Nads6969 Commission Victim - TaffyBratz

TaffyBratz was one of many unfortunate people to commission Ms. Stepputat, hoping for a nice, original, creative piece of work starring her OCs.

This looked weird to me for many reasons.

For one thing, the perspective is ALL fucked up.  Either those senshi in front are the Amazon Duo (a group the Amazon Trio and the Amazon Quartet don’t like to talk about), or the couple in the background are goddamn hobbits.

So when my artist-sense got tingling, I started searching and found something.  Somethings, actually.

I wonder if this could serve as evidence in a copyright infringement case, since there technically was an exchange of funds for dishonestly produced work?

ANYWAYS my birthday is coming up, so I treated myself to a little artwork in the absolutely lovely stylings of Yettyen

They have a bunch of nice YCH things, they work fast, it’s pretty affordable, and they are such a kind and easy going person.  I would totally recommend them if you want a little somethin’ art-wise to treat yourself.

This is my OC Ashewynn, as some of you know, with Ignis; Excellent cook, loyal advisor to the throne and love of her life.  I imagine Ashe’s homeland has pretty lantern plants around so I guess this time he’s stolen a chance to see where she hails from originally.

This is a picture I commissioned from Yettyen on DA and I absolutely love it!. My self insert/OC with Dazai Osamu from BSD. With him wearing his dashing prince outfit from the app game 100 sleeping princes. And my OC wearing a gorgeous dress designed by a dear friend of mine a long while ago!.

I’m so in love with this picture <333

The only thing is that the artist forgot to add in my character’s blonde streaks within her hair as well as making her hair longer. I’ve tried messaging her to correct it but I still haven’t heard back, I don’t know if either she is too busy at the moment or that my message somehow got lost in her inbox. I do hope to hear back from them soon though for the correction.

But I didn’t want to wait any longer to show this piece off!, because despite the correction that needs doing I do very much adore this picture!.

I want to reiterate something.  The original piece was a paid commission, meaning the art belongs to the commissioner AND to Yettyen.

 Ms. Stepputat, who apparently couldn’t finish her own paid commission by her own skills, decided that Yettyen’s work would help her.  So she traced it.

 This is like having a store where someone asks for a teddy bear, so then you go to your neighbor’s house, break in, steal the teddy bear, and then sell it. Ms. Stepputat’s commission is basically stolen goods, which she sold.  

 Another thing about commissions.  When someone commissions you, it means that they want YOUR work.  They are paying YOU for YOUR skills, your ACTUAL skills.  If they wanted someone else’s work, THEY WOULD COMMISSION SOMEONE ELSE INSTEAD OF YOU.  This is dishonest at best, false advertising as well.  

 It doesn’t matter how much you want money to draw stuff for someone.  It doesn’t matter how much you NEED money, and drawing is the only way you can get it.  Be honest about your skill set, and don’t be afraid to refuse commissions if you don’t feel that you can give you commissioner the quality of work they’re paying for.  It might suck, but they will respect you more for saying “no” than for saying “yes” and giving them absolute crap.  If you can’t draw it, you need to tell your commissioner that you can’t, or that it might take a bit of time for you to finish it because you want to practice drawing whatever it is that’s giving you trouble.  If you commissioner is patient, they’ll be okay with this too.

 IT IS NOT OKAY TO LIE TO YOU COMMISSIONER.

 IT IS DOUBLE-NOT OKAY TO TRACE SOMEONE ELSE’S WORK TO COMPLETE YOUR COMMISSION.

 IT IS TRIPLE-NOT OKAY TO TRACE SOMEONE ELSE’S WORK TO COMPLETE YOUR COMMISSION AND GET PAID FOR IT.

To make matters worse, the person who commissioned Ms. Stepputat in the first place confronted her about the traced work, and she got her comment hidden and was blocked in response:

 IT IS QUADRUPLE-NOT OKAY TO TRACE SOMEONE ELSE’S WORK TO COMPLETE YOUR COMMISSION, GET PAID FOR IT, THEN GET BUTTHURT WHEN YOUR COMMISSIONER GETS MAD THAT YOU SOLD THEM STOLEN WORK, THEN BLOCK YOUR COMMISSIONER.

Nads6969 is still around because Deviantart Admins (Kietz) are refusing to enforce their own site’s policy

You’re all probably already aware that Ms. Stepputat has had around 11 DMCA notices filed against her.

Per Deviantart’s own copyright policy, “if you are found to repeatedly post infringing content, your account will be suspended and serious offenders will have their account banned and deactivated. We consider three strikes as an indication of being a repeat infringer subject to ban. If you are found deliberately misrepresenting the copyrighted work of another as your own your account will be immediately banned and deactivated.”

Here is the list of people who, as far as I can ascertain, have filed DMCA notices against her:

And yet, no action has been taken.  This is a breach of policy.  How can a company that has the legal requirement to enforce and respect copyright policy and allow for the filing of DMCA notices fail to enforce the follow up to this, which is disciplining someone who is consistently putting them on the legal hook for allowing copyright infringement?

I’ve personally been in contact via the Deviantart “Help” Desk with the user Kietz, whose non-answers, non-apologies, and platitudinous drivel have prompted me to reach out to the CEO of Wix.com, Abrahami Avishai (Wix bought Deviantart a few years ago).

We all know that the Deviantart Help Desk has gone to shit over the years, but this case is especially egregious.  Here is the thread of conversations I have had with Kietz, which only displays their indifference to the complaints of their own userbase, and their overall incompetence regarding Deviantart’s own policies:

LMAO what.  I link them to FireFlea-San’s journal listing EVERY SINGLE PERSON who has been victimized by Ms. Stepputat’s tracing spree, give them links to conversations, identify people who’ve filed DMCA notices against her...  And they still “need to see evidence of this user breaking our terms of use.”

Furthermore, they’ve already BEEN contacted by PERSONS who have been affected by her.

Needless to say, I’m a bit irate at this point:

My next answer from Kietz confirms that they are just barely paying attention to this conversation:

You’re probably thinking “but that’s 3 people, and 3 strikes.  Why are they not enforcing policy?!  How good can their legal team be if they can’t count?!”

So here I read them the Riot Act and lay Deviantart policy out to them, while also pointing to various pieces of evidence to support my claims:

Gotta tell you, not a fan of this answer.  Guess he’s too busy playing Candy Crush to do his job.

Hopefully I don’t get banned for being “aggressive” for this.  But frankly, if your job is to just enforce policy and it’s written in black-and-white how/when to ban someone and why, and you are legally required to honor copyright and DMCA claims, then this is a simple task that should have been handled 8 DMCA notices ago.

And trust me, this isn’t all of them.  A team of us are working together to track down the original artists of every piece of “art” in Ms. Stepputat’s gallery.  So if you know any of these people, let them know that Ms. Stepputat decided that tracing their work didn’t warrant their permission or credit.

My plan, going forward, is to try to make posts for each of the names listed, and detail exactly which artworks were stolen/traced.  This will not be an easy feat, as we’re talking about nearly 5000 pieces of “art” Ms. Stepputat has created by using the artwork of others.

What I want to reiterate is that none of the people on this list gave Ms. Stepputat permission to copy, trace, or edit their artwork in any way.  And if you are one of those people who thinks “well if you don’t want it stolen then don’t put it on the internet,” then this site and this case are not for you and you are not welcome here.  If we refuse to hold people to the standard of respectful behavior, then we allow stuff like this to happen and keep happening.
