time Ango passed us insider information on Mimic, he had to pass that information on to the Special Ability Department as well. By what they talk about, its pretty obvious that Dazai recognized it was a logical solution, yet he had got very attached, Dazai has little to no problems in using people, but the problem was that Dazai had got too attached with Oda. Not to mention that getting the envelope was beneficial to the port mafia, it was like getting rid of two birds with a stone or however it is said, and as I've said a lot of times, Mori goes to the option that benefits everyone in Yokohama or at least to the pm.

Mori led Dazai out of the pm because of two reasons:
He was afraid Dazai would aspire to take his position as a boss
He wanted Dazai to learn a lesson
It's mentioned that he is afraid of Dazai so we aren't going to talk about this topic right now, but about the lesson topic; Mori wanted Dazai to become more like him in case Dazai were to take the boss position, but Mori didn't thought that Dazai had grown that attached to Oda, and while Dazai did recognize that killing Oda was the most logical solution, he didn't like it, he would have preferred that more members had lost their lives than Oda losing his, and therefore to Mori; Dazai didn't want to learn the lesson.

The basic gist is that the United States government is using BlackRock to permanently house all the illegal immigrants they've been letting in. So you know how companies like BlackRock have been buying up large amounts of the single family real estate, and a shitload of the properties that they bought are in the state of New York.
And New York just declared that they're gonna pay homeowners there a $125 a day to house a migrant.
$125 a day per migrant, per bedroom. That means the taxpayers of New York are gonna be paying $3,750 per migrant per month. Now think about all those houses that BlackRock bought. Let's say they got a 4 bedroom.
That means they can house 4 migrants. And at $3,750 per migrant, that means that property would now be bringing in $15,000 a month.
And if any of those migrants have a family, that's additional money on top. And BlackRock doesn't have to worry because the money's guaranteed by the government in New York.
I mean, you have to think so far in Biden's presidency, anywhere from 12 to 15,000,000 illegals have crossed over. And then because of all the incentive programs that New York created, you enter this country illegally, you'd have to be stupid not to go to New York.
You're gonna get paid. You're gonna get fed. You're gonna get housed all for the price of either a bus trip up there or maybe you can catch one of those flights that Biden's been sending under everyone's radar.

230605 Rough Papago translation of of EXO-CBX’s fourth legal statement
"This is Lee Jae-hak, a lawyer for Lin, a law firm that acted as legal representatives for Baekhyun, Xiumin, and Chen (Byun Baek-hyun, Kim Min-seok, Kim Jong-dae, hereinafter referred to as "artists").
On behalf of the client, the legal representative filed a complaint with the Fair Trade Commission (hereinafter referred to as the "Fair Trade Commission") against SM Entertainment (hereinafter referred to as "SM")'s "abuse of trading status." In this regard, SM distributed an official press release on the 5th. I would like to refute this case by case. In addition, I would like to tell the fans in detail about what the members have been doing.
1. Tao is a Chinese trainee's issue, and it is a different case from the beginning, and it is not reasonable to argue that the FTC's existing judgment, the correction order issued twice against SM, and our report are wrong.
SM claims that the terms of the contract for the artists were already recognized as legitimate in 2018, citing a court ruling against Tao. But this is not true.

In particular, after the above exclusive contract, Baekhyun was assigned as a member of the EXO-K (K stands for 'Korea') team and worked in a Korean or domestic unit among EXO, so it is even more unfair to sign an annex agreement to extend the period for three years due to overseas activities. In the case of XIUMIN and CHEN, no Korean or overseas activities were set at the time of the exclusive contract, but they signed an annex agreement to extend the three-year period first, and they were assigned to do Chinese activities after the exclusive contract.
As already pointed out, SM is not ordered to apply the extended contract period to all trainees without considering the individual circumstances of the trainee while signing an exclusive contract with an aspiring celebrity, according to FTC Resolution No. 2011-002 (2009 Seogyeong2741).
Nevertheless, SM is uniformly extending the exclusive period of 3 years through an annex agreement. This is clearly an illegal act that directly contradicts the FTC's corrective order.
SM, in particular, has signed an exclusive contract in advance when it was a trainee prior to its debut, but it is not allowed to extend it uniformly through an annex agreement without determining when it will debut, which activity group or overseas activities.
The artists understand that SM is still signing an annex agreement to add three years to the name of overseas activities when signing contracts with trainees. This is a criminal punishment case that requires up to two years in prison or a fine of up to 150 million won as a "person who fails to comply with corrective measures under Article 49 (1)" under Article 125 Subparagraph 1 of the Monopoly Regulation and Fair Trade Act.
It is just embarrassing to see the continued rationalization of SM, which has continued to make unfair contracts without correcting them even after receiving two corrective orders. This may be why the FTC should conduct a full investigation into SM's exclusive contracts with trainees and artists.
2. Unlike SM's press release, the party's lawyers and artists have not yet been provided with the settlement data.
At 8 a.m. today (5th), SM distributed a press release that said it would provide a copy of the settlement data, and accordingly, the legal representative provided a copy of the artists' confidentiality pledge to SM.
However, SM has not provided any settlement data until 6 p.m., when today's work and time are closed, saying, "We are not ready for settlement data yet."
3. Baekhyun, Xiumin, and Chen would like to explain in detail the process to EXO fans who are having dizzy and anxious days with worrying news, not happy news.
3-A. Continuous conciliation and promotion of atmosphere
We, who signed an exclusive contract with SM in June 2010 and May 2011, respectively, received an exclusive contract re-contract from SM for a total of 17-18 years, extending 5 years to the existing contract around December last year, a year before 12-13 years came.
First of all, during the renewal process, our members appointed a lawyer for review, and at that time, the contract was unfair, so we asked for coordination eight times, but SM did not accept it. We only saw the firm determination from SM to change nothing in the contract. In the end, almost nothing was reflected in our request.
Although we thought it was unfair, the reason why we had no choice but to reach the seal was because of the continuous conciliation and the promotion of an atmosphere that was hard to resist. I have heard that if an individual does not comply with the renewal contract, the rest of the team or the entire team could be disadvantaged.

He also said that he would cancel this contract at any time because the contract has not yet been renewed. At that time, Baekhyun was serving in the military.
Baekhyun had about a year left until the end of the exclusive contract to maintain EXO's smooth activities amid SM's contradictory attitude and different members' contract termination, but he had no choice but to sign the contract again with a shrunken and resigned mind.
I asked for coordination eight times, but it was an embarrassing process to use the word coordination, and it was a re-contract that did not reflect the request at all. Nevertheless, I signed the re-contract only because I wanted to keep my loyalty with EXO members and protect EXO. To be honest, it is true that I signed the contract almost as if I had given up.
Our lethargic work at the time was even thought to have nothing to do with the closed and collective atmosphere unique to SM and the situation such as "gaslighting" that has recently filled the media landscape.
3-B. Beyond unfair content, unfair process
Not only the contents of the contract but also the process was unfair.
At that time, even though the contract had to be issued immediately after signing, SM retrieved the contract and it was not issued to us. The contract could not be issued until a few days later at our request.
Furthermore, due to the phrase that the down payment will also be paid one year after the date of signing, our members still have not received all the down payment.

3-C. No explanation for significant changes in the company

The idea I felt during the acquisition was that the company didn't care about us at all. We were just accessories, and I felt sad that we were just subject to what the company said.
3-D. Revenue breach that artists have been going through for decades
When issues such as Like Planning filled the media, only the interests of SM and shareholders were long described as infringement, but no one noticed that the interests of our artists and staff who worked with SM were also greatly infringed.
It is well assumed that a significant portion of the profits that will be written in our statement of accounts over the past 12 to 13 years have slipped out in an unreasonable and unconvincing manner, whether it be producer fees or royalties.
Before SM says, "It won't happen like in the past from now on," I think there must be a process of knowing exactly what the 'past' actually was and explaining it to our artists, fans, the public, and shareholders. I think a fresh start is possible from there.
When the company was in disarray, it was the artists who were more disarray than that. Everyone had doubts, but we couldn't be hasty.
3-E. Request to provide settlement data 7 times
We never imagined that it would be so difficult to get the settlement data from the company.
It is the basic right of artists to receive settlement data. Can't even enjoy these basic rights even though they've been together and worked hard for more than 10 years. It was so disappointing. And the doubts grew even more and more.
I didn't expect the company to think it was so wrong to check the numbers and get help from an accountant or lawyer.

How can we understand this shamelessness, which is clearly stated in the contract as 'providing data', but has claimed that it only means 'right to read'. Did the Fair Trade Commission, as well as the court, really think that SM's poor claim that "data provision" in the contract is only a simple right to access?
I don't think the settlement data should be confidential at least to us, the parties involved. All the experts we consulted have unanimously agreed that there is a clear difference between "provided" and "right to read."
Only some media and YouTubers who are close to SM agree with the claim that it is only a "right to read." Do you think the Fair Trade Commission and the judicial authorities will accept SM's existing poor claim that it is only a "right to read"?
3-F. A message to EXO fans
If someone was taking advantage of the memories, love, youth, effort, and passion that members and fans have shared for 11 years, I think this should be corrected. More than anyone else, I hope it was fair, but if it wasn't, I believe it needs to be fixed a little.
If the "SM community" is forcing artists to condone their injustices, I think we should make a little noise about the coercion.
We value EXO members more than anything else. We've spent half of our lives together with the members. We will never betray such members, and we will put EXO first in any situation.
We will leave it up to the public and our precious fans to decide whether we are courageous to shout our rights, and whether it is an act of betraying EXO members.
Above all, we're not afraid of anything if our fans are there."

Whatever you're thinking about this, it's actually 100 times worse. I highly encourage people to read this journal article from 2011 by anthropologist Nancy Scheper-Hughes to get the whole picture. It describes in detail how and why this happened.

In 2005 new allegations of organs trafficking at Abu Kabir surfaced and Hiss admitted to having removed body parts from 125 bodies without authorization. In exchange for a guilty plea, Hiss was not pressed with criminal charges by the attorney general. He was removed as director but given the title of chief pathologist at Abu Kabir, and to this day he remains the state of Israel's highest-ranking state pathologist.
The author of this article, Scheper-Hughes, had an interview with Hiss and here is how he describes himself.

There's so much more in this article that I'm 90% sure violates Tumblr's policies if I share them.
This article also covers many things like (but not limited to) the medical abuses faced by Palestinian prisoners at a special detention facility, at Nes Ziyyona which is near Tel Aviv), how the organs would be harvested to avoid suspicion and detection by the families of the deceased, and how people have been whistleblowing on this issue for ages while institutions like the Israeli government and The New York Times chose to sweep it under the rug.

Smoke Covers Manaus, Brazil
Fires in the region have caused extremely low air quality; 2 were arrested on suspicion of illegal fires

For the second consecutive day, dense smoke from the fires covered the landscape of Manaus on Thursday (12), reducing air quality to risky levels for health.
The situation has been recurring for weeks, due to fires that, according to the city hall, are in the metropolitan region. Data from the Selva project, developed by the State University of Amazonas, show that several points in the city had very poor air quality. During the morning, one of the stations recorded a concentration of fine particulate matter of 298.9 µg/m³ (micrograms per cubic meter).
According to the scale of the National Council for the Environment, the air is considered very poor from 125 µg/m³. The smoke led the city hall to suspend events such as the Boi Manaus cultural festival. The event was scheduled to take place between the 21st and 23rd, but has been postponed indefinitely. The Tururi Fair, which was supposed to start this weekend, has also been suspended. It had already been announced that the Manaus International Marathon, which was scheduled for October 15th, has been postponed to December.

Personally attacking Sen. Risa just because she could not answer her questions regarding OVP's mandate, the spending of illegal 125 million confidential funds, and a lot more? Her projects, kung tutuusin hindi naman ganon kalaki, permanent office and museum lang naman. And bakit may museum? Ano ilalagay niya dun? Pano naging significant yun sa buhay ng mga tao? As a spare tire, sobrang laki ng confidential funds ni SWOH! This is very alarming since may reputation siya (i mean thousands of ghost employees sa davao).
Moreover, Rep. Paul Daza specifically asked her if she was aware or familiar with the public WiFi program. However, she responded with "Timeout" after messing up so bad (like wtf the secondhand embarrassment 🤧), she couldn't answer the question herself and opted to let her USEC respond, even though it was directed at her. What's even more horrifying is that her supporters are still actively praising her, painting her image as someone with an iron fist. The way they red-tag everyone na against sa reyalidad na meron sila, labeling them as supporters of NPA, is truly terrifying, especially considering that there have been abduction cases involving activists. Na natatakot lang daw ang opposition kasi supporters sila ng NPA at sa kanila ginagamit ang confidential funds para di na sila makapagrecruit ng mga kabataan. Paranoia lang daw ang meron sa mga taong nag-iisip na baka binubulsa ang confidential funds. How can you even change that mindset kung tiwala sila mismo na sa security napupunta ang funds kahit wala naman yan sa mandate ng OVP at ng DepEd?
Speaking of DepEd, shortage of classrooms and learning materials, hindi pagtaas ng sweldo ng mga teachers (kasi daw if taasan ang sweldo ng public teachers baka lumipat sa public ang mga nasa private schools teachers at baka maubusan ng teachers sa private schools 🤯), ang pag-alis ng pangalan ni Marcos sa Diktadoryang-Marcos sa learning materials (historical revisionism?), toothbrush drill, mandatory ROTC (baka daw lusubin tayo ng China, e di ba nag fei shang gao shing naman si SWOH?), at ang pag alis ng visual aids sa loob ng classroom. Ito dapat tinututukan niya as sec of deped, hindi yung security na hindi naman kasama sa mandate niya.

"Mutual Consent Divorce: Maintenance Waivers and Legal Implications"

Order: Crl. Revision filed by the revisionist husband Gaurav Chopra was allowed as the respondent-wife had already waived off her right to claim maintenance at the time of divorce.
Crl. Revision of the Wife was dismissed.
Background
This is a case where Divorce based on mutual consent was allowed by the Family Court between the parties.
Fact
The marriage between the parties was solemnized in February 2004 according to Hindu rites and customs. A son out of wedlock was born in December 2004. Things were all well till August 2006 & thereafter due to differences between them, they started living separately.
Both parties filed divorce by mutual consent u/s 13B (1) of the Hindu Marriage Act before the District Judge, New Delhi.
Out of all the terms and conditions of divorce by mutual consent one of the Terms was that the wife will not claim any amount of money by way of stridhan, maintenance, compensation, damages, etc. (past, present, and future) from her husband.
It was also agreed between the parties that the son, shall remain in the custody of his mother till he attains the age of majority.
The husband was given visitation rights to visit and meet his son once a month.
The divorce petition was decreed in August 2007 on the terms and conditions agreed between the parties.
After six years of divorce, a maintenance petition was filed by the son through her mother in the court of Principal Judge, Family Court, Gautam Buddh Nagar in the year 2013.
The maintenance petition was allowed by the Family Court in November 2019 granting maintenance in favor of the son at the rate of Rs.15,000/- per month from the date of filing the petition the father used to pay the same to his son.
The wife also filed an application before the Family Court claiming 25% of the income of the husband as maintenance in February 2020.
The wife also moved an application in August 2020 claiming interim maintenance @ Rs. 50,000/ per month.
Submission of the Husband
The husband objected pleading that the divorce petition was decreed with mutual consent and the wife had agreed that she would not claim any amount towards stridhan, maintenance, compensation damages, etc.
The Family Court allowed the application of interim maintenance awarding Rs. 25,000/- to the wife.
Submission of the wife in person
She is facing acute hardship.
The son is studying in Toronto Canada.
So long she was able to manage the expenses she didn’t claim. Now she is unable to as such she has filed a maintenance petition and the Family Court has allowed a very meager amount of Rs.25,000/-
Law
Once the wife waives her right to maintenance from her husband at the time of divorce and the divorce decree was passed on the terms and conditions of the agreement, it is not open to the wife to claim maintenance from her husband in the future.
Section 125(4) Cr.P.C. also provides that no wife shall be entitled to receive the allowance for maintenance from her husband if she is living separately by mutual consent.
Observation of the Court
The wife has waived off her right to claim maintenance by filing an affidavit in the divorce petition as such the Revision petition filed by the wife claiming maintenance, itself is not maintainable and the Family Court has committed gross illegality in granting interim maintenance @ Rs. 25,000/- per month to the wife.
