Increasingly, the police know they are being filmed, but can use the cameras to establish a false narrative. An officer in Baltimore was found to be using his camera to “re-create” the discovery of drugs he claimed to have found earlier. In this case, even though they had Nichols restrained, officers continued to yell out “give me your hands” to justify for the cameras the beating they were giving him.
In the end, the presence of body cameras did nothing to reduce the police use of violence. They did not save his life. It turns out that the hoped for value of deterrence just isn’t there in the ways we imagined. A systematic study of the introduction of body cameras in some neighborhoods in Washington, D.C., showed they made no measurable difference in any aspect of policing. But the city decided to give cameras to all officers anyway because police officers were using them for evidence collection.
Body cameras are not going to save Americans or give us a deeper truth about the world of violence that police inhabit and produce. The truth is already out there in the long history of policing. We merely refuse to look at it. We hide behind empty hopes that a little training, oversight and accountability will somehow transform an institution rooted in the use of violence to maintain systems of inequality. From Ferguson to Minneapolis to Memphis, the demand on the streets is not for more technology for police; it is to dismantle policing and replace it with less harmful alternatives in as many ways as we possibly can.

A San Antonio police officer still in his probationary period was fired after he shot at and injured a 17-year-old boy in the parking lot of McDonald's, the department said Wednesday.
The teenager, Erik Cantu, is hospitalized with multiple gunshot wounds. His condition was not known Friday morning.
The officer, identified as James Brennand, responded to the fast-food eatery on Blanco Road around 10:45 p.m. Sunday for an unrelated disturbance call, according to police.

"As the officer attempted to gather information from witnesses, he noticed a vehicle that had evaded him the day before as the officer attempted a stop because the registered license plate did not match the actual vehicle," Capt. Alyssa Campos, the department’s training commander, said in a video statement.

The car, driven by Cantu, was not the subject of the disturbance call at the McDonald's, according to Campos.
The officer, believing the car was stolen, called "for cover" but approached the vehicle before other officers arrived, she said. Campos said the officer "abruptly" opened the driver's door and ordered Cantu to get out.
Police body-camera footage released by the department shows Cantu sitting in the driver's seat eating a McDonald's hamburger. A 17-year-old girl is in the passenger's seat.
"Get out of the car," the officer says to Cantu, the video shows.
Cantu put the car in reverse with the driver's door still open and backed up, Campos said, adding the officer was hit by the open door.
"The officer then stepped back and opened fire on the vehicle as the driver reversed away from him," she said.
Multiple gunshots can be heard in the video as the maroon car backs away and the driver's door closes. More shots are fired as the car flees the parking lot, the video shows.
Cantu and his passenger were found about a block away. The passenger was not injured.
Police charged Cantu with evading detention with a vehicle and assault on a peace officer. It's not clear if he has obtained an attorney who can speak on his behalf. Police have not said if the car was, in fact, stolen.
Brennand had been on the force for seven months and was still on probation, a standard practice for San Antonio officers who graduated from the police academy less than a year ago.
“The former Officer’s actions are indefensible and do not align with our training, tactics and procedures," Chief William McManus said. "As such, I terminated him. I will withhold further comment as this incident is still under investigation."
All police shootings are sent to the district attorney's office for review. Brennand has not been charged with a crime. NBC News could not immediately reach a representative for the police union.

Waffengleicheit durch Handyaufnahme gegen Bodycam?
Ist es strafbar einen Polizeieinsatz zu filmen?
Dazu gibt es inzwischen die unterschiedlichsten Gerichtsentscheidungen von Amtsgerichten, Landgerichten, zuletzt sogar von zwei Oberlandesgerichten. Sortieren wir erst einmal die Vorwürfe und dann die Urteile.
Wir setzen dabei voraus, dass das Smartphone auch in der Lage ist den Ton aufzuzeichnen. Während der in der Öffentlichkeit ablaufende Polizeieinsatz ein öffentliches Ereignis ist, sind die Gespräche der Polizisten untereinander "nichtöffentlich". Damit dürfen sie nicht aufgezeichnet werden, im Gegensatz etwa zu Ansagen der Polizei gegenüber z.B. Demonstranten.
So hat nun das Landgericht (LG) Hanau Aussagen zu genau diesem Aspekt geliefert, der bisher noch nicht gerichtlich entschieden wurde. Wenn bei einem Polizeieinsatz die Bodycam eines Polizeibeamten eingeschaltet ist, dann macht sich nicht strafbar, wer auf der anderen Seite mit seinem Smartphone filmt und den Ton aufnimmt. Die Gespräche der Polizisten sind in der laufenden Aufnahmesituation "öffentlich".
Wenn die Polizei zum Zweck der Beweissicherung aufzeichnet, dürfen es – und zwar straffrei – auch Betroffene auf der anderen Seite. Es soll Waffengleichheit herrschen (Beschl. v. 20.04.2023 Az. 1 Qs 23/22).
Wenn die Bodycams nicht laufen? Was dann?
Es geht nur um den Ton, denn § 201 StGB schützt die Vertraulichkeit des Wortes. Wenn es technisch geht, könnte man auf die Tonaufzeichnung verzichten und wäre aus dem Schneider. Problem dabei: Erkläre das mal dem Polizisten, der dir gegenüber steht ...
Rechtswissenschaftler sind der Meinung, dass die Strafvorschrift von § 201 StGB nicht auf Polizeieinsätze in der Öffentlichkeit passe. Sie sprechen von einer "faktischen Öffentlichkeit". Das Oberlandesgericht Düsseldorf und das Landgericht Aachen sehen das jedoch sehr eng. Da Fälle zum § 201 StGB nur beim Amtsgericht und bei Beschwerde beim Landgericht entschieden werden, wird man weiter Rechtsunsicherheit haben, denn eine BGH oder OLG Entscheidung ist dazu selten zu erwarten. Natürlich könnte die Politik durch eine Klarstellung im Gesetz für Rechtssicherheit sorgen, wenn inzwischen Jede/r sein Handy "zur Beweissicherung" - oder aus Sensationsgier - zückt.
