People who try to analyze what happened on Tumblr on November 5th, 2020, often really overstate how much it was actually “about” Supernatural. As someone who has never been in the supernatural fandom ever but dID join in on the hysterical destielposting—it was really more about the stress of the pandemic and the 2020 presidential election.

The two biggest Youtubers I’ve seen try to dissect “what happened that November 5th” in video essays both weren’t American—- and I think that explains why they both tried to explain the hysteria primarily via analyzing the Supernatural fandom/the original show, rather than through the lens of the election. And while those videos are cool, valid, informational, and make lots of really well-considered interesting points— I can tell you that me and almost all my mutuals had literally no knowledge or interest in the fact that “oh supernatural had made nods at the ship in the past but the creators were adamant that I wouldn’t be canon” or etc etc etc etc. the first time I learned about any of that context was way later, watching videos where people claimed that fandom history context (that I did not know anything about) was the actual reason for the hysteria.

But the reality is that people latched on to the Destiel stuff because it was a piece of big useless inane zero-stakes fandom news in a time when we were desperately waiting for serious high stakes election news. We were latching onto a “positive “ piece of inane stupid fandom news in a time of great stress, with all the desperation of a drowning man who latches onto whatever piece of wood will keep him afloat.

The core of the hysteria was that Americans (who make up a huge chunk of tumblr’s userbase) were currently glued to their laptops watching the live presidential election vote counts come in. These vote counts were taking an extended amount of time due to the pandemic causing high numbers of mail-in ballots, resulting in a constant state of Election Day Stress for multiple days straight.

This was also during the height of the Pandemic. People had predicted Trump’s presidency would be bad; no one had predicted it would be this apocalyptically bad. No one had predicted pandemics and lockdowns and hospitals overflowing with bodybags. remember Trump spreading Covid lies and conspiracies?? There were so many Qanon conspiracies about democrats being Satanic child traffickers who had to be put to death, and coup threats were mounting from the right wing side. It seemed like this election was a choice between ‘centrist democrat’ and “apocalyptic right wing conspiracy theory authoritarianism,” in the midst of pandemic conditions that people feared would never ever improve— and it seemed like a close election.

Another major point was that Trump voters were more likely to be antimaskers/Covid deniers, while Biden voters were more likely to take the pandemic seriously— so Biden voters were more likely to send in mail-in ballots instead of risking the in-person voting crowds, which meant their ballots would take much longer to count. And so, in many state electoral vote counts, it would initially seem like Trump was very far in the lead— only for Biden to slooooowly build up an agonizingly small lead as the mail in ballots came in, and then defeat Trump at the very end.

So you’re just watching these news sites giving live election updates, refreshing the page every 2 minutes to see if you’re going to live under a spineless centrist democrat or a literal Qanon Dictatorship. And then you go on tumblr to distract yourself, and there’s more election posting, and more agonizing over the votes, and more stress and despair—-

And then it’s been days and we’re right at the crucial tipping point where it’s anyone’s game and the next few hours will determine whether Trump will win, so you need to keep your eye on the vote count, because the next hours will determine the future of the pandemic and your country and your plans for your entire life—

And then stupid Destiel becomes canon! And it becomes canon in the silliest way possible!

If Destiel had become canon at any other time, it would have been a big goofy tumblr celebration? But we wouldn’t have gotten the insane explosion of hysterical interaction.

The entire core of it was the contrast between the inane meaningless stupidity of fandom news vs the actual stressful election news you wanted to hear! It really is best conveyed in that meme where Castiel says “I love you” and Dean indifferently responds with a piece of important election news.

It’s about the contrast between the low-stakes inanity of fandom and the massive life-destroying stakes of a terrifying election. There really was no reason it had be Supernatural specifically, except that Supernatural was a thing everyone knew basic things about from dashboard osmosis— it could’ve been any other equally huge silly fandom ship news about a ship everyone *knew of* but might not necessarily be invested in (ex. Stucky becoming canon, Johnlock becoming canon, Kirk/Spock becoming more canon somehow, etc etc etc.)

I think it’s true that people who weren’t paying agonizingly close attention to the American election news got swept up in it, and that non American Supernatural fans also were extremely excited for purely fandom reasons — but the entire reason it blew up to an unprecedented degree was because of that core of stressed out terrified Americans glued to their computers watching election results and suddenly receiving stupid fandom news instead, and deciding to just hysterically parodically hyper-celebrate this absurd useless zero-stakes news.

I think it was also all elevated by the fact that, as I said before, this happened at the crucial “tipping point” of the election where the next few hours would determine the winner. The fact that Biden began to slowly develop a lead in the hours after made it feel, hysterically, as if the hours after Destiel became canon was somehow the turning point where he began to win; so celebrating Destiel felt like celebrating that slow turn towards victory.

The tl,dr is that it’s so important to Remember the Fifth of November …..in preparation the inevitable hysteria that will happen in the presidential election on November 5th of next year. XD. Personally I’m rooting for Johnlock or Frodo/Sam to somehow become canon in the eleventh hour right before the democrats win

Happy Queer Media Monday!

Today: Supernatural (2005 - 2020)

Oh dear. Here we go. Happy (belated) November 5th everyone!

(The infamous love confession that has become a meme used to talk about important news by having Dean reply with what happened. Put on a white background to avoid jumpscaring people.)

Supernatural is an US American TV show that aired on the network CW from 2005 to 2020. The story, originally spanning five seasons, tells the story of two brothers, Sam and Dean Winchester, whose single father specialized in hunting supernatural beings after their mother was killed in a mysterious incident. After the disappearance of their father, Sam and Dean take over the “family business”, and get quickly dragged into the beginnings of the Apocalypse.

Things… Got somewhat out of hand after this.

The first thing worth mentioning: Supernatural has always been rather meta. During those early seasons, there were episodes between the ones very important to the plot where the show just would poke fun of different aspects of the horror genre. In season 4, they revealed that the story of the show exists in-universe as a book series, with its own fandom. In the last few seasons, they leaned even more into the meta, by having the characters fight the author of said books, who turned out to be also God, for their right of self-determination.

Fandoms being fandoms, and Supernatural, due to its focus being on two brothers traveling from place to place lacking female characters, the main ship for the first few seasons was the one where people were shipping Sam and Dean together, a thing the show itself comments on with the in-universe book fandom. This changed when season 4 introduced a new character, the angel Castiel (nicknamed “Cas”), who quickly became an ally of the brothers and formed an especially deep connection with Dean. The Dean/Castiel ship, or “Destiel” quickly became very popular with the fans.

In the late 2000’s and the early 2010’s, queer representation was still rather rare, and much of it was happening in subtext. Many people latched on to Supernatural, as the shipping aspect was compelling and it actually did feature some queer side characters in more or less important roles. The Supernatural fandom became very prominent on, among other early social media platforms, Tumblr, where people for a while enjoyed themselves imagining a crossover AU between Supernatural, Doctor Who and BBC’s Sherlock - the infamous SuperWhoLock that said people remember with a very vivid mix of emotions.

Due to its popularity, Supernatural kept getting renewed. The writers therefore had to keep coming up with new plots, and so they expanded the Heaven and Hell aspect of their world with, among others, Purgatory, power struggles within both Heaven and Hell, a special place where angels go after their death named “The Empty”, and finally having everyone fight God. While the core of the story remained the same - two brothers travelling through the US and fighting demons - other side characters were added from time to time, and usually killed off eventually. Many of them were, in one way or another, queer. But what really kept the fans engaged was the dynamic between Dean and Cas. It didn’t really go anywhere, making Supernatural in the eyes of many a posterchild of queerbaiting (pretending to include queer content for the sake of attracting audiences, with no intention of following through).

The show ended in 2020 after 15 seasons. The third-to-last episode ends with Castiel confessing his love for Dean and being taken to the Empty as a direct consequence. He is not seen and barely mentioned after that, and Dean is so shocked that he doesn’t get to properly react.

This resulted in mass hysteria among fans, former fans, and people who had been exposed to Supernatural and Destiel by proxy. Tumblr crashed. The episode got mixed together with the other trending topic of the ongoing US elections. Supernatural trended higher than the elections. People were making memes about it, and started to call the Empty “gay super hell”. The emotion of it is difficult to describe to those who haven’t witnessed it with the context of many years of Dean and Cas being firmly kept subtext. This event in fandom history has become known simply as “Nov 5th”. We still celebrate its anniversary on Tumblr. Destiel became firmly linked to current events, and people started to edit the love confession in a way that Cas says “I love you” and Dean replies with the current news.

An imperfect rendition, but YouTuber ColeyDoesThings’ video might give you an idea what the emotional turmoil was like after the love confession. If you want more about the mess around the finale and the things that came after, please go ask somebody else. It is a VERY long and complex story, and I’m neither able nor willing to try and sum it up coherently. If you want to know about the various spin-off series of Supernatural, this article will give you a place to start. I would also like to recommend Tumblr user @whyissupernaturaltrending who, every time that Supernatural trends, explains what TF happened this time.

how did you first get into fandom? hyperfixated on a show, stumbled upon the fandom side of tumblr, did not make a tumblr but lurked a little bit, decided fic was cringey and that i didn't like reading it (it was a v small fandom with not a lot of quality content), hyperfixated on another show and decided to try reading fic again, had my entire world rocked to its core, made a blog, been around ever since.

you’re trying to convince a friend to get into your current fandom(s) with you. what episode, clip, or scene are you showing them? okay so i actually did this with one of my closest irl friends and she got...possibly more into supernatural than i am, and she reads destiel fic, and has had intense gallavich fic phases as well. and it was actually super easy lol. she just has the same kind of brain that i have, and i just had to tell her to watch the shows because i knew they'd fuck her up the same way they fucked me up. she saw my reaction after november 5th 2020 and wanted to know everything, so i told her everything, and she started watching spn the next day. i watched shameless a couple months later and lost my entire mind, and all i had to do was tell her that she NEEDED to watch it, and she started watching it right away. i think if i had to show her a specific scene though, it probably would've been mickey coming out in 4x11. iconic, legendary. she would've eaten that up even with no context. also special shoutout to this friend, because she's the person who taught me to not be embarrassed about being interested in fic, or fandom in general. i always thought she was so brave for being open about her hyperfixations in her everyday life, like for real lol. i still struggle with it, but i've gotten more open about it because of her.

and finally, what does fandom mean to you? a community of some of my best friends, and the place where i learned that i can actually be a creative person. i'm doing all kinds of fulfilling things with my life because of this space 🥹

Tiger & Bunny - You CANNOT fully understand my most current and most profound brainrot if you don't know this adorable band of heroic goobers, and most specifically Nathan and Keith, and how much they all love each other.

Yuri!!! on Ice - Favorite comfort show forever and ever. It's not quite perfect because episode 12 is so rushed, but it's overall absolutely perfect for my heart. (Witnessing episode 7 live was... certainly a thing.)

Supernatural - Speaking of witnessing things live, I feel like you can understand my derangement much better by knowing that I watched this for THE WHOLE FIFTEEN YEARS AS IT AIRED. And then November 5th 2020 happened. And then that finale, and everything that followed. I would not recommend this to anyone (because I care about people's mental health), but I thank it for bringing me to Tumblr.

Sailor Moon and Sailor Moon S - Absolute core childhood memories all over the place, and even though it took me another lifetime to realize it, Haruka was totally my main queer awakening.

Star Trek - TNG - More, even earlier core childhood memories. I imprinted on Data like a very almost-certainly-but-never-diagnosed-neurodivergent duckling. And the whole thing made me forever feel like conflict should be resolved with intelligence, diplomacy, and respect for individuals and cultures.

The X-Files - Watching this as a teen unlocked my shipper gene in full force (and actually, obviously, taught me the word 'shipper' in the first place). Unfortunately, it evidently did not teach me to look out for shows that start out amazing and then devolve into an absolute trashfire (but hey, at least I never watched the revival).

Stargate SG-1 and Stargate Atlantis - One of my main fandom experiences, back in the LiveJournal days. (In retrospect, my giant crush on John Sheppard, a man who would rather jump out of a window than face a serious personal moment or talk about his feelings, was a pretty big personal-life red flag.)

... Honestly, just pick a random bunch of the anime series that were airing in Italy in the late '80s and early '90s, throw them into a blender, and you'll get at least half of the underlying structure of my brain. Absolutely necessary mentions: Anime Sanjushi, Saint Seiya, Creamy Mami (and all her magical girl friends), Samurai Troopers, Slayers, Captain Tsubasa, and a whole lot of stuff that was probably WAY too dramatic for me to watch at that age, lol.

My Custom Gaming PC Desktop Story - 5th Anniversary [Nov 12, 2021]

Hello! Today, my (custom) gaming PC desktop is marked the 🎉5th anniversary🎉 and I'll explain the story. 🖥🖱

BTW #1: Please ignore the dust around. I haven't chance to clean it, so I apologize for that.😅

Without further ado, let's get started:

• It was Saturday, November 12th, 2016: my big brother purchased the custom gaming PC desktop for his little brother from a local custom PC store for, umm... I think it's ₱ 25,000 ($495)? As far as I know. The reason why he purchased that PC is (because of) my little brother needs to study & practice his AutoCAD/Autodesk skills after he's graduated from the Autodesk indie college and sooner he'll be hired for the job as (a) Autodesk architect. So far, his job is pretty good and he's getting paid from salary every month for 4 years. Until he finally bought his "own" custom gaming PC desktop, gaming mechanical keyboard, gaming mouse, and all sorts of gaming tools; which ultimately he give his old gaming PC desktop to me. I've been using an old Lenovo G470 laptop since November 20th, 2016, and on November 6th, 2020 I'm finally moved to a better and old gaming PC desktop! Best of all, I could finally play PC games without worrying about skip frames (better check system requirements), as well as play gaming emulators (e.g. PPSSPP, PSX2, etc...). My desktop is going smooth for months after changing thermal paste on the CPU & brushing up some dust but, I've messed up something on July 4th of this year. The (conducted) micro pins on the CPU socket from the motherboard (MSI H110M-Pro-VH) bent awkwardly after I brush'em up and I couldn't start my PC desktop because of my mistake. It seems that the CPU socket from the motherboard is the most sensitive part and it needs to be careful inserting CPU chip through that socket; I've been there many times, so I lost my mind. That said, my gaming PC desktop is useless and I need to buy a new motherboard with the same brand and same model. Good thing I've got spare savings from my piggy bank but my parents say "you don't have to". Despite, that I'm (being) a good boy in this house, my parents are buying a new motherboard for my gaming PC desktop, so I could use it once more. And when my parents finally arrived, they bought a new one but a different brand. My mom said that they don't have that same model, they're out of stock, so hope this different brand will work on my PC. From the looks of it, I'll trust her words and I'll work on it with the new motherboard. By the way, the new motherboard is BioStar H110MHC Ver. 7.0 [CLICK ME!]; sees looks promising to me. After I've installed w/ the new motherboard, my PC desktop is ready to turn on and it finally worked! Hooray! Though there is one missing, there's no metal plate for my new motherboard but ah well it's not important anyway. But if I found one then I'll plan to order. My mom says "You could pay me soon when you're rich." and then I respond "Don't worry, I will... And I love you mom & dad. Thanks so much." To this day, I'm earning profits and hopefully I will repay her. Right now my PC desktop is working normally as it used to (back in 2016) and I haven't encountered issues whatsoever. So yeah, that's my story. And you're asking what are the specs for my current PC? Well, here it is:

9. Werewolf: The Apocalypse 5th Edition (Renegade Studios/Paradox) Werewolf: The Apocalypse takes place in a fictional version of our Earth: the World of Darkness. In the World of Darkness, werewolves, vampires, magicians, and monsters are all living among us. An entire supernatural world hidden in plain sight. You are one of these monsters, pretending to be human but fighting for survival and supremacy among mysteries and conspiracies that threaten the existence of humanity.

8. Brancalonia - The Spaghetti Fantasy RPG (Acheron Books) An all-Italian medieval, roguish and picaresque setting for the 5th Edition of the most famous role-playing game of all time. This game will be releases in Italian and English. “Spaghetti Fantasy” is a new fantasy genre: imagine a Spaghetti Western – with swords instead of guns – based on Italian folklore, history and pop culture.

7. Pathfinder for Savage Worlds (Pinnacle Entertainment Group) A bombshell announcement in November 2020, the Pathfinder for Savage Worlds core rulebook will include an adaptation of the Savage Worlds game mechanics for players to make and evolve characters, and for game masters to create games of their own design, for play in Pathfinder’s world of Golarion. The Pathfinder for Savage Worlds boxed set—as typical for Pinnacle Entertainment Group—will include the core rulebook as well as other elements of game play for Savage Worlds like Bennies, Action Deck, Templates, Game Master Screen with adventure, Powers Cards, and more. Kickstarter coming this month, with a release in late 2021.

6. Rivers of London (Chaosium) At #7 on this list last year, Rivers of London has claimed one place for 2021! On Thursday, November the 5th, 2020, came a revelation so uniquely earth-shattering it overtook the news of the ongoing US Election on social media trends [1]. Fictional character Castiel from hit show Supernatural was, in fact, in love with Dean Winchester.

For such a frivolous event like a show’s love confession – even less ground-breaking considering the way in which fictional gay representation has become far more commonplace in recent times – the world seemed to be in utter disbelief. “[W]ell. [W]here’s that Lenin quote[?] There are decades where nothing happens, and there are weeks where decades happen”, one Tumblr user wrote, referring to the sensation.

What may have appeared as a bizarre overreaction from a minority to the general Twitter userbase was, however, the culmination of more than a decades’ worth of Generation Zoom’s childhoods. The memories of being a 14-year-old girl in 2011 having just discovered social media and posting maniacally about Supernatural– wildly theorising, sharing interpretations and expressing love for the show’s characters – had swiftly rushed back into the minds of millions of now-adults. Such a scene in the show, that would have sent their former selves into cardiac arrest, inspired a particular nostalgia-induced mania among ex-fans, with one user summarising the strange emotion by saying “Tonight feels like we’re staying up too late at a sleepover”.

More specifically, “Destielgate” as it came to be known reinvigorated an age-old question – Why were millions of gay teenagers yelling at show-writers in 2013 to stop “queerbaiting” them, while simultaneously aggravating heterosexual middle aged male fans who had no issue with the lack of gay romance in the show? What would prompt such infamy? What was the reason for the extent of blood, sweat and tears being put into this show by zealous fangirls in the early 2010’s?

Why were such a great number of LGBT US American teenagers so vehemently obsessed with Supernatural?

The obvious answer would be the age-old concept of self-actualisation through fiction. Particularly observable in teenagers solidifying their identity and personality, the fictional world provided ample ground for people to find plots, characters and ideals with which they resonated [2]. Research suggests this is especially true for twice exceptional teenage girls [3], who indeed are perceived to made up a good part of the “Destiel” fans within the Supernatural community – as well as demographic surveys of the fandom showing the majority of fans to be around 15-year-old girls who are LGBT [4].

The idea of Supernatural heavily focussing on a gay romance would thereby mean a great deal to aforementioned fanbase who relied on fiction not solely as entertainment but as a means of identity development. Indeed, the concept that “representation matters” was a popular one among Destiel fans, implying that to have main characters Dean and Castiel being LGBT in some way would serve as validation for their own identities.

Such an idea would perhaps hold water, if it were not for the glaring issue that Supernatural hardly had the essence of a plot that would allow for aforementioned self-realisation. As a matter of fact, the core aspects of the Supernatural identity did not seem to imply they were seeking a young LGBT audience in the slightest. The show was, rather, infamously entrenched in Midwestern masculinity culture.

The premise of the show is of two all-American brothers who ride around the USA to fight the eponymous supernatural entities that plague the country. The aesthetic choices associated with this genre, when not mythical and terrifying, encompass a blatant USAmerican stereotype. Looking at the show’s features for a minute or two provides a useful picture for Supernatural’s identity. Even the song most commonly associated with Supernatural, “Carry On Wayward Son” by Kansas, allows for a picture-perfect mental image of the show’s aesthetics and culture.

While LGBT people are born at random, meaning there is no one culture they are more likely to be born into, the Midwestern identity and culture is rarely associated with being LGBT - instead opting for urban areas with higher population density and less emphasis on traditional working-class professions such as farming. As seen in a political survey, conservatives make up the largest political alignment in the Midwest at 38%, 51% of whom say homosexuality “should be discouraged” and 63% of whom “oppose or strongly oppose” gay marriage [5].The show’s story, too, can easily be read to imply a certain lack of LGBT culture within. Sometimes there was blatant condemnation on the show of people who perceived male/male friendships romantically, including Destiel itself. More subtly, enemies of Dean would frequently refer to Castiel as his boyfriend or something similar solely to ridicule or offend him. Confirmed gay characters besides Castiel certainly existed, but hardly for long. Supernatural was never a particularly LGBT-centric show.

Indeed, the people who worked on the show itself were more than happy to make this a known fact. An infamous incident in 2013 wherein Jensen Ackles, the man who plays Dean, responded to a girl asking whether Dean was bisexual at a convention by groaning “seriously?” and the crowd booing [6] is particularly relevant here. While whether any malicious intent was present in that moment is a point of contention, for a great deal of LGBT people it is recalled as a sour and alienating memory. While other team members such as Misha Collins had a more favourable reputation, it stands that an LGBT interpretation of the show was generally received negatively by the puppet masters.

This is all to say that, on a surface level, it would seem bizarre that so many LGBT people, especially USAmericans, gravitated towards Supernatural as a show that was for their identity development. Not a great deal of the show’s setting, plot or production called for LGBT fans, besides the subtext regarding Castiel and Dean which would not be explicitly addressed until the series was effectively over.

However, the thematic implications of the Supernatural story may give insight into the origins of the Supernatural fanbase. For these fans, to resonate with the show was not to avoid these themes or hostility towards them, but to see them as aspects building towards a far more powerful gay love story.

Thank you, thank you, it means a lot!!!!!!!!!!!! To be honest, I expected blowback on my "the November 5th 2020 hysterical site meltdown was at its heart about the stressful political times and not the supernatural fandom" post, and I knew what I was walking into-- I mean, there's really nothing more Iconically Superwholock than dogpiling on a random person for their opinions on fandom stuff! I have been getting far more agreement than pushback, for the record! And it's honestly very worthwhile/funny/even heartbreaking reading through the comments, and remembering the wild political terror, despair, horror, and exhilaration that day involved. Someone reminded me that the Covid vaccines hadn't even been released yet-- we were still in the phase where we feared there might never be publicly available vaccines, and we would just all have to wait our turns to die! Remember that? Another person compared November 5th to the way you often laugh hysterically after a near-death experience; after barely surviving a car crash, suddenly the smallest things can be very funny. I do think the Frivolous Fandom News everyone latched onto on November 5th had to be a Big Fandom Ship with a wide reach that had lots of nostalgic value and a reputation as an iconic Tumblr Thing(tm), because that's the core of what makes it so funny. But again, it could've been Johnlock becoming canon-- it's not really about the specific fandom. (I also think some people are reading that original post uncharitably XD. I said it could have been any frivolous inane fandom news, yeah, but I also did say that it had to be something with a comparable level of Reach--which to me means a similar level of 'dashboard osmosis'/reputation as a tumblr ship/nostalgic value/etc. Yes, things would have looked different if it had been another fandom with comparable reach, but still. The reason I didn't go into depth about that angle was because I think people overemphasize the fandom side of it already, and I didn't want to make another post on that haha.)

But even the pushback I'm getting from Supernatural fans is so far just very entertaining to me. It's very "Potterheads, grab your wands!" ("Supernatural fans, grab your wayward sons?" ) As someone who's also been on the other end of genuinely vicious hateful bigoted threatening dogpiles, this is really nothing so far. It's a bunch of people with ''221BintheTardiswithCastiel" URLS bopping me on the head with an empty cardboard paper towel roll for daring to Remember the Fifth of November as I actually experienced it XD.

We review an abstention decision that implicates subject-matter jurisdiction de novo. See Hartford Courant Co. v. Pellegrino, 380 F.3d 83, 90 (2d Cir. 2004). "Since at least the turn of the century, courts have declined to interfere with ecclesiastical hierarchies, church administration, and appointment of clergy." Rweyemamu v. Cote, 520 F.3d 198, 204-05 (2d Cir. 2008). "First Amendment values are plainly jeopardized when church property litigation is made to turn on the resolution by civil courts of controversies over religious doctrine and practice. . . . [T]he Amendment therefore commands civil courts to decide church property disputes without resolving underlying controversies over religious doctrine." Presbyterian Church in U.S. v. Mary Elizabeth Blue Hull Mem'l Presbyterian Church, 393 U.S. 440, 449 (1969); see also Serbian E. Orthodox Diocese for U.S. of Am. & Can. v. Milivojevich, 426 U.S. 696, 709-10 (1976) (holding that the principle articulated in Presbyterian Church "applies with equal force to church disputes," like the present one, "over church polity and church administration"). Indeed, "where the identity of the governing body or bodies that exercise general authority within a church is a matter of substantial controversy, civil courts are not to make the inquiry into religious law and usage that would be essential to the resolution of the controversy." Md. & Va. Eldership of Churches of God v. Church of God at Sharpsburg, Inc., 396 U.S. 367, 369-70 (1970) (Brennan, J., concurring). Unless otherwise indicated, in quoting cases, all internal quotation marks, alterations, emphases, footnotes, and citations are omitted. At the same time, courts are not precluded from resolving disputes simply because the outcome would have religious implications. For instance, courts may apply "neutral principles of law" for the resolution of disputes involving religious matters, so long as the "neutral principles" allow the court to avoid deciding questions of religious doctrine, polity, and practice. Jones v. Wolf, 443 U.S. 595, 602-04 (1979). Relying on Jones, the plaintiff argues that the ecclesiastical abstention doctrine does not apply because we may rely on neutral principles of corporate, non-profit, agency, property, and gift law to grant him the relief sought. Beginning with the claims for declaratory judgment, we hold that, based on the allegations in the complaint, there are no neutral principles by which we can adjudicate these claims without deciding the religious question of who the rightful successor to the late Rev. Sun Moon is. The complaint alleges that defendant-appellee Family Federation for World Peace and Unification International (the "Family Federation") is a Korean entity, but its precise corporate status is unclear. The complaint also alleges that the Family Federation has no articles of organization or written bylaws governing its affairs, as the Family Federation is "governed and operated pursuant to an established and recognized set of practices, procedures, policies and customs," in which the edicts and instructions by Rev. Moon were "authoritative and required to be followed by all Unification Church entities and organizations." Joint App'x 10. And both the complaint and the plaintiff's briefs are silent as to any Korean law that might govern the organization of the Family Federation in the absence of written documents. On the basis of these allegations, we find no neutral principles of corporate, non-profit, or agency law that would allow us to declare rights and obligations that concern "matter[s] of internal church government, an issue at the core of ecclesiastical affairs," Milivojevich, 426 U.S. at 721, without making a decision "on the basis of religious doctrine or practice," Jones, 443 U.S. at 602. Similarly, we reject the plaintiff's argument that we can rely on neutral principles of property and gift law to grant him the declaratory relief sought. The plaintiff's attempt to recast this case as a property dispute is belied by the complaint, which does not request any relief specific to certain crowns and robes that were given to him as part of his alleged appointment as the leader, and which vaguely refers to other "property and assets" without identifying specific property interests in them. Joint App'x 14, 21, 29-30. As in Milivojevich, which incidentally involved church property, "this case essentially involves not a church property dispute, but a religious dispute the resolution of which under our cases is for ecclesiastical and not civil tribunals." 426 U.S. at 709. For the first time on appeal, the plaintiff argues that the Family Federation should be judicially estopped from arguing for ecclesiastical abstention because it argued against the doctrine in a different litigation. Because this argument was not properly presented before the district court, we do not consider it here. See Broidy Cap. Mgmt. LLC v. Benomar, 944 F.3d 436, 444 n.7 (2d Cir. 2019). Even if we were to consider it, "no action of the parties can confer subject-matter jurisdiction upon a federal court. Thus[,] . . . principles of estoppel do not apply." Ins. Corp. of Ir., Ltd. v. Compagnie des Bauxites de Guinee, 456 U.S. 694, 701-02 (1982). Alternatively, the plaintiff contends that a purported exception to the ecclesiastical abstention doctrine for fraud or collusion should apply. In Milivojevich, the U.S. Supreme Court noted the possibility of an exception for fraud or collusion "when church tribunals act in bad faith for secular purposes." 426 U.S. at 713. But as that phrase suggests, if the exception exists, it would apply where a religious entity engaged in a bad faith attempt to conceal a secular act behind a religious smokescreen. Here, the fact that the plaintiff has failed to articulate a secular legal right implies that he has also failed to articulate how the defendants may have deprived him of that right in the guise of a religious act. While we might not owe deference to a church's decision whose religious nature was a pretext for its secular purposes, we cannot intervene here to adjudicate what remains an essentially religious question over who the rightful leader of the Family Federation is. Other than the claims for defamation for a statement made in April 2015, tortious interference, and violation of New York's whistleblower protection statute, each of the remaining claims depends squarely on the resolution of the plaintiff's core claim that he, not defendant-appellee Hak Ja Han Moon, is the rightful leader of the Family Federation. Accordingly, we lack jurisdiction to adjudicate these remaining claims on ecclesiastical abstention grounds. With respect to the claims for defamation for a statement made in April 2015 and tortious interference, we have a neutral principle to adjudicate them: the statute of limitations. Accordingly, we affirm the district court's dismissal of these claims on the basis that they are time-barred, with the modification that such dismissal be with prejudice. With respect to the claim for violation of New York's whistleblower protection statute, contrary to the district court's dismissal on ecclesiastical abstention grounds, we hold that a small subset of the allegations in support of the claim—specifically, that the plaintiff was "suspended from his role as the International President of Family Federation" for exposing that the Unification Church and Family Federation leaders "were benefitting from excessive salaries and benefits at the expense of the Unification Church and Family Federation," Joint App'x 37-38—can be evaluated without reference to any religious doctrine. Nevertheless, we affirm the district court's dismissal on grounds that the complaint fails to adequately allege what law or adopted policy of the Unification Church and Family Federation these officials violated (or, with particularity, what fraud they have committed) in paying themselves excessive salaries. See N.Y. Not-for-Profit Corp. Law § 715-b(a); see also Fed. R. Civ. P. 9(b). To clarify, on ecclesiastical abstention grounds, we lack jurisdiction to adjudicate the claim for violation of whistleblower protections to the extent that it is based on the succession dispute or other issues of religious practice—for instance, that these officials were acting improperly by "dishonoring the directions and teachings of Rev. Moon to curry favor with Mrs. Moon," that the retaliation consisted of these officials "asking him to go along with Mrs. Moon's exercise of authority," and the like. Joint App'x 37. We do not reach the unsettled issue of whether N.Y. Not-for-Profit Corp. Law § 715-b(a) confers a private right of action. -------- We have considered all of the plaintiff's remaining arguments and have found in them no grounds for reversal. For the reasons above, we MODIFY the judgment of the district court to reflect that the time-barred claims are dismissed with prejudice and all other claims are dismissed without prejudice and AFFIRM the judgment as modified.
