I moved to DC almost two years ago from the US Virgin Islands and Puerto Rico. The USVI is much less populated and has fewer resources than Puerto Rico, but their weed business is booming. “Cocaine Alley” is a waterway known for transferring hard drugs from South America through the Caribbean Islands to the mainland USA that passes through the Virgin Islands. Especially after the hurricanes, homelessness and unemployment set rise to hard drug use. However, it was not a surprise that when I’d board the Safari (the island’s ghetto bus system) at 8 am, the driver would pass me a fat blunt to share out of the goodness of his heart after I’d hand him a dollar for my trip. I would need that weed because the “Safari” is pretty much a pickup truck with chairs nailed down int he backseat, used to transport residents from one side of the island to another. Marijuana is illegal in the islands, but police turn a blind eye, and only arrest serious crimes for lack of jail space. For example, my good friend was drunk and high one night, drove up the mountain on St Thomas, crashed his car into another one going downhill, and when the cops showed up, they just drove him home to “sleep it off.”

When I moved to DC on the mainland, I was utterly shocked that marijuana was “legal” here! I would have thought conservative republicans had a hold on this city and wouldn’t allow it. But I was very wrong. I smell the scent of pungent weed everywhere I go. I personally never got into weed, but curiosity of it’s legality really got me interested in finding out more on the business.

On April 10, 2018, the Medical Marijuana Certified Business Enterprise Preference Amendment Act of 2018 passed. Robert White, Jr. was one of the sponsors. The bill gives preference to minority-, women-, and locally-owned businesses that apply to operate medical marijuana dispensaries in the District. The bill establishes a point preference for certified business enterprises (CBEs) applying to operate a medical marijuana dispensary, cultivation center, or testing laboratory in the District of Columbia.

CBEs will be awarded the greater of 20 points or 7.5 percent of the total available points when applying for a registration. Currently, a six-member panel reviews and scores each medical marijuana dispensary, cultivation center, or testing laboratory registration based on a 250-point scale. Funds are sufficient in fiscal year 2018 and the proposed fiscal year 2019 through fiscal year 2022 budget and financial plan to implement the bill. There is no cost to providing CBEs with a point preference during the medical marijuana dispensary, cultivation center, or testing laboratory registration review and scoring process.

This act gives priority to minority and women-owned CBEs to operate a marijuana dispensary or lab testing facility. This prevents an over-supply issue, which are problems facing the states of Washington and Oregon. They made mistakes including allowing black market marijuana growers to become legal growers, they lowered the licensing fees to sell in stores, and removed caps on the number of licenses allowed. Currently in DC, only 5-8 medical marijuana CBEs are allowed to operate under the Mayor, and no more than 2 in one ward. Preference is given for DC residents so that those from out-of-state cannot bombard the weed market and have a giant surplus like the 2 states mentioned.

According to Forbes, “There are just over 4 million people in Oregon, but they would each have to buy 5.2 ounces of cannabis today to clear the 1.3 million pound surplus.”

We are preventing this problem here in DC. But with the legalization of paraphernalia, I wonder if there will have to be follow-up legislation in the future to tie up loose ends. Allowing priority to minority and women business owners locally is a fantastic law. However, I don’t want to board the bus here and have the driver hand me a fat blunt, and then I’d worry about my safety and the safety of the other passengers.
