Gemeinsame Erklärung zu Klimaprotesten

Wo bleibt die Verhältnismäßigkeit?

Statt endlich gegen den umweltschädlichen (Auto-) Verkehr vorzugehen, dessen Emissionen trotz aller (kaum sichtbaren) Maßnahmen weiter steigt und das von allen Staaten der Erde auf internationalen Konferenzen gemeinsam beschlossene 1,5° Ziel gefährdet, werden diejenigen kriminalisiert, die sich für das Ziel einsetzen, die auf 8 Milliarden Menschen angewachsene Erdbevölkerung auch noch in 10 Jahren ausreichend zu ernähren.

In der gemeinsamen Erklärung heißt es deshalb abschließend:

Die Dringlichkeit des Problems erkennen!

Die Verantwortlichen sollten sich mit dem Ruf der Protestierenden nach wirksamen Maßnahmen gegen die drohende Klimakatastrophe auseinandersetzen und endlich ihren verfassungsrechtlichen Pflichten nachkommen. Klimaschutz ist Menschenrecht, das haben Gerichte rund um die Welt bereits entschieden – und dieses Menschenrecht hat jeder Staat zu achten. Die "Letzte Generation" wählt drastische Mittel, um auf das bis heute andauernde, drastische Versagen der Klimaschutzpolitik hinzuweisen. Die Dringlichkeit der Klimakrise haben die meist jungen Betroffenen nicht zu verantworten.

Motivation, Ziele und Kontext entscheidend - Ermittlungsmaßnahmen müssen Verhältnismäßigkeit wahren

Zur juristischen Beurteilung heißt es:

Mit dem Vorwurf der "Bildung einer kriminellen Vereinigung" nach § 129 StGB fahren die Strafverfolgungsbehörden schweres Geschütz gegen gewaltfreien Klimaprotest auf, der mit der Einhaltung der Klimaschutzziele ein verfassungs- und völkerrechtlich legitimiertes Anliegen verfolgt. Angesichts der weitreichenden Grundrechtseingriffe, die durch diesen Vorwurf gerechtfertigt werden, halten wir die Ermittlungen der Staatsanwaltschaft Neuruppin nach § 129 StGB gegen Menschen aus der Bewegung "Letzte Generation" für unverhältnismäßig.

Die strafrechtliche Verfolgung von Mitgliedern der Bewegung "Letzte Generation" hat eine neue Qualität erreicht. Am vergangenen Dienstag, den 13.12., kam es zu elf Hausdurchsuchungen und der Beschlagnahmung von Handys, Laptops und Plakaten. Der Vorwurf lautet "Bildung einer kriminellen Vereinigung" gemäß § 129 Abs. 1 StGB, außerdem Störung öffentlicher Betriebe (§ 316b StGB), Hausfriedensbruch (§ 123 StGB) und Nötigung (§ 240 StGB). Medienberichten zufolge wurden Ermittlungen gegen insgesamt 34 Beschuldigte in acht Bundesländern eingeleitet, nachdem seit Mai bei mehreren Protestaktionen an der PCK-Raffinerie in Schwedt Ventile zugedreht und der Öl-Zufluss damit kurzzeitig unterbrochen worden sein soll. Zwei Wochen vor den Hausdurchsuchungen hatten mehrere Landesminister auf der Innenministerkonferenz Ermittlungen nach § 129 StGB gefordert.

Die Unterzeichnenden kritisieren dieses Vorgehen, denn bereits das Vorliegen des Anfangsverdachts bezüglich der Bildung einer kriminellen Vereinigung erscheint zweifelhaft. Der Tatbestand setzt voraus, dass eine Gruppe die Begehung von schweren Straftaten bezweckt, von denen eine erhebliche Gefahr für die öffentliche Sicherheit ausgeht. Das trifft auf das Festkleben an Straßen, Gemälden und Flughäfen als bislang wichtigster Protestform der "Letzten Generationen" schon im Ansatz nicht zu. Ob Sitzblockaden und andere Formen des zivilen Ungehorsams überhaupt strafbares Verhalten darstellen, ist fraglich – Gerichte und Staatsanwaltschaften haben die wertungsoffenen juristischen Fragen der Verwerflichkeit und eines rechtfertigenden Klimanotstandes zuletzt unterschiedlich beantwortet und Protestierende vereinzelt freigesprochen. Jedenfalls aber haben die mit den Sitzblockaden verbundenen Vorwürfe kein ausreichendes Gewicht, um Vorwürfe nach § 129 StGB begründen zu können.

Ähnlich sieht es bei dem Zudrehen von Ventilen an der Raffinerie in Schwedt aus. Weder wurden durch die kurzzeitige Unterbrechung der Versorgung einer Raffinerie Menschen gefährdet, noch die öffentliche Sicherheit in erheblichem Maße beeinträchtigt. Auch zu Sachbeschädigungen kam es nicht.

Gerade weil der Vorwurf nach § 129 StGB weitreichende Ermittlungsmaßnahmen ermöglicht, die mit schweren Grundrechtseingriffen verbunden sind, fordert auch der BGH die strikte Einhaltung des Verhältnismäßigkeitsgrundsatzes bei der Bewertung der Zwecke einer Vereinigung. Ob die Schwelle zu einer kriminellen Vereinigung im Sinne der Vorschrift überschritten wird, ist nicht allein anhand der begangenen Straftaten, sondern anhand einer Gesamtwürdigung aller Umstände zu bewerten ...

Die "Letzte Generation" weist mit ihrem Protest auf etwas hin, das auch Barack Obama und Annalena Baerbock genau so formuliert haben: Dass wir zu der letzten Generation gehören, die die katastrophalen Auswirkungen des Klimawandels noch stoppen kann. "Die nächsten acht Jahre sind entscheidend", erkennt selbst Bundeskanzler Olaf Scholz. Trotzdem reichen weder global noch national die bisherigen Klimaschutzmaßnahmen aus, um die globalen Klimaziele sowie den in Deutschland verfassungsrechtlich vorgegebenen Reduktionspfad einzuhalten. Das wurde unlängst durch das Zweijahresgutachten des Expertenrates für Klimafragen bestätigt, der einen Paradigmenwechsel in der deutschen Klimaschutzpolitik anmahnt. Derweil hat der voranschreitende Klimawandel bereits in vielen Teilen der Erde verheerende Konsequenzen. Angesichts dieser Entwicklungen richtet sich die "Letzte Generation" an die Politik. Die Bewegung fordert im Grunde nicht mehr, als die Einhaltung des Klimaschutzgesetzes und der völker- und verfassungsrechtlichen Pflicht, den globalen Temperaturanstieg auf 1,5° C zu begrenzen. ...

Leider reihen sich die Ermittlungen in andere staatliche Maßnahmen gegen die "Letzte Generation" ein, wie die wahrscheinlich verfassungswidrige Anordnung eines 30-tägigem Gewahrsams in Bayern. In ihrer Gesamtheit erwecken diese Maßnahmen den Eindruck einer Instrumentalisierung des Ordnungs- und Strafrechts für die Delegitimierung und Einschüchterung von unliebsamem Protest. Das ist eines demokratischen Rechtsstaats unwürdig.

Repression sollte nicht die Antwort des Staats auf eine Klimabewegung sein, die den Erhalt unser aller Lebensgrundlagen einfordert und an die Einhaltung von Gesetz und Recht erinnert.

"Die Reichen müssen die Rechnung zahlen"

Die zentrale Aussage vor 50 Jahren war: Wenn sich die globale Wirtschaftsweise nicht ändere, würden Umwelt, Ökonomie und Lebensqualität im 21. Jahrhundert, also jetzt, zusammenbrechen.

Und erst nach 40 Jahren, also in den letzten 10 Jahren, ist es gelungen, dieses Wissen zumindest in den internationalen Klimaverhandlungen mehrheitsfähig zu machen. Dazu beigetragen haben auch die Klimakatastrophen der letzten Jahre.

Mehrheitsfähig heißt leider noch lange nicht, dass man auch gemeinsam tätig geworden ist. Man schiebt sich gegenseitig den Schwarzen Peter zu und versucht möglichst billig damit durch zu kommen. Das wird nicht funktionieren!

Die taz zitiert dazu Jorgen Randers, der schon an den „Grenzen des Wachtums“ mitgearbeitet hatte: „Innerhalb der nächsten 50 Jahre wird das derzeitige Wirtschaftssystem soziale Spannungen verstärken und den Wohlstand verringern.“ Wenn sich die gegenwärtigen Trends fortsetzten, komme es zu „regionalen Zusammenbrüchen“ – und zwar nicht nur in armen Staaten wie Afghanistan, Pakistan oder Somalia, sondern auch in reichen Ländern.

Die Mittel zur Kompensation dieser "regionalen Zusammenbrüche" und gleichzeitig zum Gegensteuern kann auch ein wirtschaftlich starkes Land nicht so nebenbei zahlen. Als Beispiel denke man an Waldbrände, deren CO2 Ausstoß den Klimawandel verstärkt und deren Aufforstung - also nur die Wiederherstellung des Staus Quo Jahrzehnte dauert wird. Die taz führt die Katastrophe im Ahrtal an, deren Beseitigung ebenfalls mehr als 5 Jahre dauern wird und gleichzeitig die Lebensleistung und Ersparnisse von Tausenden vernichtet hat.

50 Jahre zu spät

Da wir nun einerseits die alltäglichen Kosten der Klimakatastrophen zu tragen haben und gleichzeitig klimaschützende Maßnahme finanzieren müssen, bleibt nur ein Weg, wieder aus der taz zitiert: Jorgen Randers zu der These: „Die Reichen müssen die Rechnung zahlen.“ Damit meinte er die obersten „zehn Prozent“ der Bevölkerung, die national und global etwa die Hälfte aller Einkommen auf sich vereinen. Die ökonomische Elite müsse ungefähr ein Fünftel ihrer Einkommen und Vermögen abgeben, damit Sozialpolitik und Klimaschutz finanziert werden können.

Ende 2020 besaß 1,1% der Weltbevölkerung 45,8% des weltweiten Vermögen. Rund 55% der Weltbevölkerung besaßen hingegen lediglich 1,3% des weltweiten Vermögens, sagt die Statistik und sie sagt auch, dass die Lebensumstände und die Zufriedenheit der Menschen in den Ländern besser und höher sind, in denen die Schere zwischen arm und reich sich nicht zu weit geöffnet hat.

Wie viel Geld wirklich nötig ist, hängt davon ab, wann man endlich gemeinsam tätig wird. Die Autoren der Studie schätzen zwei bis vier Prozent des globalen Einkommens jährlich dürften reichen, so steht es im Survivalguide. Und dort steht auch warum es unerlässlich ist, die Reichen zur Kasse zu bitten - nur dann lässt sich der soziale Friede aufrecht erhalten. Dieser ist eine weitere Grundvoraussetzung, um überhaupt voran zu kommen.

So weit zur nationalen Dimension des Problems, darüber hinaus sind Aufrüstung und Kriege eine weitere Hürde, die gemeinsames Handeln und die Mittel dazu vernichten.

Die deutsche "Klimaregierung" hatte doch vor knapp einem Jahr 60 Milliarden für die Bekämpfung des Klimawandels beiseite gelegt und dann sind da noch die 100 Milliarden, die statt bei der Bundeswehr aktuell viel besser beim schnellen Ausbau von Solar- und Windenergie genutzt werden sollte. Man muss nur was tun anstatt über Laufzeitverlängerung von Kohle- und Atomkraftwerken zu diskutieren.
